In a case where an employee of Kookmin Bank sought to invalidate a standby order (대기발령) and dismissal, and to recover unpaid wages, the Supreme Court held that the first standby order was lawful but the subsequent dismissal was invalid. The Court also ruled that the performance bonus (보로금) does not constitute 'wages' for purposes of calculating average wage (평균임금), and that annual leave allowance (연차휴가수당) is included in average wage calculations only to the extent proportional to the relevant work period.

Key takeaways
  • CaseAn employee of Kookmin Bank was placed on standby order (대기발령) and later dismissed, then sued to invalidate the dismissal and claim unpaid wages.
  • OutcomeThe court ruled the standby order valid but the dismissal invalid, held that the performance bonus (보로금) is not wages, and that annual leave allowance (연차휴가수당) should be included in average wage calculations only proportionally to the work period.
  • LessonStandby orders (대기발령) require separate legitimacy assessment distinct from disciplinary dismissal, and employers/employees should be cautious that performance-based bonuses are not automatically treated as wages when calculating average wage (평균임금).
Issues
  • Criteria for determining the legitimacy of a standby order (대기발령)
  • Whether a performance bonus (보로금) qualifies as 'wages' under labor law
  • Scope of inclusion of annual leave allowance (연차휴가수당) in average wage (평균임금) calculations
  • Applicability of the Act on Special Cases Concerning Expedition of Legal Proceedings to Labor Relations Commission remedy orders
  • Requirements for establishing tort liability (불법행위)
Key reasoning

A standby order (대기발령), unlike disciplinary action, is a temporary measure taken to prevent operational disruption, and its legitimacy must be assessed separately from that of any subsequent dismissal. The performance bonus (보로금) in this case was determined through labor-management agreement based on business performance, and therefore does not qualify as 'wages' includible in the average wage calculation. Regarding annual leave allowance (연차휴가수당), only the portion corresponding to and proportional to the actual work period served should be included in the average wage base, not the full annual amount.

Summary of Decision (English, AI translation)

[1] Suspension from duty pending further disposition (待機發令) means a provisional measure whereby, in a case where it is anticipated that allowing an employee to continue holding his or her current position or duties in the future would cause obstacles to business operations, the employer temporarily deprives the employee of a position so as to prevent the employee from performing duties, in order to prevent such obstacles. This differs in nature from disciplinary action, which is a punitive sanction imposed for the purpose of maintaining corporate order in response to an employee's past misconduct. Therefore, the legitimacy of a suspension from duty pending further disposition imposed on an employee must be determined based on whether grounds for such suspension exist with respect to the employee, and whether, and to what extent, any procedural rules concerning the suspension were violated.

[2] If a bonus is paid continuously and regularly and the amount to be paid is fixed, it has the character of wages paid as consideration for work; however, a bonus whose grounds for payment are uncertain and which is paid on a one-time basis cannot be regarded as wages.

[3] In a case where it was at issue whether a reward payment (報勞金) paid by an employer to an employee constituted wages, the court held it was proper for the court below to determine that the reward payment could not be regarded as wages paid continuously and regularly as consideration for work to the employee, but rather that, since whether it would be paid and the standards for payment, etc., were determined each year through labor-management agreement according to business performance, it did not constitute wages forming the basis for calculating average wages.

[4] The main text of Article 3(1) of the former Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings (Act No. 10303, before its amendment on May 17, 2010; hereinafter referred to as the "former Litigation Promotion Act") provides: "Where a court renders a judgment (including an adjudication; the same shall apply hereinafter) ordering performance of the whole or part of a monetary obligation, the statutory interest rate serving as the standard for calculating the amount of damages arising from nonperformance of the monetary obligation shall, from the day following the date on which the complaint seeking performance of the monetary obligation or a document equivalent thereto is served on the obligor, be the rate determined by Presidential Decree within the scope of 40 percent per annum or less, taking into account economic conditions such as the overdue interest rate applied by financial institutions under the Banking Act." This provision, by delegating to Presidential Decree the determination of the statutory interest rate applicable from the day following the date on which the complaint, etc., is served on the obligor when a judgment ordering performance of a monetary obligation is rendered, is intended to allow the statutory interest rate to be flexibly set in accordance with changes in economic conditions, such as the actual interest rate, so that the obligee may, in principle, be compensated for actual damages from the time litigation is commenced. Meanwhile, a remedial order of the Labor Relations Commission merely imposes on the employer a public-law obligation to comply with the remedial order, and does not directly create or alter the private-law legal relationship between the employee and the employer. Therefore, a remedial order of the Labor Relations Commission is not included in "an adjudication ordering performance of the whole or part of a monetary obligation" as provided in Article 3(1) of the former Litigation Promotion Act.

