A campus security guard (수위) working at a private university, classified as an administrative staff member, was found to be covered by the Labor Standards Act (근로기준법). Although he worked under a comprehensive wage system (포괄임금제) covering an alternating-day shift schedule, the Supreme Court held that he was still entitled to claim overtime pay (시간외 근로수당) for hours worked beyond the statutory 44-hour workweek.

Key takeaways
  • CaseA university security guard working alternating-day shifts sought overtime pay for hours worked beyond the 44-hour statutory workweek.
  • OutcomeThe Court ruled that even under a comprehensive wage system (포괄임금제), employers must pay separate overtime compensation for hours exceeding 44 hours per week, and that standard wage regulations apply equally to alternating-day shift workers.
  • LessonNeither a comprehensive wage system nor unconventional shift arrangements (such as alternating-day shifts) exempt employers from the obligation to pay statutory overtime, so accurate time tracking and wage calculation remain essential.
Issues
  • Whether the Labor Standards Act (근로기준법) applies to administrative staff employed by a private school
  • Whether a comprehensive wage system (포괄임금제) contract is valid under Korean labor law
  • Whether employers must pay overtime compensation for work exceeding the statutory 44-hour workweek
  • Whether overtime, night, and holiday pay rules apply to employees working alternating-day (격일제) shifts
Key reasoning

The Court reasoned that administrative staff at private schools are engaged under private employment contracts and therefore fall within the scope of the Labor Standards Act. Even where a comprehensive wage system (포괄임금제)—a lump-sum wage arrangement intended to cover overtime, night, and holiday pay in advance—is validly adopted, employers must still pay additional overtime compensation for work exceeding the statutory 44-hour weekly limit if actual hours surpass what the lump sum accounts for. The Court further clarified that provisions on overtime, night, and holiday pay (시간외·야간·휴일근로수당) apply equally to employees working alternating-day (격일제) shift patterns, just as they would to employees on standard schedules. Thus, unusual shift arrangements do not exempt employers from statutory wage obligations.

Summary of Decision (English, AI translation)

[1] The Private School Act (사립학교법) merely provides that matters concerning the appointment and dismissal, remuneration, service, and status guarantee of administrative staff of private schools shall be determined by the articles of incorporation of the school foundation, without prescribing the specific contents thereof, and the employment relationship of such staff is essentially a private-law employment contract relationship. Therefore, among matters concerning working conditions such as remuneration and service of administrative staff of private schools, matters other than those concerning retirement benefits, etc. as provided in the Private School Teachers' Pension Act (사립학교교원연금법) are subject to the Labor Standards Act (근로기준법).

[2] Under Articles 22 and 46 through 48, etc. of the former Labor Standards Act (근로기준법) (before amendment by Act No. 5245 of December 31, 1996), when an employer enters into an employment contract, it is in principle required to determine a basic wage for the employee and to add and pay various allowances calculated on the basis thereof. However, in consideration of working hours, the form of work, and the nature of duties, where a wage payment contract of the so-called comprehensive (lump-sum) wage system is concluded with the consent of the employee, under which the basic wage is not calculated in advance but a monthly salary or daily wage combining various allowances is fixed, or a fixed amount is paid each month as various allowances, such a contract cannot be deemed invalid if it causes no disadvantage to the employee and is found to be justifiable in light of all the circumstances. (Case holding that, in view of the specific circumstances, the form of wage payment for a university security guard did not constitute a comprehensive wage system.)

[3] Under Article 42(1) of the former Labor Standards Act (근로기준법) (before amendment by Act No. 5245 of December 31, 1996), working hours, excluding rest periods, shall not exceed 8 hours per day and 44 hours per week, provided that overtime work of up to 12 hours per week may be performed by agreement between the parties; and under Article 46, an employer shall pay an additional 50% of the ordinary wage for hours worked in excess pursuant to Article 42. Therefore, the argument that overtime work within the scope of 56 hours per week does not constitute extended work requiring the payment of additional wages is an interpretation that directly contravenes the above statutory provisions and is unreasonable.

