When a taxi company labor union launched a 'work-to-rule' campaign (준법투쟁, a form of industrial action where workers strictly follow all regulations to slow operations), the employer responded with a lockout (직장폐쇄). The Supreme Court ruled that this lockout, carried out abruptly just three days after the campaign began, lacked legitimacy, and ordered the employer to pay wages for the lockout period.

Key takeaways
  • CaseA taxi company imposed a lockout just three days after its union began a work-to-rule campaign.
  • OutcomeThe court ruled the hasty lockout lacked reasonable proportionality and was therefore invalid, ordering the employer to pay wages for the lockout period.
  • LessonEmployers must engage in sufficient negotiation before resorting to a lockout, and the lockout's scale must be proportionate to the union's industrial action to be recognized as legitimate.
Issues
  • Legitimacy of the labor union's industrial action (work-to-rule campaign)
  • Requirements for a valid employer lockout (직장폐쇄) under labor law
  • Employer's obligation to pay wages during the lockout period
Key reasoning

An employer's lockout is only legitimate when it serves as a reasonably proportionate countermeasure or defensive response to the union's industrial action. Courts must evaluate this by comprehensively considering the history of labor-management negotiations, the nature and intensity of the union's actions, and overall fairness between the parties. In this case, the employer's swift and sudden lockout—imposed merely three days after the work-to-rule campaign began—failed to meet the requirement of reasonable proportionality, rendering it illegitimate. Because the lockout was not a valid exercise of the employer's right, the employer remained obligated to pay wages to the workers for the lockout period.

Summary of Decision (English, AI translation)

[1] A trade union's industrial action refers to a struggle act carried out by the union for the purpose of achieving its own demands by developing, to its advantage, a dispute situation that has arisen from a disagreement over working conditions, and it means an act that impedes the normal operation of business. Therefore, even if a dispute arose merely because the trade union made a somewhat unreasonable demand for a wage increase to the employer, and even if the employer's normal business operations were impeded as a result of the union's industrial action, this alone does not render the union's industrial action lacking in legitimacy.

[2] Our Constitution (헌법) and labor-related statutes contain express provisions actively guaranteeing workers' right to industrial action, whereas they contain no express provision regarding an employer's right to industrial action. This is because the purpose is to liberate workers—who are placed in a position of significant disadvantage vis-à-vis employers due to the considerable constraints imposed on their means of exerting pressure under general civil law—from such constraints, thereby promoting and securing equality between labor and management. Accordingly, in general, there is no need to recognize a right to industrial action for employers, who are in a position of superior strength. However, in the context of an individual, concrete labor dispute, where the balance of power between labor and management is disrupted by the workers' industrial action such that the employer is instead placed under significantly disadvantageous pressure, it accords with the principle of equity to recognize the employer's right to industrial action as a means of counteraction and defense to block that pressure and restore the balance of power. It appears that our law, precisely contemplating such a situation, provided in Article 3 of the former Labor Dispute Adjustment Act (구 노동쟁의조정법, abolished by Article 3 of the Addenda to the Act on the Adjustment of Labor Relations and Labor Unions (노동조합및노동관계조정법), Act No. 5244 of December 31, 1996) for an employer's lockout as a type of industrial action alongside a trade union's strike, slowdown, etc. However, in order for an employer's lockout carried out in the context of a concrete labor dispute to be evaluated as a legitimate industrial action, it must be limited to cases where, in light of the specific circumstances concerning the bargaining attitudes and conduct of labor and management, the manner of the workers' industrial action, the degree of the blow suffered by the employer as a result thereof, and so forth, the lockout is recognized, from the standpoint of equity, as an appropriate means of counteraction and defense against the workers' industrial action. Only when the lockout is evaluated as a legitimate industrial action is the employer exempted from the obligation to pay wages to the workers subject to the lockout during the period of the lockout.

