Taxi companies had set nominal 'prescribed working hours' (소정근로시간) — such as just 2 hours per day — that were wildly disconnected from drivers' actual working hours, in order to sidestep the Minimum Wage Act (최저임금법). The Supreme Court ruled that such agreements, whether they shortened or simply maintained an unrealistic prescribed working hours figure, were void as an unlawful evasion of mandatory law. The Court reversed and remanded the case, opening the door for taxi drivers to recover the difference between what they were paid and the legal minimum wage.

Key takeaways
  • CaseTaxi companies operating a fixed-quota pay system set artificially short 'prescribed working hours' (e.g., 2 hours a day) that had no relation to drivers' real working hours, aiming to avoid minimum wage obligations.
  • OutcomeThe Supreme Court held such agreements void as an unlawful evasion of the Minimum Wage Act and sent the case back for recalculation of the drivers' unpaid wages.
  • LessonEmployers cannot escape minimum wage law by manipulating nominal working hours on paper — courts will look at actual working hours and can substitute a fair figure when contract terms are found invalid.
Issues
  • Whether an agreement by taxi companies operating under a fixed daily quota system (정액사납금제) to shorten or maintain an unrealistic 'prescribed working hours' figure constitutes an unlawful act evading the Minimum Wage Act, rendering it void
  • How to determine the legally valid prescribed working hours when the original agreement is found void
  • The validity of an agreement that changes only the stated prescribed working hours without any actual change in work patterns or driving schedules
  • The proper method (supplementary contract interpretation) for determining a substitute, valid prescribed working hours figure when the original clause is void as an unlawful evasion
Key reasoning

An agreement on prescribed working hours is void as an unlawful act circumventing mandatory statutory law (탈법행위) if it is merely a formality that grossly diverges from the employee's actual working hours, or if it was shortened or deliberately kept unchanged specifically to avoid the special provisions of the Minimum Wage Act. This applies not only to newly shortened hours but also to cases where companies simply left an already unrealistic prescribed-hours clause unchanged to keep dodging the law. Where such an agreement is void, the previously valid prescribed working hours clause under the collective bargaining agreement or employment rules should apply instead. If no such valid clause exists, the court must fill the gap by objectively determining what a reasonable, fair allocation of working hours the parties would have intended, based on the purpose of the contract, industry practice, applicable statutes, and the principle of good faith (신의칙).

Summary of Decision (English, AI translation)

[1] An employee bears the obligation to work during the agreed working hours (소정근로시간), and the employer pays wages for the performance of that work obligation. The employer and employee may, in principle, freely agree on the agreed working hours so long as they do not exceed the standard working hours. However, where the determination of the agreed working hours is merely nominal, or where there are special circumstances such that the agreed working hours were set with the intent to circumvent mandatory provisions of labor-related statutes, the effect of such an agreement on the agreed working hours must be denied.

Comprehensively considering Article 32(1) of the Constitution (헌법) and the content and structure of the relevant provisions of the Minimum Wage Act (최저임금법), the legislative purpose and history of Article 6(5) of the Minimum Wage Act as amended by Act No. 8964 on March 21, 2008 (hereinafter the “special provision”), the purpose of the provisions of the Passenger Transport Service Act (여객자동차 운수사업법) and the public nature of the general taxi transportation business, and the circumstances surrounding an agreement to shorten the agreed working hours, where, under a fixed-amount remittance quota system (사납금제), an employer, intending to avoid the situation in which the fixed wage excluding wages based on production output falls below the minimum wage, agrees with the taxi drivers’ labor union to shorten only the agreed working hours—without any change in the actual work pattern or operating hours—in order to increase the nominal amount of the hourly fixed wage calculated based on the agreed working hours, such an agreement must be deemed void as an unlawful act intended to circumvent the application of the mandatory special provision of the Minimum Wage Act, among other provisions.

[2] Whether an agreement to shorten the agreed working hours made under a fixed-amount remittance quota system is void as an unlawful act should be judged from a normative standpoint, focusing on whether the primary purpose of the parties to the employment relationship who concluded the agreement was to avoid the application of the Minimum Wage Act, as well as on whether there is a substantial discrepancy between the shortened agreed working hours and the actual working hours of the taxi driver.