[4] Article 42(1) of the same Act, which provides that working hours, excluding rest periods, shall not exceed 8 hours per day, Article 45 of the same Act, which provides that an employer shall grant employees at least one paid holiday per week on average, and Article 46 of the same Act, which provides that the period from 10:00 p.m. to 6:00 a.m. constitutes night work, are not limited to cases where work is provided continuously every day, but also apply to so-called shift work performed on an alternating-day basis of 24 hours per shift. Therefore, the argument that, in the case of alternating-day shift work, the number of hours of overtime work or night work should be calculated by dividing it in half, or that there is no need to separately pay holiday work allowance even where a holiday falls on a working day, is without merit.

[Plaintiff, Appellee]

[Defendant, Appellant] Hanyang Educational Foundation, School Juridical Person (Defendant's Attorney: Kim Hyun-chae)

[Judgment Below] Seoul High Court Judgment 96Na725, rendered on July 26, 1996

[Order]

The appeal is dismissed. The costs of the appeal shall be borne by the Defendant.

[Reasoning]

The grounds of appeal are examined.

1. As to whether there was an agreement not to bring suit
According to the reasoning of the judgment below, the court below rejected the Defendant's assertion that, when the Defendant, on May 20, 1994, agreed to pay unpaid allowances for the period from June 1991 to May 1994 to the Plaintiffs and other security guards, the Plaintiffs agreed not to file any lawsuit regarding this matter in the future, on the ground that, upon examination of the relevant evidence, it was insufficient to find that the Plaintiffs made such an agreement, and there was no other evidence to prove this. Upon examination of the record, the above finding of the court below is justified, and there is no error of law such as misapprehension of facts or insufficient deliberation as argued. This ground of appeal is without merit.

2. As to whether the Labor Standards Act (근로기준법) applies to administrative staff of private schools
The principle that special law takes precedence over general law applies to cases where statutes of the same formal type conflict with or contradict each other, and whether statutes are mutually contradictory must be determined by comprehensively examining the legislative purpose, matters regulated, and scope of application of each statute (see this Court's Decision 89Daka24780, rendered on March 13, 1990). The Private School Act (사립학교법) (Act No. 4376, May 31, 1991, hereinafter the same) is intended to secure the autonomy and enhance the public nature of private schools in light of their special characteristics, thereby promoting the sound development of private schools (Article 1 of the said Act), and specifically regulates matters concerning the appointment and dismissal, qualifications, service, status guarantee, and disciplinary action of private school teachers (Chapter 4 of the said Act). The Private School Teachers' Pension Act (사립학교교원연금법) (Act No. 4455, December 27, 1991, hereinafter the same) is intended to contribute to the economic stability and welfare improvement of private school faculty and staff (teachers and administrative staff appointed under the Private School Act) and their bereaved families (Article 1 of the said Act), and requires appropriate benefits to be paid for the retirement, death, and occupational illness, injury, or disability of faculty and staff (Article 33 of the said Act), and requires the relevant provisions of the Public Officials Pension Act (공무원연금법) to be applied mutatis mutandis with respect to the types of benefits, grounds for benefits, amount of benefits, and restrictions on benefits (Article 42 of the Private School Teachers' Pension Act). Therefore, the Labor Standards Act does not apply to the above matters. However, with respect to the appointment and dismissal, remuneration, service, and status guarantee of administrative staff of private schools, the Private School Act merely provides that these matters shall be determined by the articles of incorporation of the school juridical person, without prescribing the specific contents thereof (Article 70-2, Paragraph 1 of the said Act), and since the employment relationship is essentially a private-law employment contract relationship, matters concerning working conditions such as remuneration and service of administrative staff of private schools, excluding benefits upon retirement and the like as provided for in the Private School Teachers' Pension Act, shall be subject to the Labor Standards Act.

