Cabin crew members of Asiana Airlines sought additional statutory allowances by arguing that the Cabin Language Allowance (캐빈어학수당) should be included in the calculation of ordinary wages (통상임금). The Supreme Court (대법원) ruled that the Cabin Language Allowance does qualify as part of the ordinary wage, but ultimately limited the crew members' claim for additional statutory allowances, citing the good faith principle (신의성실원칙) in light of the airline's severe financial difficulties.

Key takeaways
  • CaseAsiana Airlines cabin crew members claimed additional statutory allowances by arguing that their Cabin Language Allowance should be counted as part of their ordinary wage.
  • OutcomeThe Supreme Court agreed the allowance qualified as ordinary wage but restricted the crew's claim, ruling that pursuing it fully would violate the good faith principle given the airline's serious financial crisis.
  • LessonEven if an allowance is legally recognized as part of the ordinary wage, courts may limit claims for additional statutory allowances when the employer faces genuine financial hardship, so workers and companies should carefully weigh such circumstances before litigating.
Issues
  • Whether the Cabin Language Allowance (캐빈어학수당) qualifies as part of the ordinary wage (통상임금)
  • Whether the airline's holiday substitution practice was lawful and whether holiday work allowances were owed
  • Whether the good faith principle (신의성실원칙) can limit employees' right to claim additional statutory allowances
Key reasoning

The Court found that the Cabin Language Allowance, which is tied to language proficiency grades for international flight crew, reflects the value of the employees' regular scheduled work (소정근로) and therefore should be classified as part of the ordinary wage (통상임금). However, the Court also recognized that enforcing this classification and requiring the airline to pay additional statutory allowances retroactively could severely threaten the company's survival, given its serious financial distress. Balancing these competing interests, the Court held that allowing the full claim would violate the good faith principle (신의성실원칙), which under Korean labor law can limit otherwise valid wage claims when enforcement would cause extreme hardship to the employer's business operations.

Summary of Decision (English, AI translation)

[1] Whether a certain wage falls under ordinary wages should be determined according to its objective nature, based on whether it is money or valuables paid to an employee as consideration for prescribed work, and paid regularly, uniformly, and in a fixed manner, rather than being determined by formal criteria such as the name of the wage or the length of the payment cycle. Here, “consideration for prescribed work” means the money or valuables that the employer and employee agree to pay for the work that the employee has agreed to ordinarily provide during prescribed working hours. Wages additionally paid by the employer because the employee provided work exceeding the prescribed working hours or specially provided work other than that agreed to be provided under the employment contract, or wages paid without relation to work during prescribed working hours, cannot be considered consideration for prescribed work and thus do not fall under ordinary wages. As stated above, what constitutes consideration for prescribed work must be determined comprehensively based on how the employee and employer evaluated the value of the work that the employee agreed to ordinarily provide during prescribed working hours, and how much money or valuables they agreed to pay for it.

For a certain wage to fall under ordinary wages, it must have the character of being paid uniformly. Being paid “uniformly” includes not only payment to “all employees” but also payment to “all employees who meet a certain condition or standard.” Here, the “certain condition” must be a fixed condition, in light of the concept of ordinary wages, which seeks to calculate a fixed and average wage. Meanwhile, considering that ordinary wages are a concept that evaluates the value of prescribed work, the “certain condition or standard,” which serves as the criterion for determining whether a wage paid to all employees within a certain range has the character of uniformity, must be a condition related to the evaluation of the value of prescribed work, such as work content, skill, or experience.

[2] Where an employer pays money or valuables under the name of a qualification allowance, etc., to an employee who holds a certain qualification, if the existence or content of such qualification may affect the quality or content of the prescribed work that the employee provides to the employer, then, absent special circumstances, it can be regarded as a certain condition related to the evaluation of the value of prescribed work, and therefore money or valuables paid under the name of a qualification allowance, etc., may fall under ordinary wages.

[3] In a case where Company A, engaged in domestic and international air transportation business, etc., granted foreign language qualification grades to international flight crew members based on scores obtained in a recognized language proficiency test and whether they passed an oral test, and paid a monthly allowance under the name of a cabin language allowance according to the grade, and where B and others, who worked as international flight crew members for Company A, sought payment of additional statutory allowances recalculated by including the cabin language allowance in ordinary wages: the court held that the work of B and others, international flight crew members, such as attending to foreign customers, could be regarded as work that B and others agreed to ordinarily provide to Company A during prescribed working hours; that the quality or content of the prescribed work, such as attending to foreign customers, that B and others provide to Company A could vary depending on the existence of a foreign language qualification grade and the level of the grade obtained; and that it is difficult to conclude that the cabin language allowance, which was paid regularly and continuously pursuant to the wage agreement, was paid solely for the purpose of motivation and encouragement, unrelated to the evaluation of the value of prescribed work. Accordingly, the cabin language allowance falls under ordinary wages, and the lower court’s judgment, which held otherwise, was found to have erred in its legal reasoning, etc.