Whether the primary purpose of shortening the agreed working hours was to avoid the application of the Minimum Wage Act should be determined by considering the specific circumstances and timing of the agreement to shorten the agreed working hours, and the objective difference and trend of change between the hourly wage for comparison calculated by applying the agreed working hours before and after the shortening and the statutory minimum wage.

The actual working hours of a taxi driver is a concept encompassing not only the operating hours during which the taxi carries passengers (actual passenger-carrying time), but also the time actually spent working by the taxi driver, such as preparation time spent on bringing the taxi in and out of the garage and organizing it, and waiting time spent searching for or waiting for passengers (vacant time, excluding, however, meal and rest periods), and must be estimated in consideration of the actual working environment and work pattern of the taxi driver. Furthermore, where it can be found that such actual working hours of the taxi driver have decreased to some extent, in determining whether there is a substantial discrepancy between the decreased actual working hours and the shortened agreed working hours, the ratio, frequency, and abruptness of the reduction in the agreed working hours must be taken into account.

Moreover, the mere fact that there was a voluntary agreement between the parties to the employment relationship regarding the shortening of the agreed working hours does not weaken the mandatory nature and normative force of Article 6(5) of the Minimum Wage Act; therefore, even if the agreed working hours were freely determined by the parties, where it can be evaluated that they were merely nominally set with the intent to circumvent the application of the said provision, it is difficult to recognize the effect of such agreement.

[3] Not only in cases where a taxi company operating under the fixed-amount remittance quota system shortens the existing agreed working hours, but also in cases where, after the entry into force of Article 6(5) of the Minimum Wage Act as amended by Act No. 8964 on March 21, 2008, the company maintains the existing agreed working hours as they were, if the determination of the existing agreed working hours reaches such a degree that it can be evaluated as merely nominal—for example, because it was set at an unrealistic length significantly divergent from the actual working hours—or if the primary purpose of the parties to the employment relationship in maintaining the existing agreed working hours as they were was to avoid the application of the Minimum Wage Act, and there is a substantial discrepancy between the taxi driver’s actual working hours and the agreed working hours such that it can be regarded as an unlawful act, then such determination of the agreed working hours must be deemed void.

[4] Where an agreement between the parties to an employment relationship to shorten the agreed working hours is void as an unlawful act intended to circumvent the application of, among others, Article 6(5) of the Minimum Wage Act as amended by Act No. 8964 on March 21, 2008, then, in light of the particular nature of such grounds for invalidity, the legal doctrine concerning the loss of effect of collective agreements, and the normative character of employment rules (취업규칙), it is, in principle, the valid provision on agreed working hours as set forth in the prior collective agreement, employment rules, etc. that shall apply. However, where there is no valid provision on the agreed working hours even in the prior collective agreement, employment rules, etc., the court needs to determine the valid agreed working hours by supplementing the intent of the parties to the employment relationship through interpretation of the employment contract, in order to determine, among other things, whether the wage falls short of the minimum wage and the amount of any such shortfall. In this context, the supplemented intent of the parties refers not to the actual or subjective intent of the parties, but to the legitimate intent to adjust interests that can be objectively inferred in light of the purpose of the contract, transactional practice, applicable statutes, and the principle of good faith.

