A person with a physical disability applied to use a disability call-taxi service (a special transportation service for people with disabilities), but the local government and the public agency operating the service refused, claiming the applicant did not meet the eligibility criteria set by statute. The Supreme Court (대법원) upheld the lower court's ruling that this refusal constituted unlawful discrimination under the Act on the Prohibition of Discrimination Against Persons with Disabilities (장애인차별금지법).

Key takeaways
  • CaseA person with a physical disability applied to use a disability call-taxi service, but the local government and public agency refused, citing failure to meet statutory eligibility criteria.
  • OutcomeThe Supreme Court ruled that the public institutions' refusal to provide the special transportation service constituted discrimination in violation of the Act on the Prohibition of Discrimination Against Persons with Disabilities.
  • LessonPublic institutions may be held legally liable for discrimination if they refuse to provide necessary transportation services to people with disabilities without a justifiable reason.
Issues
  • Whether the refusal to provide disability call-taxi services constitutes discriminatory conduct under the Act on the Prohibition of Discrimination Against Persons with Disabilities
  • Whether services with a limited or restricted pool of eligible users, such as special transportation services for the disabled, are still subject to the Act on the Prohibition of Discrimination Against Persons with Disabilities
Key reasoning

The Supreme Court held that when a public institution refuses, without justifiable reason, to provide a special transportation service that a person with a disability needs, this refusal constitutes discriminatory conduct in violation of Article 4(1)(3) and Article 26(1) of the Act on the Prohibition of Discrimination Against Persons with Disabilities. The Court clarified that even services with a limited or restricted pool of eligible users—such as disability call-taxi programs—are not exempt from the application of this anti-discrimination law. In other words, having eligibility criteria does not give public agencies unlimited discretion to deny services to qualifying individuals with disabilities. The Court found that denying the plaintiff's request based on an overly strict application of eligibility standards, without adequate justification, amounted to actionable discrimination.

Summary of Decision (English, AI translation)

[1] Article 34(1) of the Constitution (헌법) guarantees all citizens the right to lead a life worthy of human dignity, and Article 34(5) of the same provision states that persons with physical disabilities shall be protected by the State as prescribed by statute, thereby requiring the State to give special consideration and support to socially vulnerable groups. In order to fulfill this constitutional duty of the State to protect persons with disabilities, the Act on the Prohibition of Discrimination against Persons with Disabilities, Remedy against Infringement of Their Rights, etc. (장애인차별금지 및 권리구제 등에 관한 법률, hereinafter the "Anti-Discrimination Against Disabled Persons Act") was enacted.

Article 4(1) of the Anti-Discrimination Against Disabled Persons Act, which is contained in Chapter 1 "General Provisions," enumerates the types of prohibited discriminatory acts, and Item 3 thereof provides for "refusing to provide reasonable accommodation to a person with a disability without justifiable grounds." Here, "reasonable accommodation" means all human and material means and measures, including convenience facilities, equipment, tools, and services, that take into account a person with disability's sex, type and degree of disability, characteristics, etc., so as to enable the person with disability to participate in the same activities on an equal footing with a person without a disability (Article 4(2) of the same Act). Subsequently, in Chapter 2 "Prohibition of Discrimination," the Anti-Discrimination Against Disabled Persons Act again declares the prohibition of discrimination in each area of life, such as employment, education, provision and use of goods and services, judicial and administrative procedures and services and the right to political participation, maternity/paternity rights, sex, etc., family, household, and welfare facilities, and the right to health, while regulating the content of the duty to provide reasonable accommodation for each area of life in order to prevent such discrimination, and delegates the detailed content of some matters to Presidential Decree.

In this way, while the Anti-Discrimination Against Disabled Persons Act has provisions specifying the content of prohibited discriminatory acts for each area of life, it also has, above these, a provision that can be generally applied. Considering the structure, wording, and legislative intent of these statutory provisions, it can be viewed that the Anti-Discrimination Against Disabled Persons Act leaves room for an act, even if it does not fall under the detailed discriminatory acts anticipated by the statute, to nonetheless fall under a discriminatory act encompassed by the higher-level general provision.

