Even when an agreement to reduce a taxi driver's statutory working hours (소정근로시간) is invalidated, the previous deemed working hours (간주근로시간) agreement does not automatically apply; instead, the actual working hours must be proven by the worker. For workers on an alternate-day shift system, weekly holiday allowance (주휴수당) must be calculated based on the average daily statutory working hours, adjusted to a five-day standard if the actual statutory working days per week are fewer than five. Diligence allowances (성실수당) paid for statutory work are considered part of wages counted toward the minimum wage (최저임금).

Key takeaways
  • CaseA taxi company argued that since the agreement to reduce working hours was invalid, the previous deemed working hours agreement should apply for calculating wages.
  • OutcomeThe Supreme Court ruled that even if the reduction agreement is invalid, the previous deemed working hours agreement does not automatically apply, and weekly holiday allowance for alternate-day shift workers must be calculated using a special method.
  • LessonWhen a working hours agreement is invalidated, actual working hours must be newly proven, and employers/workers should be aware that alternate-day shift workers are subject to a special weekly holiday allowance calculation method.
Issues
  • Whether the previous deemed working hours agreement remains effective when the agreement to reduce statutory working hours is invalidated
  • Who bears the burden of proving actual overtime hours worked
  • How to calculate paid weekly holiday hours for workers on an alternate-day shift system
  • Whether diligence allowances paid to taxi drivers count as wages includable in the minimum wage calculation
Key reasoning

Even if an agreement to shorten statutory working hours is void as an unlawful evasion of legal obligations, this does not mean the previous deemed working hours agreement automatically revives or applies. Where no valid deemed working hours agreement exists, the burden falls on the worker to prove the actual extended working hours worked. For workers operating under an alternate-day shift system, a special calculation method must be applied to determine the paid weekly holiday allowance, taking into account the average daily statutory working hours and adjusting for weeks with fewer than five statutory working days.

Summary of Decision (English, AI translation)

[1] If labor and management agreed to deem a certain period of time as overtime work hours regardless of the actual overtime work hours, taking into account the characteristics of the work form or working environment, it is not permissible for the employer to dispute the working hours on the ground that the employee's actual overtime work hours fall short of the agreed hours. However, in the absence of such an agreement, the employer is obligated to pay overtime allowance only for the actual overtime work hours, absent other special circumstances, and in such a case, the actual overtime work hours must be proven by the employee claiming payment of overtime allowance. The same applies to night work hours that overlap with overtime work hours.

[2] Where an employee and an employer agreed, in a previous collective bargaining agreement, in addition to agreeing on the prescribed working hours (소정근로시간), to deem a certain period of time as overtime work hours regardless of the actual overtime work hours (hereinafter referred to as the "deemed working hours agreement"), but thereafter agreed, through a newly concluded collective bargaining agreement, to shorten the prescribed working hours without making any agreement on overtime work hours, even if the agreement to shorten the prescribed working hours constitutes, and is void as, an unlawful act aimed at evading the application of Article 6(5) of the Minimum Wage Act (최저임금법), as amended by Act No. 8964 on March 21, 2008 (hereinafter referred to as the "special provision"), such circumstance alone does not mean that the deemed working hours agreement under the previous collective bargaining agreement continues to apply as is. The reasons are as follows.

① Wages included in the minimum wage for taxi driving employees do not include wages paid for anything other than the prescribed working hours or prescribed working days (Article 6(5) of the Minimum Wage Act; Item 1 of the proviso to Article 5-2 of the former Enforcement Decree of the Minimum Wage Act (최저임금법 시행령) (before amendment by Presidential Decree No. 29469 on December 31, 2018) (the same applies under Article 5-3, Item 1 of the current Enforcement Decree of the Minimum Wage Act)). Here, "prescribed working hours" means the working hours determined by the employee and the employer within the scope of 40 hours per week and 8 hours per day (Article 2(1), Item 8, and Article 50 of the Labor Standards Act (근로기준법)). Considering the content and purport of these Minimum Wage Act provisions, where the weekly working hours determined by the employee and the employer exceed 40 hours, or the daily working hours exceed 8 hours, the excess portion, i.e., the overtime work hours, is not included, absent other special circumstances, in the hours for which wages equal to or exceeding the minimum wage amount must be paid (hereinafter referred to as "hours subject to minimum wage payment"). This applies equally to the alternate-day work form in which an employee works one day and rests the following day.

