A Korean taxi company, operating under a fixed quota remittance system (사납금제), entered into an agreement that shortened the 'statutory working hours' (소정근로시간) on paper only, without actually reducing drivers' real working hours, in order to evade minimum wage law obligations. The Supreme Court ruled that such an agreement constitutes an unlawful evasion scheme (탈법행위) and is therefore void, and held that when the agreement is invalidated, the statutory working hours specified in the prior collective bargaining agreement (단체협약) should apply instead.

Key takeaways
  • CaseA taxi company, seeking to avoid minimum wage obligations, signed an agreement that reduced only the paper-recorded 'statutory working hours' while keeping drivers' actual working hours unchanged.
  • OutcomeThe Supreme Court ruled that this agreement was void as an unlawful evasion of the Minimum Wage Act, and ordered that the statutory working hours from the previous collective bargaining agreement should apply instead.
  • LessonEmployers cannot manipulate written employment terms to evade minimum wage laws without actually changing real working conditions; working conditions must be set through lawful means.
Issues
  • The standard for determining when an agreement to shorten statutory working hours under a fixed quota remittance system (정액사납금제) constitutes an unlawful evasion of the Minimum Wage Act
  • The proper method for determining which statutory working hours apply when such an evasive agreement is declared void
  • Whether weekly holiday allowances (주휴수당) may be included in calculating compliance with the minimum wage
  • The scope of what qualifies as a 'judicial claim' for purposes of interrupting the statute of limitations
Key reasoning

The Court found that an agreement which reduces only the formally recorded 'statutory working hours' while leaving the actual working schedule unchanged is designed solely to circumvent the Minimum Wage Act (최저임금법), and such conduct qualifies as an unlawful evasion (탈법행위) that renders the agreement void. Once the shortened-hours agreement is voided, the working hours cannot simply be left undefined; instead, the previously effective statutory working hours under the earlier collective bargaining agreement should govern, since that reflects the parties' last valid consensus. Where no such prior agreement exists or it is unclear which hours should apply, the court must supplement the parties' intent and reasonably determine the applicable statutory working hours based on the actual employment relationship. The Court also addressed related issues, including whether weekly holiday allowances (주휴수당) may be counted toward satisfying minimum wage requirements, and clarified the scope of what constitutes a 'judicial claim' sufficient to interrupt the statute of limitations (소멸시효 중단).

Summary of Decision (English, AI translation)

[1] A worker bears the obligation to work during the agreed working hours (소정근로시간, “prescribed working hours”), and the employer pays wages for the performance of that work obligation; as a general rule, the employer and the worker may freely agree on the prescribed working hours so long as they do not exceed the statutory working hours (기준근로시간). However, where the determination of prescribed working hours can be evaluated as being merely a formality, or where there are special circumstances such as the prescribed working hours having been set with the intent to circumvent mandatory labor-related statutes, the effect of such determination as an agreement on prescribed working hours must be denied.

Comprehensively considering Article 32(1) of the Constitution (헌법) and the content and structure of the relevant provisions of the Minimum Wage Act (최저임금법), the legislative purpose and history of Article 6(5) of the Minimum Wage Act as amended by Act No. 8964 on March 21, 2008 (hereinafter the “special provision”), the purpose of the provisions of the Passenger Transport Service Act (여객자동차 운수사업법) and the public nature of general taxi transportation business, and the circumstances surrounding the agreement shortening the prescribed working hours, where, under a fixed-amount quota (사납금) system, the employer, intending to avoid a situation in which the fixed wage excluding wages based on production output falls short of the minimum wage, agrees with the taxi drivers’ labor union merely to shorten the prescribed working hours—without any change in the actual work pattern or operating hours—in order to increase the nominal amount of the hourly fixed wage calculated on the basis of prescribed working hours, such an agreement must be regarded as void as an act evading the application of the special provision and other mandatory statutes.

In this context, whether an agreement to shorten prescribed working hours made under the fixed-amount quota system is void as an evasive act must be determined from a normative viewpoint, focusing on whether the primary purpose of the parties to the labor relationship who concluded the agreement was to avoid the application of the Minimum Wage Act, together with whether there is a substantial discrepancy between the shortened prescribed working hours and the actual working hours of the taxi drivers.

[2] Not only in cases where an existing taxi company operating under the fixed-amount quota system shortens its previously established prescribed working hours, but also in cases where a newly established company first sets prescribed working hours after the enforcement of Article 6(5) of the Minimum Wage Act as amended by Act No. 8964 on March 21, 2008 (hereinafter the “special provision”), if the primary purpose of the parties to the labor relationship who set the prescribed working hours was to avoid the application of the Minimum Wage Act, and there is a substantial discrepancy between the prescribed working hours and the actual working hours of the taxi drivers, such determination of prescribed working hours must be regarded as void as an evasive act. The same applies where an existing taxi company, after the enforcement of the special provision, introduces a new work pattern and, for that pattern, sets prescribed working hours for the first time.

[3] Where an agreement between the parties to a labor relationship to shorten prescribed working hours is void as an act evading the application of Article 6(5) of the Minimum Wage Act as amended by Act No. 8964 on March 21, 2008 (hereinafter the “special provision”) and other provisions, in light of the particular nature of such grounds for invalidity, the legal doctrine on the loss of effect of collective agreements, and the normative character of employment rules, the prescribed working hours provisions set forth in the previous collective agreement, employment rules, etc. must, in principle, apply; the hypothetical intent of the parties regarding prescribed working hours should not be construed on the premise of the civil law doctrine of conversion of void acts.

