This case concerned whether a video recording of an interview conducted by a statement analyst (진술분석관) from the Supreme Prosecutors' Office with a child victim of sexual abuse could be admitted as evidence. The Supreme Court (대법원) ruled that the recording was effectively created during the investigative process and therefore could not be admitted under Article 313(1) of the Criminal Procedure Act (형사소송법). The Court established the principle that even video recordings made by persons who are not formal investigative authorities, if produced during an investigation, must be subject to strict limitations on admissibility.

Key takeaways
  • CaseA statement analyst from the Supreme Prosecutors' Office interviewed a child victim of sexual abuse and the resulting video recording was sought to be used as evidence in court.
  • OutcomeThe Supreme Court ruled that the video recording was effectively created during the investigative process and therefore could not be admitted as evidence under the Criminal Procedure Act (형사소송법).
  • LessonEven video recordings made by individuals who are not formal investigative officials are subject to strict evidentiary limitations if produced during an investigation, so proper legal procedures must be followed when creating such records.
Issues
  • Whether a video recording produced by a statement analyst can be admitted as evidence
  • The criteria for determining what constitutes a 'document prepared outside the investigative process' under Article 313(1) of the Criminal Procedure Act (형사소송법)
  • The scope of admissibility limitations applicable to video recordings made by persons who are not formal investigative authorities but who created the recording during an investigation
Key reasoning

The Supreme Court considered the affiliation and status of the statement analyst, the circumstances and purpose of the interview, and the manner and content of the interview as a whole. Based on this comprehensive assessment, the Court concluded that the video recording was substantively created in the course of a criminal investigation, even though the analyst was not formally part of the investigative agency. As such, the recording could not qualify as a document falling outside the scope of 'documents prepared during the investigative process' under Article 313(1) of the Criminal Procedure Act. The Court held that allowing such recordings to bypass the strict evidentiary requirements simply because the preparer was not a formal investigator would undermine the purpose of the statutory safeguards, and thus strict limitations on admissibility must apply regardless of the preparer's formal status.

Summary of Decision (English, AI translation)

[1] In order to implement the principle of due process prescribed in Article 12(1) of the Constitution (헌법) and the right to a fair trial guaranteed by Article 27 of the Constitution, the Criminal Procedure Act (형사소송법) adopts trial-centeredness, the principle of oral argument, and the principle of direct examination as its basic principles. Accordingly, the fact that the Criminal Procedure Act recognizes the admissibility of documentary evidence such as protocols prepared by investigative agencies where certain requirements are met is merely an exceptional allowance made in consideration of the ideal of discovering substantive truth and the demands of procedural economy; therefore, the provisions concerning the requirements for recognizing admissibility must be strictly interpreted and applied.

The Criminal Procedure Act, in Article 310-2, in principle denies admissibility to hearsay evidence, and recognizes admissibility only exceptionally where the requirements set forth in Articles 311 through 316 are satisfied.

Article 311 of the Criminal Procedure Act provides for the admissibility of protocols of a court or a judge, and Article 312(1) through (3) provides for the admissibility of protocols of suspect interrogation prepared by a prosecutor or an investigative agency other than a prosecutor. Article 312(4) of the Criminal Procedure Act recognizes the admissibility of a protocol prepared by a prosecutor or judicial police officer recording the statement of a person other than the defendant, only where it is proven that the protocol was prepared according to lawful procedure and form, that its substantial authenticity has been established, that the right to cross-examination is guaranteed, and that the statement was made under especially reliable circumstances. Article 312(5) of the Criminal Procedure Act provides that where a written statement of the defendant or of a person other than the defendant is prepared during the investigative process, paragraphs (1) through (4) of the same Article shall apply mutatis mutandis. Article 313(1) of the Criminal Procedure Act recognizes admissibility, where authenticity is proven, of "a written statement prepared by the defendant or a person other than the defendant, or a document recording such person's statement, other than as provided in the preceding two Articles," provided it bears the author's or declarant's own handwriting, signature, or seal. In light of the purpose of Article 312 of the Criminal Procedure Act, which prescribes stricter requirements than Article 313(1) of the Criminal Procedure Act regarding the admissibility of documents prepared during the investigative process, the documents referred to in Article 313(1) of the Criminal Procedure Act mean documents prepared outside the investigative process.