② The purport of the special provision is to raise the ordinary and basic fixed wage paid in correspondence with the prescribed working hours, which the employee has agreed to work, to a level at or above the minimum wage. Furthermore, Article 6(3) of the Minimum Wage Act provides that "any portion of a labor contract between an employee subject to the minimum wage and an employer, which sets an amount as wages that is less than the minimum wage amount, shall be void, and in such case, the void portion shall be deemed to have agreed to pay wages equal to the minimum wage amount set by this Act." Even if the agreement to shorten the prescribed working hours is void as an unlawful act aimed at evading the application of the special provision, etc., the portion rendered void under Article 6(3) of the Minimum Wage Act is limited to the portion concerning the prescribed working hours, etc., which are hours subject to minimum wage payment. Even if labor and management did not maintain the deemed working hours agreement of the previous collective bargaining agreement with respect to overtime work hours, which are not hours subject to minimum wage payment, it is difficult to view this, absent other special circumstances, as an unlawful act evading the special provision, etc., and it cannot be said that the deemed working hours agreement of the previous collective bargaining agreement continues to apply as is.

[3] Article 55(1) of the Labor Standards Act provides that "the employer shall guarantee the employee at least one paid holiday per week on average." This provision applies not only where the employee provides labor every day, but also where the employee works in a shift system or in an alternate-day work form.

[4] The weekly holiday allowance paid pursuant to Article 55(1) of the Labor Standards Act and Article 30(1) of the Enforcement Decree of the Labor Standards Act (근로기준법 시행령) is wages paid in accordance with the provision of prescribed labor, and is paid on the premise that the employee is deemed to have worked even if the employee did not actually work on the weekly holiday. In light of the nature and purport of such weekly holiday allowance, the number of hours serving as the standard for payment of the weekly holiday allowance should, in principle, absent special circumstances, be the average daily prescribed working hours (the value obtained by dividing the weekly prescribed working hours by the weekly prescribed working days).

However, since the weekly holiday allowance is wages paid to an employee who has worked without absence on the prescribed working days during one week (Article 30(1) of the Enforcement Decree of the Labor Standards Act), it is also necessary to consider differences such as the number of prescribed working days per week. If the above principal method of calculation is applied as is to employees whose average daily prescribed working hours are the same but whose weekly prescribed working hours differ due to differences in the number of prescribed working days per week, an unreasonable result occurs whereby an employee whose weekly prescribed working days number fewer than 5 receives the same weekly holiday allowance as an employee whose weekly prescribed working days number 5 or more, even though the former's weekly prescribed working hours are fewer. Therefore, where the employee and the employer have agreed only on the prescribed working hours, it is reasonable, for an employee whose weekly prescribed working days fall short of 5 days, to deem the weekly prescribed working days as 5 days and to calculate by dividing the weekly prescribed working hours by 5 days.

[5] In a case where the issue was whether certain allowances were included in the minimum wage of taxi driving employees, in a case where Eul et al., who were employed by Gap general partnership company engaged in the general taxi transportation business and worked in an alternate-day work form, were paid Diligence Allowance I when they worked all 13 days per month (12 days in February) designated as full attendance days under the wage agreement, and were paid Diligence Allowance II and Production Allowance when they worked 10 days: the Supreme Court held that there was room to view the monthly full attendance days set forth in the wage agreement as also constituting monthly prescribed working days, and since the number of working days that formed the condition for payment of Diligence Allowance I, Diligence Allowance II, and Production Allowance was within the monthly prescribed working days, these allowances constituted wages paid at least once a month for prescribed labor and thus fell within the wages included in the minimum wage of taxi driving employees; the Supreme Court held that the court below erred in its misapprehension of the legal principles by holding otherwise.