[5] In a case where Company A set the daily agreed working hours at 2 hours for the one-person, one-shift work pattern (1인 1차제) under its prior wage agreement, and maintained the same 2-hour daily agreed working hours even in the wage agreement concluded after the entry into force of Article 6(5) of the Minimum Wage Act as amended by Act No. 8964 on March 21, 2008 (hereinafter the “special provision”), and where B and others, who had worked as taxi drivers and then retired, claimed that the above agreement on agreed working hours was void and sought payment of the shortfall in minimum wage, etc. against Company A, the Supreme Court held as follows: ① the relevant statutes recognize significant exceptions to employee protection provisions or the social security system for “certain employees who provide temporary and occasional labor with low exclusivity to, or contribution toward, the workplace due to extremely short working hours,” i.e., ultra-short-time workers, etc.; however, it cannot be said that the taxi drivers employed by Company A were merely such workers; moreover, since 2 hours of daily agreed working time is markedly insufficient time in which to ordinarily raise the daily remittance quota (사납금), regardless of the taxi driver’s work pattern, the 2-hour daily agreed working hours under the above wage agreement constitutes an unrealistic period significantly divergent from the actual working hours; ② furthermore, in circumstances where Company A would have violated the Minimum Wage Act had it set the daily agreed working hours in excess of 3 hours, the fact that it maintained the daily agreed working hours at 2 hours as before indicates that its primary purpose was to avoid the application of the Minimum Wage Act, and it can also be found that there was a substantial discrepancy between the actual working hours and the agreed working hours. In light of these circumstances, there is a strong possibility that Company A’s maintaining the agreed working hours at 2 hours, as before, is itself either a merely nominal determination of the agreed working hours, or an unlawful act intended to circumvent the application of, among others, the special provision, and is therefore void; the Supreme Court found that the court below erred in its misapprehension of the law, among other errors, in holding otherwise.

[Judgment Below] Busan High Court (Ulsan) Decision 2023Na11053 dated December 11, 2024

[Order]

The judgment below is reversed, and the case is remanded to the Busan High Court.

[Reasoning]

The grounds of appeal are examined.

1. Overview of the Case
According to the reasoning of the judgment below and the evidence lawfully adopted and examined by the court below, the following facts may be found.

A. The Defendants are corporations engaged in the general taxi transportation business. Plaintiff 1 worked as a taxi driving employee at and retired from Defendant ○○ Taxi Co., Ltd. (hereinafter, when referring to the Defendants, the phrase "Co., Ltd." is omitted), Plaintiff 2 at Defendant △△△ Taxi, Plaintiff 3 at Defendant □□ Taxi and Defendant ◇◇ Taxi, Plaintiffs 4 and 8 at Defendant ☆☆ Transportation, Plaintiff 5 at Defendant ◇◇ Taxi, Plaintiff 6 at Defendant ▽▽ Transportation and Defendant ◎◎ Taxi, and Plaintiff 7 at Defendant ◁◁ Transportation.

B. The Plaintiffs were paid wages under the so-called fixed quota (deposit) system, whereby they remitted only a certain fixed amount of the transportation revenue (hereinafter "quota amount") to the Defendants, retained the remainder of the transportation revenue for themselves, and received a certain fixed wage from the Defendants; and they worked under either the alternate-day work system or the one-person-one-vehicle work system.

C. Article 6(5) of the Minimum Wage Act (최저임금법), as amended by Act No. 8964 on March 21, 2008 (hereinafter "the Special Provision at issue"), took effect from July 1, 2009 in Ulsan Metropolitan City, where the Defendants are located, excluding "wages based on production performance" from the scope of wages included in the calculation of the minimum wage.

D. The Defendants each reached the following agreements with labor unions composed of their employees, etc., regarding the daily prescribed working hours under the alternate-day work system (Defendant ○○ Taxi) or the one-person-one-vehicle work system (hereinafter, the agreements by which the Defendants other than Defendant ☆☆ Transportation shortened the prescribed working hours, and the agreement by which Defendant ☆☆ Transportation maintained the prescribed working hours, are collectively referred to as "the instant prescribed working hours agreements").

1) Defendant ○○ Taxi agreed, through the 2007 wage agreement, that the daily prescribed working hours under the alternate-day work system (13 full working days per month) would be 7 hours 20 minutes, then shortened this to 5 hours through the 2009 wage agreement concluded on July 20, 2009, and continued to shorten it in each wage agreement from 2011 to 2018, ultimately setting the daily prescribed working hours at 2 hours 51 minutes under the 2018 wage agreement. Meanwhile, around 2007, Defendant ○○ Taxi additionally agreed, with respect to the one-person-one-vehicle work system, that "23 working days per month shall constitute full attendance. Working 23 days shall be deemed equivalent to full attendance of 13 days under the alternate-day work system, and wages shall be paid in accordance with the 2007 wage agreement." From the 2009 wage agreement onward, Article 9(2) provided that "regardless of the work format, the monthly wage shall be paid in accordance with the wage applicable to the alternate-day work format."

