In this defamation (명예훼손) case arising from false statements and insulting expressions made about the May 18 Democratic Uprising (5·18민주화운동), a historic pro-democracy movement in Gwangju, South Korea, the Supreme Court comprehensively laid out the legal standards for defamation. The ruling addressed how to distinguish between statements of opinion and statements of fact, the scope of a corporation's right to reputation, and the rights of surviving family members when a deceased person's reputation is defamed.

Key takeaways
  • CaseThe defendant made false statements and used insulting language about the May 18 Democratic Uprising, harming the reputation of related organizations and the bereaved families of victims.
  • OutcomeThe Supreme Court ruled that even statements framed as opinions can constitute defamation if they conceal false factual claims, and that insulting personal attacks can constitute a separate tort.
  • LessonWhen expressing opinions—especially about historical events—one must avoid implying unfounded false facts or using degrading, insulting language, as such statements can carry legal liability even outside the traditional bounds of defamation.
Issues
  • Criteria for distinguishing between statements of opinion and statements of fact, and the requirements for establishing defamation (명예훼손)
  • The scope of a corporation's right to reputation and what constitutes harm to its social evaluation
  • The right of surviving family members to seek damages when a deceased person's reputation is defamed
  • Burden of proof regarding falsity and grounds for excluding illegality in defamation cases
Key reasoning

The Court held that even when a statement is framed as an opinion, defamation can still be established if it implies underlying false facts that damage another person's social reputation. However, a purely subjective opinion, without any implied factual assertion, does not constitute defamation. That said, insulting or contemptuous personal attacks—even if framed as opinions—can constitute a separate tort (불법행위) independent from defamation. The Court further clarified that corporations, like individuals, can be victims of defamation when their social reputation is harmed to an extent that affects their ability to carry out their stated organizational purposes.

Summary of Decision (English, AI translation)

[1] While it is clear that an expressive act which explicitly asserts facts specific enough to have the potential to impair another person's social evaluation can constitute defamation, an expressive act in the form of expressing an opinion or commentary may also constitute defamation if, in light of its overall purport, it implicitly includes an assertion of hidden underlying facts that serve as the basis for the opinion, and those facts are capable of impairing another person's social evaluation. Defamation is not established by the expression of a pure opinion alone; however, if the form and content of the expressive act constitute an insulting and contemptuous personal attack, it may constitute a separate type of tort distinct from defamation. Whether a particular expression constitutes the assertion of fact or the statement of opinion must be determined by considering the wording of the expression and its ordinary meaning, the overall flow including the context before and after, the meaning the expression carries in connection with the social context that formed its background, the knowledge and experience of the average member of society, and whether it is possible to determine the truth or falsity of the expression. Furthermore, in determining whether facts asserted through a publication are false, the standard for judgment should be the overall impression given to readers, comprehensively considering the objective content of the publication, the ordinary meaning of the vocabulary used, and the manner in which phrases are connected, in conjunction with the overall purport of the publication, premised on the ordinary manner in which general readers encounter the publication. In addition, the meaning that the expression carries within the social context that formed the background of the publication must also be considered together.

[2] In light of the purpose and social function of the corporate system, a corporation may be the subject of honor and other aspects of personality rights, to the extent not contrary to its nature. The term "honor" as used in Article 751, Paragraph 1 or Article 764 of the Civil Code (민법) refers to the objective evaluation received from society regarding a person's character, virtue, reputation, and credit, and in the case of a corporation, refers to its social reputation and credit; defaming someone means impairing that social evaluation. Since a corporation becomes the subject of rights and obligations within the scope of its purpose as prescribed in its articles of incorporation in accordance with statutory provisions (Article 34 of the Civil Code), where a corporation's social reputation and credit are damaged to the extent that it affects the performance of the corporation's purpose business, thereby impairing the corporation's social evaluation, this constitutes a tort against the corporation.

[3] For a tort based on defamation to be established, the victim must be specified; however, this does not necessarily require specification to the degree of explicitly stating a person's name or an organization's name. Even where a person's name or an organization's name is not explicitly stated, if, upon comprehensive consideration of the content of the expression together with the surrounding circumstances, it is to a degree that people who know the victim or people around the victim could recognize that the expression points to the victim, the victim can be said to have been specified.