More specifically, Article 26 of the Anti-Discrimination Against Disabled Persons Act, which concerns the area of judicial and administrative procedures and services, likewise provides, under the heading "Prohibition of Discrimination in Judicial and Administrative Procedures and the Provision of Services," in paragraph (1) thereof, that "public institutions, etc. shall not discriminate against persons with disabilities in providing judicial and administrative procedures and services necessary for persons with disabilities to protect and secure their rights, including protection of life, body, or property rights." Paragraphs (2) through (7) of the same Article then set forth provisions concerning specific discriminatory acts and their prohibition in this area of life, and matters necessary in connection with paragraphs (4) through (7) are delegated to Presidential Decree (paragraph (8) of the same Article). Accordingly, in the area of judicial and administrative procedures and services as well, if an act falls under a specified discriminatory act set forth in Article 26(2) et seq. of the Anti-Discrimination Against Disabled Persons Act, it shall directly constitute a discriminatory act as defined in paragraph (1) of the same Article; conversely, there may also be cases where an act does not fall under a specified discriminatory act set forth in paragraph (2) et seq. of the same Article but nonetheless falls under a discriminatory act under paragraph (1) of the same Article.

Meanwhile, the Anti-Discrimination Against Disabled Persons Act does not limit the object of its regulation or governance solely to discriminatory acts between persons with disabilities and persons without disabilities, and Article 26(1) of the Anti-Discrimination Against Disabled Persons Act likewise does not limit the content of the services, etc. subject to regulation according to the scope of persons eligible to use them. Since discriminatory acts without justifiable grounds, even as between persons with disabilities, need to be regulated and governed under strict requirements, a service, etc., such as special transportation means, whose users are limited, should not be readily excluded from the scope of application of the Anti-Discrimination Against Disabled Persons Act. This is all the more so considering that the purpose of the Anti-Discrimination Against Disabled Persons Act is to realize the dignity and value of persons with disabilities as human beings through the full participation of persons with disabilities in society and the realization of the right to equality (Article 1 of the same Act), and that it imposes on the State and local governments a duty to prevent all discrimination against persons with disabilities and to take affirmative measures to remedy such discrimination (Article 8 of the same Act).

[2] In a case where Party A, a person with disabilities having a severe disability in upper limb function and a non-severe disability in lower limb function, and thus falling under a "person with a walking disability" as defined in Article 28 of the Enforcement Rule of the Act on Welfare of Persons with Disabilities (장애인복지법 시행규칙), applied to use a disabled-persons' call taxi, which is a special transportation means under Article 2, Item 8 of the Act on Promotion of the Convenience of Mobility of Persons with Reduced Mobility, etc. (교통약자의 이동편의 증진법), and where Corporation C, which had been entrusted by the head of Local Government B with the management and operation of the disabled-persons' call taxi, rejected Party A's application on the ground that Party A did not fall under a person set forth in Article 6(1), Item 1 of the former Enforcement Rule of the Act on Promotion of the Convenience of Mobility of Persons with Reduced Mobility, etc. (as before the amendment by Ordinance of the Ministry of Land, Infrastructure and Transport No. 1236 of July 20, 2023), and where a public official in charge at Local Government B likewise gave a rejection response to the same effect in connection with Party A's civil petition regarding this matter — the Supreme Court upheld the lower court's determination that: Local Government B, as a local government, and Corporation C, as a local public corporation entrusted with the management and operation of the disabled-persons' call taxi, each fall under a "public institution" as defined by the Anti-Discrimination Against Disabled Persons Act; since the operation of the special transportation means provided by Local Government B, etc. constitutes a service for guaranteeing the right to mobility of persons with disabilities, the provision of services concerning the special transportation means (disabled-persons' call taxi) by Local Government B, etc. constitutes the provision of services necessary for persons with disabilities as set forth in Article 26(1) of the Anti-Discrimination Against Disabled Persons Act; and accordingly, the above rejection by Local Government B, etc., in response to Party A's — a person with reduced mobility eligible to use the special transportation means — application to use the disabled-persons' call taxi, which is a service necessary for Party A to secure his rights, constitutes a failure to provide the relevant service without justifiable grounds, and thus constitutes a discriminatory act in violation of Article 4(1), Item 3 and Article 26(1) of the Anti-Discrimination Against Disabled Persons Act.