The admissibility, or scope of use as evidence, of video recordings produced by an investigative agency is even more strictly limited. That is, a video recording produced by a prosecutor or judicial police officer pursuant to Article 221(1) of the Criminal Procedure Act in the course of examining a person other than the defendant cannot be used as independent evidence directly proving the facts charged, absent special circumstances such as a different provision under another statute. Furthermore, even when a video recording is used, pursuant to Article 312(4) of the Criminal Procedure Act, as a means of proving the substantial authenticity of a protocol prepared by a prosecutor or judicial police officer recording the statement of a person other than the defendant, such video recording must be produced according to the manner and procedure prescribed in the Criminal Procedure Act and the Rules on Criminal Procedure (형사소송규칙).

In light of these provisions of the Constitution and the Criminal Procedure Act, and the principles of interpretation concerning the recognition of admissibility of hearsay evidence, even if a document recording the statement of a person other than the defendant was prepared by a person who is not a member of an investigative agency, if it was prepared after the commencement of investigation under the involvement or influence of an investigative agency, and if, considering substantively the status or position of the person who prepared the document, the circumstances and purpose of its preparation, the time and place of its preparation, and the manner in which the statement was obtained, it is difficult to view the document as having been prepared outside the investigative process, then such document cannot be deemed to fall under "a document recording the statement of a person other than the defendant, other than as provided in the preceding two Articles" under Article 313(1) of the Criminal Procedure Act. Furthermore, in light of the principle that the admissibility of hearsay evidence is recognized only exceptionally where there is a legal basis for doing so, and the purport of the relevant precedents that limit the admissibility, or scope of use as evidence, of video recordings produced by an investigative agency more strictly than other hearsay evidence, it is necessary to strictly limit the admissibility of video recordings made by a person who is not a member of an investigative agency, recording the statement of a person other than the defendant, during the investigative process.

[2] In a case where, in the course of investigating the defendants on suspicion of violation of the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (성폭력범죄의 처벌 등에 관한 특례법) (rape by a person in a relationship of kinship), etc., the prosecutor requested a statement analyst affiliated with the Scientific Investigation Department of the Supreme Prosecutors' Office to analyze the content of the statement made by the child victim, and accordingly, the statement analyst interviewed the victim and produced a "CD video recording of the process of analyzing the victim's statement" (hereinafter referred to as the "video recording") recording the content thereof, which was submitted as evidence, thereby raising the issue of its admissibility, the Supreme Court held: given that the prosecutor requested the statement analyst to analyze the credibility of the victim's statement pursuant to Article 33(4) and (1) of the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes; that the statement analyst, having received the case file, interviewed the victim at the Women's and Children's Investigation Room of the public prosecutor's office, with the interview being conducted by way of putting questions and answers to the victim regarding the content that the investigative agency had investigated with respect to the case up to that point, and the interview process being recorded and produced as the video recording; and in light of the affiliation and status of the statement analyst, the circumstances and purpose of the statement analyst's interview with the victim and production of the video recording, the content and nature of the materials the statement analyst obtained from the investigative agency in connection with the interview, the manner and content of the interview, and the place of the interview, the video recording cannot be regarded as having been produced outside the investigative process; therefore, admissibility cannot be recognized under Article 313(1) of the Criminal Procedure Act, and furthermore, since it is neither a protocol of suspect interrogation prepared by an investigative agency nor a protocol recording the statement of a person other than the defendant, nor a written statement prepared by the defendant or a person other than the defendant, admissibility cannot be recognized under Article 312 of the Criminal Procedure Act either; and thus the Supreme Court held that the lower court's determination, which, on the same reasoning, found that the video recording lacked admissibility, was justified.

