A taxi company agreed with its labor union to shorten the statutory working hours (소정근로시간) from 6.6 hours to as little as 2 hours and 50 minutes, without making any actual change to the drivers' work patterns, in an apparent attempt to circumvent the Minimum Wage Act (최저임금법). The Supreme Court held that such an agreement, which reduced working hours only on paper while leaving actual working conditions unchanged, constituted an unlawful act designed to evade mandatory statutory provisions and was therefore invalid. The Court reversed the lower court's decision and remanded the case for further proceedings.

Key takeaways
  • CaseA taxi company, seeking to avoid minimum wage obligations, entered into an agreement with its union to shorten the officially recorded statutory working hours from 6.6 hours to as little as 2 hours and 50 minutes, without changing the drivers' actual work schedules.
  • OutcomeThe Supreme Court ruled that reducing working hours only on paper, without any real change in work patterns, was an unlawful evasion of the Minimum Wage Act and therefore invalid.
  • LessonEven with union agreement, formal changes to working conditions made solely to circumvent mandatory labor laws like the Minimum Wage Act will not be legally recognized.
Issues
  • Whether an agreement to reduce statutory working hours (소정근로시간) is valid under a fixed quota wage system (정액사납금제) used by taxi companies
  • Whether such an agreement constitutes an unlawful act (탈법행위) intended to evade the application of Article 6(5) of the Minimum Wage Act
  • The discrepancy between taxi drivers' actual working hours and their officially recorded statutory working hours
Key reasoning

Under Korea's fixed quota wage system (정액사납금제) commonly used by taxi companies, drivers are paid a fixed wage regardless of actual driving hours, which can be used to evade minimum wage obligations under Article 6(5) of the Minimum Wage Act. The Supreme Court found that where a company reduces the officially recorded statutory working hours without any corresponding change in actual driving schedules or work patterns, the agreement is merely a formal device aimed at circumventing mandatory labor law protections. Such an agreement qualifies as an unlawful evasion (탈법행위) of compulsory statutory provisions and cannot be given legal effect, even if the reduction was agreed to voluntarily by the labor union. The Court emphasized that the substance of the actual working arrangement—not the formal terms on paper—must be considered in determining whether wage and hour laws have been properly applied.

Summary of Decision (English, AI translation)

[1] An employee bears the obligation to work during the agreed working hours, and the employer pays wages for the performance of that work obligation. In principle, the employer and employee may freely agree on the prescribed working hours (소정근로시간) as long as they do not exceed the standard working hours. However, where the determination of the prescribed working hours can be assessed as merely formal, or where there exist special circumstances such as the fact that the prescribed working hours were set with the intent to circumvent mandatory statutory provisions such as labor relations statutes, the effect of the agreement as to the prescribed working hours must be denied.

Considering comprehensively Article 32(1) of the Constitution (헌법) and the content and structure of the relevant provisions of the Minimum Wage Act (최저임금법), the legislative purpose and legislative history of Article 6(5) of the Minimum Wage Act as amended by Act No. 8964 on March 21, 2008 (hereinafter “the special provision”), the purport of the provisions of the Passenger Transport Service Act (여객자동차 운수사업법) and the public nature of general taxi transportation business, and the circumstances surrounding the agreement to shorten the prescribed working hours, where, under a fixed-amount remittance quota system (정액사납금제), an employer, with the intent to avoid a situation in which the fixed wage excluding wages based on output falls below the minimum wage, agrees with a taxi driver's labor union to shorten only the prescribed working hours—without any change in the actual work pattern or driving hours—in order to increase the nominal amount of the hourly fixed wage calculated on the basis of the prescribed working hours, such an agreement must be regarded as void as an unlawful act (탈법행위) intended to circumvent the application of the special provision of the Minimum Wage Act, which is a mandatory statutory provision. The specific circumstances establishing that such an agreement constitutes an unlawful act must be asserted and proven by the party claiming that the agreement is void.

[2] Whether an agreement to shorten the prescribed working hours made under a fixed-amount remittance quota system is void as an unlawful act must be determined from a normative perspective, focusing on whether the primary purpose of the parties to the employment relationship who concluded the agreement was to avoid the application of the Minimum Wage Act, as well as on whether there is a significant discrepancy between the shortened prescribed working hours and the taxi driver's actual working hours.