[Plaintiff, Appellee] Plaintiff (Attorney Choi Jeong-gyu and 1 other, Wongok Law Firm, Counsel for the Plaintiff)

[Defendants, Appellants] Seoul Metropolitan Government and 1 other (Lin LLC and 1 other, Counsel for the Defendants)

[Judgment Below] Seoul High Court Decision 2022Na2052639 decided December 21, 2023

[Order]

All appeals are dismissed. The costs of the appeal shall be borne by the Defendants.

[Reasoning]

The grounds of appeal are examined.

1. Outline of the Case

Based on the reasoning of the judgment below and the record, the following facts are found.

A. The Plaintiff is a male born on (date of birth omitted), who was registered as a person with a disability under the Act on Welfare of Persons with Disabilities (장애인복지법) around March 2, 1994. On the Plaintiff's disability certificate, the column for "Primary Disability and Degree of Disability" states "Severe Physical Disability (Upper Limb Function)," the column for "Secondary Disability and Degree of Disability" states "Non-Severe Physical Disability (Lower Limb Function)," and the column for "Overall Degree of Disability" states "Severe Disability." The Plaintiff applied for a disability grade examination around February 8, 2021, and was notified of the result that he "falls under a 'person with a walking disability' pursuant to Article 28 of the Enforcement Rule of the Act on Welfare of Persons with Disabilities and related public notices."

B. The Mayor of Seoul, as the representative of Defendant Seoul Metropolitan Government, is a "transportation administrative agency" as defined in Article 2, Subparagraph 6 of the Act on Promotion of Transportation Convenience for Mobility Disadvantaged Persons (교통약자의 이동편의 증진법, hereinafter the "Mobility Disadvantaged Persons Act"), and has an obligation to operate "special transportation means" as defined in Article 2, Subparagraph 8 of the same Act (Article 16, Paragraph 1 of the Mobility Disadvantaged Persons Act). In this regard, the management and operation of special transportation means may, for their efficient management and operation, be entrusted to Defendant Seoul Facilities Corporation (hereinafter "Defendant Corporation") (Article 16, Paragraph 12 of the Mobility Disadvantaged Persons Act; Article 13, Paragraph 1, Subparagraph 1 of the Seoul Metropolitan Government Ordinance on the Promotion of Transportation Convenience for Mobility Disadvantaged Persons). Defendant Corporation is a local public corporation that has been entrusted by the Mayor of Seoul, pursuant to these provisions, with the management and operation of call taxis for persons with disabilities, which constitute special transportation means.

C. Around November 2020, the Plaintiff applied to Defendant Corporation to use the aforementioned call taxi service for persons with disabilities, but Defendant Corporation refused the Plaintiff's application on the ground that the Plaintiff did not fall under the persons described in Article 6, Paragraph 1, Subparagraph 1 of the former Enforcement Rule of the Act on Promotion of Transportation Convenience for Mobility Disadvantaged Persons (before amendment by Ordinance of the Ministry of Land, Infrastructure and Transport No. 1236 on July 20, 2023, hereinafter the "former Enforcement Rule of the Mobility Disadvantaged Persons Act"). The Plaintiff also filed a civil petition with Defendant Seoul Metropolitan Government requesting that he be allowed to use the call taxi service for persons with disabilities, but the public official in charge at Defendant Seoul Metropolitan Government likewise refused this request, giving the same reasoning as Defendant Corporation (hereinafter, "Defendant Corporation's refusal" and "the refusal by the public official in charge at Defendant Seoul Metropolitan Government" are collectively referred to as "the instant refusal").

2. Judgment on the First Ground of Appeal

A. The court below determined, for the reasons stated in its judgment, that the Plaintiff falls under a "mobility disadvantaged person eligible to use special transportation means" as provided in Article 6, Paragraph 1, Subparagraph 1 of the former Enforcement Rule of the Mobility Disadvantaged Persons Act.

B. Upon examination of the reasoning of the judgment below in light of the relevant legal principles and the record, there is no error in the judgment below, as argued in the grounds of appeal, that failed to conduct necessary deliberation, violated the principles of logic and experience so as to exceed the limits of the principle of free evaluation of evidence, or misapprehended the legal principles concerning the scope of eligible users of special transportation means under Article 6, Paragraph 1, Subparagraph 1 of the former Enforcement Rule of the Mobility Disadvantaged Persons Act, thereby affecting the conclusion of the judgment.