[Order]

All appeals are dismissed.

[Reasoning]

The grounds of appeal are examined as follows.

1. As to the Public Prosecutor's Grounds of Appeal

A. On the Admissibility of the "Video Recording CD of the Victim Statement Analysis Process"

1) Relevant Legal Principles

A) In order to implement the principle of due process provided in Article 12(1) of the Constitution (헌법) and the right to a fair trial guaranteed by Article 27 of the Constitution, the Criminal Procedure Act (형사소송법) adopts, as its basic principles, the principle of trial-centeredness, the principle of oral argument, and the principle of direct examination. Accordingly, the fact that the Criminal Procedure Act recognizes the admissibility of documentary evidence such as protocols prepared by investigative agencies where certain requirements are met is merely an exceptional allowance made in consideration of the ideal of discovering the substantive truth and the demand for procedural economy; therefore, the provisions concerning the requirements for recognizing admissibility must be strictly interpreted and applied (see Supreme Court Decision 2022Do364, decided June 16, 2022).

B) Article 310-2 of the Criminal Procedure Act, in principle, denies the admissibility of hearsay evidence, and admissibility is exceptionally recognized only where the requirements set forth in Articles 311 through 316 are satisfied (see Supreme Court en banc Decision 2018Do13792, decided August 29, 2019).
Article 311 of the Criminal Procedure Act provides for the admissibility of protocols of a court or a judge, and Article 312(1) through (3) provides for the admissibility of protocols of interrogation of a suspect prepared by a prosecutor or an investigative agency other than a prosecutor. Article 312(4) of the Criminal Procedure Act recognizes the admissibility of a protocol prepared by a prosecutor or a judicial police officer recording the statement of a person other than the defendant, only where it is proven that the protocol was prepared in accordance with lawful procedure and form, that its substantial authenticity has been proven, that the right to cross-examination is guaranteed, and that the statement was made under circumstances that particularly guarantee its reliability. Article 312(5) of the Criminal Procedure Act provides that where a written statement of the defendant or a person other than the defendant was prepared in the course of an investigation, paragraphs (1) through (4) of the same Article shall apply mutatis mutandis. Article 313(1) of the Criminal Procedure Act recognizes the admissibility of "a written statement prepared by the defendant or a person other than the defendant, or a document recording such person's statement, other than as provided in the preceding two Articles," bearing the handwriting, signature, or seal of the person who prepared it or made the statement, where its authenticity is proven. In light of the purport of Article 312 of the Criminal Procedure Act, which provides stricter requirements than Article 313(1) of the Criminal Procedure Act regarding the admissibility of documents prepared in the course of an investigation, the documents referred to in Article 313(1) of the Criminal Procedure Act mean documents prepared outside the investigative process.

C) The admissibility of, or the scope of use as evidence of, video recordings produced by investigative agencies is subject to even stricter limitations. That is, a video recording produced by a prosecutor or a judicial police officer pursuant to Article 221(1) of the Criminal Procedure Act in the course of investigating a person other than the defendant cannot be used as independent evidence directly proving the facts charged, absent special circumstances such as a differing provision under another statute (see Supreme Court Decision 2012Do5041, decided July 10, 2014). Furthermore, even where a video recording is used as a means of proving the substantial authenticity of a protocol prepared by a prosecutor or a judicial police officer recording the statement of a person other than the defendant pursuant to Article 312(4) of the Criminal Procedure Act, such video recording must be produced in accordance with the manner and procedure prescribed by the Criminal Procedure Act and the Rules of Criminal Procedure (Criminal Procedure Rules, 형사소송규칙) (see the above Supreme Court Decision 2022Do364).