[4] Where an expressive act damages the honor of a deceased person or infringes upon their personality rights, such as by asserting false facts about the deceased or constituting an insulting and contemptuous personal attack, the bereaved family may exercise rights such as claims for damages under the Civil Code, or claims for exclusion or prohibition of the infringing act, on the grounds of infringement of their own honor or of their feelings of affection and remembrance toward the deceased. In this regard, persons who may exercise rights such as claims for damages under the Civil Code are not limited to the bereaved family members specified in Article 5-2, Paragraphs 2 through 4 of the Act on Press Arbitration and Remedies, etc. for Damage Caused by Press Reports (언론중재 및 피해구제 등에 관한 법률), namely, the spouse, lineal descendants or ascendants, or siblings of the deceased. Whether an expressive act, such as the assertion of false facts about a deceased person, has infringed upon the feelings of remembrance, etc. of a particular bereaved family member must be individually and specifically determined in accordance with social norms, comprehensively considering various circumstances in the specific case, including the form and content of the expressive act, the familial relationship and life relationship that the person claiming infringement of feelings of remembrance, etc. had with the deceased during the deceased's lifetime, and the attitude that person has ordinarily shown toward the deceased since the deceased's death.

[5] Where honor is damaged by the assertion of facts through the press or publications, and the plaintiff, as the cause of action, seeks damages on the ground that the asserted facts are false, the burden of proving the falsity lies with the plaintiff. However, where the defendant raises the defense that there is no illegality because the purpose of the asserted facts was solely for the public interest and the content was either true or there were reasonable grounds to believe it to be true, the burden of proving the grounds for excluding illegality lies with the defendant. In this regard, whether there were reasonable grounds to believe the content to be true must be determined by comprehensively considering various circumstances, including the content of the asserted facts, the certainty and reliability of the grounds or materials that led to the belief that it was true, the ease of verifying the facts, and the extent of harm to the victim, and by examining whether the actor exercised appropriate and sufficient investigation to verify the truth or falsity of the asserted content, and whether the truthfulness thereof is supported by objective and reasonable materials or grounds.

[Judgment Below] Gwangju High Court Judgment 2018Na24881, 24898, decided September 14, 2022

[Order]

All appeals are dismissed. The costs of the final appeal shall be borne by the Defendants.

[Reasoning]

The grounds for final appeal are examined.

1. Outline of the Case

According to the reasoning of the judgment below and the record, the following facts may be found.

A. The Plaintiff May 18 organizations are corporations whose purpose business is the commemoration, etc. of the May 18 Democratization Movement, and Plaintiff 5 is the nephew of the deceased Father △△△ (baptismal name □□, hereinafter “Nonparty 2”) and is a Catholic priest. Nonparty 2 served at Gyerim-dong Catholic Church in Gwangju at the time of the May 18 Democratization Movement, and thereafter stated on several occasions that he had witnessed helicopter firing by the martial law troops at that time.

B. The deceased ○○○ (hereinafter “Nonparty 1”) wrote the first printing of the first edition of “(title omitted)” (hereinafter “the First Edition of the Memoir at Issue”), and Defendant 2, the son of Nonparty 1, published, distributed, and sold it as the publisher on April 3, 2017.

C. The Plaintiffs asserted that the First Edition of the Memoir at Issue stated false facts related to the May 18 Democratization Movement, and filed an application for a provisional injunction prohibiting the publication and distribution of the First Edition of the Memoir at Issue against Nonparty 1 and Defendant 2 (hereinafter collectively “Nonparty 1, etc.”) with the Gwangju District Court, Case No. 2017Kahap50236. On August 4, 2017, the court granted the application and issued a provisional injunction decision ordering that the First Edition of the Memoir at Issue not be published, distributed, etc. without deleting the expressions that the Plaintiffs sought to have deleted.

D. Nonparty 1, etc. revised the First Edition of the Memoir at Issue by merely blacking out the portions containing the expressions ordered to be deleted in the provisional injunction decision, and Defendant 2 published, distributed, and sold, on October 13, 2017, the first printing of the second edition of the book bearing the same title as thus revised (hereinafter, together with the First Edition of the Memoir at Issue, “the Memoir at Issue”).

E. Nonparty 1 died on November 23, 2021 while the case was pending in the court below, and after the co-heirs renounced their inheritance, etc., his spouse, Defendant 1, succeeded to this litigation.