[5] Where an employer, despite there being no grounds whatsoever for taking an adverse action such as dismissal against an employee, intentionally asserts or fabricates nominal grounds for an adverse action solely with the intent of driving the employee out of the workplace, and thereby takes the adverse action; or where it is objectively clear that the grounds for the adverse action do not fall under the grounds for adverse action prescribed in the rules of employment, etc., or cannot be relied upon as grounds for adverse action, and it is possible to easily recognize such circumstances with a little attention, yet the employer nevertheless proceeds with the adverse action on such grounds—in other words, where it is clear that the adverse action cannot be tolerated under our sound social norms or common sense—such adverse action is not merely rendered invalid as an unlawful act exceeding the bounds of discretion or constituting an abuse of discretion, but also, by unlawfully inflicting mental distress upon the other party, constitutes a tort against the employee.

[6] In a case where an employer issued a first suspension from duty pending further disposition against an employee, then dismissed the employee, and thereafter reinstated the employee and issued a second suspension from duty pending further disposition, followed by an order of mandatory leave of absence during the period of that suspension, the court held it was proper for the court below to determine as follows: the first suspension from duty pending further disposition was legitimate as a personnel order based on the employer's personnel regulations; and even if the dismissal, the second suspension from duty pending further disposition, and the order of mandatory leave of absence during that suspension period were all void, it could not be found that the employer, despite having no grounds whatsoever for taking adverse action against the employee, intentionally took the adverse actions such as the dismissal or suspension solely with intent to harm the employee, or that the employer wrongfully took the adverse actions even though it was clear that no grounds for adverse action existed and such circumstances could have been easily recognized with a little attention; therefore, the dismissal and other adverse actions did not constitute a tort against the employee.

[7] The average wage that serves as the basis for calculating retirement pay refers to the amount obtained by dividing the total amount of wages paid as consideration for work to a retiring employee during the three months preceding the date of retirement by the total number of days in that period. Even if an employee, having worked without absence or having attended work at a rate of 90 percent or more during the year preceding the year of retirement, thereby becoming entitled to annual paid leave under Article 59 of the former Labor Standards Act (Act No. 6974, before its amendment on September 15, 2003), failed to use such leave, thus giving rise to a claim for annual leave allowance for that period, such annual leave allowance is compensation for work performed during the one-year period of the year preceding the year of retirement, not compensation for work performed during the year of retirement. Therefore, where a portion of the one-year period during which the employee worked without absence or attended at a rate of 90 percent or more, which formed the basis of the right to annual leave, falls within the three months preceding the date of retirement, only the annual leave allowance corresponding to that included portion is to be included in the total amount of wages serving as the basis for calculating the average wage.

[Defendant, Appellant and Appellee] Kookmin Bank Co., Ltd. (Attorneys for the defendant, Lee Im-soo and three others)
[Judgment Below] Seoul High Court Decision 2008Na94884 rendered on September 25, 2009

[Order]

All appeals are dismissed. Each party shall bear its own costs of appeal.

[Reasoning]

The grounds of appeal (including the supplementary brief on grounds of appeal submitted after the expiration of the period for submitting the brief on grounds of appeal, to the extent it supplements the grounds of appeal) are examined as follows.

1. As to the Plaintiff's grounds of appeal

A. As to the first ground of appeal

A standby order (待機發令, "daegi baleong") refers to a temporary measure whereby, when it is anticipated that a worker's continued occupation of his or her current position or duties in the future would cause obstacles to business operations, etc., the employer temporarily withholds the assignment of a position from the worker in order to prevent such obstacles, thereby preventing the worker from performing duties. Since this differs in nature from disciplinary action, which is a punitive sanction imposed for the purpose of maintaining corporate order in response to a worker's past misconduct, the legitimacy of a standby order against a worker should be determined based on whether grounds for the standby order exist as to the worker and whether, and to what extent, procedural rules concerning the standby order have been violated (see Supreme Court Decision 95Nu15926 rendered on October 29, 1996; Supreme Court Decision 2005Du14226 rendered on March 9, 2006).

According to the reasoning of the judgment below, the court below, after citing the first instance judgment and finding the facts as stated therein, held that the standby order issued by the Defendant against the Plaintiff on December 27, 2000 (hereinafter referred to as the "first standby order") was a personnel order based on Article 38 of the Defendant's personnel regulations concerning "non-assignment of duties and standby orders," and that its legitimacy should be assessed separately from the disciplinary action, including the disciplinary dismissal (hereinafter referred to as "the instant dismissal") that the Defendant imposed on the Plaintiff on March 31, 2001. On this premise, the court below determined that the first standby order was legitimate based on the circumstances stated in its reasoning.