D) In light of these provisions of the Constitution and the Criminal Procedure Act, as well as the principles of interpretation concerning the recognition of admissibility of hearsay evidence, even if a document recording the statement of a person other than the defendant was prepared by a person other than an investigative agency, if it was prepared after the commencement of an investigation under the involvement or influence of an investigative agency, and if, upon substantive examination of the identity or status of the person who prepared the document, the circumstances and purpose of its preparation, the time and place of preparation, and the manner in which the statement was obtained, it is difficult to regard the document as having been prepared outside the investigative process, then such document cannot be deemed to fall under "a document recording the statement of a person other than the defendant, other than as provided in the preceding two Articles" under Article 313(1) of the Criminal Procedure Act (see Supreme Court Decision 2022Do9510, decided October 27, 2022). Furthermore, in light of the principle that the admissibility of hearsay evidence is exceptionally recognized only where there is a legal basis for recognizing it, and the purport of relevant precedents that impose even stricter limitations on the admissibility of, or the scope of use as evidence of, video recordings produced by investigative agencies compared to other hearsay evidence, it is necessary to strictly limit the admissibility of video recordings made by a person other than an investigative agency, recording the statement of a person other than the defendant, in the course of an investigation.

2) The record and the reasoning of the lower court judgment reveal the following facts.

A) The victim underwent police investigation on three occasions—May 26, 2021, July 5, 2021, and September 11, 2021—and the investigation process was video-recorded.

B) Pursuant to Article 33(4) and (1) of the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (성폭력범죄의 처벌 등에 관한 특례법), the prosecutor requested a statement analyst belonging to the Forensic Science Analysis Division of the Forensic Science Investigation Department of the Supreme Prosecutors' Office to analyze the reliability of the victim's statement. The statement analyst received the case record, including the video recording CDs of the aforementioned three investigations and the stenographic records.

C) The statement analyst interviewed the victim from 10:44 to 14:23 on April 27, 2022, and from 13:56 to 16:32 on May 2, 2022, each time at the Women and Children Investigation Room of the Changwon District Public Prosecutors' Office. The interviews were conducted in a question-and-answer format concerning the content of the investigation into this case as conducted by the investigative agency up to that point, and the interview process was video-recorded, producing the "Video Recording CD of the Victim Statement Analysis Process" (hereinafter "the video recording in this case").

D) Around June 17, 2022, the statement analyst submitted to the prosecutor a "Statement Analysis Result Notification" analyzing the reliability of the victim's statement based on the video recording in this case, its transcript, and the aforementioned case record as the materials for analysis, together with the aforementioned transcript, and around September 30, 2022, submitted the video recording in this case to the prosecutor.

3) In light of the aforementioned legal principles, considering the affiliation and status of the statement analyst, the circumstances and purpose under which the statement analyst interviewed the victim and produced the video recording in this case, the content and nature of the materials the statement analyst obtained from the investigative agency in connection with the interview, the manner and content of the interview, and the place of the interview, the video recording in this case cannot be regarded as having been prepared outside the investigative process, and thus its admissibility cannot be recognized under Article 313(1) of the Criminal Procedure Act.

4) Since the video recording in this case is neither a protocol of interrogation of a suspect nor a protocol recording the statement of a person other than the defendant prepared by an investigative agency, nor a written statement prepared by the defendant or a person other than the defendant, its admissibility cannot be recognized under Article 312 of the Criminal Procedure Act either.

5) In this vein, the lower court's determination that the video recording in this case is inadmissible is justified, and there is no error in misunderstanding the legal principles concerning Article 313, etc. of the Criminal Procedure Act relating to the admissibility of hearsay evidence.

B. As to Defendant 1

For the reasons stated in its judgment, the lower court determined that there was no proof of crime as to the facts charged against Defendant 1 (excluding the part found guilty) and thus found this part not guilty. Examining the reasoning of the lower court judgment in light of the relevant legal principles and the record, there is no error in the lower court's determination that exceeds the limits of free evaluation of evidence in violation of the rules of logic and experience, or that misunderstands the legal principles concerning the determination of the reliability of the victim's statement, thereby affecting the judgment.