[Judgment Below] Busan High Court Judgment (Changwon) 2021Na13205 decided October 13, 2022

[Order]

The part of the judgment below against the Defendant is reversed, and this part of the case is remanded to the Busan High Court.

[Reasoning]

The grounds of appeal are examined.

1. Outline of the case

According to the reasoning of the judgment below and the record, the following facts can be known.

A. The Defendant is a general partnership company operating a general taxi transportation business, and the Plaintiffs are workers employed by the Defendant who worked on an alternating-day (24-hour on, 24-hour off) basis.

B. Article 6(5) of the Minimum Wage Act (최저임금법), as amended by Act No. 8964 on March 21, 2008 (hereinafter "the special provision at issue"), came into effect from July 1, 2010 in the Jinju-si area where the Defendant is located, excluding "wages based on production output" from the scope of wages included in the minimum wage.

C. In the 2009 wage agreement concluded between the Defendant and the Gyeongnam ○○ Branch of the National Democratic Taxi Workers' Union Federation (hereinafter "the Branch"), the daily working hours were set at a total of 12 hours, consisting of 8 hours of basic work plus "4 hours of extended work, including 1 hour of night work" (hereinafter, only the portion concerning extended work and night work is referred to as "the agreement on prescribed working hours at issue").

D. The Defendant, in concluding respective wage agreements with the Branch in 2010, 2015, and 2018, agreed to sequentially shorten the daily prescribed working hours to 4 hours, 3 hours 30 minutes, and 2 hours, respectively (hereinafter "the agreement to shorten prescribed working hours at issue").

E. The 2010 wage agreement provides that the existing extended work allowance and night work allowance would be renamed and paid as Driving Allowance I, which is included in the minimum wage.

2. As to the first ground of appeal

The court below determined, for the reasons stated in its judgment, that the agreement to shorten prescribed working hours at issue constitutes an unlawful act aimed at circumventing the application of the special provision at issue, which is a mandatory statutory provision, and is therefore void, and accordingly that the Plaintiffs' prescribed working hours were the 8 hours of basic work among the 12 hours of daily working hours set forth in the 2009 wage agreement.

Examining the reasoning of the judgment below in light of the relevant legal principles and the record, there is no error in the judgment below, as alleged in the grounds of appeal, in misapprehending the legal principles concerning the effect of an agreement to shorten prescribed working hours, or in exceeding the bounds of the principle of free evaluation of evidence in violation of the rules of logic and experience, thereby affecting the conclusion of the judgment.

3. As to the second ground of appeal

A. Judgment of the court below

The court below determined that, since the Defendant paid the Plaintiffs Driving Allowance I, and this was merely a renaming of the existing extended work allowance and night work allowance, the Plaintiffs performed 4 hours (it appears that "3 hours" in footnote 7 of the judgment below is a clerical error for "4 hours") of extended work exceeding the 8-hour prescribed working hours on each working day, including 1 hour of night work therein, and accordingly that the Defendant was obligated to pay extended work allowance and night work allowance calculated on the basis of such hours.

B. Judgment of the Supreme Court

1) A) Where labor and management have agreed, in consideration of the nature of the work pattern or working environment, to deem a certain number of hours as extended working hours regardless of the actual extended working hours (hereinafter "deemed working hours agreement"), it is not permissible for the employer to dispute the working hours on the ground that the worker's actual extended working hours fall short of the agreed hours (see Supreme Court Decision 2006Da81523 decided November 29, 2007). However, where there is no such agreement, the employer is obligated, absent other special circumstances, to pay extended work allowance only for the actual extended working hours, and in such a case, the actual extended working hours must be proven by the worker claiming payment of the extended work allowance. The same applies to night working hours that overlap with extended working hours.

B) Where a worker and an employer, in a prior collective agreement, in addition to agreeing on prescribed working hours, also entered into a deemed working hours agreement, but subsequently, through a newly concluded collective agreement, agreed to shorten the prescribed working hours without stipulating anything regarding extended working hours, even if the agreement to shorten the prescribed working hours constitutes an unlawful act aimed at circumventing the application of the special provision at issue and is therefore void, it does not follow, merely from that circumstance, that the deemed working hours agreement under the prior collective agreement continues to apply as is. The reasons are as follows.

