A taxi company required drivers to submit all fare revenue collected (운송수입금 전액관리제) and paid them fixed monthly wages (정액급여제). Under the collective bargaining agreement, if a driver's actual revenue submission fell short of a set target amount, the company deducted the shortfall from the driver's fixed wage. The Supreme Court held that such deductions are generally valid, but ruled that whether the resulting wage complies with the Minimum Wage Act (최저임금법) must be determined based on the wage amount remaining after the deduction, not the amount before deduction.

Key takeaways
  • CaseA taxi company deducted the shortfall from drivers' fixed wages whenever their submitted fare revenue fell below a company-set target amount.
  • OutcomeThe Supreme Court ruled that while such deductions are permissible, the wage remaining after deduction must still meet the minimum wage requirement.
  • LessonTaxi companies may deduct revenue shortfalls from wages, but must ensure that drivers' post-deduction pay never falls below the legal minimum wage (최저임금).
Issues
  • Whether deducting shortfall amounts from fixed wages under the full revenue management system (운송수입금 전액관리제) is valid
  • The proper standard for determining whether the Minimum Wage Act (최저임금법) has been violated
  • Whether minimum wage compliance should be assessed based on wages before or after the shortfall deduction is applied
Key reasoning

When drivers submit their full fare revenue as required, deducting the shortfall between actual revenue and the target amount from the fixed wage is, in principle, a valid practice under the collective bargaining agreement. However, the critical question of whether this arrangement violates the Minimum Wage Act must be assessed using the wage figure after the deduction has been applied, not the pre-deduction figure. This approach aligns with the fundamental purpose of the Minimum Wage Act, which is to guarantee a stable standard of living for workers, including taxi drivers. If courts assessed minimum wage compliance based on pre-deduction amounts, the practical effect of the deduction could push actual take-home pay below the legally guaranteed minimum, undermining the statute's protective intent. Therefore, the lower court erred by failing to apply this post-deduction standard when evaluating compliance.

Summary of Decision (English, AI translation)

[1] The former Passenger Transport Service Act (Yeogaekjadongcha Unsusaeopbeop) (before amendment by Act No. 13800 on January 19, 2016; hereinafter the “former Passenger Transport Service Act”) provided only, in Article 21(1), that “a transport business operator prescribed by Presidential Decree shall receive from a person engaged in driving duties who possesses the qualification for driving duties under Article 24 and is engaged in driving duties for a passenger automobile transport business (hereinafter a ‘transport service worker’) the full amount of the fare or charge received from users (hereinafter ‘transport revenue’),” and did not contain any provisions regarding the distribution of the collected transport revenue or working conditions such as the wage level or pay system at individual workplaces. Accordingly, under the former Passenger Transport Service Act, since a transport business operator could determine working conditions, such as the method of distributing the transport revenue after receiving it in full from transport service workers, through autonomous agreement between labor and management, so long as the transport business operator received the full amount of the transport revenue for the day worked from the transport service workers, it was in principle also permissible to stipulate in a collective agreement that, where the actual amount of transport revenue submitted falls short of the standard transport revenue amount, the shortfall would be deducted from the monthly fixed salary, and such a deduction cannot be regarded as a violation of Article 21(1) of the former Passenger Transport Service Act.

[2] Article 6(1) of the Minimum Wage Act (Choejeoimgeumbeop) provides that “an employer shall pay wages of at least the minimum wage amount to workers subject to the minimum wage,” and Article 43(1) of the Labor Standards Act (Geunrogijunbeop) provides that “wages shall be paid in currency directly to workers in full; provided that where there is a special provision in laws or a collective agreement, part of the wages may be deducted or paid in a form other than currency.” Considering these provisions of the Minimum Wage Act and the Labor Standards Act together, in a case where a collective agreement contains a provision for deducting part of the wages, in determining whether the wages paid fall short of the minimum wage, absent special circumstances, the principle is to calculate the wages included in the minimum wage under the Minimum Wage Act and its subordinate regulations based on the wages before such deduction, and then compare this with the minimum wage amount.