3. Judgment on the Second Ground of Appeal

A. Relevant Legal Principles

1) Article 34, Paragraph 1 of the Constitution guarantees all citizens the right to a life worthy of human dignity, and Paragraph 5 of the same Article provides that persons with physical disabilities shall be protected by the State as prescribed by law, thereby requiring the State to give special consideration and support to socially disadvantaged persons (see Supreme Court en banc Decision 2022Da289051, decided December 19, 2024). The Act on the Prohibition of Discrimination Against Persons with Disabilities, Remedy against Infringement of Their Rights, etc. (장애인차별금지 및 권리구제 등에 관한 법률, hereinafter the "Disability Discrimination Act") was enacted to fulfill this constitutional obligation of the State to protect persons with disabilities.

Article 4, Paragraph 1 of the Disability Discrimination Act, in Chapter 1 ("General Provisions"), enumerates the types of prohibited discriminatory acts, and Subparagraph 3 thereof provides for "refusing to provide reasonable accommodation to a person with a disability without justifiable reason." Here, "reasonable accommodation" refers to all human and material means and measures, including convenience facilities, equipment, tools, and services, that take into account the sex, type and degree of disability, and characteristics of the person with a disability, so as to enable the person with a disability to participate in the same activities on an equal basis with persons without disabilities (Paragraph 2 of the same Article). The Disability Discrimination Act, in Chapter 2 ("Prohibition of Discrimination"), further declares the prohibition of discrimination in each area of life, including employment, education, provision and use of goods and services, judicial and administrative procedures and services and the right to political participation, motherhood and fatherhood, gender, etc., family, household, and welfare facilities, and the right to health, and regulates the content of the obligation to provide reasonable accommodation for each area of life in order to prevent such discrimination, delegating certain detailed matters to Presidential Decree.

As such, while the Disability Discrimination Act has provisions specifying the content of prohibited discriminatory acts for each area of life, it also has provisions of a general nature that may apply above and beyond those specific provisions. Considering the structure, language, and legislative purpose of these statutory provisions, it can be seen that the Disability Discrimination Act leaves room for an act, even if it does not fall under the specific discriminatory acts contemplated by the statute, to nonetheless fall under a discriminatory act encompassed by the higher-level general provision.

2) More specifically, Article 26 of the Disability Discrimination Act, concerning the area of judicial and administrative procedures and services, likewise provides, under the heading "Prohibition of Discrimination in the Provision of Judicial and Administrative Procedures and Services," in Paragraph 1: "Public institutions, etc. shall not discriminate against persons with disabilities in providing judicial and administrative procedures and services necessary for persons with disabilities to protect and secure their rights, including the protection of life, body, or property rights." Paragraphs 2 through 7 of the same Article contain provisions on specific discriminatory acts and their prohibition in this area of life, and matters necessary in connection with Paragraphs 4 through 7 are delegated to Presidential Decree (Paragraph 8 of the same Article). Accordingly, in the area of judicial and administrative procedures and services as well, an act that falls under a specified discriminatory act as provided in Article 26, Paragraph 2 et seq. of the Disability Discrimination Act shall immediately constitute a discriminatory act under Paragraph 1 of the same Article; conversely, there may also be cases where an act does not fall under a specified discriminatory act as provided in Paragraph 2 et seq. of the same Article, but nonetheless constitutes a discriminatory act under Paragraph 1 of the same Article.

Meanwhile, the Disability Discrimination Act does not limit the object of its regulation solely to discriminatory acts between persons with disabilities and persons without disabilities, and Article 26, Paragraph 1 of the Disability Discrimination Act likewise does not limit the content of the services, etc. subject to its regulation according to the scope of eligible users. Since discriminatory acts without justifiable reason, even between persons with disabilities, need to be strictly regulated, services such as special transportation means, whose eligible users are limited, should not be readily excluded from the scope of application of the Disability Discrimination Act. This is all the more so considering that the Disability Discrimination Act aims to realize the dignity and value of persons with disabilities as human beings through the full social participation of persons with disabilities and the realization of the right to equality (Article 1 of the same Act), and imposes on the State and local governments the duty to prevent all discrimination against persons with disabilities and to take affirmative measures to remedy such discrimination (Article 8 of the same Act).