However, where the working hours prescribed under the previous provision on prescribed working hours exceed the statutory working hours—40 hours per week or 8 hours per day—the prescribed working hours are limited to within the scope of the statutory working hours, and the excess hours do not fall within hours for which wages of at least the minimum wage amount must be paid (hereinafter “hours subject to minimum wage payment”). Furthermore, where the worker and the employer had, through a previous collective agreement, made an agreement deeming the excess hours to be overtime hours regardless of the actual overtime hours worked (hereinafter the “deemed working hours agreement”), but subsequently agreed, through a new collective agreement, only to shorten the prescribed working hours without maintaining the previous deemed working hours agreement, then even if the agreement to shorten the prescribed working hours is void as an act evading the application of the special provision and other provisions, this alone does not mean that the deemed working hours agreement under the previous collective agreement continues to apply as is. The reasons are as follows.

① Wages included in the minimum wage of a taxi driver do not include wages other than those paid for prescribed working hours or a prescribed number of working days [Article 6(5) of the Minimum Wage Act; proviso, item 1 of Article 5-2 of the former Enforcement Decree of the Minimum Wage Act (최저임금법 시행령) (before amendment by Presidential Decree No. 29469 of December 31, 2018) (the same applies under item 1 of Article 5-3 of the current Enforcement Decree of the Minimum Wage Act)]. Here, “prescribed working hours” means working hours set by the worker and the employer within the scope of the statutory working hours of 40 hours per week and 8 hours per day (Article 2(1)(8) and Article 50 of the Labor Standards Act (근로기준법)). Considering the content and purpose of these Minimum Wage Act provisions, where the weekly working hours set by the worker and employer exceed 40 hours, or the daily working hours exceed 8 hours, the excess portion—i.e., overtime hours—does not, absent other special circumstances, fall within the hours subject to minimum wage payment. The same applies to an every-other-day work pattern in which the employee works one day and rests the next.

② The purpose of the special provision is to raise the ordinary and basic fixed wage paid in correspondence with the prescribed working hours during which the work obligation is agreed to be performed, to a level at or above the minimum wage. Furthermore, Article 6(3) of the Minimum Wage Act provides: “Any portion of a labor contract between an employer and a worker subject to the minimum wage that sets an amount of wages below the minimum wage amount shall be void, and in such case, the void portion shall be deemed to have agreed to pay wages equal to the minimum wage amount prescribed by this Act.” Even if an agreement to shorten prescribed working hours is void as an act evading the application of the special provision and other provisions, the portion rendered void under Article 6(3) of the Minimum Wage Act is, in principle, limited to the portion concerning the prescribed working hours, etc., which are the hours subject to minimum wage payment. Even where labor and management did not maintain the deemed working hours agreement of the previous collective agreement with respect to overtime hours that are not hours subject to minimum wage payment, this cannot, absent special circumstances, be regarded as an evasive act voiding the special provision and other provisions, and it cannot be said that the deemed working hours agreement of the previous collective agreement continues to apply as is.

[4] There are cases in which a company was newly established and first set prescribed working hours after the enforcement of Article 6(5) of the Minimum Wage Act as amended by Act No. 8964 on March 21, 2008 (hereinafter the “special provision”), or an existing company operating under the fixed-amount quota system introduced a new work pattern after the enforcement of the special provision and first set prescribed working hours for it, and in such cases the determination of the prescribed working hours may be void as an evasive act. Where, as such, there is no valid determination of prescribed working hours in the labor contract, employment rules, collective agreement, etc., the court needs to determine valid prescribed working hours by interpreting the labor contract in a manner that supplements the intent of the parties to the labor relationship, in order to determine whether there is a shortfall from the minimum wage and the amount of any such shortfall. Here, the supplemented intent of the parties refers not to their actual or subjective intent but to the legitimate intent for adjustment of interests that can be objectively inferred in light of the purpose of the contract, transactional practice, applicable statutes, the principle of good faith, and the like. Furthermore, if the actual working hours under the new work pattern have not decreased compared to the existing work pattern, then in determining the valid prescribed working hours for the new work pattern, priority must be given to the content of the previous provision on prescribed working hours applicable to the existing work pattern. This is because, if the actual working hours have not decreased despite the change in work pattern, it is reasonable to view the worker as bearing a work obligation corresponding at least to the previous prescribed working hours.

[5] In a case where Company A, a taxi company, had set, in its collective agreement, the daily working hours for the two-shift-per-day work pattern at 8 hours and the daily working hours for the every-other-day work pattern at 16 hours, but then, after the enforcement of Article 6(5) of the Minimum Wage Act as amended by Act No. 8964 on March 21, 2008, concluded a wage agreement with the labor union setting the daily prescribed working hours for the one-person-one-shift work pattern at 2 hours 15 minutes and the daily prescribed working hours for the every-other-day work pattern at 4 hours, while no longer operating the two-shift-per-day work pattern; and where the issue was what prescribed working hours should apply to the taxi drivers of Company A, given that the above agreement on prescribed working hours was void as an act evading the application of Article 6(5) of the Minimum Wage Act and other provisions: the Supreme Court held that, with respect to the every-other-day work pattern, since there had been an agreement on working hours in the previous collective agreement, the prescribed working hours set therein must apply, and the hypothetical intent of the parties regarding prescribed working hours should not be construed; since the collective agreement had set the daily working hours for the every-other-day work pattern at 16 hours, the daily prescribed working hours for the every-other-day work pattern must be limited to 8 hours, the statutory working hours, out of the 16 hours, and the remaining hours in excess thereof do not fall within the hours for which wages of at least the minimum wage amount must be paid (hereinafter “hours subject to minimum wage payment”); accordingly, even after the wage agreement, the daily prescribed working hours subject to minimum wage payment for the every-other-day work pattern must be regarded as 8 hours. Meanwhile, since the previous collective agreement had not set prescribed working hours for the one-person-one-shift work pattern, it was necessary to determine the valid prescribed working hours for the one-person-one-shift work pattern by supplementing the intent of the parties to the labor relationship; and since it did not appear that the actual working hours under the one-person-one-shift work pattern had decreased compared to the existing two-shift-per-day work pattern, it is reasonable to view that workers under the one-person-one-shift work pattern bear a work obligation corresponding to, or exceeding, the previous prescribed working hours applicable to the existing two-shift-per-day work pattern; therefore, in determining the valid prescribed working hours for the one-person-one-shift work pattern, priority must be given to the fact that the collective agreement had set the daily working hours for the two-shift-per-day work pattern at 8 hours. The Supreme Court held that the lower court’s judgment, which held otherwise, erred in its understanding of the applicable legal doctrine.