2. Whether False Facts Infringing upon the Social Reputation of the Plaintiff May 18 Organizations Were Stated

A. 1) An act of expression that explicitly states facts with sufficient specificity to be capable of infringing upon another person’s social reputation may constitute defamation; likewise, an act of expression in the form of stating an opinion or commentary may also constitute defamation if, in light of its overall purport, it implicitly includes an assertion of an underlying hidden fact that forms the basis of the opinion, and that fact is capable of infringing upon another person’s social reputation. The mere expression of a pure opinion does not constitute defamation; however, if the form and content of the expressive act amount to an insulting and contemptuous personal attack, it may constitute a separate type of tort distinct from defamation. Whether a particular expression constitutes a statement of fact or a statement of opinion must be determined by considering the wording of the expression and its ordinary meaning, the overall flow including the context before and after, the meaning the expression carries in connection with the social context that formed its background, the knowledge or experience of the average person in society, and whether it is possible to determine the truth or falsity of the expression (see Supreme Court Decision 2000Da14613, decided December 24, 2002; Supreme Court en banc Decision 2014Da61654, decided October 30, 2018; Supreme Court Decision 2022Da280283, decided November 30, 2023, etc.). Furthermore, in determining whether a fact stated through a publication is false, the standard for judgment should be the overall impression given to readers, comprehensively considering, on the premise of the ordinary manner in which general readers encounter the publication, the objective content of the publication, the ordinary meaning of the vocabulary used, the manner in which phrases are connected, etc., in conjunction with the overall purport of the publication. In addition, the meaning that the expression carries within the social context that formed the background of the publication must also be considered together (see Supreme Court Decision 2011Da86782, decided November 15, 2012, etc.).

2) In light of the purpose and social function of the corporate system, a corporation may, within the scope not contrary to its nature, be a subject of honor, etc., which is a component of personality rights (see Constitutional Court en banc Decision 2009Hun-Ga27, decided August 23, 2012, etc.). The “honor” referred to in Article 751, Paragraph 1 and Article 764 of the Civil Code (민법) means the objective evaluation received from society regarding a person’s character, virtue, reputation, credit, etc., and in the case of a corporation, refers to its social reputation and credit; defaming honor means infringing upon such social evaluation (see Supreme Court Decision 87Daka1450, decided June 14, 1988, etc.). Since a corporation becomes a subject of rights and obligations within the scope of the purpose prescribed in its articles of incorporation in accordance with statutory provisions (Article 34 of the Civil Code), where the corporation’s social reputation and credit are damaged to an extent that affects the performance of the corporation’s purpose business, thereby infringing upon the corporation’s social evaluation, this constitutes a tort against the corporation (see Supreme Court Decision 96Da12696, decided June 28, 1996; Supreme Court Decision 2021Da250735, decided October 14, 2022, etc.).

3) For a tort by defamation to be established, the victim must be specified; however, it is not necessary that the victim be specified to the extent of expressly naming the person’s name or the organization’s name. Even where a person’s name or an organization’s name is not expressly stated, if, upon comprehensive consideration of the content of the expression together with the surrounding circumstances, a person who knows the victim or people around the victim can recognize that the expression points to the victim, the victim may be deemed to have been specified (see Supreme Court Decision 2015Da45857, decided April 12, 2018, etc.).

B. The court below determined, for the following reasons, that among the expressions in the Memoir at Issue that the court below ordered to be deleted, all expressions other than the insulting expression set forth in Paragraph 3 below (hereinafter “the Expressions at Issue”) constituted the statement of false facts by Nonparty 1, etc., and that the social evaluation of the Plaintiff May 18 organizations was thereby infringed.

1) The Expressions at Issue are not mere statements of opinion but explicitly or implicitly state specific facts, such as that “North Korean soldiers, agents, and special agents who had infiltrated from the North participated in the demonstrations at the time of the May 18 Democratization Movement and intensified them,” that “there was no firing by helicopters used by the martial law troops at the time,” and that “the martial law troops had no choice but to exercise the right of self-defense because the citizens had armed themselves first at the time.”

2) Comprehensively considering the course of development of the May 18 Democratization Movement, the content of the related final and conclusive judgments, the content of documents prepared before and after the May 18 Democratization Movement, the statements of persons concerned (including courtroom testimony), and the findings of the investigation by the Ministry of National Defense’s Commission for the Investigation of the Truth about Past Incidents, it must be held that the facts stated in the Expressions at Issue have all been proven to be false.

