A mother who single-handedly raised her children for 16 years after her divorce filed a claim against her ex-husband for approximately KRW 64.6 million (about USD 48,000) in retroactive child support (과거 양육비). The Supreme Court (대법원) overturned the lower court's ruling, holding that it failed to consider the property division (재산분할) circumstances at the time of divorce and did not properly distinguish between the children's status as minors versus adults when calculating the support amount.

Key takeaways
  • CaseA divorced mother who raised her children alone for 16 years sued her ex-husband for KRW 64.6 million in unpaid, retroactive child support.
  • OutcomeThe Supreme Court sent the case back to the lower court, ruling that it must reconsider the divorce-time property division context and separately calculate support for adult versus minor children.
  • LessonWhen claiming or defending against retroactive child support long after divorce, both the property settlement history and each child's age status must be factored into the calculation.
Issues
  • What is the proper scope and standard for a retroactive child support (과거 양육비) claim filed long after an uncontested divorce?
  • How should the absence of a property division (재산분할) claim at the time of divorce affect the allocation of retroactive child support responsibility?
  • Should the calculation standards for retroactive child support differ between children who are now adults and those who are still minors?
Key reasoning

The Supreme Court established that when determining the scope of a parent's obligation to share retroactive child support costs, courts must take into account how property was divided (or not divided) between the parties at the time of divorce. If one party did not pursue a property division claim, this may be a relevant factor affecting the fairness of a delayed child support claim. Additionally, the Court ruled that retroactive child support for a child who is now an adult must be assessed separately from that of a child who is still a minor, because the legal basis for finalizing and allocating such support differs depending on the child's age status at the time of the claim and during the relevant support period. The lower court's failure to conduct this differentiated analysis meant its calculation of the support amount could not stand.

Summary of Decision (English, AI translation)

[1] Child support costs, which are the expenses incurred in raising a child, should in principle be borne jointly by the parents who are jointly responsible for raising the child. However, where, due to certain circumstances, only one parent comes to raise the child, the parent who raises the child may claim from the other parent the sharing of an appropriate amount of present and future child support costs, and, further, except where there are special circumstances, may claim reimbursement of an amount that it would be reasonable for the other party to share with respect to past child support costs. However, with regard to past child support costs, if the other party is made to bear all at once the costs already incurred prior to the claim for child support, the other party would be forced to bear an unexpected amount at one time, which could be excessively harsh or contrary to the principle of good faith or the principle of equity. Therefore, it is not necessarily required that such costs be determined on the same standard as child support costs after the claim for performance, and the scope of sharing that is recognized as appropriate may be determined by considering various circumstances, such as the circumstances under which one parent came to raise the child and the amount of costs incurred therein, whether and when the other party recognized the duty of support, whether the costs were ordinary living expenses incurred in the course of child-rearing or unusual and unavoidable large special expenses (such as medical expenses), and the parties' financial circumstances or economic capacity and the equity of the burden.
In particular, in determining the scope of sharing of child support costs, whether present and future child support costs or past child support costs, in relation to the parties' financial circumstances or economic capacity and the equity of the burden, it is necessary to consider the existence and content of any division of property or property-related agreement made at the time of the parties' divorce, and the relationship between such division of property and the bearing of child support costs, since the division of property upon dissolution of a marital relationship is carried out not only with a liquidative element between the parties but also including elements of post-divorce support and the nature of a payment to compensate for mental damages (consolation money), among other things. This is because parents who dissolve their marital relationship while having a child determine, in a relationship of close mutual influence, the issues of who will raise the child after the divorce and how much child support will be borne, together with the issue of liquidating the property jointly formed during the marriage, and thereby reach an agreement on the person who will raise the child, the child support, and the division of property, or decide whether to claim division of property or child support.