[6] Since the weekly holiday allowance (주휴수당) is wages paid regularly at least once a month for prescribed work, it constitutes wages that the employer must pay at an amount equal to or greater than the minimum wage.

[7] The reason for the existence of the statute of limitations system lies in respecting a continued state of fact and in not protecting one who sleeps on his or her rights, and this latter meaning is particularly significant with respect to extinctive prescription (소멸시효). Where it can be viewed that the holder of a right has, by asserting that right in litigation, manifested that he or she is not sleeping on that right, this should be regarded as constituting a ground for interruption of extinctive prescription, and it is not necessarily required to examine this in a manner coinciding with the scope of res judicata that attaches to a claim asserted in litigation as a ground for interruption of prescription.

Even where only a part of a single claim is sought by a lawsuit, if it can be interpreted, in light of the purport thereof, that judgment is sought with respect to the entire claim, then the extinctive prescription may be regarded as having been interrupted with respect to the whole of the claim, within the scope of the claim’s identity. Where a plaintiff, in the complaint, seeks only a part of the claim that is the subject of the claim, while expressing an intent to expand the amount claimed in the future in accordance with the progress of the litigation, and actually expands the amount claimed by the time the relevant lawsuit is concluded, this is interpreted as meaning that judgment was sought with respect to the entire claim from the time of the filing of the lawsuit; in such a case, the effect of interruption of prescription due to a judicial claim arises, from the time of the filing of the lawsuit, with respect to the whole of the claim within the scope of the claim’s identity.

[Judgment Below] Daegu High Court Judgment 2021. 2. 19., Case Nos. 2016Na24452, 2019Na24682

[Order]

The judgment below is reversed, and the case is remanded to the Daegu High Court. The applications for succession to litigation filed by the applicants for succession to litigation of Plaintiff (Defendant on Counterclaim) 6 are dismissed. The costs of the applications for succession to litigation shall be borne by the applicants.

[Reasoning] The grounds for appeal (including the supplementary brief on grounds for appeal filed after the expiration of the period for submitting the brief on grounds for appeal, to the extent it supplements the grounds for appeal) are examined as follows.

1. Overview of the case
According to the reasoning of the judgment below and the evidence lawfully adopted and examined by the court below, the following facts may be found.

A. The Defendant (Plaintiff on Counterclaim, hereinafter “Defendant”) is a corporation engaged in the general taxi transportation business, and the respective decedents of the Plaintiffs (Defendants on Counterclaim, hereinafter “Plaintiffs”) listed as Nos. 2, 50, 66, 67, and 68 in the attached list, along with the remaining Plaintiffs (hereinafter “the workers in this case”), are persons who are or were employed as taxi-driving employees of the Defendant.

B. The workers in this case were paid wages under the so-called fixed quota system (jeongaeksanapgeumje), whereby they paid only a certain fixed amount (hereinafter “quota”) out of their transportation revenue to the Defendant, retained the remainder of the transportation revenue themselves, and received a certain fixed wage from the Defendant.

C. Under the 2004 Wage Agreement concluded between the Defendant and the ○○ Taxi Branch of the National Taxi Industry Labor Union (전국택시산업노동조합 ○○택시분회), the working arrangement was, in principle, a two-shift system per day, but a alternate-day system or a single-driver, one-shift-per-day system could be adopted by agreement between the parties; and under the alternate-day working arrangement, the daily working hours were set at 16 hours, consisting of 8 hours of basic work plus 8 hours of overtime work (2 of which overlapped with night work).

D. Under the 2007 Collective Agreement concluded between the Defendant and the ○○ Taxi Labor Union (hereinafter “the Labor Union in this case”), the daily working hours under the two-shift-per-day working arrangement were set at 8 hours with 26 full working days per month, and the daily working hours under the alternate-day working arrangement were set at 16 hours with 13 full working days per month (12 days in February).

E. Article 6(5) of the Minimum Wage Act (최저임금법), as amended by Act No. 8964 on March 21, 2008 (hereinafter “the special provision at issue”), took effect in the ○○ City area from July 1, 2010, excluding “wages based on production output” from the scope of wages included in the minimum wage.