[4] Where a collective agreement, etc. contains a provision allowing a specified holiday to be made a working day and, instead, an ordinary working day to be substituted as a holiday, or even without such a provision, where the employee’s consent has been obtained, if the substitute holiday is specified and notified to the employee in advance, this constitutes a lawful substitution of holidays, absent circumstances requiring otherwise. Accordingly, the original holiday becomes an ordinary working day, and work performed on that day becomes ordinary work rather than holiday work, and thus the employer is not obligated to pay the employee a holiday work allowance.

[5] In a case where it was at issue whether it violated the principle of good faith for B and others, employees of Company A, which is engaged in domestic and international air transportation business, etc., to seek payment of additional statutory allowances recalculated by including bonuses, etc. in ordinary wages, the lower court's judgment—which held that if Company A were to pay additional statutory allowances to its employees, this could impose an unforeseen new financial burden on the company, leading to serious managerial difficulties, and that therefore the claims of B and others could not be permitted as they violated the principle of good faith—was upheld, in consideration of the following circumstances comprehensively: that Company A, despite having entered into a autonomous agreement (자율협약) with its creditor group and undergone a restructuring process through joint management by the creditor group, still bears substantial debt; that Company A has never had a positive cumulative net profit since its establishment, and even until recently, the scale of net losses has significantly exceeded the scale of net profits; that Company A's debt ratio has failed to meet the target set in the autonomous agreement, and, considering the operating leases used for the introduction of new aircraft, etc., external borrowings are bound to continue increasing, such that the amount of debt and the debt ratio are expected to increase further in the future; that it is difficult to expect that Company A's profitability will improve in the short term due to competition with low-cost carriers; and that Company A also amended its rules of employment to reduce bonus payments with the consent of a majority of its employees, whereby a majority of employees made a decision taking into account the company's management situation.

[Judgment Below] Seoul High Court Judgment 2014Na32153, decided August 28, 2015

[Order]

Among the portions of the judgment below concerning Plaintiff 1, Plaintiff 2, Plaintiff 3, and Plaintiff 4, the portions of their claims other than the claim for holiday work allowance are reversed, and this portion of the case is remanded to the Seoul High Court. The remaining appeals of Plaintiff 1, Plaintiff 2, Plaintiff 3, and Plaintiff 4, and the appeals of the remaining plaintiffs are all dismissed. Of the costs of appeal, the portion arising between the remaining plaintiffs (excluding Plaintiff 1, Plaintiff 2, Plaintiff 3, and Plaintiff 4) and the Defendant shall be borne by the remaining plaintiffs.

[Reasoning] The grounds of appeal (including the supplementary appellate brief submitted after the expiration of the period for submission of the grounds of appeal, to the extent it supplements the grounds of appeal) are examined as follows.

1. As to Ground of Appeal No. 1

A. Whether a certain wage falls under ordinary wages should be determined according to its objective nature based on whether it is money or valuables paid to an employee as consideration for prescribed work and is paid regularly, uniformly, and in a fixed manner, rather than by formal criteria such as the name of the wage or the length of the payment cycle. Here, "consideration for prescribed work" means money or valuables that the employer and employee have agreed to pay for the work that the employee has agreed to ordinarily provide during prescribed working hours. Wages additionally paid by the employer because the employee provided work exceeding the prescribed working hours or provided work other than that agreed to be provided under the labor contract, or wages paid without relation to work during prescribed working hours, cannot be regarded as consideration for prescribed work and therefore do not fall under ordinary wages. As described above, what constitutes consideration for prescribed work must be determined comprehensively based on how the employer and employee evaluated the value of the work that the employee agreed to ordinarily provide during prescribed working hours and how much money or valuables they agreed to pay therefor.

In order for a certain wage to fall under ordinary wages, it must have the character of being paid uniformly. Being paid "uniformly" includes not only wages paid to "all employees" but also wages paid to "all employees who meet a certain condition or standard." Here, the "certain condition" must be a fixed condition, in light of the concept of ordinary wages, which is intended to calculate a fixed and average wage. Meanwhile, considering that ordinary wages are a concept that evaluates the value of prescribed work, the "certain condition or standard," which serves as the yardstick for determining whether wages paid to all employees within a certain scope have the characteristic of uniformity, must be a condition related to the evaluation of the value of prescribed work, such as work content, skill, or career (see Supreme Court en banc Decision 2012Da89399, decided December 18, 2013).

Meanwhile, where an employer pays money or valuables under the name of a qualification allowance, etc. to an employee who possesses a certain qualification, if the existence or content of such qualification can affect the quality or content of the prescribed work that the employee provides to the employer, then, absent special circumstances, it may be regarded as a certain condition related to the evaluation of the value of prescribed work, and thus money or valuables paid under the name of a qualification allowance, etc. may fall under ordinary wages.

B. Examining the following circumstances, which can be ascertained from the reasoning of the judgment below and the record, in light of the above legal principles, the cabin language allowance at issue in this case falls under ordinary wages.

1) The Defendant classified the language qualifications of international flight cabin crew members from Grade 1 to Grade 5, based on scores obtained in official English, Japanese, and Chinese language proficiency tests (TOEFL, JPT, HSK) and whether they passed an oral test, and paid KRW 30,000 to holders of Grade 1, KRW 20,000 to holders of Grade 2, and KRW 10,000 to holders of Grade 3, monthly, in the name of the cabin language allowance.