3) As set forth above, public institutions, etc. bear a statutory obligation not to discriminate against persons with disabilities in providing judicial and administrative procedures and services necessary for persons with disabilities to protect and secure their rights, including the protection of life, body, or property rights (Article 26, Paragraph 1 of the Disability Discrimination Act). Defendant Seoul Metropolitan Government, as a local government, and Defendant Corporation, as a local public corporation entrusted by the Mayor of Seoul with the management and operation of call taxis for persons with disabilities, each fall under a "public institution" under the Disability Discrimination Act (Article 3, Subparagraph 4 of the Disability Discrimination Act; Article 3, Subparagraph 4 of the Enforcement Decree of the same Act). Furthermore, since the operation of special transportation means provided by the Defendants constitutes a service to guarantee the right to mobility of persons with disabilities, the Defendants' provision of services concerning special transportation means (call taxis for persons with disabilities) ultimately constitutes the provision of services necessary for persons with disabilities as provided in Article 26, Paragraph 1 of the Disability Discrimination Act.

B. Specific Determination

1) The court below determined, for the reasons stated in its judgment, that the instant refusal by the Defendants, in response to the Plaintiff's application to use the call taxi service for persons with disabilities—a service necessary for the Plaintiff, a mobility disadvantaged person eligible to use special transportation means, to secure his rights—constituted a failure to provide such service without justifiable reason, and thus held that this constituted a discriminatory act in violation of Article 4, Paragraph 1, Subparagraph 3 and Article 26, Paragraph 1 of the Disability Discrimination Act. The court below thus rendered a judgment for affirmative relief ordering the Defendants to permit the Plaintiff to use the call taxi service for persons with disabilities operated by the Defendants.

2) Upon examination of the reasoning of the judgment below in light of the legal principles set forth above and the record, there is no error in the judgment below, as argued in the grounds of appeal, that failed to conduct necessary deliberation, violated the principles of logic and experience so as to exceed the limits of the principle of free evaluation of evidence, or misapprehended the legal principles concerning discriminatory acts under the Disability Discrimination Act, thereby affecting the conclusion of the judgment.

4. Judgment on the Third Ground of Appeal

A. Article 46, Paragraph 1 of the Disability Discrimination Act provides: "Any person who causes damage to another person in violation of the provisions of this Act shall be liable for damages to the person who suffered the damage as a result thereof: Provided, That this shall not apply where the person who committed the discriminatory act proves that there was no intent or negligence."

The court below determined that the Plaintiff must have suffered considerable mental distress due to the Defendants' instant refusal, and that it could not be found, based solely on the evidence submitted by the Defendants, that the Defendants had proven the absence of intent or negligence. Accordingly, the court below partially upheld the Plaintiff's claim for consolation money based on Article 46, Paragraph 1 of the Disability Discrimination Act set forth above.

B. Upon examination of the reasoning of the judgment below in light of the relevant legal principles and the record, there is no error in the judgment below, as argued in the grounds of appeal, that failed to conduct necessary deliberation, violated the principles of logic and experience so as to exceed the limits of the principle of free evaluation of evidence, or misapprehended the legal principles concerning liability for damages under Article 46, Paragraph 1 of the Disability Discrimination Act, thereby affecting the conclusion of the judgment.

Furthermore, when using public transportation such as buses or subways, vibrations, sudden starts, sudden stops, turns, or accidents may occur, and if a user fails to properly hold onto a handrail or loses balance, he or she may fall or collide with something in an instant. While this may be a momentary jolt for a person without a disability, it poses a risk that could result in serious injury for a mobility disadvantaged person. Therefore, the Defendants, upon receiving an application requesting the provision of special transportation means, should have exercised greater care in interpreting the relevant provisions concerning eligible users and in determining whether the Plaintiff fell under such eligible users.

5. Conclusion

Therefore, all appeals are dismissed, and the costs of the appeal are to be borne by the losing parties. This judgment is rendered in accordance with the Order, with the unanimous consent of the Justices participating in the decision.