F. Under the 2010 Wage Agreement concluded between the Defendant and the Labor Union in this case on November 27, 2010, the working arrangement was, in principle, a two-shift-per-day system, but an alternate-day system or a single-driver, one-shift-per-day system could be adopted by agreement between the parties; and the prescribed daily working hours under the single-driver, one-shift-per-day working arrangement were set at 2 hours and 15 minutes with 23 full working days per month, and the prescribed daily working hours under the alternate-day working arrangement were set at 4 hours with 13 full working days per month (12 days in February). After the 2010 Wage Agreement, the Defendant no longer operated the two-shift-per-day working arrangement, and operated only the alternate-day and single-driver, one-shift-per-day working arrangements.

G. Through the 2011 Wage Agreement, the Defendant and the Labor Union in this case changed the number of full working days under the single-driver, one-shift-per-day working arrangement to 26 days, and, upon concluding the 2019 Wage Agreement, shortened the prescribed daily working hours under the single-driver, one-shift-per-day working arrangement to 2 hours (26 full working days) or 2.07 hours (25 full working days), and shortened the prescribed daily working hours under the alternate-day working arrangement to 3 hours and 30 minutes (hereinafter, the agreements on prescribed working hours between the Defendant and the Labor Union in this case following the 2010 Wage Agreement are referred to as “the agreement on prescribed working hours in this case”).

2. Regarding the effect of the agreement on prescribed working hours in this case (Defendant’s first ground of appeal)

A. Relevant legal principles

1) An employee bears a duty to work during the agreed prescribed working hours, and the employer is obligated to pay wages for the performance of that duty to work. As long as the standard working hours are not exceeded, the employer and employee may, in principle, freely agree on the prescribed working hours according to their own free will. However, where the determination of the prescribed working hours can be assessed as being merely a formality, or where there are special circumstances such that the prescribed working hours were set with the intent to evade mandatory provisions of labor-related statutes, the effect of such agreement as an agreement on prescribed working hours must be denied.

Considering comprehensively the content and system of Article 32(1) of the Constitution (헌법) and the relevant provisions of the Minimum Wage Act (최저임금법), the legislative purpose and legislative history of the special provision at issue, the purport of the provisions of the Passenger Transport Service Act (여객자동차 운수사업법) and the public nature of the general taxi transportation business, and the circumstances surrounding any agreement to shorten the prescribed working hours, where, under the fixed quota system, the employer, with the intent of avoiding a situation in which the fixed wage excluding production-output-based wages falls short of the minimum wage, agrees with the taxi-driving employees’ labor union to shorten only the prescribed working hours—without any change in the actual working arrangement or operating hours—in order to increase the nominal amount of the hourly fixed wage calculated based on the prescribed working hours, such an agreement must be deemed void as an illegal act intended to evade the application of the special provision at issue, which is a mandatory provision (see Supreme Court en banc Decision 2016Da2451, decided April 18, 2019, and others).

At this juncture, whether an agreement to shorten prescribed working hours made under the fixed quota system is void as an illegal act must be determined from a normative perspective, focusing on whether the main purpose of the parties to the employment relationship who concluded the agreement was to evade the application of the Minimum Wage Act, together with whether there is a substantial discrepancy between the shortened prescribed working hours and the actual working hours of the taxi-driving employees (see Supreme Court Decision 2023Da279402, 280563, decided May 30, 2024, and others).

2) Not only in cases where a taxi company operating under the fixed quota system shortens the previously existing prescribed working hours, but also in cases where a newly established company sets prescribed working hours for the first time after the special provision at issue took effect, if the main purpose of the parties to the employment relationship who set the prescribed working hours was to evade the application of the Minimum Wage Act, and there is a substantial discrepancy between the prescribed working hours and the actual working hours of the taxi-driving employees, such determination of prescribed working hours must be deemed void as an illegal act (see Supreme Court Decision 2023Da206138, decided October 25, 2024). The same applies where an existing taxi company introduces a new working arrangement after the special provision at issue takes effect and sets the prescribed working hours for that arrangement for the first time.

B. Judgment of the court below

The court below determined, for the reasons stated in its judgment, that the agreement on prescribed working hours in this case was set with the intent of nominally increasing the hourly fixed wage in order to avoid a situation, following the enforcement of the special provision at issue, in which the fixed wage excluding production-output-based wages would fall short of the minimum wage, and that such agreement constituted an illegal act intended to evade the application of the special provision at issue, which is a mandatory provision, and was therefore void.

C. Judgment of the Supreme Court

Examining the reasoning of the judgment below in light of the legal principles and factual relationships set forth above, although there are portions of the reasoning stated by the court below that are not appropriate, the conclusion of the court below that the agreement on prescribed working hours in this case constitutes an illegal act intended to evade the application of the special provision at issue and is therefore void, is justified. There is no error in the judgment below, as alleged in the grounds of appeal, involving a misapprehension of the legal principles regarding the effect of an agreement on prescribed working hours, a violation of the rules of evidence, or the like, that affected the outcome of the judgment.

3. Regarding the claim for minimum wage and the claim for overtime premium wages (Plaintiffs’ first, second, and third grounds of appeal, and Defendant’s second ground of appeal)

A. Judgment of the court below

The court below determined as follows.

1) The agreement on prescribed working hours in this case is void; however, the prescribed working hours set forth in the previous 2007 Collective Agreement do not apply to the workers in this case, and instead the prescribed working hours that the workers in this case and the Defendant would have agreed upon had they known that the agreement was void must be ascertained and applied. Considering the following circumstances, the workers in this case and the Defendant would have agreed on a daily prescribed working hours of 5 hours.

A) Even after Supreme Court en banc Decision 2016Da2451, decided April 18, 2019, was rendered, the taxi companies located in ○○ City, including the Defendant, had failed, up to the closing of oral argument in the court below, to establish new prescribed working hours through a wage agreement.