[3] A case holding that, even though the average wage was the highest among taxi companies within the province, the wage negotiations broke down because the trade union demanded the highest level of wage increase, and the employer's lockout, carried out abruptly only three days after the trade union began its rule-compliance struggle, was found to lack legitimacy.

[Judgment Below] Gwangju High Court, Jeju Branch, Judgment rendered June 12, 1998, Case No. 97Na562

[Order]

The appeal is dismissed. The costs of the appeal shall be borne by the Defendant.

[Reasoning]

The grounds of appeal are examined.

A labor union's industrial action refers to a struggle conducted by the labor union with the purpose of unfolding, in a manner advantageous to itself, a state of dispute arising from a disagreement of positions concerning working conditions, so as to carry through its own demands, thereby impeding the normal operation of business (see Article 3 of the former Trade Union and Labor Relations Adjustment Act (노동쟁의조정법) (before its abolition by Act No. 5244 on December 31, 1996; hereinafter the same)). Therefore, even if a dispute arose merely because the labor union demanded a somewhat unreasonable wage increase from the employer, and even if, as a result of the union's industrial action, the employer's normal business operations were impeded, this alone does not mean that the union's industrial action lacks legitimacy.

Meanwhile, our Constitution and labor-related statutes contain explicit provisions actively guaranteeing the right to industrial action of workers, whereas they do not contain any explicit provision concerning the employer's right to industrial action. This is because workers, who are placed in a position of being significantly disadvantaged in relation to the employer due to substantial restrictions on their means of exerting pressure under general civil law, need to be liberated from such restrictions in order to promote and secure equality between labor and management. Accordingly, in general, there is no need to recognize a right to industrial action for the employer, who is in a position of superior strength. However, in the context of a specific, actual labor dispute, where the balance of power between labor and management is disrupted by the workers' industrial action, and the employer is instead subjected to significantly disadvantageous pressure, it accords with the principle of equity to recognize the employer's right to industrial action as a means of counteraction and defense to block that pressure and restore the balance of power. It appears that our law, precisely envisioning such a situation, provides for the employer's lockout as one type of industrial action, alongside a labor union's strike or slowdown (former Trade Union and Labor Relations Adjustment Act, Article 3).

However, in order for an employer's lockout carried out in the context of a specific labor dispute to be evaluated as legitimate industrial action, it must be recognized, from the standpoint of equity and in light of the specific circumstances concerning the bargaining attitude and progress between labor and management, the manner of the workers' industrial action, the degree of impact suffered by the employer as a result thereof, and so forth, as an appropriate means of counteraction and defense against the workers' industrial action. Only when the lockout is evaluated as legitimate industrial action is the employer relieved of the obligation to pay wages to the workers subject to the lockout during the period thereof.