Moreover, even if the articles of incorporation or the faculty and staff service regulations of a school juridical person were enacted based on the Private School Act, it cannot be said that their contents necessarily encompass all the various provisions of the Labor Standards Act. Accordingly, whether the Defendant Foundation's articles of incorporation or faculty and staff service regulations actually encompass the various provisions of the Labor Standards Act can only be determined by applying the Labor Standards Act, and therefore this argument cannot be accepted either.

Although the judgment of the court of first instance, as cited by the court below, is somewhat insufficient in its reasoning on this point, its conclusion—that the Labor Standards Act should apply to matters concerning the remuneration and other working conditions of administrative staff of private schools, which are not matters concerning benefits as prescribed by the Private School Teachers' Pension Act—is correct, and there is no error of law such as misunderstanding of the Defendant's factual assertions, misapprehension of the applicable law, misapprehension of facts, or insufficient deliberation as argued. This ground of appeal is without merit.

3. As to the comprehensive (lump-sum) wage system
According to Articles 22 and 46 through 48, etc. of the former Labor Standards Act (before amendment by Act No. 5245, December 31, 1996), in principle, when an employer concludes an employment contract, the employer must determine the basic wage for the employee and add various allowances thereto based on this basic wage, and pay the sum thereof. However, in cases where, taking into account working hours, forms of work, and the nature of duties, a wage payment contract is concluded with the consent of the employee under a so-called comprehensive wage system, whereby a fixed amount combining various allowances is set as the monthly salary or daily wage without calculating the basic wage in advance, or a fixed amount is paid each month as various allowances, such a contract cannot be deemed invalid if it is not disadvantageous to the employee and is recognized as justifiable in light of all the circumstances (see this Court's Decisions 80Da2384, rendered on March 9, 1982; 83Do1050, rendered on October 25, 1983; 89Daka32118, rendered on April 23, 1991; 94Da54542, rendered on July 28, 1995, etc.).

According to the record, the Plaintiffs, as security guards at ○○ University under the Defendant Foundation, were mainly in charge of security duties, such as regularly patrolling and inspecting their assigned areas, including the interior of buildings, and controlling persons entering and leaving and goods being brought in and out (Articles 7 and 9 of the Work Rules), and worked either day shifts of 10 hours per day or alternating shifts of 24 hours every other day. Given the nature of their duties and form of work, overtime, night, and holiday work could be expected. However, according to the salary regulations based on the Defendant Foundation's articles of incorporation and personnel rules, the salary of faculty and staff is to be paid as a basic salary amount plus various allowances (Article 6), and according to the collective agreement and the faculty and staff service regulations, the working hours of faculty and staff are set from 09:00 to 18:00 from April to October, and from 09:00 to 17:00 from November to March of the following year, with Saturdays set from 09:00 to 13:00 (Article 19 of the 1991 Collective Agreement, Article 15 of the Faculty and Staff Service Regulations), and Sundays and various other public holidays are designated as holidays (Article 16 of the Faculty and Staff Service Regulations), and it is provided that when work is performed beyond the working hours prescribed by the Labor Standards Act, overtime, night, and holiday work allowances shall be paid (Article 20 of the 1991 Collective Agreement). Thus, it can be seen that, under the Defendant Foundation's collective agreement, faculty and staff service regulations, and salary regulations, the payment of salary to staff is not provided to be made under the so-called comprehensive wage system. Furthermore, Plaintiff 1 joined ○○ University under the Defendant as a security guard on November 20, 1973, and Plaintiff 2 joined on December 1, 1976. According to the record (the examination record of witness Nonoutside Person), up until 1980, the number of security guards at ○○ University under the Defendant Foundation was about 78, and in the case of night duty, the first shift worked from 18:00 to 24:00 and the second shift from 00:00 to 08:00 on a rotating basis, while day shift workers worked 10 hours from 08:00 to 18:00, with day and night shifts alternating. However, after 1980, as the number of security guards was reduced to 49 in total, the guards came to work 24-hour shifts every other day, as noted above. If, as such, the working hours increased compared to when the original employment contract was concluded, and the working conditions were thus changed disadvantageously in the interim, it cannot be said that the Plaintiffs concluded an employment contract with the Defendant Foundation to receive only a fixed amount encompassing wages for working hours that would increase in the future. Nor can it be said that the Plaintiffs unconditionally consented to the working conditions that were changed disadvantageously in the interim.