B) The Act on the Development of the Taxi Transportation Business (택시운송사업의 발전에 관한 법률) was amended by Act No. 16500 on August 20, 2019, newly inserting Article 11-2, which provides that “Where the working hours of taxi drivers engaged in the general taxi transportation business are set pursuant to Article 58(1) and (2) of the Labor Standards Act (근로기준법), they shall be set to be no less than 40 hours per week,” and the corresponding daily prescribed working hours would be at least 6 hours and 40 minutes (40 hours ÷ 6 days). This provision was scheduled to take effect in Seoul Metropolitan City from January 1, 2021, but the Seoul Taxi Transportation Business Association petitioned for a postponement of its enforcement.

C) Synthesizing the cases in which labor-management agreements on prescribed working hours were reached in regions other than ○○ City after the en banc decision was rendered, the average daily prescribed working hours as of 2020 was approximately 4.97 hours.

D) If the prescribed working hours applicable to the workers in this case exceed 5 hours per day, the shortfall in minimum wage would exceed the Defendant’s cumulative net income for the claim period in this case, which would be excessively harsh on the Defendant.

2) Therefore, since the valid daily prescribed working hours applicable to the workers in this case is 5 hours, the shortfall in minimum wage is basically calculated based on 5 hours for the single-driver, one-shift-per-day working arrangement and 10 hours for the alternate-day working arrangement.

3) Given the above daily prescribed working hours of the workers in this case, their monthly working hours (= 5 hours × number of working days per month) do not exceed 174 hours per month (= 40 standard weekly working hours × 365 days ÷ 12 months ÷ 7 days), and therefore it cannot be found that the workers in this case performed overtime work, and thus the claim for overtime premium wages is not accepted.

B. Judgment of the Supreme Court

The judgment of the court below is difficult to accept, for the following reasons.

1) Regarding the alternate-day working arrangement

A) Relevant legal principles

(1) Where an agreement between the parties to an employment relationship to shorten the prescribed working hours is void as an illegal act intended to evade the application of the special provision at issue, in light of the particular nature of such grounds for invalidity, the legal principles concerning the loss of effect of a collective agreement, and the normative character of employment rules, the provisions on prescribed working hours set forth in the previous collective agreement, employment rules, etc., should, in principle, apply, and it is not appropriate to interpret the parties’ hypothetical intent regarding the prescribed working hours on the premise of the doctrine of conversion of void juristic acts under the Civil Act (민법).

(2) However, if the working hours set forth in the previous prescribed working hours provision exceed the standard working hours of 40 hours per week or 8 hours per day, the prescribed working hours are limited to within the scope of the standard working hours, and the excess hours do not constitute hours for which wages of at least the minimum wage amount must be paid (hereinafter “hours subject to minimum wage payment”). Furthermore, where the employee and employer agreed, through a previous collective agreement, on a provision deeming the excess hours to be overtime hours regardless of the actual overtime hours worked (hereinafter “deemed working hours agreement”), but subsequently agreed through a new collective agreement to shorten the prescribed working hours without maintaining the previous deemed working hours agreement, even if the agreement to shorten the prescribed working hours is void as an illegal act intended to evade the application of the special provision at issue, this alone does not mean that the deemed working hours agreement under the previous collective agreement continues to apply as is. The reasons are as follows.

(a) Wages included in the minimum wage of taxi-driving employees (hereinafter “the comparison wages”) do not include wages other than those paid for the prescribed working hours or prescribed working days (Article 6(5) of the Minimum Wage Act; the proviso, item 1, of Article 5-2 of the former Enforcement Decree of the Minimum Wage Act (before amendment by Presidential Decree No. 29469 on December 31, 2018) (which is the same as item 1 of Article 5-3 of the current Enforcement Decree of the Minimum Wage Act)). Here, “prescribed working hours” means the working hours agreed upon by the employee and employer within the scope of the standard working hours of 40 hours per week and 8 hours per day (Article 2(1)8 and Article 50 of the Labor Standards Act). Considering the content and purpose of these Minimum Wage Act provisions, where the weekly working hours agreed upon by the employee and employer exceed 40 hours, or the daily working hours exceed 8 hours, the excess portion, i.e., the overtime hours, does not, absent other special circumstances, constitute hours subject to minimum wage payment (see Supreme Court Decision 2023Da223744, 223751, decided July 25, 2024). This applies equally to the alternate-day working arrangement, in which an employee works one day and rests the following day (see Supreme Court Decision 2022Da257238, decided July 18, 2025).

(b) The special provision at issue is intended to raise the ordinary and basic fixed wage, paid in correspondence to the prescribed working hours agreed to be worked, to at least the level of the minimum wage (see Supreme Court en banc Decision 2016Da2451, decided April 18, 2019). Furthermore, Article 6(3) of the Minimum Wage Act provides that “Any portion of an employment contract between an employee subject to the minimum wage and an employer that provides for wages lower than the minimum wage amount shall be void, in which case the void portion shall be deemed to provide for wages equal to the minimum wage amount set forth in this Act.” Even if an agreement to shorten the prescribed working hours is void as an illegal act intended to evade the application of the special provision at issue, the portion that becomes void pursuant to Article 6(3) of the Minimum Wage Act is, in principle, limited to the portion concerning the prescribed working hours, which are the hours subject to minimum wage payment. Even if labor and management did not maintain the deemed working hours agreement under the previous collective agreement with respect to overtime hours, which are not hours subject to minimum wage payment, it is difficult, absent special circumstances, to view this as an illegal act intended to evade the special provision at issue, and it cannot be said that the deemed working hours agreement under the previous collective agreement continues to apply as is.