Whether the primary purpose of shortening the prescribed working hours was to avoid the application of the Minimum Wage Act must be determined by considering the specific circumstances and timing of the agreement to shorten the prescribed working hours, and the objective difference and trend of change between the hourly wage for comparison purposes calculated by applying the prescribed working hours before and after the shortening, and the statutory minimum wage.

The actual working hours of a taxi driver are a concept encompassing not only the operating hours during which the taxi carries passengers (actual driving time), but also the preparation time required for the taxi's entry, exit, and arrangement, and the waiting time spent looking for or waiting for passengers (empty driving time, excluding meal and rest periods)—that is, all the time during which the taxi driver actually provides labor—and must be estimated by taking into account the actual working environment and work pattern of the taxi driver. Furthermore, where it can be found that the taxi driver's actual working hours have partially decreased, in determining whether there is a significant discrepancy between such decreased actual working hours and the shortened prescribed working hours, the ratio, frequency, and abruptness of the shortening of the prescribed working hours must be considered.

[3] Even if there was a voluntary agreement between the parties to the employment relationship regarding the shortening of the prescribed working hours, this does not weaken the purport and normative force of Article 6(5) of the Minimum Wage Act as a mandatory statutory provision. Therefore, even prescribed working hours set by the parties' free will may be deemed ineffective as an agreement where it can be assessed that they were set merely formally with the intent to circumvent the application of the aforementioned provision.

[4] In a case where, upon the enforcement of Article 6(5) of the Minimum Wage Act (hereinafter “the special provision”) as amended by Act No. 8964 on March 21, 2008, Company A, a taxi company, entered into a wage agreement with its labor union setting the daily prescribed working hours at 5 hours, down from the previous 6.6 hours, and thereafter continued to shorten the daily prescribed working hours through annual wage agreements down to 2 hours and 50 minutes; and where B, who worked as a taxi driver, sought payment of unpaid minimum wages, etc., from Company A, asserting that the agreement to shorten the prescribed working hours was void: the Supreme Court held that there was substantial room to view the agreement to shorten the prescribed working hours as an unlawful act intended to circumvent the application of the special provision, in light of the following: Company A would have violated the Minimum Wage Act had it not shortened the prescribed working hours; the prescribed working hours shortened to 2 hours and 50 minutes are difficult to regard as the daily working hours of an ordinary employee; considering the actual driving conditions of taxi drivers in the same region, B's work pattern, the level of the fixed wage, and the rate of increase in consumer prices, it can be inferred that there was a significant discrepancy between B's actual working hours and the shortened prescribed working hours; the special provision merely excluded excess operating revenue from the wage used for comparison purposes, and did not exclude from working hours the driving time spent to earn such excess operating revenue; and the mere fact that the labor union voluntarily entered into the wage agreement with Company A does not render the agreement to shorten the prescribed working hours valid. The Supreme Court found that the lower court's judgment, which held otherwise, erred in its understanding of the applicable legal principles.

[Judgment Below] Suwon District Court Decision 2021Na79254, 79261, decided August 24, 2023

[Order]

The judgment below is reversed, and the case is remanded to the Suwon District Court.

[Reasoning]

The grounds of appeal are examined.

1. Relevant legal principles

A. A worker bears the duty to work during the agreed working hours (소정근로시간), and the employer pays wages for the performance of that duty to work. As long as the statutory working hours are not exceeded, the employer and the worker may, in principle, freely agree on the agreed working hours according to their free will. However, where the setting of the agreed working hours can be evaluated as merely a matter of form, or where there exist special circumstances such that the agreed working hours were set with the intent to circumvent mandatory provisions of labor-related statutes, the effect of the agreement as to the agreed working hours must be denied.