(1) Wages included in the minimum wage of a taxi-driving worker (hereinafter "wages subject to comparison") do not include wages other than those paid for the prescribed working hours or prescribed working days [Article 6(5) of the Minimum Wage Act, Article 5-2, proviso, item 1 of the former Enforcement Decree of the Minimum Wage Act (before amendment by Presidential Decree No. 29469 on December 31, 2018; hereinafter "the former Enforcement Decree of the Minimum Wage Act") (the same applies under Article 5-3, item 1 of the current Enforcement Decree of the Minimum Wage Act)]. Here, "prescribed working hours" means the working hours determined by the worker and the employer within the scope of 40 hours per week and 8 hours per day (Article 2(1)8 and Article 50 of the Labor Standards Act (근로기준법)). Considering the content and purport of these provisions of the minimum wage statutes, where the weekly working hours determined by the worker and the employer exceed 40 hours or the daily working hours exceed 8 hours, the excess portion, i.e., the extended working hours, is not included, absent other special circumstances, in the hours for which wages equal to or exceeding the minimum wage must be paid (hereinafter "hours subject to minimum wage payment") (see Supreme Court Decision 2023Da223744, 223751 decided July 25, 2024). This also applies to the alternating-day work pattern of working one day and resting the next.

(2) The purpose of the special provision at issue is to raise the ordinary and basic fixed wage paid in correspondence with the prescribed working hours agreed to be worked, to a level at or above the minimum wage (see Supreme Court en banc Decision 2016Da2451 decided April 18, 2019). Furthermore, Article 6(3) of the Minimum Wage Act provides that "any portion of a labor contract between a worker and an employer subject to the minimum wage that sets wages below the minimum wage amount shall be void, and in such a case, the void portion shall be deemed to have provided for wages equal to the minimum wage amount prescribed by this Act." Even if the agreement to shorten the prescribed working hours is void as an unlawful act aimed at circumventing the application of the special provision at issue, the portion rendered void under Article 6(3) of the Minimum Wage Act is limited to the portion concerning the prescribed working hours, etc., which constitute the hours subject to minimum wage payment. Even if labor and management did not maintain the deemed working hours agreement under the prior collective agreement with respect to extended working hours, which are not hours subject to minimum wage payment, it is difficult to regard this, absent other special circumstances, as an unlawful act circumventing the special provision at issue, and it cannot be said that the deemed working hours agreement under the prior collective agreement continues to apply as is.

2) Examining the following circumstances, which can be known from the reasoning of the judgment below and the record, in light of the legal principles set forth above, it is difficult to conclude, based solely on the circumstances under which the Defendant came to pay Driving Allowance I, that it has been proven that the Plaintiffs performed 4 hours of extended work, including 1 hour of night work therein, on each working day; rather, there is substantial room to view that the Defendant paid the Plaintiffs Driving Allowance I not as extended work allowance or night work allowance, but as wages for the prescribed working hours.

A) The agreement on prescribed working hours at issue in the 2009 wage agreement may be viewed as an agreement deeming that, in addition to the 8 hours of basic working hours per day, 4 hours of extended work, including 1 hour of night work, were performed. The Defendant, in the respective wage agreements of 2010, 2015, and 2018, agreed only on the shortening of the prescribed working hours, and did not stipulate anything regarding extended working hours or night working hours. Although the agreement to shorten the prescribed working hours at issue is void, it does not follow, merely from that circumstance, that the agreement on prescribed working hours at issue concerning the portion exceeding the basic working hours continues to apply as is; rather, it should be considered that no deemed working hours agreement existed after 2010, and therefore the Plaintiffs, who claim extended work allowance and night work allowance, must prove the actual extended working hours and night working hours.