[3] Under the former Passenger Transport Service Act (before amendment by Act No. 13800 on January 19, 2016; hereinafter the “former Passenger Transport Service Act”), where a taxi transport business operator implements the full transport revenue management system and stipulates in a collective agreement that, where the actual amount of transport revenue submitted falls short of the standard transport revenue amount, the shortfall shall be deducted from the monthly fixed salary of taxi driving workers, such a deduction is itself permissible. However, where such a deduction has been made, absent special circumstances such as that the deduction amount arose or increased because the taxi driving worker failed to submit all or part of the transport revenue to the taxi transport business operator, whether there has been a violation of the Minimum Wage Act must be determined by calculating the wages included in the minimum wage under the Minimum Wage Act and its subordinate regulations (hereinafter the “wages subject to comparison”) based on the salary after deduction of the shortfall in the standard transport revenue. The reasons are as follows.

① The Minimum Wage Act compels employers to pay workers wages of at least the minimum amount set by the State, and further directly recognizes a worker’s right to claim the wage difference for any amount falling short of the minimum wage. Meanwhile, Article 6(5) of the Minimum Wage Act, as amended by Act No. 8964 on March 21, 2008 (effective from July 1, 2010 in cities other than special cities, metropolitan cities, and special self-governing cities), excludes “wages based on production performance” from the scope of wages subject to comparison for workers engaged in driving duties in the general taxi transport business. This is intended to ensure that, by increasing the proportion of fixed wages among the wages received by taxi driving workers, they can receive wages of at least the minimum wage amount even when transport revenue is low, thereby enabling them to lead a more stable life. Therefore, so long as a taxi driving worker has submitted the full amount of transport revenue, it is consistent with the purpose of the Minimum Wage Act to guarantee wages of at least the minimum wage amount even in cases where the shortfall in the standard transport revenue is deducted from the monthly fixed salary simply because the transport revenue is low due to low production performance.

② The full transport revenue management system was introduced for the purpose of improving upon the various problems inherent in the sanap-geum (quota remittance) system, which was the conventional wage form generally used in the general taxi transport business, thereby enhancing the transparency of business management for general taxi transport business operators and, at the same time, promoting the stability of the livelihood of taxi driving workers, so as to reduce the incentive for excessive and reckless taxi operation and thereby improve the quality of service provided to taxi users. In addition, the Passenger Transport Service Act, apart from containing provisions on the full transport revenue management system, operates a State licensing system for the general taxi transport business while imposing substantial regulation and providing support, which is intended, on the premise of the public nature of the general taxi transport business, to establish order in the taxi transport business and to promote the safe and smooth transport of passengers, ultimately to enhance the public welfare of citizens. Considering the relevant provisions of the Passenger Transport Service Act, the purpose of the full transport revenue management system, and the public nature of the general taxi transport business, it is difficult to accept, even from the standpoint of social interest, a situation in which, at a workplace implementing the full transport revenue management system, a taxi driving worker who has submitted the full amount of transport revenue nonetheless fails to be guaranteed even the minimum wage level because the amount submitted falls short of the standard transport revenue amount and the shortfall is deducted from the monthly fixed salary.

③ Even where the deduction of the shortfall in the standard transport revenue has been made through agreement between labor and management, that fact alone cannot justify disregarding the purposes of the Minimum Wage Act and other relevant laws as set out above and determining whether there has been a violation of the Minimum Wage Act on the basis of the salary before such deduction. On the contrary, if, even where such a deduction has been made, whether there has been a violation of the Minimum Wage Act were determined on the basis of the wages before deduction of the standard transport revenue, this would lead to the unreasonable result that, even where the standard transport revenue is set at an unrealistically high amount inconsistent with the taxi fares or taxi demand in the relevant business area, such that most of the monthly fixed salary that the taxi driving worker should originally receive is deducted despite having submitted the full amount of transport revenue, such a result would inevitably have to be deemed valid.

[Judgment Below] Jeonju District Court Decision 2016Na6128 Decided June 14, 2017

[Order]

The part of the judgment below concerning the conjunctive claim is reversed, and this part of the case is remanded to the Jeonju District Court. All remaining appeals by the plaintiffs are dismissed.

[Reasoning]

The grounds of appeal (including the descriptions in the reference materials submitted after the submission period had passed, to the extent they supplement the grounds of appeal) are examined.