Examined in light of the legal principles set forth above and the record, this determination by the court below is justified, and there is no error therein, such as a misunderstanding of the legal principles concerning standby orders or a violation of the limits of the principle of free evaluation of evidence, as alleged in the Plaintiff's grounds of appeal.

B. As to the second ground of appeal

If a bonus is paid continuously and regularly and the amount to be paid is fixed, it has the nature of wages paid as consideration for labor; however, if the occurrence of the grounds for payment is uncertain and the payment is made on a one-time basis, it cannot be regarded as wages (see, e.g., Supreme Court Decision 2003Da54322, 54339 rendered on May 26, 2006).

According to the reasoning of the judgment below, the court below determined that there was no evidence to prove that the reward money (報勞金, "borogeum") was continuously and regularly paid to the worker as consideration for labor, and rather, since whether and how it was to be paid, and the standards for payment, etc., were determined each year through labor-management agreement according to business performance, it did not constitute wages forming the basis for calculating average wages.

Examined in light of the legal principles set forth above and the record, this determination by the court below is justified, and there is no error of misunderstanding the legal principles concerning the scope of wages forming the basis for calculating average wages, as alleged in the Plaintiff's grounds of appeal.

C. As to the third ground of appeal

The gist of the Plaintiff's argument in this ground of appeal is that the court below erred in finding that the Plaintiff's use of annual leave was not compelled by the Defendant, contrary to the actual facts. However, this argument ultimately concerns the selection and evaluation of evidence and fact-finding, which fall within the exclusive authority of the court below as the fact-finding court, and thus cannot be regarded as a legitimate ground of appeal.

D. As to the fourth ground of appeal

The main text of Article 3(1) of the former Act on Special Cases Concerning Expedition of Legal Proceedings (소송촉진 등에 관한 특례법) (before its amendment by Act No. 10303 on May 17, 2010; hereinafter referred to as the "former Special Cases Act") provides: "In rendering a judgment (including a decision; the same shall apply hereinafter) ordering the performance of all or part of a monetary obligation, the statutory interest rate that serves as the basis for calculating damages arising from non-performance of the monetary obligation shall, from the day following the date on which the complaint or a document equivalent thereto demanding performance of the monetary obligation is served on the obligor, be governed by an interest rate determined by Presidential Decree, within the range not exceeding 40% per annum, taking into account economic conditions such as the overdue interest rates applied by financial institutions under the Banking Act." This provision, by delegating to Presidential Decree the setting of a statutory interest rate applicable from the day following the date on which the complaint, etc. is served on the obligor when rendering a judgment ordering performance of a monetary obligation, is intended to allow the statutory interest rate to be flexibly set in accordance with changes in economic conditions such as the actual interest rate, so that, in principle, the obligee may recover actual damages from the time the lawsuit is filed.

Meanwhile, a remedial order issued by the Labor Relations Commission merely imposes on the employer a public law obligation to comply with the remedial order, and does not directly create or alter the private law relationship between the worker and the employer (see, e.g., Supreme Court Decision 2010Da21962 rendered on March 24, 2011).

In light of the above legal principles, the judgment below, which determined that the remedial order of the Seoul Regional Labor Relations Commission does not fall within "a decision ordering the performance of all or part of a monetary obligation" under Article 3(1) of the former Special Cases Act, is justified. There is no error therein, such as a misunderstanding of the legal principles concerning Article 3(1) of the former Special Cases Act, as alleged in the Plaintiff's grounds of appeal.

The Supreme Court Decision 91Nu1127 rendered on January 17, 1992, cited by the Plaintiff in the grounds of appeal, concerns a case with different facts from the instant case and is inappropriate to invoke in this case.

E. As to the fifth ground of appeal

Where an employer imposes an adverse measure such as dismissal on a worker even though there is absolutely no ground justifying such an adverse measure, and does so intentionally by asserting or fabricating a nominal ground for the adverse measure solely with the intent of driving the worker out of the workplace; or where it is objectively clear that the ground for the adverse measure does not fall under the grounds for adverse measures prescribed in the rules of employment, etc., or cannot be used as a ground for the adverse measure, and it is easily recognizable as such with only a little attention, yet the employer nevertheless proceeds with the adverse measure on that ground—in such cases, where it is clear that the adverse measure cannot be tolerated under sound social norms or common social standards, the adverse measure is not merely rendered ineffective as an unlawful act exceeding the scope of discretion or abusing discretion, but also constitutes the unlawful infliction of mental suffering on the other party, thereby constituting a tort against the worker.