3) The Plaintiff May 18 organizations consist of one foundation (재단법인) and three incorporated associations (사단법인) [pursuant to Article 55 of the Act on Honorable Treatment of Persons of Distinguished Service to the May 18 Democratization Movement and Establishment of Related Organizations (hereinafter “the May 18 Meritorious Persons Act”), the May 18 Democratization Movement Injured Persons Association, the May 18 Democratization Movement Bereaved Family Association, and the May 18 Democratization Movement Meritorious Persons Association were established and simultaneously deemed dissolved, and each newly established organization succeeded to this litigation], and these organizations have, for a long time, led activities related to the punishment of those responsible for the May 18 Democratization Movement, the investigation of the truth, and the restoration of honor of participants, while carrying out commemorative projects. Article 96 of the May 18 Meritorious Persons Act prohibits organizing a for-profit organization or engaging in organizational or individual activity under the pretext of supporting May 18 democratization meritorious persons or their bereaved families or family members (Paragraph 1), and prohibits using, in the name of an organization, terms that may be mistaken for “May 18 democratization meritorious person” or a title thereof unless done in accordance with law (Paragraph 2); provisions to this effect have been maintained continuously since the enactment of the former Act on Honorable Treatment of Persons of Distinguished Service to the Gwangju Democratization Movement, Act No. 6650, on January 26, 2002 (see Article 68, etc. of the former Act). Considering the fact that arbitrarily organizing or purporting to represent organizations related to the May 18 Democratization Movement has long been prohibited, together with the course of the activities of the Plaintiff May 18 organizations discussed above and the effect that the facts related to the May 18 Democratization Movement have on the social reputation, credit, and social evaluation of the Plaintiff May 18 organizations, it must be held that the statement of false facts through the Expressions at Issue resulted in an infringement of the social evaluation of the Plaintiff May 18 organizations.

4) Although the Memoir at Issue does not directly name the Plaintiff May 18 organizations, it repeatedly points to a group of persons holding a perception contrary to the facts stated above. Considering this manner of description together with the circumstances discussed above, a general reader reading the Memoir at Issue in the ordinary manner could recognize that the Expressions at Issue point to the Plaintiff May 18 organizations, who may be regarded as the group of persons holding a perception contrary to the facts stated above; accordingly, the Plaintiff May 18 organizations may be specified as victims of defamation.

C. Examining the reasoning of the judgment below in light of the legal principles set forth above and the record, there is no error in the judgment below, as alleged in the grounds for final appeal, of misapprehending the legal principles concerning the elements of defamation, specification of the victim, defamation of a corporation, defamation by group designation, etc., or of violating the principle of party presentation, or of finding facts in a manner that exceeds the limits of free evaluation of evidence in violation of logic and empirical rules, thereby affecting the judgment.

3. Whether Plaintiff 5, as a Bereaved Family Member of Nonparty 2, May Exercise Rights Such as a Claim for Damages

A. Where an act of expression, such as stating false facts about a deceased person or subjecting the deceased to an insulting and contemptuous personal attack, defames the deceased’s honor or infringes upon the deceased’s personality rights, the bereaved family may exercise rights such as a claim for damages under the Civil Code, or a claim for exclusion or prohibition of the infringing act, on the ground of infringement of their own honor or of feelings of affection and mourning, etc., toward the deceased (see Supreme Court Decision 2010Da8341, 8358, decided June 10, 2010, etc.). In this regard, the persons entitled to exercise rights such as a claim for damages under the Civil Code are not limited to the bereaved family members prescribed in Article 5-2, Paragraphs 2 through 4 of the Act on Press Arbitration and Remedies, etc. for Damage Caused by Press Reports, namely the spouse, lineal descendants or ascendants, or siblings of the deceased. Whether an act of expression, such as the statement of false facts about a deceased person, infringes upon the feelings of mourning, etc. of a particular bereaved family member must be determined individually and specifically in light of social norms in each case, comprehensively considering various circumstances such as the form and content of the expressive act, the familial relationship and living relationship that the person claiming infringement of feelings of mourning, etc. had with the deceased during the deceased’s lifetime, and the attitude ordinarily shown toward the deceased after the deceased’s death.

B. The court below determined, for the following reasons, that Nonparty 1, etc.’s act of stating false facts regarding the helicopter firing by the martial law troops through the Memoir at Issue and expressing contempt toward Nonparty 2 through the insulting expression that “Nonparty 2 is nothing but a shameless liar, making a mockery of the word ‘clergyman,’” infringed upon Plaintiff 5’s feelings of mourning, etc. as a bereaved family member of Nonparty 2, and that Plaintiff 5 may claim damages against the Defendants and seek prohibition of the publication, etc. of the Memoir at Issue.