[2] Once a child reaches the age of majority, the divorced parents' joint duty to raise the child terminates, and there is no longer any issue of determining or sharing future child support for the child. Between the divorced parents, there remains only the relationship in which they must settle the costs that either party spent in the past for raising the child. Furthermore, with respect to the sharing of past child support costs for the child, from the time the child reaches the age of majority, any agreement between the relevant parties or a family court's adjudication has only the meaning of concretely determining, after confirming and evaluating the past circumstances of child-rearing and the costs incurred, the amount of past child support costs that it is reasonable for the other party to bear, and no longer has the meaning of discretionarily formulating the amount of child support to be shared as necessary for the welfare of the child. After the child has reached the age of majority, there is no need to go through a process of harmonizing the determination of the amount of past child support to be shared with the amount of future child support to be shared, which inherently carries the possibility of change, and since there is no room for the right to past child support to be provided for the current or future needs of child-rearing, there is likewise no need to consider the impact on the welfare of the child. As such, since the meaning of determining and sharing past child support costs differs depending on whether the person in question (the child) has already reached the age of majority or is still a minor, a court that determines the sharing of past child support costs for a child who has reached the age of majority, as between divorced parents, needs to examine the parties' financial circumstances, economic capacity, and the equity of the burden, among other matters, based on this difference, and to reflect the results thereof in its determination.

[Petitioner, Appellee] Petitioner
[Respondent, Re-appellant] Respondent (Attorney Lee Hyun-seok)
[Persons Concerned in the Case] Person Concerned in the Case 1 and 1 other person
[Decision Below] Gwangju Family Court Decision 2022Beu349 dated May 4, 2023

[Order]

The decision below is reversed, and the case is remanded to the Gwangju Family Court.

[Reasoning]

The grounds for re-appeal are examined.

1. Outline of the Case

According to the reasoning of the decision below and the record, the following facts may be ascertained.

A. The Petitioner and the Respondent registered their marriage on August 7, 1997, and had as their children Person Concerned in the Case 1 (born January 1998) and Person Concerned in the Case 2 (born May 2004), and were divorced by mutual consent on January 27, 2006.

B. During the marriage, the Respondent, together with the Petitioner, purchased and resided in an apartment located in ○○-dong, Gwangsan-gu, Gwangju (hereinafter “the apartment in this case”). The Respondent fully repaid the loan debt incurred for, among other things, the purchase funds for the apartment by receiving an interim settlement of his retirement allowance, but did not claim division of property against the Petitioner after the divorce by mutual consent.

C. The Petitioner raised the Persons Concerned in the Case alone after the divorce by mutual consent. Meanwhile, approximately 16 years after the divorce by mutual consent, on April 27, 2022, the Petitioner filed a petition against the Respondent seeking payment of past child support in the amount of 26,000,000 won for Person Concerned in the Case 1, who is now an adult (200,000 won per month from April 2006 until he reached adulthood in January 2017), and 38,600,000 won for Person Concerned in the Case 2, who is a minor (200,000 won per month from April 2006 to April 2022), totaling 64,600,000 won, together with future child support of 350,000 won per month for Person Concerned in the Case 2.

2. Judgment of the Court Below

The court below determined, for the reasons stated in its decision, that it was reasonable to fix the past child support that the Respondent should bear for the Persons Concerned in the Case at 60,000,000 won, and the future child support for Person Concerned in the Case 2 at 350,000 won per month.

3. Judgment of the Supreme Court

However, this judgment of the court below is difficult to affirm as it stands.

A. Child support, being the cost of raising a child, must in principle be borne jointly by the parents who bear joint responsibility for raising the child. However, where, for some reason, only one parent comes to raise the child, the raising parent may claim from the other party the sharing of an appropriate amount of current and future child support, and, further, except in cases where special circumstances exist, may claim reimbursement of an amount that it is reasonable for the other party to bear as a share of past child support. However, with respect to past child support, since imposing on the other party at once the expenses already incurred prior to the claim for child support may impose upon that party an unforeseen amount all at once, which could be excessively harsh or contrary to the principle of good faith or the principle of equity, it is not necessarily required to be determined on the same basis as child support following a claim for performance. Rather, the appropriate scope of sharing may be determined by considering various circumstances, including: the circumstances under which one parent came to raise the child and the amount of expenses incurred therefor; whether and when the other party recognized the duty of support; whether the expenses were ordinary living expenses incurred in raising the child or exceptional and unavoidable large special expenses (such as medical expenses); and the parties’ financial circumstances, economic capacity, and the equity of the burden (see Supreme Court en banc Decision 92Seu21 dated May 13, 1994; Supreme Court Decision 2019Meu15302 dated May 14, 2020, etc.).

