Taxi drivers who had voluntarily agreed to piece-rate employment contracts sought a separate fixed wage (고정급) meeting the minimum wage, excluding their production-based earnings (excess fare revenue, 초과운송수입금), under the special provision of the Minimum Wage Act. The Supreme Court held that, despite the drivers' voluntary choice of the piece-rate arrangement, they were entitled to a fixed wage at or above the statutory minimum wage separate from their production-based pay. The Court rejected the company's argument that this claim violated the principle of good faith (신의성실원칙), finding no special circumstances justifying an exception to the mandatory statute, and reversed and remanded the case to the High Court.

Key takeaways
  • CaseIncident: Taxi drivers who had signed piece-rate employment contracts demanded a separate fixed-wage minimum wage payment under the special provision of the Minimum Wage Act.
  • OutcomeResult: The Supreme Court ruled that, regardless of their voluntary choice of a piece-rate contract, the drivers were entitled to a separate fixed wage meeting the minimum wage, apart from their production-based earnings.
  • LessonLesson: Even under a piece-rate contract, taxi drivers must be paid a fixed minimum wage separate from their fare revenue, as required by the special provision of the Minimum Wage Act.
Issues
  • The scope of application of the special provision of the Minimum Wage Act (Article 6(5)) for taxi drivers
  • Whether the principle of good faith (신의성실원칙) can bar a worker's claim under this mandatory statutory provision in a piece-rate employment contract
  • The distinction between production-based wages (생산고에 따른 임금) and fixed wages (고정급) under the Minimum Wage Act
Key reasoning

The special provision of the Minimum Wage Act is a mandatory rule (강행규정) intended to increase the proportion of fixed wages for taxi drivers in order to guarantee them a stable income. Even if a driver voluntarily chose a piece-rate contract, this does not waive their statutory right to a separate fixed wage meeting the minimum wage, exclusive of production-based earnings. Because this right derives from a mandatory statutory provision, asserting it does not, in itself, violate the principle of good faith. The Court found no special circumstances suggesting that the drivers' claim was an abuse of rights or an attempt to circumvent the law in bad faith. Accordingly, the lower court's dismissal of the drivers' claim was found to be an error of law.

Summary of Decision (English, AI translation)

[1] Article 6(1) of the Minimum Wage Act (최저임금법) provides that "an employer shall pay wages not less than the minimum wage to workers subject to the minimum wage," and Article 6(3) provides that "the part of an employment contract between a worker subject to the minimum wage and an employer that sets wages below the minimum wage amount shall be null and void, and in such case, the invalidated part shall be deemed to have agreed to pay wages equal to the minimum wage amount prescribed by this Act." However, with respect to workers engaged in driving duties in the general taxi transportation business (hereinafter "taxi driver-employees"), Article 6(5) of the Minimum Wage Act, as amended by Act No. 8818 on December 27, 2007, limits the scope of wages included in the minimum wage calculation to wages prescribed by Presidential Decree "excluding wages based on production output" (hereinafter the "Special Provision"). Accordingly, Article 5-2 of the Enforcement Decree of the same Act provides that "wages paid at least once a month according to the payment conditions and rates set forth in a collective agreement, rules of employment, or employment contract" shall be included in the minimum wage, while "wages paid for something other than prescribed working hours or prescribed working days" and "wages paid for workers' living assistance and welfare benefits" shall not be included in the minimum wage.

The purpose of the amended Minimum Wage Act, through the Special Provision, in excluding wages based on production output from inclusion in the minimum wage, is to ensure that taxi driver-employees can lead a more stable life by increasing the proportion of fixed wages among the wages they receive, thereby guaranteeing that they receive wages not less than the minimum wage amount even when transportation revenue is low. Therefore, the part of an employment contract that sets wages below the minimum wage amount as a result of applying the Special Provision is null and void as being contrary to a mandatory provision.

[2] The principle of good faith (hereinafter "the good faith principle") refers to the abstract norm that parties to a legal relationship must not exercise rights or perform obligations in a manner or with content that is inequitable or betrays trust, while giving consideration to the interests of the other party. In order to deny the exercise of a right on the ground that it violates the good faith principle, it must be established that trust was extended to the other party, or that, viewed objectively, the other party has reached a state where it is justified in holding such trust, and that exercising the right in violation of such trust of the other party has reached a degree that cannot be tolerated in light of the concept of justice. Where the content of a labor-management agreement, such as a collective agreement, is null and void for violating mandatory provisions such as those of the Labor Standards Act (근로기준법), if an assertion of such invalidity is rejected on the ground that it constitutes an exercise of rights in violation of the good faith principle, this would result in undermining the legislative purpose of the mandatory provision. Therefore, unless the general requirements for applying the good faith principle are met and, in addition, this case falls under an exceptional circumstance where there are special grounds justifying the application of the good faith principle in preference to the mandatory nature of the provision, such an assertion cannot be deemed to violate the good faith principle.