B) The 2010 wage agreement provides that the existing extended work allowance and night work allowance would be renamed and paid as Driving Allowance I, while also expressly stating that Driving Allowance I is included in the minimum wage. Since the 2010 wage agreement, the Defendant paid workers Driving Allowance I as a fixed amount of KRW 9,100 per working day, regardless of the fluctuation in the amount of ordinary wages resulting from the agreement to shorten the prescribed working hours at issue. The Plaintiffs, too, claim the shortfall in minimum wage on the premise that Driving Allowance I is included in the wages subject to comparison, which are included in the minimum wage.

3) Nevertheless, the court below, based on the circumstances under which Driving Allowance I came to be paid, found that the Plaintiffs performed 4 hours of extended work per day, including 1 hour of night work therein, and determined that the Defendant was obligated to pay such allowances. Such determination by the court below is erroneous, having affected the conclusion of the judgment, in that it misapprehended the legal principles concerning the effect of a deemed working hours agreement and the burden of proof in claims for extended work allowance, etc., and, without conducting the necessary examination, exceeded the bounds of the principle of free evaluation of evidence in violation of the rules of logic and experience. The ground of appeal pointing this out has merit.

4. As to part of the fourth ground of appeal

A. Regarding the average number of weekly holidays per month

Article 55(1) of the Labor Standards Act (근로기준법) provides that "an employer shall guarantee a worker at least one paid holiday per week on average." This provision applies not only where a worker provides labor every day, but also where the worker works in a shift or alternating-day work pattern (see Supreme Court Decision 96Da38995 decided July 22, 1997).

The court below determined, for the reasons stated in its judgment, that the average number of weekly holidays per month for the Plaintiffs, who worked on an alternating-day basis, was 4.34 days (= 365 days ÷ 7 days ÷ 12 months, with figures below the third decimal place discarded; the same applies hereinafter).

Examining the reasoning of the judgment below in light of the legal principles set forth above, there is no error in the judgment below, as alleged in the grounds of appeal, in misapprehending the legal principles concerning the method of calculating the average number of weekly holidays per month.

B. Regarding paid weekly holiday hours

1) The weekly holiday allowance paid pursuant to Article 55(1) of the Labor Standards Act and Article 30(1) of the Enforcement Decree of the Labor Standards Act (근로기준법 시행령) is wages paid in return for the provision of prescribed labor (see Supreme Court Decision 2021Da246545 decided July 24, 2024), and is paid by deeming the worker to have worked even if the worker did not actually work on the weekly holiday (see Supreme Court Decision 2009Da74144 decided January 28, 2010). In light of the nature and purpose of such weekly holiday allowance, the number of hours serving as the basis for payment of the weekly holiday allowance (hereinafter "paid weekly holiday hours") should, in principle, absent special circumstances, be the average daily prescribed working hours (the value obtained by dividing the weekly prescribed working hours by the weekly prescribed working days).

However, since the weekly holiday allowance is wages paid to a worker who has worked full attendance on the prescribed working days for one week (Article 30(1) of the Enforcement Decree of the Labor Standards Act), it is also necessary to consider differences such as the number of prescribed working days per week. If the above principal method of calculation is applied as is to workers who have the same average daily prescribed working hours but differing weekly prescribed working hours due to different numbers of weekly prescribed working days, an unreasonable result arises whereby a worker with fewer than 5 prescribed working days per week receives the same weekly holiday allowance as a worker with 5 or more prescribed working days per week, despite having fewer weekly prescribed working hours. Therefore, where the worker and the employer have agreed only on the prescribed working hours, it is appropriate, for a worker whose weekly prescribed working days are fewer than 5, to deem the weekly prescribed working days to be 5, and to calculate by dividing the weekly prescribed working hours by 5 days.

2) According to the reasoning of the judgment below and the record, the Plaintiffs worked on an alternating-day basis, the 2009 wage agreement set the full attendance days at 13 days per month (12 days in February), and the daily prescribed working hours under the 2009 wage agreement were 8 hours; and, as noted above, the agreement on prescribed working hours at issue no longer applies.