According to the reasoning of the judgment below, the court below, taking into consideration the circumstances stated in its reasoning, determined that even if the instant dismissal, as well as the standby order issued by the Defendant against the Plaintiff on December 24, 2001, and the ordered leave of absence disposition issued during the period of that standby order on December 26, 2006, were all invalid, the evidence presented by the Plaintiff was insufficient to establish that the Defendant, despite having absolutely no grounds for imposing an adverse measure on the Plaintiff, intentionally imposed adverse measures such as the instant dismissal or the standby order solely with the intent to harm the Plaintiff, or that it was clear that the grounds did not constitute grounds for an adverse measure and that the Defendant, despite being able to easily recognize such circumstances with only a little attention, nevertheless wrongfully imposed the adverse measure; and that there was no other evidence to prove this. Accordingly, the court below rejected the Plaintiff's argument on this point.

Examined in light of the legal principles set forth above and the record of this case, this determination by the court below is justified, and there is no error therein, such as a misunderstanding of the legal principles concerning the requirements for the establishment of a tort, as alleged in the Plaintiff's grounds of appeal.

F. As to the sixth ground of appeal

In cases of partial loss, the litigation costs to be borne by each party may be determined by the court at its discretion after comprehensively considering all relevant circumstances, and need not necessarily be determined solely by the ratio of the amount claimed to the amount awarded (see, e.g., Supreme Court Decision 2005Da38324 rendered on July 12, 2007).

Examined in light of the legal principles set forth above and the record, the court below's order that the Plaintiff bear 90% of the litigation costs of this case is acceptable, and there is no error therein as alleged in the Plaintiff's grounds of appeal.

2. As to the Defendant's grounds of appeal

A. As to the first ground of appeal

According to the reasoning of the judgment below, the court below, after finding the facts as stated in its reasoning, determined that the employee welfare pension (personal pension subsidy) paid by the Defendant, since the Defendant was obligated to pay it under the collective bargaining agreement and it was paid uniformly to workers meeting certain requirements, constitutes wages as consideration for labor, and thus should be included in the average wage forming the basis for calculating the Plaintiff's interim retirement allowance.

Examined in light of the record, the fact-finding and determination by the court below as described above are justified, and there is no error therein, such as violating the rules of logic and experience, exceeding the limits of the principle of free evaluation of evidence, mistakenly finding facts, or misunderstanding the legal principles concerning wages subject to the calculation of average wages, as alleged by the Defendant in the grounds of appeal.

B. As to the second ground of appeal

The average wage that serves as the basis for calculating retirement allowances refers to the amount obtained by dividing the total amount of wages paid as consideration for labor to a retiring worker during the three months preceding the date of retirement by the total number of days in that period. Even where a worker who has worked without absence or has attended at least 90% of the time during the year preceding the year of retirement, and thus was entitled to receive annual paid leave under Article 59 of the former Labor Standards Act (근로기준법) (before its amendment by Act No. 6974 on September 15, 2003), fails to use such leave, giving rise to a claim for annual leave allowance for that period, such annual leave allowance is consideration for labor performed during the one year preceding the year of retirement, not for labor performed during the year of retirement itself. Accordingly, where part of the one-year period of full attendance or attendance of at least 90%, which forms the basis of the right to annual leave, falls within the three months preceding the date of retirement, only the portion of the annual leave allowance corresponding to that included part is included in the total amount of wages that serves as the basis for calculating average wages (see, e.g., Supreme Court Decision 95Da32631 rendered on December 23, 1996).

According to the record, in calculating the interim retirement allowance, the Defendant included in the average wage forming its basis the annual leave allowance paid to the Plaintiff on December 21, 2000, which was consideration for labor performed in the year 2000; however, it can also be seen that around December 2001, the Defendant paid the Plaintiff an annual leave allowance, as consideration for labor performed in 2001, in an amount equal to or greater than that paid on December 21, 2000.

Examining these facts in light of the legal principles set forth above, although the portion of the annual leave allowance paid to the Plaintiff on December 21, 2000 corresponding to the three-month period cannot be included in the total wage amount that serves as the basis for calculating average wages, the portion of the annual leave allowance paid to the Plaintiff around December 2001 corresponding to the three months preceding the date of retirement should be included therein. Accordingly, the court below's determination, in the same vein, that the average monthly wage as of October 31, 2001, including the personal pension subsidy, was 4,359,048 won, is justified in its conclusion, and there is no error therein that affected the outcome of the judgment. The Defendant's argument in its grounds of appeal that the annual leave allowance cannot be included in the average wage as the basis for calculating the Plaintiff's interim retirement allowance is without merit.

3. Conclusion

Therefore, all appeals are dismissed, and each party is ordered to bear its own costs of appeal. This judgment is rendered as stated in the Order, in accordance with the unanimous opinion of the participating Justices.
