In a case where an interview panel member for a fire station's public service position hiring process misused personal information of job applicants for private purposes, the Supreme Court held that a fire station, which lacks independent legal personality (법인격), does not qualify as a 'corporation or individual (법인 또는 개인)' subject to punishment under the joint penalty provision (양벌규정) of the Personal Information Protection Act. Consequently, an individual employee acting on behalf of the fire station also could not be punished under that provision. The lower court's guilty verdict was reversed and remanded for misapplying the legal principles governing joint penalty provisions.

Key takeaways
  • CaseA fire station interview panel member misused a job applicant's personal information obtained during the hiring process for private purposes.
  • OutcomeThe Supreme Court ruled that since the fire station lacks legal personality, it cannot be punished under the joint penalty provision, and therefore the individual employee also cannot be held liable under that clause.
  • LessonCriminal liability under joint penalty provisions (양벌규정) cannot be extended beyond their explicit statutory wording to cover public institutions without legal personality or their employees, in accordance with the principle of legality in criminal law (죄형법정주의).
Issues
  • Whether a public institution without independent legal personality (such as a fire station) falls within the scope of 'corporation or individual (법인 또는 개인)' subject to the joint penalty provision under Article 74(2) of the former Personal Information Protection Act
  • If such a public institution does not fall within the scope of the joint penalty provision, whether an individual employee acting on its behalf can nonetheless be punished under that provision
Key reasoning

The joint penalty provision (양벌규정) under Article 74(2) of the former Personal Information Protection Act (개인정보 보호법) explicitly limits its scope of punishment to 'corporations or individuals (법인 또는 개인),' with no express provision extending liability to public institutions lacking legal personality. Under the principle of legality in criminal law (죄형법정주의), courts cannot expand this provision by interpretation to cover entities such as a fire station, which is an organ of a local government (Gyeonggi Province) without independent legal personality. Because the fire station itself cannot be punished under the joint penalty provision, its employee—who acted as the fire station's agent—likewise cannot be held criminally liable under that same provision. Therefore, the defendant, an employee of the fire station, could not be punished as the 'actor' under the joint penalty clause.

Summary of Decision (English, AI translation)

[1] Article 71 Subparagraph 2 of the former Personal Information Protection Act (개인정보 보호법, before amendment by Act No. 19234 of March 14, 2023; hereinafter the same) provides for the punishment of a personal information controller who, in violation of Article 18(1) of the same Act, uses personal information beyond the scope of the purpose of collection. Article 74(2) of the same Act is a joint penalty provision (양벌규정) under which, if a representative of a corporation, or an agent, employee, or other worker of a corporation or an individual commits a violation falling under Article 71 of the same Act in connection with the business of the corporation or individual, the actor shall be punished, and in addition, the corporation or individual shall also be punished with the fine prescribed in the relevant provision.

Article 71 Subparagraph 2 and Article 18(1) of the former Personal Information Protection Act limit the scope of application of the penal provisions to a personal information controller. However, the purpose of the above joint penalty provision is, where there exists a person who actually handles such business without being the personal information controller, to secure the effectiveness of the penal provisions by extending their scope of application to the actor who actually handles the relevant business, thereby punishing both the actor and the personal information controller. Accordingly, by virtue of the joint penalty provision, an actor who is not the personal information controller also becomes subject to the penal provisions.

However, while the former Personal Information Protection Act, in Article 2 Subparagraphs 5 and 6, designates as one type of personal information controller a public institution that lacks legal personality, such as a “central administrative agency and its affiliated agencies,” Article 74(2) of the same Act, in defining the personal information controller subject to punishment under the joint penalty provision, provides only for a “corporation or individual,” and contains no explicit provision as to whether the above joint penalty provision applies to a public institution lacking legal personality. Therefore, in accordance with the principle of statutory nullum crimen sine lege (죄형법정주의), a “public institution lacking legal personality” cannot be punished under the above joint penalty provision, and it is reasonable to hold that, in such a case, the actor likewise cannot be punished under the above joint penalty provision.

[2] In a case where the defendant, an interview panel member for the recruitment of public service position employees at Fire Station A, was indicted for violation of the former Personal Information Protection Act (before amendment by Act No. 19234 of March 14, 2023; hereinafter the same) on the ground that he personally retained the personal information of interview applicant B, which he had been provided with in connection with the interview process, and then called B’s mobile phone number and made personal remarks, thereby using the personal information beyond the scope of the purpose of collection without the consent of the data subject: the Supreme Court held that Fire Station A, being merely a direct affiliated agency of Gyeonggi-do and lacking legal personality, could not be deemed to fall within the personal information controller subject to punishment under the joint penalty provision of Article 74(2) of the former Personal Information Protection Act, and that, accordingly, the actor likewise could not be punished under the above joint penalty provision. The Supreme Court found that the court below erred in its interpretation of the law regarding the joint penalty provision of Article 74 of the former Personal Information Protection Act by finding the defendant guilty on the premise, contrary to the above, that Fire Station A could be punished as a personal information controller under the joint penalty provision of Article 74(2) of the former Personal Information Protection Act, and that the defendant, as an “actor” who was an employee of Fire Station A under the above joint penalty provision, was thus guilty.