B) Specific determination

Examining the factual relationships set forth above in light of the aforementioned legal principles:

(1) Regarding the claim for minimum wage

(a) With respect to the alternate-day working arrangement, since there was an agreement on working hours in the previous 2007 Collective Agreement, the prescribed working hours set forth therein should apply, and it is not appropriate to interpret the parties’ hypothetical intent regarding the prescribed working hours.

(b) However, the 2007 Collective Agreement set the daily working hours under the alternate-day working arrangement at 16 hours, and the 2004 Wage Agreement likewise set the daily working hours under the alternate-day working arrangement at 16 hours, consisting of 8 hours of basic work plus 8 hours of overtime work. Given this, the daily prescribed working hours under the alternate-day working arrangement is limited to 8 hours, the standard working hours, out of the 16 hours, and the remaining hours in excess thereof do not constitute hours subject to minimum wage payment.

(c) Therefore, even after the 2010 Wage Agreement, the daily prescribed working hours constituting hours subject to minimum wage payment under the alternate-day working arrangement should be regarded as 8 hours. Nevertheless, the court below, for the reasons stated in its judgment, regarded the hours subject to minimum wage payment under the alternate-day working arrangement as 10 hours per day, and calculated the shortfall in minimum wage on that basis. The judgment below contains an error affecting the outcome of the judgment, resulting from a misapprehension of the legal principles concerning the determination of prescribed working hours and the method of calculating the minimum wage.

(2) Regarding the claim for overtime premium wages

(a) In light of the content of the 2004 Wage Agreement and the 2007 Collective Agreement, there is room to view that an agreement existed to deem the remaining 8 hours, in excess of the 8-hour prescribed working hours out of the 16 hours of daily working hours, as overtime hours regardless of the actual overtime hours worked. However, the Defendant did not conclude a deemed working hours agreement regarding overtime hours in the wage agreements from 2010 onward. Although the agreement on prescribed working hours in this case is void, this circumstance alone does not mean that the deemed working hours agreement under the previous collective agreement continues to apply as is.

(b) However, the Plaintiffs argued in the court below that they worked in excess of 8 hours per day even after the 2010 Wage Agreement, by agreement with the Defendant. Even in the absence of a deemed working hours agreement, if the workers in this case performed overtime work by agreement with the Defendant, the Defendant is obligated to pay premium wages corresponding to the actual overtime hours worked. If so, the court below, upon remand, should have examined and determined whether the Defendant had impliedly agreed, even after the 2010 Wage Agreement, to accept overtime work from the workers in this case exceeding the standard working hours, and whether there existed hours during which the workers in this case actually performed overtime work. Nevertheless, the court below rejected the claim for overtime premium wages solely on the ground that, based on the prescribed working hours it had determined, no overtime hours existed, without specifically examining this issue. This portion of the judgment below contains an error affecting the outcome of the judgment, resulting from a failure to conduct the necessary examination due to a misapprehension of the legal principles concerning overtime allowances.

2) Regarding the single-driver, one-shift-per-day working arrangement

A) Relevant legal principles

There are cases in which a company was newly established after the special provision at issue took effect and set the prescribed working hours for the first time, or an existing company operating under the fixed quota system introduced a new working arrangement after the special provision at issue took effect and set the prescribed working hours for that arrangement for the first time, and the determination of such prescribed working hours is void as an illegal act. In such cases, where there is no valid determination of prescribed working hours in the employment contract, employment rules, collective agreement, etc., the court needs to determine the valid prescribed working hours by supplementing the intent of the parties to the employment relationship and interpreting the employment contract in order to determine whether there is a shortfall in the minimum wage and, if so, the amount thereof. Here, the supplemented intent of the parties refers not to the actual or subjective intent of the parties, but to the legitimate intent to adjust interests that can be objectively inferred in light of the purpose of the contract, transactional practice, applicable statutes, the principle of good faith, and the like (see Supreme Court Decision 2023Da206138, decided October 25, 2024). Furthermore, if the actual working hours under the new working arrangement have not decreased compared to the existing working arrangement, then in determining the valid prescribed working hours applicable to the new working arrangement, the content of the previous prescribed working hours provision applicable to the existing working arrangement should be given priority consideration. This is because, if the actual working hours have not decreased despite the change in working arrangement, it is reasonable to view that the employee bears a duty to work corresponding at least to the previous prescribed working hours.

B) Specific determination

Examining the factual relationships set forth above in light of the aforementioned legal principles, there is substantial room to find that the valid daily prescribed working hours applicable to the single-driver, one-shift-per-day working arrangement exceeds 5 hours.

(1) After the special provision at issue took effect, the Defendant no longer operated the existing two-shift-per-day working arrangement, and newly introduced and operated the single-driver, one-shift-per-day working arrangement. Since the previous 2004 Wage Agreement and 2007 Collective Agreement did not set forth prescribed working hours for the single-driver, one-shift-per-day arrangement, the valid prescribed working hours for the single-driver, one-shift-per-day arrangement must be determined by supplementing the intent of the parties to the employment relationship.