2) Defendant △△△ Taxi set the hours at 4 hours in the 2004 and 2009 wage agreements, then shortened them to 3 hours 30 minutes, 3 hours, and 2 hours 30 minutes through the 2013, 2015, and 2018 wage agreements, respectively.

3) Defendant □□ Taxi set the hours at 4 hours in the 2006 and 2009 wage agreements, then shortened them to 3 hours 30 minutes, 3 hours, and 2 hours 30 minutes through the 2011, 2014, and 2018 wage agreements, respectively.

4) Defendant ◇◇ Taxi set the hours at 4 hours in the 2009 wage agreement, then shortened them to 3 hours 30 minutes and 3 hours through the 2014 and 2017 wage agreements, respectively.

5) Defendant ☆☆ Transportation set the hours at 2 hours in the 2006 wage agreement, and maintained the same 2 hours in the wage agreements from 2009 onward.

6) Defendant ▽▽ Transportation set the hours at 4 hours in the 2004 wage agreement, reduced them to 3 hours 30 minutes through the 2013 wage agreement, then shortened them to 3 hours through the 2015 wage agreement, and maintained the same 3 hours in the 2017 wage agreement.

7) Defendant ◁◁ Transportation set the hours at 4 hours in the 2004 and 2011 wage agreements, then shortened them to 3 hours and 2 hours 30 minutes through the 2013 and 2016 wage agreements, respectively, but through an additional 2016 wage agreement, again set them at 3 hours.

8) Defendant ◎◎ Taxi set the hours at 4 hours 30 minutes in the 2008 wage agreement, then shortened them to 4 hours in the 2009 wage agreement concluded on June 30, 2009, and continued to shorten them annually through each wage agreement from 2014 to 2018, ultimately setting the daily prescribed working hours at 2.36 hours under the 2018 wage agreement.

2. Relevant Legal Principles

A. An employee bears the duty to work during the agreed prescribed working hours, and the employer pays wages for the performance of that duty to work. As long as they do not exceed the statutory standard working hours, the employer and employee may, in principle, freely agree upon the prescribed working hours according to their own will. However, where the determination of the prescribed working hours can be evaluated as reaching a degree of being merely a formality, or where there are special circumstances such as the prescribed working hours having been set with the intent to circumvent mandatory statutory provisions such as labor-related laws, the effect of the agreement as to the prescribed working hours must be denied.

Considering comprehensively Article 32(1) of the Constitution (헌법) and the content and structure of the relevant provisions of the Minimum Wage Act (최저임금법), the legislative purpose and legislative history of the Special Provision at issue, the purport of the provisions of the Passenger Transport Service Act (여객자동차 운수사업법) and the public nature of the general taxi transportation business, and the circumstances surrounding agreements to shorten prescribed working hours, where, under the fixed quota system, an employer, with the intent to avoid a fixed wage excluding production-based wages falling short of the minimum wage, agrees with a labor union of taxi driving employees to shorten only the prescribed working hours—without any change in the actual work format or driving hours—in order to increase the nominal amount of the hourly fixed wage calculated based on the prescribed working hours, such agreement must be deemed void as an unlawful act intended to circumvent the application of the mandatory Special Provision of the Minimum Wage Act, etc. (see Supreme Court en banc Decision 2016Da2451 delivered on April 18, 2019).

B. Whether an agreement to shorten the prescribed working hours reached under the fixed quota system is void as an unlawful circumvention act should be determined from a normative standpoint, focusing on whether the main purpose of the parties to the labor relationship who concluded the agreement was to avoid the application of the Minimum Wage Act, as well as on whether there is a substantial discrepancy between the shortened prescribed working hours and the actual working hours of the taxi driving employee.

