Parental Leave Benefits in Korea: Eligibility, Amount & Key Cautions – Foreign Workers' Guide

What Are Parental Leave Benefits?

Parental leave benefits (육아휴직 급여) are benefits paid from employment insurance to workers who take parental leave to care for a child aged 8 or under (or in the second grade of elementary school or below). The governing provision is Article 70 of the Employment Insurance Act (고용보험법 제70조). The purpose is to encourage parental leave and compensate for the resulting income gap.

Note for foreign workers: Your employment contract may provide terms more favorable than the statutory minimum, but the rules below are the legal floor that applies to all insured workers in Korea.

Eligibility Requirements — The Key Points

  1. Insured unit period: The cumulative insured unit period before the start date of parental leave must be at least 180 days (Article 70(1) of the Employment Insurance Act (고용보험법 제70조 제1항)).
  2. Continuous use of 30 days or more: Parental leave must be taken continuously for at least 30 days for the same child. According to a 2003 administrative interpretation, if a worker takes 30 or more days of leave for the same child, returns to work, and then takes a second period of parental leave of fewer than 30 days for that child, the second period does not qualify for benefits.
  3. Use within the statutory period: If an employer voluntarily extends parental leave beyond the legally prescribed period, the excess period is not subject to benefit payment under the Employment Insurance Act (2004 administrative interpretation).

Application Deadline — Do Not Miss the 12-Month Window

Article 70(2) of the Employment Insurance Act (고용보험법 제70조 제2항) requires that benefits be applied for within 12 months after the last day of parental leave. Missing this deadline will in principle result in a non-payment decision.

Twins and Parental Leave — Benefits Are Not Doubled

Even if you give birth to twins, benefits are not paid at double the rate. Parental leave benefits are calculated based on one worker on leave, not on the number of children (2003 administrative interpretation). However, if parental leave of two years or more is taken consecutively for two or more children born on the same day, benefits for each child must be applied for separately each time the leave for that child ends. If you wait until all leave periods have ended and apply all at once, some periods may exceed the application deadline (2021 administrative interpretation).

Ordinary Wage and Benefit Calculation — Bonuses vs. Welfare Points

Which items are included in the ordinary wage (통상임금) used to calculate parental leave benefits is frequently disputed in practice. The Supreme Court held in cases 2015Du48976 and 2015Du49481 that bonuses paid regularly and uniformly constitute ordinary wage. By contrast, customized welfare card points (복지포인트) are considered difficult to regard as compensation for work and are therefore not included in ordinary wage. Whether a particular item qualifies as ordinary wage must be assessed concretely based on the form and conditions of payment.