[3] In a case where the labor and management of Company A, a taxi transportation business operator, agreed that workers would individually choose between a so-called piece-rate employment contract, under which workers pay a fixed quota (사납금) to the company out of the transportation revenue earned through taxi operation and take only the excess transportation revenue remaining thereafter, and a monthly salary employment contract, and where Eul et al., taxi driver-employees of Company A, entered into piece-rate employment contracts with Company A, and Eul et al. subsequently claimed that the said employment contracts violated the Minimum Wage Act and sought payment of unpaid minimum wages, etc. from Company A: the Supreme Court held that the excess transportation revenue that Eul et al. took under the piece-rate employment contracts concluded with Company A should be regarded as "wages based on production output" as provided in Article 6(5) of the Minimum Wage Act (hereinafter the "Special Provision"), and thus Company A was obligated to pay Eul et al. fixed wages not less than the minimum wage amount, exclusive of such excess transportation revenue. The Court further held that, in light of the legislative purpose of the Special Provision, which sought to enable taxi driver-employees to lead a stable life by increasing the proportion of fixed wages among their wages, as well as all the circumstances including the motive and process by which Company A continued to maintain the piece-rate employment contract even after the Special Provision took effect, and the circumstances under which Eul et al. came to enter into the piece-rate employment contracts with Company A, it was difficult to find that Eul et al.'s claim for payment of the minimum wage calculated in accordance with the Special Provision reached a degree that could not be tolerated in light of the concept of justice, or that there existed special circumstances justifying the application of the good faith principle in preference thereto. The Supreme Court determined that the lower court erred in its understanding of the applicable law by holding that Eul et al.'s claim was impermissible as violating the principle of good faith.

[Lower Court Judgment] Seoul High Court Decision 2015Na18857, 28977, decided January 15, 2016

[Order]

The judgment of the court below is reversed, and the case is remanded to the Seoul High Court.

[Reasoning]

The grounds for appeal (including the supplementary brief on grounds for appeal submitted after the deadline for submission of the grounds for appeal, to the extent it supplements the grounds for appeal) are examined as follows.

1. (a) Article 6(1) of the Minimum Wage Act (최저임금법) provides that "an employer shall pay wages not less than the minimum wage to workers subject to the minimum wage," and Article 6(3) provides that "any part of an employment contract between a worker subject to the minimum wage and an employer that sets wages below the minimum wage amount shall be null and void, and in such case, the invalidated part shall be deemed to have been agreed to pay wages equal to the minimum wage amount prescribed by this Act." However, in the case of workers engaged in driving duties in the general taxi transportation business (hereinafter referred to as "taxi driver-employees"), Article 6(5) of the Minimum Wage Act, as amended by Act No. 8818 on December 27, 2007, limits the scope of wages included in the minimum wage to wages prescribed by Presidential Decree "excluding wages based on production output" (hereinafter referred to as "the special provision at issue"). Accordingly, Article 5-2 of the Enforcement Decree of the same Act provides that "wages paid at least once a month in accordance with the payment conditions and payment rates set forth in collective agreements, employment rules, or employment contracts" shall be included in the minimum wage, but "wages other than those paid for prescribed working hours or prescribed working days" and "wages paid for workers' living assistance and welfare benefits" shall not be included in the minimum wage.
The purpose of the amended Minimum Wage Act in prohibiting the inclusion of production-output-based wages in the minimum wage through this special provision is to increase the proportion of fixed wages among the wages received by taxi driver-employees, thereby guaranteeing that they receive wages not less than the minimum wage amount even when transportation revenue is low, so that they may lead a more stable life (see Constitutional Court Decision 2008Hun-Ma477, decided August 30, 2011, en banc). Therefore, any part of an employment contract that sets wages below the minimum wage amount as a result of applying this special provision is null and void as being contrary to a mandatory provision.
(b) Meanwhile, the principle of good faith (hereinafter referred to as "the principle of good faith") refers to the abstract norm that parties to a legal relationship must not exercise rights or perform obligations in a manner or with content that is inequitable or betrays trust, giving due consideration to the interests of the other party. In order to deny the exercise of a right on the ground that it violates the principle of good faith, it must be shown that trust was extended to the other party, or that, objectively viewed, the other party has reached a state where it is justified in having such trust, and that exercising the right in violation of such trust of the other party has reached a degree that cannot be tolerated in light of the concept of justice. Where the content of a labor-management agreement, such as a collective agreement, is null and void for violating a mandatory provision such as the Labor Standards Act (근로기준법), if an assertion of such invalidity is rejected on the ground that it constitutes an exercise of rights in violation of the principle of good faith, this would result in undermining the legislative purpose of the mandatory provision. Therefore, unless the case falls under an exceptional circumstance where, in addition to satisfying the general requirements for applying the principle of good faith, there exist special circumstances justifying the prioritized application of the principle of good faith despite the mandatory nature of the provision, such an assertion cannot be deemed to violate the principle of good faith (see Supreme Court Decision 2012Da89399, decided December 18, 2013, en banc).