Whether the main purpose of shortening the prescribed working hours was to avoid the application of the Minimum Wage Act should be determined by considering the specific circumstances and timing of the agreement to shorten the prescribed working hours, and the objective difference and trend of change between the hourly wage for comparison calculated by applying the prescribed working hours before and after the shortening, and the statutory minimum wage.

The actual working hours of a taxi driving employee is a concept encompassing not only the business hours during which the taxi carries passengers (actual driving time) but also the preparation time required for entering and exiting the garage and organizing the vehicle, and the waiting time spent looking for or waiting for passengers (empty driving time, excluding meal and rest time), i.e., all time during which the taxi driving employee actually provides labor, and this must be estimated in consideration of the actual working environment and work format of the taxi driving employee. Further, where it can be found that the actual working hours of the taxi driving employee have decreased to some extent, in determining whether there is a substantial discrepancy between such decreased actual working hours and the shortened prescribed working hours, the ratio, frequency, and abruptness of the reduction in the prescribed working hours must be considered.

Moreover, the fact that the parties to the labor relationship voluntarily agreed to shorten the prescribed working hours does not weaken the mandatory nature and normative force of the Special Provision at issue as a mandatory statutory provision; therefore, even prescribed working hours freely determined by the parties cannot be given effect where it can be evaluated that they were merely formally set with the intent to circumvent the application of the Special Provision at issue (see Supreme Court Decision 2023Da279402, 280563 delivered on May 30, 2024, etc.).

C. Not only where a taxi company operating under the fixed quota system has shortened the existing prescribed working hours, but also where it has maintained the existing prescribed working hours unchanged even after the Special Provision at issue took effect, if the determination of the existing prescribed working hours reaches a degree that can be evaluated as merely formal, such as being set at an unrealistic level significantly divergent from the actual working hours, or if the main purpose of the parties to the labor relationship who maintained the existing prescribed working hours unchanged was to avoid the application of the Minimum Wage Act, and there is a substantial discrepancy between the actual working hours of the taxi driving employee and the prescribed working hours such that it can be regarded as an unlawful circumvention act, such determination of the prescribed working hours must be deemed void.

D. Where an agreement between the parties to a labor relationship to shorten the prescribed working hours constitutes, and is void as, an unlawful act intended to circumvent the application of the Special Provision at issue, etc., then, in light of the particular nature of such grounds for invalidity, the legal doctrine on the loss of effect of collective agreements, and the normative nature of employment rules, in principle, the valid prescribed working hours clause set forth in the previous collective agreement, employment rules, etc. shall apply. However, where there is no valid provision regarding prescribed working hours even in the previous collective agreement, employment rules, etc., the court needs to determine the valid prescribed working hours by supplementing the intent of the parties to the labor relationship through interpretation of the employment contract, in order to determine whether the minimum wage was not met and, if so, the shortfall amount, etc. In this context, the supplemented intent of the parties does not refer to the actual or subjective intent of the parties, but to the legitimate interest-adjusting intent that can be objectively inferred in light of the purpose of the contract, transactional practice, applicable laws, the good faith principle, etc. (see Supreme Court Decision 2023Da206138 delivered on October 25, 2024).

3. Judgment of the Court Below
The court below, for the following reasons, found it insufficient to conclude that the instant prescribed working hours agreements (excluding, however, Defendant ▽▽ Transportation's 2015 wage agreement) constituted unlawful circumvention acts aimed at evading the Special Provision at issue, and thus did not accept the Plaintiffs' claims for the shortfall in minimum wage and unpaid retirement allowances.

A. Since the hourly amount converted by applying the prescribed working hours (excluding weekly holiday hours) set in the immediately preceding wage agreement to the comparison-target wage under each wage agreement related to the instant prescribed working hours agreements is higher than the hourly minimum wage for the year in which each wage agreement was concluded, it cannot be concluded that the instant prescribed working hours agreements were made for the purpose of circumventing the Special Provision at issue.

B. As for the Defendants other than Defendant ☆☆ Transportation, the degree of shortening of the prescribed working hours cannot be regarded as abrupt, or the prescribed working hours were shortened after a considerable period had elapsed from the time the Special Provision at issue took effect.