According to the reasoning of the judgment below, the court below found as follows: ① In the 1994 wage agreement, the labor union of the Defendant company (hereinafter the "Union"), together with 11 other companies among the 35 taxi companies in Jeju Island, agreed to the highest wage increase of 14%; in the 1995 wage negotiations, the Union again demanded a 10% wage increase, while the Defendant insisted on a wage freeze on the ground that the wages of the Defendant company's drivers were higher than those of other companies; the Union and the Defendant attempted wage negotiations eight times from June 12, 1995 to July 12, 1995, but the negotiations broke down due to differences in position concerning the rate of wage increase and the amount of the "sabnamgeum" (the fare revenue that drivers remit to the company); ② Thereupon, the Union reported the occurrence of a labor dispute to the Jeju Regional Labor Relations Commission, etc. on July 31 of that year, and attempted negotiations several times even during the cooling-off period, but these likewise broke down; at an extraordinary general meeting on August 17 of that year, the Union resolved to conduct a slowdown, and thereafter entered into a so-called "law-abiding struggle" (compliance campaign), whereby drivers commuted to and from work punctually, refrained from traffic law violations such as speeding or running red lights, and refrained from illegal operations such as carrying multiple unrelated passengers or collecting unjust fares; ③ As a result, the sabnamgeum, which had previously ranged from KRW 98,000 to KRW 120,000 per day, decreased to about half that level, ranging from KRW 35,000 to KRW 75,000 per day; ④ Thereupon, on August 19 of that year, the third day after the Union commenced the compliance campaign, the Defendant reported a lockout to the aforementioned Labor Relations Commission, etc. on the ground of a decrease in company revenue, and from around 04:00 on August 20, suspended the operation of 46 vehicles belonging to the Defendant company, excluding 5 vehicles operated by non-union members, thereby carrying out a lockout against all union members; ⑤ Thereafter, the Defendant maintained that "the lockout cannot be lifted unless the Union first withdraws the compliance campaign and other industrial actions and gives a definite promise to resume normal operations," and continued the lockout without engaging in any substantial dialogue with the Union, until September 22 of that year, when it entered into a wage agreement with the Union to raise wages by 4.5% while raising the sabnamgeum by KRW 4,000, and lifted the lockout that same day; ⑥ However, as of August 17, 1995, when the Union commenced the compliance campaign, the average wage of drivers belonging to the Defendant company was KRW 651,004 per month (based on one year of service), which, together with 12 other companies, was the highest level among the 35 taxi companies in Jeju Island; ⑦ At that time, among the 25 companies (out of 35 taxi companies in Jeju Island) that had completed 1995 wage negotiations, 12 companies agreed to raise 1995 wages by 2% to 10%, and 13 companies agreed to freeze wages; in particular, among the other 12 companies that paid wages at the same level as the Defendant company, only 3 companies agreed to raise wages by 3% to 10%, while the remaining 9 companies agreed to freeze wages and were operating normally.

Based on these findings, the court below determined as follows: In light of the purpose, procedure, and form of the compliance campaign, as well as the resulting decrease in the Defendant's revenue, the Union's compliance campaign is to be regarded as industrial action similar to a slowdown; however, comprehensively considering the subject, purpose, timing, procedure, means, and methods of such industrial action, the mere fact that the Defendant's normal business operations and financial situation were disrupted cannot deny the legitimacy of the industrial action. Furthermore, in light of the fact that, among the other 12 companies paying wages at the same level as the Defendant company at that time, there was a company that agreed to a 10% wage increase as demanded by the Defendant company's Union, the Union's demand for a wage increase was not so unreasonable as to be entirely unacceptable to the Defendant; the Union's compliance campaign did not go so far as to reach the level of illegal or disruptive operation, such as fixing the sabnamgeum at a certain level or operating vehicles empty, beyond merely observing the various regulations concerning vehicle operation or the working hours under the collective agreement; and the period during which the Union conducted the compliance campaign was merely three days, so it cannot be concluded that the decrease in the Defendant's revenue due to such a short-term compliance campaign reached a level of serious impact on its management. In light of these circumstances, the lockout, which the Defendant abruptly carried out only three days after the compliance campaign began, without taking more time to attempt wage negotiations with the Union through dialogue, is difficult to view as having been inevitably initiated as a passive and defensive means to protect the company in a situation where the balance of power between labor and management had been disrupted by the workers' industrial action and the employer side was instead subjected to significantly disadvantageous pressure. Accordingly, the court below concluded that the Defendant's lockout lacked legitimacy, and therefore the Defendant cannot be relieved of its obligation to pay wages to the Plaintiffs during the period of the lockout.

The above determination by the court below is justified in accordance with the legal principles set forth above, and there is no error of law, as alleged in the grounds of appeal, in misapprehending the legal principles concerning the legitimacy of the compliance campaign and the legitimacy of the lockout.

The grounds of appeal cannot be accepted.

Therefore, the appeal is dismissed, and the costs of the appeal are to be borne by the losing party. The Justices participating in this decision unanimously agree, and the judgment is rendered as set forth in the Order.