(2) The two-shift-per-day system is a working arrangement in which two taxi-driving employees alternately work 12 hours each out of the 24 hours in a day, whereas the single-driver, one-shift-per-day system is a working arrangement in which a single taxi-driving employee handles the operation for the entire day without alternation. Given the content and characteristics of such working arrangements, the working hours under the single-driver, one-shift-per-day arrangement are ordinarily longer than those under the two-shift-per-day arrangement. In fact, according to the tachometer operating records for March 2014 submitted by the Plaintiffs (Exhibit A No. 9-5 through 9-9), the average daily working hours (the sum of operating hours and empty-car hours) of some Plaintiffs who worked under the single-driver, one-shift-per-day arrangement ranged from 12.5 hours to 17.16 hours, exceeding the maximum daily working hours of 12 hours under the two-shift-per-day arrangement. Even under the 2010 Wage Agreement, single-driver, one-shift-per-day employees, like alternate-day employees, had a fixed dispatch start time between 07:00 and 08:00, but no fixed dispatch end time.

Given this, since it cannot be found that the actual working hours under the single-driver, one-shift-per-day arrangement decreased compared to the existing two-shift-per-day working arrangement, it is reasonable to view that employees under the single-driver, one-shift-per-day working arrangement bear a duty to work corresponding to, or exceeding, the previous prescribed working hours applicable to the existing two-shift-per-day working arrangement. Therefore, in determining the valid prescribed working hours for the single-driver, one-shift-per-day arrangement, priority consideration should be given to the fact that the 2007 Collective Agreement set the daily working hours under the two-shift-per-day arrangement at 8 hours.

(3) Around 2020, there was an agreement in the taxi industry in regions other than ○○ City setting the average daily prescribed working hours at approximately 4.97 hours; however, this reflects circumstances approximately 10 years after the special provision at issue took effect or after the 2010 Wage Agreement, which is void as an agreement on prescribed working hours, was concluded. Furthermore, although the workers in this case, upon filing the instant lawsuit on January 10, 2014, asserted that the agreement on prescribed working hours in this case was void, it appears that the shortfall in minimum wage accumulated and increased because the Defendant disputed the validity of the agreement on prescribed working hours in this case and took no particular measures. It is difficult to find that the workers’ claims for minimum wage, etc., violate the principle of good faith merely on the ground that the Labor Union in this case voluntarily entered into the agreement on prescribed working hours in this case with the Defendant. It is difficult to regard the aforementioned circumstances as factors that should be given priority consideration in determining the prescribed working hours for the single-driver, one-shift-per-day arrangement.

C) Sub-conclusion

(1) Nevertheless, the court below, without applying the previous prescribed working hours provision concerning the two-shift-per-day arrangement, determined the daily prescribed working hours under the single-driver, one-shift-per-day working arrangement to be 5 hours by way of interpreting the parties’ hypothetical intent, and calculated the shortfall in minimum wage on that basis. This portion of the judgment below contains an error affecting the outcome of the judgment, resulting from a misapprehension of the legal principles concerning the determination of prescribed working hours and the method of calculating the minimum wage.

However, since prescribed working hours means the working hours set by the employee and employer within the scope of the standard working hours, if the 8-hour daily working hours under the two-shift-per-day arrangement set forth in the 2007 Collective Agreement is applied as is to the 26 full working days per month set forth therein, or to the 23 full working days per month under the single-driver, one-shift-per-day arrangement set forth in the 2010 Wage Agreement, the average weekly working hours would be 47.86 hours (= 8 hours × 26 days × 12 months ÷ 365 days × 7 days) or 42.34 hours (= 8 hours × 23 days × 12 months ÷ 365 days × 7 days), respectively, exceeding the standard weekly working hours of 40 hours. Therefore, it should also be noted that the court below, upon remand, should apply the working hours provision concerning the two-shift-per-day arrangement under the 2007 Collective Agreement, while determining the valid daily prescribed working hours applicable to the single-driver, one-shift-per-day working arrangement within the scope of the standard weekly working hours of 40 hours.

(2) The valid prescribed working hours applicable to the single-driver, one-shift-per-day arrangement is, as noted above, capped at the standard weekly working hours of 40 hours. The Defendant did not conclude a deemed working hours agreement regarding overtime hours after the 2010 Wage Agreement. Therefore, as discussed above with respect to the claim for overtime premium wages under the alternate-day working arrangement, the court below, upon remand, should have examined and determined whether the workers in this case actually performed overtime work by agreement with the Defendant even after the 2010 Wage Agreement. Nevertheless, the court below rejected the claim of the workers in this case for overtime premium wages solely on the ground that, based on the standard of 5 hours per day, no overtime hours existed, without examining this issue. This portion of the judgment below contains an error affecting the outcome of the judgment, resulting from a failure to conduct the necessary examination due to a misapprehension of the legal principles concerning overtime allowances.

4. Regarding whether unpaid weekly holiday allowances should be included in the comparison wages (Defendant’s third ground of appeal)

A. This ground of appeal by the Defendant is to the effect that ‘the court below ordered payment of unpaid weekly holiday allowances based on the recalculated ordinary wages, separately from the shortfall in minimum wage, for the period up to December 31, 2018; however, since weekly holiday allowances are included in the comparison wages, the shortfall in minimum wage should be recalculated by including the unpaid weekly holiday allowances in the comparison wages as well.’

B. Weekly holiday allowance is wages paid regularly at least once a month for prescribed work, and therefore constitutes wages that the employer must pay at least the minimum wage amount for (see Supreme Court Decision 2021Da246545, decided July 25, 2024).

The court below, in accordance with the aforementioned legal principle, construed the Plaintiffs’ claim for weekly holiday allowances up to December 31, 2018, as a claim for the shortfall in minimum wage, and ordered payment of the shortfall in minimum wage, without separately ordering payment of unpaid weekly holiday allowances by way of recalculating the ordinary wages.

C. Therefore, this ground of appeal, which is premised on a different understanding from that determined by the court below, cannot be accepted.