C. Defendant ☆☆ Transportation merely maintained, without shortening, the 2-hour prescribed working hours set in the 2006 wage agreement, and since the prescribed working hours clause of the 2006 wage agreement was determined before the Special Provision at issue was amended, it cannot be regarded as void as an unlawful circumvention act aimed at circumventing the application of the Special Provision at issue.

4. Judgment of the Supreme Court
The judgment of the court below is difficult to uphold as it stands, for the following reasons.

A. As to the Defendants other than Defendant ☆☆ Transportation

1) Defendant ○○ Taxi did not explicitly set the daily prescribed working hours for the one-person-one-vehicle work format. However, around 2007, Defendant ○○ Taxi additionally agreed that even where an employee worked 23 days under the one-person-one-vehicle format, wages would be paid as if the employee had worked 13 days under the alternate-day format. In light of such wage calculation and payment methods and work format, it can be seen that the daily prescribed working hours under the one-person-one-vehicle format were set as the equivalent of 13/23 of the daily prescribed working hours under the alternate-day format. Accordingly, Defendant ○○ Taxi set the daily prescribed working hours under the one-person-one-vehicle format at 4.14 hours (= 7.33 hours (7 hours 20 minutes) × 13 ÷ 23, rounding down after the second decimal place, hereinafter the same) through the 2007 additional agreement, then shortened it to 2.82 hours (= 5 hours × 13 ÷ 23) through the 2009 wage agreement, immediately after the Special Provision at issue took effect, and continued to shorten it every year from 2011 to 2018, ultimately reducing it to only about 39% of the original prescribed working hours of 4.14 hours, i.e., 1.61 hours [= 2.85 hours (2 hours 51 minutes) × 13 ÷ 23]. Considering the timing, ratio, frequency, and abruptness of the initial agreement to shorten the prescribed working hours as described above, together with the fact that a daily period of 2.82 hours or less is difficult to regard as the ordinary daily working hours of a taxi driving employee under the one-person-one-vehicle format, there is substantial ground to find that Defendant ○○ Taxi, through the wage agreements from 2009 onward, set the prescribed working hours at a level substantially discrepant from the actual working hours, with the main purpose of avoiding the application of the Special Provision at issue, etc.

2) Defendants △△△ Taxi, □□ Taxi, ◇◇ Taxi, ▽▽ Transportation, and ◁◁ Transportation, having shortened the daily prescribed working hours under the one-person-one-vehicle format to 3 hours 30 minutes each (3 hours in the case of Defendant ◁◁ Transportation) between 2011 and 2014, further shortened these, ultimately reducing them to 2 hours 30 minutes for Defendants △△△ Taxi, □□ Taxi, and ◁◁ Transportation (although Defendant ◁◁ Transportation later increased it back to 3 hours), and to 3 hours for Defendants ◇◇ Taxi and ▽▽ Transportation.

The aforesaid Defendants shortened the prescribed working hours under the one-person-one-vehicle format to 3 hours 30 minutes or less per day, which is a level difficult to regard as the ordinary daily working hours of a taxi driving employee under the one-person-one-vehicle format. The actual working hours of a taxi driving employee include, in addition to business hours, preparation time and waiting time; considering the dispatch schedules of the aforesaid Defendants, the actual driving conditions of taxi driving employees located in Ulsan Metropolitan City, the work format (one-person-one-vehicle) of Plaintiffs 2, 3, 5, 6, and 7, the level of fixed wages, the consumer price inflation rate, and other factors, it can be inferred that there was a substantial discrepancy between the actual working hours of the aforesaid Plaintiffs and the shortened prescribed working hours. Even if the actual working hours of taxi driving employees affiliated with the aforesaid Defendants decreased to some extent due to, for example, an increase in taxi fares, the finally shortened 2 hours 30 minutes or 3 hours, as well as the preceding 3 hours 30 minutes, appear to be insufficient even for a taxi driving employee under the one-person-one-vehicle format to earn the daily quota amount. It cannot be said that the change in the working hours or work format of the taxi driving employees affiliated with the aforesaid Defendants was sufficient to correspond to the finally shortened prescribed working hours of 2 hours 30 minutes or 3 hours.