Examining the above factual relationship in light of the legal principles set forth above: there is room to view the monthly full attendance days under the 2009 wage agreement as also constituting monthly prescribed working days, in which case the Plaintiffs' average weekly prescribed working hours would be 23.78 hours [= {(8 hours × 13 days × 11 months) + (8 hours × 12 days × 1 month)} ÷ 365 days × 7 days]. However, since the Plaintiffs, working on an alternating-day basis, worked 13 or 12 days per month, it is clear that their weekly prescribed working days were fewer than 5, and therefore the paid weekly holiday hours must be calculated by deeming the weekly prescribed working days to be 5. Accordingly, the Plaintiffs' paid weekly holiday hours are 4.75 hours (= 23.78 hours ÷ 5 days).

3) Nevertheless, the court below determined, contrary to the above, that the Plaintiffs' paid weekly holiday hours were 8 hours; such determination by the court below is erroneous, having affected the conclusion of the judgment, in that it misapprehended the legal principles concerning the method of calculating paid weekly holiday hours. The ground of appeal pointing this out has merit.

C. Regarding wages subject to comparison

1) Article 6(5) of the Minimum Wage Act and the main text and proviso item 1 of Article 5-2 of the former Enforcement Decree of the Minimum Wage Act (the same applies under the main text and proviso item 1 of Article 5-3 of the current Enforcement Decree of the Minimum Wage Act) provide, with respect to the scope of wages subject to comparison that are included in the minimum wage of a worker engaged in driving duties in the general taxi transportation business, that such wages refer to wages paid at least once a month in accordance with the payment conditions and payment rates set forth in a collective agreement, employment rules, or labor contract, but shall not include wages other than those paid for the prescribed working hours or prescribed working days.

2) According to the reasoning of the judgment below and the record, it can be known that the Diligence Allowance I received by the Plaintiffs was paid when they worked all of the aforementioned full attendance days of 13 days per month (12 days in February), while the Diligence Allowance II and the Production Allowance were each paid when they worked 10 days.

If the setting of the monthly full attendance days in the 2009 wage agreement is, as noted above, a setting of monthly prescribed working days, then since the number of working days constituting the payment conditions for Diligence Allowance I, Diligence Allowance II, and the Production Allowance fell within the monthly prescribed working days, each of these allowances constitutes wages paid at least once a month for prescribed labor, and thus falls within the wages subject to comparison.

Nevertheless, the court below regarded Diligence Allowance I, Diligence Allowance II, and the Production Allowance as bonus-type allowances paid differentially according to the attendance record for the relevant month, excluded them from the wages subject to comparison, and calculated the shortfall in minimum wage accordingly. Such determination by the court below is erroneous, having affected the conclusion of the judgment, in that it misapprehended the legal principles concerning the scope of wages subject to comparison. The ground of appeal pointing this out has merit.

5. As to part of the sixth ground of appeal

The court below determined, for the reasons stated in its judgment, that the effect of interruption of the statute of limitations resulting from the filing of the instant lawsuit also extends to the portion of the claim seeking the minimum wage corresponding to weekly holiday hours, which falls within the scope of identity with the claim for unpaid minimum wage.

Examining the reasoning of the judgment below in light of the relevant legal principles and the record, such determination by the court below is justifiable, and there is no error therein, as alleged in the grounds of appeal, in misapprehending the legal principles concerning the statute of limitations, etc.

6. Scope of reversal

The portions of the judgment below concerning the claims for extended work allowance, night work allowance, and the shortfall in minimum wage contain the grounds for reversal set forth above. Since, in the court below to which the case is remanded, it will be necessary, in light of the purport of this reversal, to newly calculate the scope of the amount to be granted in respect of the Plaintiffs' claims, including the portion of Plaintiff 2's claim for the shortfall in retirement allowance, the entire portion of the judgment below against the Defendant must be reversed.

7. Conclusion

Without examining the remaining grounds of appeal, the part of the judgment below against the Defendant is reversed, and this part of the case is remanded to the court below for further hearing and determination. This Judgment is rendered by the unanimous opinion of the Justices participating in the adjudication, as set forth in the Order.