In conclusion, since the Plaintiffs' employment contracts in this case are not recognized as falling under the comprehensive wage system, the judgment of the court of first instance, as cited by the court below, which reached the same conclusion, is correct, and there is no error of law such as misapprehension of facts due to violation of the rules of evidence or insufficient deliberation as argued. This ground of appeal is also without merit.

4. As to the flexible work system and shift work system
The finding of the judgment of the court of first instance, as cited by the court below, that the Plaintiffs' actual daily working hours were 9 hours for day shifts and 18 hours for 24-hour alternating shifts, is correct, and there is no error of law such as misapprehension of facts or insufficient deliberation as argued.

Moreover, according to Article 42, Paragraph 1 of the former Labor Standards Act (before amendment by Act No. 5245, December 31, 1996), which was in effect during the period from 1991 to 1994 when the Plaintiffs worked, working hours, excluding rest periods, shall not exceed 8 hours per day and 44 hours per week, provided that overtime work may be performed up to 12 hours per week by agreement between the parties, and according to Article 46, an employer shall pay an additional 50% of the ordinary wage for work performed during the hours extended pursuant to Article 42. Therefore, the assertion that overtime work does not occur within the range of 56 hours per week, and thus there is no need to pay additional wages, is an unjustified interpretation that directly contradicts the above statutory provisions. The precedent of this Court cited in the argument was rendered before the Labor Standards Act was amended as above, and is not appropriate to be invoked in this case.

Furthermore, Article 42, Paragraph 1 of the said Act, which provides that working hours, excluding rest periods, shall not exceed 8 hours per day, Article 45, which provides that an employer shall grant employees at least one paid holiday per week on average, and Article 46, which provides that the hours from 10:00 p.m. to 6:00 a.m. constitute night work, are not limited to cases where work is provided continuously every day, but also apply to so-called shift work, such as the 24-hour alternating shift work performed by the Plaintiffs and others (see this Court's Decision 90Daka11636, rendered on July 26, 1991). Therefore, the argument that, in the case of alternating shift work, the number of overtime hours or night work hours should be calculated by dividing them in half, or that even if a holiday coincides with a working day, there is no need to separately pay holiday work allowance, cannot be accepted.

Accordingly, the conclusion of the judgment of the court of first instance, as cited by the court below, which rejected the Defendant's above assertion, is also correct, and there is no error of law such as misapprehension of facts due to violation of the rules of evidence or insufficient deliberation as argued. This ground of appeal is likewise without merit.

5. As to the agreement regarding unpaid allowances
Since a worker's wage claim is strongly protected under the Labor Standards Act, any expression of intent that may be disadvantageous to the worker with respect to a wage claim must be strictly construed. Upon a thorough examination of the record, including the circumstances under which the Defendant, on May 20, 1994, agreed to pay overtime, night, and holiday work allowances for 36 months from June 1991 to May 1994 to the Plaintiffs and other security guards, the process by which the final amount to be paid was determined, and the contents of the receipts written and given by the Plaintiffs upon receiving the amount paid by the Defendant on May 27, 1994, it is not recognized that the Plaintiffs agreed that the amount paid by the Defendant was the proper amount that the Plaintiffs were entitled to receive and that there was no further amount to be paid, or that the Plaintiffs agreed to receive only the amount paid by the Defendant and to waive the remainder.

There is no error of law such as misapprehension of facts or insufficient deliberation, as argued, in the judgment of the court of first instance as cited by the court below. This ground of appeal is also without merit.

6. Therefore, the appeal is dismissed, and the costs of the appeal are to be borne by the losing party. It is so decided by the unanimous opinion of the Justices involved, as stated in the Order.

Justice Jeong Gwi-ho (Presiding Justice), Choi Jong-yeong, Lee Don-hee, Lee Im-su (Justice in charge)