5. Regarding whether the extinctive prescription has run (Defendant’s fifth ground of appeal)

A. The rationale for the prescription system lies in respecting a continued state of facts and in not protecting a person who sleeps on his or her rights, and in the case of extinctive prescription in particular, the latter meaning is stronger. Where it can be viewed that a right holder has asserted the right in litigation, thereby manifesting that he or she is not sleeping on the right, this must be regarded as a ground for interrupting extinctive prescription, and it is not necessary to consider the litigation claim, which is a ground for interrupting prescription, as coinciding exactly with the scope of res judicata (see Supreme Court Decision 2011Da19737, decided July 14, 2011, and others).

Even where only a part of a single claim has been claimed by way of a lawsuit, if it can be interpreted, in light of the purport thereof, that judgment is sought for the entire claim, then the extinctive prescription may be deemed interrupted for the entire claim within the scope of the identity of the claim. Where, in the complaint, only a part of the claim which is the subject of the claim is initially claimed while indicating an intent to expand the claim amount in the future in accordance with the progress of the litigation, and the claim amount is actually expanded before the conclusion of the relevant litigation, it is interpreted that judgment was sought for the entire claim from the time of filing the lawsuit; in such a case, the effect of interruption of prescription due to litigation claim arises, from the time of filing the lawsuit, for the entire claim within the scope of the identity of the claim (see Supreme Court Decision 2014Da41681, decided July 4, 2019; Supreme Court Decision 2022Du19, decided November 17, 2022).

B. The Plaintiffs (including their decedents) claimed, in the complaint in this case, on the premise that the agreement on prescribed working hours in this case is void, a portion of the shortfall in minimum wage and unpaid overtime allowances, while indicating an intent to expand the claim amount in the future in accordance with the progress of the litigation; and thereafter, in accordance with the progress of the litigation, added, under the same premise, the ending date for the calculation of minimum wage and overtime allowances, and added a claim for unpaid retirement allowances arising before and after the filing of the lawsuit, thereby expanding the claim amount. The minimum wage, overtime allowances arising after May 2014, and unpaid retirement allowances for those among the workers in this case who retired on or before June 30, 2016, claimed by the Plaintiffs, can be evaluated as falling within the scope of the identity of the claims which the complaint anticipated would be specified and modified in the future. Therefore, the effect of interruption of prescription due to litigation claim arises, from the time of filing the lawsuit in this case, for the entire scope of the aforementioned claims.

C. Given this, it is justified that the court below rejected the Defendant’s defense of completion of extinctive prescription, and there is no error in the judgment below, as alleged in the grounds of appeal, involving a misapprehension of the legal principles concerning the completion of extinctive prescription, that affected the outcome of the judgment.

6. Regarding the Defendant’s defense of violation of the principle of good faith and the conjunctive counterclaim (Defendant’s sixth and seventh grounds of appeal)

The court below, for the reasons stated in its judgment, rejected both the Defendant’s defense of violation of the principle of good faith and the Defendant’s conjunctive counterclaim, which was premised on the workers in this case owing an obligation to return unjust enrichment equivalent to additional transportation revenue.

Examining the reasoning of the judgment below in light of the relevant legal principles and the record, there is no error in this determination of the court below, as alleged in the grounds of appeal, involving a misapprehension of the legal principles concerning the principle of good faith, the effect of the remaining portion where an agreement on prescribed working hours is void, and the like, that affected the outcome of the judgment.

7. Scope of reversal

The judgment below, insofar as it pertains to the principal claim, contains the aforementioned grounds for reversal with respect to (i) the claim for minimum wage and (ii) the claim for overtime premium wages. In light of the foregoing purport of reversal, the court below, upon remand, needs to recalculate the amounts to be awarded on each of these claims. Furthermore, if the scope of the awarded amount on the claims for minimum wage, etc., changes, the scope of the awarded amount on some Plaintiffs’ claims for retirement allowances, which are based on the average wage reflecting such changes, may also change. Therefore, the entirety of the portion of the judgment below concerning the principal claim must be reversed.

Meanwhile, although the Defendant’s appeal concerning the conjunctive counterclaim is without merit, as discussed above, since the conjunctive counterclaim is premised on the portion of the principal claim awarded by the court below being upheld, insofar as the entirety of the principal claim is reversed as above, the portion concerning the conjunctive counterclaim must also be reversed for the purpose of ensuring a consistent determination.

8. Determination on the applications for succession to litigation filed by the applicants for succession to litigation of Plaintiff 6

According to the record, it can be found that Plaintiff 6 died on November 26, 2021, after the expiration of the period for submitting the brief on grounds for appeal; however, where the litigation procedure in the appellate trial has reached the stage after the expiration of the period for submitting the brief on grounds for appeal, and judgment is to be rendered without oral argument, there is no need for the heirs to succeed to the litigation procedure in the appellate trial, and if the case is reversed and remanded, the procedure for succession to litigation may be taken in the court below upon remand (see Supreme Court Decision 2014Da210449, decided April 29, 2016; Supreme Court Decision 2018Da273530, decided October 27, 2022, and others); therefore, the applications for succession to litigation are not accepted.

9. Conclusion

Without rendering a determination on the remaining grounds of appeal, the judgment below is reversed, and the case is remanded to the court below for further examination and determination; the applications for succession to litigation filed by the applicants for succession to litigation of Plaintiff 6 are dismissed, and the costs of the applications for succession to litigation shall be borne by the applicants; and it is so ordered as set forth in the Order above, by the unanimous consent of the Justices participating in the decision.