In particular, regardless of whether it concerns current and future child support or past child support, when determining the scope of sharing of child support in relation to the parties’ financial circumstances, economic capacity, and the equity of the burden, it should be noted that division of property upon dissolution of a marital relationship is carried out including not only the liquidating element between the parties, but also the post-divorce support element and the nature of a payment made to compensate for mental damages (solatium) (see Supreme Court Decision 2022Seu613 dated July 28, 2022, etc.). Accordingly, it is necessary to consider the existence and content of any division of property or property-related agreement made at the time of the parties’ divorce, and the relationship between such property division circumstances and the bearing of child support. This is because parents who dissolve their marital relationship while having children come to reach an agreement on, or decide whether to claim, the custodian of the child and child support, division of property, etc., in a relationship where the issue of raising the child after divorce and the issue of liquidating property jointly formed during the marriage closely influence each other.

B. Meanwhile, once a child reaches adulthood, the duty of the divorced couple to jointly bear the responsibility of raising the child comes to an end, and the issue of determining or sharing future child support for the child no longer arises. What remains between the couple is only the relationship in which one party must settle accounts for expenses previously incurred by the other in raising the child in the past. Furthermore, with respect to the sharing of past child support for a child, from the time the child reaches adulthood, any agreement between the parties concerned or a family court's decision has only the meaning of specifically fixing, through confirmation and evaluation of the past circumstances of upbringing and expenses incurred, the amount that it is reasonable for the other party to bear among the past child support, and the meaning of discretionarily forming the amount of child support sharing necessary for the welfare of the child disappears. After a child reaches adulthood, there is no need to go through a process of harmoniously adjusting the amount of past child support sharing with the amount of future child support sharing, which inherently carries the possibility of change, and since there is no room for the right to past child support to be applied to the current or future needs of raising the child, there is also no need to consider the impact on the welfare of the child (see Supreme Court en banc Decision 2018Seu724 dated July 18, 2024). As such, since the meaning of fixing and sharing past child support differs depending on whether the person concerned in the case has already reached adulthood or is still a minor, a court determining the sharing of past child support for a child who has reached adulthood, as between a divorced couple, needs to examine and reflect in its findings the parties’ financial circumstances, economic capacity, the equity of the burden, etc., based on this distinction.

C. Examining the facts set forth above in light of the foregoing legal principles:

The apartment in this case is an apartment that the Respondent and the Petitioner jointly purchased and resided in during their approximately nine years of marriage, and the Respondent fully repaid the loan debt relating to the apartment in this case by receiving an interim settlement of his retirement allowance; therefore, there is room to view it as joint property that the Petitioner and the Respondent formed through cooperation during the marriage. However, after the divorce by mutual consent, the Respondent did not claim division of property with respect to the apartment in this case against the Petitioner, whereby ownership ultimately vested in the Petitioner.

According to the record, it appears that the Persons Concerned in the Case resided in the apartment in this case for a considerable period before and after the divorce by mutual consent, and there is room to evaluate that the Respondent's failure to claim division of property with respect to the apartment in this case substituted, in whole or in part, for the performance of his duty of support by allowing the Persons Concerned in the Case to continue residing in the apartment in this case and be raised in a stable manner. It appears that the Respondent also argued that these circumstances should be reflected in the calculation of child support, but it is difficult to find in the record that the court below specifically examined this point.

Furthermore, at the time of this claim for child support, Person Concerned in the Case 1 had already reached adulthood, while Person Concerned in the Case 2 was a minor; therefore, although the court below should have reflected this distinction in its examination of the scope of calculation of past child support for the Persons Concerned in the Case, it does not appear to have taken this into consideration.

Accordingly, the court below should have examined whether the Respondent's failure to claim division of property upon divorce had an aspect of contributing to the raising of the Persons Concerned in the Case, whether the property subject to division that the Respondent did not claim was substantially provided for the raising of the Persons Concerned in the Case, and whether the distinction between the adult child claiming only past child support and the minor child claiming both past and future child support affected the calculation of child support, and then should have considered these matters in relation to the parties’ financial circumstances, economic capacity, and the equity of the burden, which are factors in determining the scope of calculation of child support. The judgment of the court below, which failed to consider these matters, contains an error that affected the judgment by misunderstanding the legal principles concerning the calculation of child support, etc., and by failing to conduct the necessary examination.

4. Conclusion

Therefore, the decision below is reversed, and the case is remanded to the court below for further examination and judgment, and it is so decided as set forth in the Order by the unanimous opinion of the Justices involved.