1. Outline of the Case
According to the reasoning of the judgment below and the record, the following facts may be found.
A. The defendant is a company operating a taxi transportation business in Gunsan City, and the plaintiffs are persons who worked as taxi transport workers (taxi driving employees) belonging to the defendant.
B. On December 10, 2014, the defendant concluded the 2015 Wage Agreement (hereinafter "the Wage Agreement in this case") with the bargaining representative labor union, which took effect from January 1, 2015. Its main contents are as follows.
(1) Labor and management shall fully deposit and receive/manage the transportation revenue recorded by the operation recording device (tachometer) during statutory working hours, and shall implement a monthly salary system combining a fixed monthly wage based on the Minimum Wage Act (Choejeoimgeumbeop) and a performance-based allowance system.
(2) Pursuant to Article 4, Paragraph 1 of the Guidelines for Implementation of the Full Management System of Taxi Transportation Revenue, the full amount of transportation revenue for one day's work shall be deposited on the day work ends.
(3) The monthly fixed (standard) amount shall be 2,750,000 won per person for a two-shift, one-person system per day.
(4) Amounts embezzled without being deposited as transportation revenue shall be treated as advance payments and deducted from wages and retirement pay, and if the amount falls short of the monthly wage, disciplinary action and criminal prosecution shall be imposed.
(5) If the monthly transportation revenue falls short of the standard amount, the shortfall shall be treated as an advance payment and deducted from wages and other monetary payments made by the company, including retirement pay, and the matter shall be referred to the Reward and Disciplinary Committee.
C. Pursuant to the Wage Agreement in this case, the defendant received the full amount of transportation revenue from taxi transport workers, including the plaintiffs, belonging to it, and paid basic pay and various allowances to its taxi transport workers; however, when an individual taxi transport worker deposited an amount of transportation revenue that fell short of the monthly standard transportation revenue amount (hereinafter "standard transportation revenue"), the defendant deducted the shortfall from wages under the name of "advance payment" (hereinafter "the deduction in this case").
D. The plaintiffs filed this lawsuit, ① primarily arguing that the deduction in this case is invalid as violating Article 21, Paragraph 1 of the former Passenger Transport Service Act (Yeogaekjadongchaunsusaeopbeop) (before being amended by Act No. 13800 on January 19, 2016; hereinafter "the former Passenger Transport Service Act") and Article 12, Paragraph 1 of the Act on the Development of the Taxi Transportation Business (Taeksiunsongsaeobui Baljeone Gwanhan Beopnyul; hereinafter "the Taxi Development Act"), and thereby seeking payment of the entire amount deducted under the name of advance payment, and ② in the alternative, arguing that the deduction in this case is invalid as violating the Minimum Wage Act (Choejeoimgeumbeop) only insofar as it resulted in the plaintiffs being paid wages below the minimum wage, and thereby seeking payment of a portion of the amount deducted under the name of advance payment.

2. As to the Grounds of Appeal Concerning the Primary Claim
A. The former Passenger Transport Service Act, in Article 21, Paragraph 1, provided only that "a transportation business operator prescribed by Presidential Decree shall receive from a person who is qualified to engage in driving duties under Article 24 and who is engaged in driving duties for the passenger automobile transportation business (hereinafter 'transport worker') the full amount of fares or charges (hereinafter 'transportation revenue') received by the transport worker from users," and contained no provisions whatsoever regarding the distribution of collected transportation revenue or working conditions such as the wage level or wage system of individual workplaces. Therefore, under the former Passenger Transport Service Act, the working conditions, including the method by which a transportation business operator, after receiving the full amount of transportation revenue from transport workers, distributes it, may be determined through autonomous negotiation between labor and management. Accordingly, as long as the transportation business operator receives the full amount of the transportation revenue for the day worked from the transport workers, it is in principle also permissible for a collective agreement to provide that, where the actual amount of transportation revenue deposited falls short of the standard transportation revenue amount, the shortfall shall be deducted from the monthly fixed wage, and such deduction cannot be deemed to violate Article 21, Paragraph 1 of the former Passenger Transport Service Act (see Supreme Court Decision 2005Do8221, decided January 26, 2006; Supreme Court Decision 2004Du7665, decided March 30, 2007, etc.).