2) Since Plaintiff 1, Plaintiff 2, Plaintiff 3, and Plaintiff 4, etc. worked as the Defendant's international flight crew members, work such as responding to foreign customers can be regarded as work that the above plaintiffs agreed to ordinarily provide to the Defendant during prescribed working hours.

3) Depending on whether the above plaintiffs held a foreign language qualification grade and the level of the grade obtained, the quality or content of prescribed work such as responding to foreign customers that the above plaintiffs provide to the Defendant may vary.

4) It is difficult to conclude that the cabin language allowance at issue in this case, which was paid regularly and continuously pursuant to the wage agreement, was paid solely for the purpose of motivation and encouragement, unrelated to the evaluation of the value of prescribed work.

C. Nevertheless, the court below determined that the cabin language allowance at issue in this case did not fall under ordinary wages, on grounds such as that there was no evidence to acknowledge that the granting of language qualification grades was related to the evaluation of the prescribed work value of cabin crew members. Such determination by the court below contains an error that affected the judgment, by misapprehending the legal principles concerning ordinary wages, among other things.

2. As to Ground of Appeal No. 2

The court below determined that the standard hours for calculating ordinary wages were 226 hours per month, on grounds such as that it appears the Defendant calculated the ordinary hourly wage by treating 4 hours on Saturday as a paid holiday pursuant to the collective agreement, etc.

Examining the record in light of the relevant legal principles, there is no error in the above determination by the court below, such as violating the principles of logic and experience or exceeding the limits of free evaluation of evidence with respect to the standard hours for calculating ordinary wages, as alleged in the grounds of appeal.

3. As to Ground of Appeal No. 3

Where a collective agreement, etc. contains a provision allowing a specified holiday to be treated as a working day and, instead, an ordinary working day to be substituted as a holiday, or even absent such a provision, where the consent of the employee has been obtained, if the employer notifies the employee in advance of the specific holiday to be substituted, then, absent circumstances requiring otherwise, this constitutes a lawful substitution of holidays, whereby the original holiday becomes an ordinary working day and work performed on that day becomes ordinary work rather than holiday work, and thus the employer is not obligated to pay the employee a holiday work allowance (see Supreme Court Decision 99Da7367, decided September 22, 2000).

The court below determined that, since a lawful substitution of holidays was made with the consent of the employees, the originally scheduled holiday work became ordinary work, and on that and other grounds as stated in its reasoning, the Defendant was not obligated to pay the plaintiffs a holiday work allowance.

Examining the record in light of the relevant legal principles, there is no error in the above determination by the court below, such as misapprehending the legal principles concerning substitution of holidays, as alleged in the grounds of appeal.

4. As to Ground of Appeal No. 4

The court below, considering circumstances as stated in its reasoning—namely, that the Defendant, despite having entered into a voluntary agreement with its creditor group in 2010 and undergone a restructuring process through joint management by the creditor group, still bears a substantial amount of debt; that the Defendant has never had a positive cumulative net income since its establishment, and that even recently, the scale of net losses has significantly exceeded the scale of net income; that the Defendant's debt ratio, at around 600-700%, has not achieved the target of 400% set forth in the voluntary agreement, and rather, considering the operating leases used by the Defendant for the introduction of new aircraft, etc., external borrowings are bound to continue increasing, such that the amount of debt and the debt ratio are expected to increase further in the future; that the interest coverage ratio for the entire period from 2008 was only about 60%, and it is difficult to expect that the Defendant's profitability will improve in the short term due to competition with low-cost carriers; and that in December 2014, the Defendant obtained the consent of a majority of its employees to amend its rules of employment to reduce bonus payments, such that a majority of the Defendant's employees also made a decision considering the Defendant's management condition—determined, comprehensively taking these circumstances into account, that if the Defendant were to pay the additional statutory allowances at issue in this case to the Plaintiffs and other employees, this could impose an unforeseen new financial burden on the Defendant, resulting in serious managerial difficulties, and on that ground determined that the Plaintiffs' claims violate the principle of good faith and cannot be permitted.

Examining the record in light of the relevant legal principles, there is no error in the above determination by the court below, such as misapprehending the legal principles concerning the principle of good faith or violating the principles of logic and experience and exceeding the limits of free evaluation of evidence, as alleged in the grounds of appeal.

5. Conclusion

Therefore, among the judgment below, the portions of the remaining claims of Plaintiff 1, Plaintiff 2, Plaintiff 3, and Plaintiff 4, excluding the portion concerning the claim for holiday work allowance, are reversed, and this portion of the case is remanded to the court below for further deliberation and judgment; the remaining appeals of the above plaintiffs and the appeals of the remaining plaintiffs are all dismissed; and of the costs of appeal, the portion arising between the remaining plaintiffs and the Defendant shall be borne by the remaining plaintiffs. This judgment is rendered as set forth in the Order by the unanimous opinion of the Justices participating in the decision.