3) Defendant ◎◎ Taxi initially set the daily prescribed working hours under the one-person-one-vehicle format at 4 hours 30 minutes through the 2008 wage agreement, then shortened this to 4 hours through the 2009 wage agreement concluded on June 30, 2009, the day before the Special Provision at issue took effect, and thereafter continued to shorten it every year from 2014 to 2018, ultimately reducing it to only about 52% of the original prescribed working hours of 4 hours 30 minutes, i.e., 2.36 hours. Even though there is no confirmed evidence that the actual work format or driving hours of the employees changed within the one year following the conclusion of the 2008 wage agreement, Defendant ◎◎ Taxi shortened the prescribed working hours to 4 hours immediately before the Special Provision at issue took effect, and not only continued to shorten the prescribed working hours every year from 2014 onward, but also, the finally shortened daily prescribed working hours of 2.36 hours is a level difficult to regard as the ordinary working hours of a taxi driving employee under the one-person-one-vehicle format. Considering the foregoing circumstances, there is substantial ground to find that Defendant ◎◎ Taxi entered into the agreement to shorten the prescribed working hours with the main purpose of avoiding the application of the Special Provision at issue, etc., and that there was a substantial discrepancy between the shortened prescribed working hours and the actual working hours.

B. As to Defendant ☆☆ Transportation

1) Regarding the Validity of the Wage Agreements from 2009 Onward

A) Defendant ☆☆ Transportation, in the 2006 wage agreement concluded before the amendment of the Special Provision at issue, set the daily prescribed working hours under the one-person-one-vehicle format at 2 hours and the full-attendance days at 25 days, and merely changed the full-attendance days to 24 days after the Special Provision at issue took effect, while maintaining, without shortening, the daily prescribed working hours of 2 hours.

B) Daily prescribed working hours of 2 hours amounts to a weekly prescribed working hours of only 12 hours, based on 6 working days per week. The Labor Standards Act (근로기준법) excludes the application of the weekly paid holiday system (Article 55) and the annual paid leave system (Article 60) with respect to employees whose weekly prescribed working hours average less than 15 hours over a 4-week period (hereinafter "ultra-short-time employees") (Article 18(3)), and the Act on the Guarantee of Employees' Retirement Benefits (근로자퇴직급여 보장법) exempts employers from the obligation to establish a retirement benefit system for ultra-short-time employees (proviso to Article 4(1)). Furthermore, a person whose monthly prescribed working hours are less than 60 hours is excluded from the application of employment insurance (Article 10(2) of the Employment Insurance Act (고용보험법) and Article 3(1) of its Enforcement Decree), and is also excluded from workplace-based coverage under national health insurance (Article 6(2)(4) of the National Health Insurance Act (국민건강보험법) and Article 9(1) of its Enforcement Decree).

Each of the aforesaid statutory provisions recognizes significant exceptions to employee protection provisions or social security systems for ultra-short-time employees, etc., on the ground that they are "some employees who provide temporary and occasional labor, having low affiliation with or contribution to the workplace due to extremely short working hours" (see Supreme Court Decision 2023Da217312 delivered on July 11, 2024; Constitutional Court en banc Decision 2015Hun-Ba334, 2018Hun-Ba42 delivered on November 25, 2021, etc.).

However, considering the actual driving conditions of taxi driving employees affiliated with taxi companies located in Ulsan Metropolitan City, and the level of fixed wages and quota amounts of Defendant ☆☆ Transportation, it cannot be said that the taxi driving employees affiliated with Defendant ☆☆ Transportation were merely employees whose actual working hours were extremely short, whose affiliation with or contribution to the workplace was low, and who provided temporary and occasional labor. Rather, in light of the fact that Defendant ☆☆ Transportation paid retirement allowances to its affiliated taxi driving employees, it does not appear that Defendant ☆☆ Transportation itself recognized or treated the taxi driving employees as ultra-short-time employees.