1) By the nature of the priesthood, a Catholic priest ordinarily cannot have lineal descendants. Plaintiff 5, the nephew of Nonparty 2, became a Catholic priest following in Nonparty 2’s footsteps and served together with him in the same diocese, and succeeded Nonparty 2 as the representative director of a Catholic-affiliated social welfare organization called ☆☆ Jamae-won, located in ◇◇-dong, Nam-gu, Gwangju, thereby forming a close relationship with Nonparty 2 comparable to that of a lineal blood relative.

2) When the Memoir at Issue was published, Plaintiff 5, as a relative with standing to file a criminal complaint, personally filed a criminal complaint against Nonparty 1 for defamation of the deceased with respect to the portion mentioning Nonparty 2 in connection with the helicopter firing by the martial law troops.

3) In addition, Plaintiff 5 continuously and publicly represented his close relationship with Nonparty 2, both during Nonparty 2’s lifetime and after his death, through numerous media outlets, etc.

C. Examining the reasoning of the judgment below in light of the legal principles set forth above and the record, there is no error in the judgment below, as alleged in the grounds for final appeal, of misapprehending the legal principles concerning the scope of bereaved family members entitled to exercise rights such as a claim for damages on the ground of infringement of feelings of mourning, etc. toward the deceased, thereby affecting the judgment.

4. Whether Grounds for Exclusion of Illegality May Be Recognized for Nonparty 1, etc.

A. Where a person defames another’s honor by stating facts through the press or a publication, and the plaintiff, as the cause of action, claims damages on the ground that the stated facts are false, the burden of proving falsity lies with the plaintiff. However, where the defendant raises the defense that the stated facts were solely for the public interest and were either true or there was a reasonable ground to believe them to be true, such that there is no illegality, the burden of proving the grounds for exclusion of illegality lies with the defendant. In this regard, whether there was a reasonable ground to believe the content to be true must be determined by comprehensively considering various circumstances such as the content of the stated facts, the certainty and reliability of the grounds or materials on which the belief in truth was based, the ease of verifying the facts, and the degree of harm to the victim, in light of whether the actor made appropriate and sufficient investigation to verify the truth or falsity of the stated content, and whether the truthfulness thereof is supported by objective and reasonable materials or grounds (see Supreme Court Decision 2005Da58823, decided January 24, 2008, etc.).

B. The court below determined as follows.

1) Defendant 2, as the son of Nonparty 1 and the person listed as “publisher” in the Memoir at Issue, was in a position to review the overall content of the Memoir at Issue and make the final decision on its publication, distribution, etc., and is also a person who, as the publisher, jointly enjoys the economic benefit arising from the publication of the Memoir at Issue. Accordingly, Defendant 2 must, jointly with Nonparty 1, the author, bear liability for damages to the Plaintiffs arising from the statement of false facts, etc.

2) The Expressions at Issue constitute the explicit or implicit statement of false facts. This being so, the Defendants bear the burden of proving that Nonparty 1, etc. had reasonable grounds to believe that the facts were true. However, comprehensively considering the scope of information that Nonparty 1 could have gathered by virtue of his position at the time of the May 18 Democratization Movement, Nonparty 1’s own past statements, the existence of related final and conclusive judgments, the progress of the investigation into the truth of the May 18 Democratization Movement, and the content of related media reports, it is difficult to find, based solely on the evidence submitted by the Defendants, that Nonparty 1, etc. had reasonable grounds to believe that the facts stated in the remaining expressions among the Expressions at Issue were true, except for a portion of the expression listed at Serial Number 1-12 of Attachment List 2 to the judgment below (the portion relating to the martial law soldier who died after being run over by an armored vehicle).

C. Examining the reasoning of the judgment below in light of the legal principles set forth above and the record, there is no error in the judgment below, as alleged in the grounds for final appeal, of misapprehending the legal principles concerning the grounds for exclusion of illegality applicable to authors and publishers, thereby affecting the judgment.

5. Conclusion

All appeals are dismissed, and the costs of the final appeal are to be borne by the losing parties. This Judgment is rendered as set forth in the Order by the unanimous opinion of the participating Justices.