C. As to Defendant and Person Subject to Request for Attachment Order (hereinafter "Defendant") 2

1) As to the Criminal Case

For the reasons stated in its judgment, the lower court upheld the first instance judgment, which determined that there was no proof of crime as to the facts charged against Defendant 2 and thus found this part not guilty. Examining the reasoning of the lower court judgment in light of the relevant legal principles and the record, there is no error in the lower court's determination that exceeds the limits of free evaluation of evidence in violation of the rules of logic and experience, or that misunderstands the legal principles concerning the determination of the reliability of the victim's statement.

2) As to the Case Concerning the Request for Attachment Order

Since the prosecutor filed an appeal with respect to the criminal case, the appeal is deemed to have also been filed with respect to the case concerning the request for attachment order. However, the notice of appeal contains no statement of grounds, and no grounds of objection concerning this matter can be found in the appellate brief either.

D. As to Defendant 3

1) As to the Criminal Case

For the reasons stated in its judgment, the lower court determined that there was no proof of crime as to the facts charged against Defendant 3 (excluding the part found guilty) and thus found this part not guilty. Examining the reasoning of the lower court judgment in light of the relevant legal principles and the record, there is no error in the lower court's determination that exceeds the limits of free evaluation of evidence in violation of the rules of logic and experience, or that misunderstands the legal principles concerning the determination of the reliability of the statements of the victim and others, thereby affecting the judgment.

2. As to Defendant 3's Grounds of Appeal

For the reasons stated in its judgment, the lower court upheld the first instance judgment, which found Defendant 3 guilty of the facts charged (excluding the part found not guilty). Examining the reasoning of the lower court judgment in light of the relevant legal principles and the evidence lawfully adopted, there is no error in the lower court's determination that exceeds the limits of free evaluation of evidence in violation of the rules of logic and experience, or that misunderstands the legal principles concerning the determination of the reliability of the statements of the victim and others.
Pursuant to Article 383, Subparagraph 4 of the Criminal Procedure Act, an appeal on the ground of unfair sentencing is permitted only in cases where the death penalty, life imprisonment, or imprisonment with or without labor for ten years or more has been imposed. In this case, where a sentence lighter than the above has been imposed on Defendant 3, the argument that the sentence is too severe and unfair does not constitute a legitimate ground of appeal.

3. As to Defendant 4's Grounds of Appeal

For the reasons stated in its judgment, the lower court found Defendant 4 guilty of the facts charged. Examining the reasoning of the lower court judgment in light of the relevant legal principles and the evidence lawfully adopted, there is no error in the lower court's determination that exceeds the limits of free evaluation of evidence in violation of the rules of logic and experience, or that misunderstands the legal principles concerning the establishment of the crime of violation of the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (quasi-sexual intercourse with a minor under 13 years of age).

The argument alleging an error of law in misunderstanding the legal principles concerning the voluntariness of confession is raised for the first time at the appellate (Supreme Court) stage, without the Defendant having raised it as a ground of appeal to the lower court or the lower court having addressed it ex officio as a matter for adjudication, and thus does not constitute a legitimate ground of appeal.

The argument alleging an error of law due to insufficient deliberation in the lower court's sentencing determination ultimately amounts to an argument of unfair sentencing. However, pursuant to Article 383, Subparagraph 4 of the Criminal Procedure Act, an appeal on the ground of unfair sentencing is permitted only in cases where the death penalty, life imprisonment, or imprisonment with or without labor for ten years or more has been imposed. In this case, where a sentence lighter than the above has been imposed on Defendant 4, the argument that the sentence is too severe and unfair does not constitute a legitimate ground of appeal.

4. Conclusion

Therefore, all appeals are dismissed, and it is so decided by the unanimous opinion of the Justices participating, as stated in the Order.

Justice Lee Dong-won (Presiding Justice), Kim Sang-hwan, Kwon Young-jun (Justice in Charge), Shin Sook-hee