Moreover, as noted above, the actual working hours of a taxi driving employee include, in addition to business hours, preparation time and waiting time, and daily prescribed working hours of 2 hours is a period significantly insufficient, regardless of the work format, to ordinarily earn even the daily quota amount. Furthermore, it is difficult to conceive of, and unrealistic for, not only taxi driving employees but also ordinary employees—who are not employees providing temporary or occasional labor—to have their prescribed working hours set at a level recognized under the relevant statutes as qualifying for the significant exceptions applicable to ultra-short-time employees.

Ultimately, the daily prescribed working hours of 2 hours under the wage agreements from 2009 onward can be regarded as an unrealistic period significantly divergent from the actual working hours.

C) Furthermore, the comparison-target wage under the 2009 wage agreement was KRW 300,000 per month, and dividing this by the full-attendance days of 25 or 24 days yields only KRW 12,000 or KRW 12,500; since the hourly minimum wage in 2009 was KRW 4,000, Defendant ☆☆ Transportation would have violated the Minimum Wage Act had it set the prescribed working hours in excess of 3 hours per day. Under these circumstances, the fact that Defendant ☆☆ Transportation, at the time of the 2009 wage agreement, maintained the daily prescribed working hours unchanged at 2 hours—which is significantly shorter even compared to the prescribed working hours of other taxi companies located in Ulsan Metropolitan City around that time—indicates that its main purpose was to avoid the application of the Minimum Wage Act, and it can also be found that there was a substantial discrepancy between the actual working hours and the prescribed working hours.

D) Examining the foregoing circumstances in light of the legal principles discussed above, there is substantial ground to find that Defendant ☆☆ Transportation's maintenance of the prescribed working hours at 2 hours, the same as before, in the wage agreements from 2009 onward, is itself either merely a formal determination of the prescribed working hours, or void as an unlawful act intended to circumvent the application of the Special Provision at issue, etc.

2) Regarding Whether the Agreement on Prescribed Working Hours in the 2006 Wage Agreement Is Valid

A) At the time Defendant ☆☆ Transportation concluded the 2006 wage agreement, the relevant statutes already provided, in the same or similar manner as at the time of the 2009 wage agreement, for matters such as the weekly paid holiday system, the annual paid leave system, the establishment of retirement benefit systems, and the application of employment insurance and national health insurance to ultra-short-time employees, etc. Considering this circumstance together with the fact that the actual working hours of taxi driving employees affiliated with Defendant ☆☆ Transportation at the time of the 2006 wage agreement do not appear to have been shorter than the actual working hours at the time of the 2009 wage agreement, there is substantial ground to find that the determination of the daily prescribed working hours at 2 hours in the 2006 wage agreement was likewise, as with the prescribed working hours under the 2009 wage agreement, an unrealistic determination significantly divergent from the actual working hours, and thus that this too is merely a formality and void.

B) Therefore, the determination of the prescribed working hours under the previous 2006 wage agreement is also invalid, and since there is otherwise no valid determination of the prescribed working hours in the collective agreement, employment rules, etc., the court below should have determined the valid prescribed working hours for the one-person-one-vehicle format by supplementing the intent of the parties to the labor relationship, in order to determine whether the minimum wage was not met by employees under the one-person-one-vehicle format affiliated with Defendant ☆☆ Transportation and, if so, the shortfall amount, etc.

C. Sub-conclusion
There is substantial ground to find that the instant prescribed working hours agreements are void. Nevertheless, the court below, relying solely on the circumstances stated in its reasoning, determined that all of the instant prescribed working hours agreements (excluding, however, Defendant ▽▽ Transportation's 2015 wage agreement) were valid, and thereby rejected all of the Plaintiffs' claims. Such determination by the court below contains an error that affected the judgment, by misapprehending the legal principles concerning the validity of agreements on prescribed working hours and failing to conduct the necessary examination.

5. Conclusion
The judgment below is reversed, and the case is remanded to the court below for further examination and determination, and it is so decided by the unanimous opinion of the Justices participating in the decision, as set forth in the Order.

Justice Park Young-jae (Presiding Justice), Justice Oh Kyung-mi, Justice Kwon Young-jun (Justice in charge), Justice Eom Sang-pil