[Defendant] Defendant
[Appellant] Defendant
[Defense Counsel] Attorney Kim Myeong-cheol
[Judgment Below] Seoul Eastern District Court Judgment 2024No737, dated June 13, 2025

[Order]

The judgment below is reversed, and the case is remanded to the Seoul Eastern District Court.

[Reasoning]

The grounds of appeal are examined.

1. Summary of the Charged Facts
The Defendant was an interview panel member in the interview procedure for the recruitment of public service position employees of ○○ Fire Station conducted on February 1, 2023, and An ○-rin was an applicant taking the interview for the said recruitment.

A personal information controller shall not use personal information beyond the scope of the purpose of collection without the consent of the data subject, etc., and where an employee or other worker of a corporation or individual commits such a violation in connection with the business of the corporation or individual, not only shall the actor be punished, but the corporation or individual shall also be punished with the fine prescribed in the relevant provision.

Nevertheless, the Defendant, as an employee of a personal information controller, personally retained the personal information of An ○-rin that had been provided to him in his capacity as an interview panel member in connection with the above interview, and around 16:02 on February 9, 2023, called An ○-rin's mobile phone number and made personal remarks, thereby using personal information beyond the scope of the purpose of collection without the consent of the data subject.

2. Judgment Below
The court below found that the Defendant, as an employee of ○○ Fire Station, a personal information controller, fell under the category of "actor" under the joint penalty provision, and accordingly found the Defendant guilty of the charged facts by applying the joint penalty provision of Article 74(2), the penal provision of Article 71(2), and the obligation provision of Article 18(1) of the former Personal Information Protection Act (Individual Information Protection Act) (before amendment by Act No. 19234 on March 14, 2023; hereinafter referred to as the "former Personal Information Protection Act (개인정보 보호법)").

3. Judgment of the Supreme Court
A. Article 71(2) of the former Personal Information Protection Act provides for the punishment of a personal information controller who uses personal information beyond the scope of the purpose of collection in violation of Article 18(1) of the same Act. Article 74(2) of the same Act is a joint penalty provision under which, where a representative of a corporation, or an agent, employee, or other worker of a corporation or individual commits a violation falling under Article 71 of the same Act in connection with the business of the corporation or individual, not only shall the actor be punished, but the corporation or individual shall also be punished with the fine prescribed in the relevant provision.

B. Article 71(2) and Article 18(1) of the former Personal Information Protection Act limit the scope of application of the penal provision to personal information controllers. However, the purpose of the above joint penalty provision is, where there exists a person who is not a personal information controller but who actually handles such business, to secure the effectiveness of the penal provision by extending its scope of application to include the actor who actually handles the relevant business, thereby punishing both the actor and the personal information controller. Accordingly, by virtue of the joint penalty provision, an actor who is not a personal information controller also becomes subject to the penal provision (see Supreme Court en banc Decision 95Do2870, delivered on July 15, 1999; Supreme Court Decision 2017Do11564, delivered on December 5, 2017, etc.).

However, while the former Personal Information Protection Act, in Article 2(5) and (6), provides that among public institutions, "central administrative agencies and their affiliated agencies" lacking legal personality, etc., are also included as one type of personal information controller, Article 74(2) of the same Act, in defining the personal information controllers punishable under the joint penalty provision, provides only for a "corporation or individual," and does not contain any express provision as to whether the above joint penalty provision applies to public institutions lacking legal personality. Therefore, in light of the principle of legality in criminal law (죄형법정주의), it is not permissible to punish a "public institution lacking legal personality" under the above joint penalty provision, and in such a case, it is proper to conclude that the actor likewise cannot be punished under the above joint penalty provision (see Supreme Court Decision 2020Do1942, delivered on October 28, 2021).

C. In light of the above legal principles, ○○ Fire Station, being merely a direct subordinate agency of Gyeonggi-do and lacking legal personality, cannot be deemed to fall within the scope of personal information controllers punishable under the joint penalty provision of Article 74(2) of the former Personal Information Protection Act, and therefore the actor likewise cannot be punished under the above joint penalty provision.

D. Nevertheless, the court below, on the premise that ○○ Fire Station could be punished as a personal information controller under the joint penalty provision of Article 74(2) of the former Personal Information Protection Act, found the Defendant guilty of the charged facts on the ground that the Defendant fell under the category of "actor" as an employee of ○○ Fire Station under the said joint penalty provision. Such a judgment by the court below contains an error that misapprehends the legal principles concerning the joint penalty provision of Article 74 of the former Personal Information Protection Act, thereby affecting the judgment.

4. Conclusion
Without examining the remaining grounds of appeal, the judgment below is reversed, and the case is remanded to the court below for further deliberation and adjudication. This judgment is rendered as set forth in the Order by the unanimous opinion of the Justices participating in the decision.