The judgment below, in the same vein, determined that a labor union having bargaining authority may conclude a wage agreement containing content such as the deduction in this case without the consent of individual employees, and that the portion of the Wage Agreement in this case concerning the deduction in this case cannot be deemed to violate the full transportation revenue management system prescribed in Article 21, Paragraph 1 of the former Passenger Transport Service Act. This determination is justified. There is no error in the judgment below, as alleged in the grounds of appeal, in misapprehending the legal principles concerning employment contracts and wages as prescribed by the Labor Standards Act (Geunrogijunbeop), the full transportation revenue management system prescribed by the former Passenger Transport Service Act, the normative effect of collective agreements, or the interpretation of Article 33 of the Trade Union and Labor Relations Adjustment Act (Nodongjohap Mit Nodonggwangyejojeongbeop). Furthermore, it is difficult to find grounds to overturn Supreme Court Decision 2004Du7665, decided March 30, 2007, as alleged in the grounds of appeal.

B. The judgment below determined, for the reasons stated therein, that the portion of the Wage Agreement in this case concerning the deduction in this case cannot be deemed to have violated Article 12, Paragraph 1 of the Taxi Development Act. Examining the record in light of the relevant legal principles, there is no error in this determination of the judgment below, as alleged in the grounds of appeal, in misapprehending the legal principles concerning the interpretation of Article 12, Paragraph 1 of the Taxi Development Act.

C. The argument that the portion of the Wage Agreement in this case concerning the deduction in this case constitutes a penalty agreement in violation of Article 20 of the Labor Standards Act and is therefore invalid is raised for the first time at the appellate stage, and thus does not constitute a legitimate ground of appeal. Moreover, even upon examination, there is no error in the judgment below's determination in misapprehending the legal principles concerning Article 20 of the Labor Standards Act.

3. As to the Grounds of Appeal Concerning the Conjunctive Claim
A. Article 6, Paragraph 1 of the Minimum Wage Act provides that "an employer shall pay wages not less than the minimum wage amount to employees subject to the minimum wage," and Article 43, Paragraph 1 of the Labor Standards Act provides that "wages shall be paid directly to employees in full in currency; provided, however, that where there is a special provision in statutes or collective agreements, a portion of wages may be deducted or paid in something other than currency." Synthesizing the contents of these provisions of the Minimum Wage Act and the Labor Standards Act, in a case where a collective agreement contains a provision for deducting a portion of wages, in determining whether the wages paid fall short of the minimum wage, the principle, absent special circumstances, is to calculate the wages included in the minimum wage under the Minimum Wage Act and its subordinate statutes (hereinafter "comparison wages") based on the wages before such deduction, and then compare this with the minimum wage amount.

As discussed above, in a case where a taxi transportation business operator implements the full transportation revenue management system under the former Passenger Transport Service Act, it is itself permissible for a collective agreement to provide that, where the actual amount of transportation revenue deposited falls short of the standard transportation revenue amount, the shortfall shall be deducted from the taxi driving employee's monthly fixed wage. However, where such deduction has been made, unless there are special circumstances such as the deduction amount having arisen or increased because the taxi driving employee failed to deposit all or part of the transportation revenue with the taxi transportation business operator, then, contrary to the principle set forth above, whether there has been a violation of the Minimum Wage Act must be determined by calculating the comparison wages based on the wages after deduction of the shortfall in the standard transportation revenue. The reasons are as follows.

(1) The Minimum Wage Act compels employers to pay employees wages not less than the minimum amount set by the State, and further directly recognizes an employee's right to claim the wage difference for amounts falling short of the minimum wage (see Supreme Court en banc Decision 2016Da2451, decided April 18, 2019). Meanwhile, Article 6, Paragraph 5 of the Minimum Wage Act, as amended by Act No. 8964 on March 21, 2008 (effective from July 1, 2010, in cities other than special cities, metropolitan cities, and special self-governing cities), excludes "wages based on output" from the scope of comparison wages for employees engaged in driving duties in the general taxi transportation business. This is intended to raise the proportion of fixed pay among the wages received by taxi driving employees, thereby guaranteeing that they receive wages not less than the minimum wage amount even when transportation revenue is low, so that they may lead a more stable life (see Supreme Court Decision 2016Da9261, 9278, decided July 11, 2018; Constitutional Court en banc Decision 2008Heonma477, decided August 30, 2011). Therefore, as long as a taxi driving employee has deposited the full amount of transportation revenue, it accords with the purpose of the Minimum Wage Act to guarantee wages not less than the minimum wage amount even in a case where the shortfall in the standard transportation revenue is deducted from the monthly fixed wage simply because the transportation revenue was low due to low output.