2. (a) The court below did not accept the plaintiffs' (counterclaim defendants', hereinafter "the plaintiffs") claim for payment of unpaid minimum wages, etc., holding, for reasons stated in its judgment, that it was impermissible under the principle of good faith for the plaintiffs, who had entered into so-called piece-rate employment contracts under which they received no fixed wages at all according to their own will, to subsequently assert that such employment contracts violated the Minimum Wage Act.
(b) However, this determination by the court below is difficult to accept for the following reasons.
(1) According to the reasoning of the judgment below and the record, the following facts may be found.
(A) As the special provision at issue came to apply to the business establishment of the defendant (counterclaim plaintiff, hereinafter "the defendant") from July 1, 2010, the defendant was required to pay its taxi driver-employees wages not less than the minimum wage amount solely through fixed wages, excluding wages based on production output.
(B) In order to pay a fixed wage not less than the minimum wage amount in accordance with the special provision at issue, it was necessary to raise the quota amount (사납금), but many taxi driver-employees opposed the increase in the quota amount.
(C) Accordingly, around September 30, 2010, labor and management at the defendant company agreed that employees could individually choose between a so-called piece-rate employment contract, under which the employee would take only the excess transportation revenue remaining after paying the quota amount to the company out of the transportation revenue earned through taxi operation, and a monthly salary-based employment contract.
(D) Most of the defendant's taxi driver-employees, including Plaintiff 3, Plaintiff 4, Plaintiff 5, Plaintiff 6, Plaintiff 7, and Plaintiff 8, chose the piece-rate employment contract as before, and Plaintiff 1, who joined on October 11, 2010, and Plaintiff 2, who joined on April 8, 2012, also entered into piece-rate employment contracts with the defendant.
(2) Examining these facts in light of the legal principles set forth above, the excess transportation revenue taken by the plaintiffs through the piece-rate employment contracts entered into between the plaintiffs and the defendant must be regarded as "wages based on production output" as defined in the special provision at issue, and therefore the defendant is obligated to pay the plaintiffs a fixed wage not less than the minimum wage amount, excluding such excess transportation revenue. Furthermore, in light of the legislative purpose of the special provision at issue, which was to increase the proportion of fixed wages among taxi driver-employees' wages so that they could lead a stable life, and in light of all the circumstances discernible from the record, including the motive and process by which the defendant continued to maintain piece-rate employment contracts even after the special provision at issue took effect, and the circumstances under which the plaintiffs came to enter into piece-rate employment contracts with the defendant, it is difficult to conclude that the plaintiffs' claim for payment of the minimum wage calculated in accordance with the special provision at issue reaches a degree that cannot be tolerated in light of the concept of justice, or that there exist special circumstances justifying the prioritized application of the principle of good faith.
(c) Nevertheless, the court below determined, based solely on the reasons stated in its judgment, that the plaintiffs' assertion was impermissible as violating the principle of good faith. This determination by the court below contains an error that misapprehends the legal principles concerning the principle of good faith, thereby affecting the judgment. The ground for appeal pointing this out is well-founded.

3. Therefore, the judgment of the court below is reversed, and the case is remanded to the court below for further examination and determination, in accordance with the unanimous opinion of the participating Justices, as set forth in the Order.