(2) The full transportation revenue management system was introduced to improve upon the various problems inherent in the sabnageum (quota deposit) system, which was the conventional wage form generally used in the general taxi transportation business, thereby enhancing the transparency of management for general taxi transportation business operators and promoting the stability of the livelihood of taxi driving employees, so as to reduce the causes of excessive taxi operation and improve the quality of service to taxi users (see Constitutional Court en banc Decision 97Heonma345, decided October 29, 1998, etc.). Furthermore, in addition to establishing provisions concerning the full transportation revenue management system, the Passenger Transport Service Act operates a State licensing system for the general taxi transportation business while imposing considerable regulation and support, which is intended, on the premise of the public nature of the general taxi transportation business, to establish order in the taxi transportation business and to promote the safe and smooth transportation of passengers, ultimately to enhance the public welfare of citizens (see the above Supreme Court en banc Decision 2016Da2451). Considering the relevant provisions of the Passenger Transport Service Act, the purpose of the full transportation revenue management system, and the public nature of the general taxi transportation business, it is difficult to accept, even from the standpoint of social benefit, a situation in which, at a workplace implementing the full transportation revenue management system, a taxi driving employee, despite having deposited the full amount of transportation revenue, fails even to be guaranteed the minimum wage level because the deposited amount fell short of the standard transportation revenue amount and the shortfall was deducted from the monthly fixed wage.

(3) Even where a deduction of the shortfall in the standard transportation revenue has been made pursuant to labor-management agreement, such circumstance alone cannot justify disregarding the purpose of the Minimum Wage Act and other statutes as set forth above and determining whether there has been a violation of the Minimum Wage Act based on wages prior to such deduction. On the contrary, if a violation of the Minimum Wage Act were to be determined based on wages prior to deduction of the standard transportation revenue even where such deduction has been made, this would lead to the unreasonable result that, where the standard transportation revenue is set at an unrealistically high amount inconsistent with the taxi fares or taxi demand of the relevant business area, causing most of the monthly fixed wage that the taxi driving employee should originally receive to be deducted despite the employee having deposited the full amount of transportation revenue, such a result would nonetheless have to be deemed valid.

B. Examining the facts found above in light of the legal principles set forth above, whether the wages the defendant paid to the plaintiffs fell short of the minimum wage must be determined by calculating the comparison wages based on the wages after the deduction in this case was made, and then comparing this with the minimum wage amount. However, if it is found that the plaintiffs failed to deposit all or part of the transportation revenue with the defendant, and that the deduction amount arose or increased as a result thereof, then the deduction amount that arose or increased due to the plaintiffs' failure to deposit all or part of the transportation revenue should be reflected in the calculation of the comparison wages.

C. Nevertheless, without examining whether circumstances exist showing that the plaintiffs failed to deposit all or part of the transportation revenue with the defendant, the judgment below, on the premise that whether the wages the defendant paid to the plaintiffs fell short of the minimum wage must be determined based on the wages prior to the deduction in this case, dismissed all of the plaintiffs' conjunctive claims on the ground that the basic pay prior to the deduction in this case as set forth in the Wage Agreement in this case exceeded the minimum wage. This determination by the judgment below contains an error affecting the judgment, by misapprehending the legal principles concerning the minimum wage and failing to exhaust the necessary examination. The ground of appeal pointing this out has merit.

4. Conclusion
Therefore, the part of the judgment below concerning the conjunctive claim is reversed, and this part of the case is remanded to the court below for further hearing and determination, and all remaining appeals by the plaintiffs are dismissed. This Judgment is rendered with the unanimous consent of the participating Justices, as stated in the Order.