Considering comprehensively the content and structure of Article 32(1) of the Constitution (헌법) and the relevant provisions of the Minimum Wage Act (최저임금법), the legislative purpose and legislative history of Article 6(5) of the Minimum Wage Act as amended by Act No. 8964 on March 21, 2008 (hereinafter “the special provision at issue”), the purport of the provisions of the Passenger Transport Service Act (여객자동차 운수사업법) and the public nature of the general taxi transportation business, and the circumstances surrounding the agreement to shorten the agreed working hours, in a case where, under the fixed-amount quota (사납금) system, an employer, with the intent of avoiding a situation in which the fixed wage excluding production-based wages falls short of the minimum wage, agrees with the taxi drivers’ labor union merely to shorten the agreed working hours—without any change in the actual working pattern or driving hours—in order to increase the nominal amount of the hourly fixed wage calculated on the basis of the agreed working hours, such agreement must be deemed void as an act circumventing the mandatory special provision of the Minimum Wage Act, among other provisions (see Supreme Court en banc Decision 2016Da2451, decided April 18, 2019). The specific circumstances establishing that such an agreement constitutes an act of circumvention must be asserted and proven by the party asserting that the agreement is void.

B. Whether an agreement to shorten the agreed working hours made under the fixed-amount quota system is void as an act of circumvention must be determined from a normative standpoint, focusing on (i) whether the primary purpose of the parties to the labor relationship who concluded the agreement was to avoid the application of the Minimum Wage Act, and (ii) whether there is a substantial discrepancy between the shortened agreed working hours and the actual working hours of the taxi driver, upon comparison of the two.

Whether the primary purpose of shortening the agreed working hours was to avoid the application of the Minimum Wage Act must be determined by considering the specific background and timing of the agreement to shorten the agreed working hours, and the objective difference and trend of change between the hourly wage for comparison calculated by applying the agreed working hours before and after the shortening, on the one hand, and the statutory minimum wage, on the other.

The actual working hours of a taxi driver is a concept encompassing not only the business hours during which the taxi carries passengers (actual passenger-carrying time), but also all time during which the taxi driver actually renders labor, such as preparation time spent on bringing the taxi in and out of the garage and organizing it, and waiting time spent looking for or waiting for passengers (empty-car time, excluding, however, meal and rest breaks), and must be estimated by considering the actual working environment and working pattern of the taxi driver. Further, in a case where it can be found that such actual working hours of the taxi driver have partially decreased, whether there is a substantial discrepancy between the decreased actual working hours and the shortened agreed working hours must be determined by considering the ratio, frequency, and abruptness of the shortening of the agreed working hours.

C. Meanwhile, the fact that there was a voluntary agreement between the parties to the labor relationship regarding the shortening of the agreed working hours does not weaken the purport and normative force of the special provision at issue as a mandatory provision. Therefore, even if the agreed working hours were set by the parties’ free will, where it can be evaluated that the agreed working hours were set merely as a matter of form with the intent to circumvent the application of the special provision at issue, it is difficult to recognize the effect of such agreement.

2. The court below, having comprehensively considered the evidence it adopted, found the facts as stated in its reasoning, and then, considering the circumstances set out below, determined that the agreements to shorten the agreed working hours at issue in this case, made from 2011 through 2018, could not be deemed void.

A. Given the characteristics of the taxi transportation business, in which it is difficult for the Defendant (Counterclaim Plaintiff, hereinafter “Defendant”) to substantively direct and supervise whether the taxi drivers are actually working during their driving hours, or to accurately ascertain their actual working hours, there was a need to set the agreed working hours in advance through labor-management agreement.

B. The Defendant sought to implement the full-amount management system (전액관리제) pursuant to the Passenger Transport Service Act, but the taxi drivers, concerned that their income would decrease due to increased taxes and the like, firmly opposed this. Accordingly, the labor union voluntarily concluded each of the wage agreements at issue in this case, under which, instead of raising the fixed quota amount or raising it only slightly, the agreed working hours were gradually reduced, and the union has consistently maintained its position opposing the implementation of the full-amount management system up to the date the oral argument was closed in the court below.

C. Taxi fares in Gyeonggi-do increased by approximately 65% from 2010 to 2019, while during that same period the Defendant’s fixed quota amount increased only by approximately 34%, and the Defendant’s dispatch time was reduced from 12 hours to 10 hours. It cannot be excluded that the agreement to shorten the agreed working hours at issue in this case may be the result of reflecting, in the wage agreements, the changes in operational indicators, improvements in operational efficiency, and changes in working conditions attributable to the aforementioned increase in taxi fares and reduction in dispatch time.

D. The special provision at issue gave rise to the issue of whether driving hours spent earning excess transport revenue (초과운송수입금) are included in working hours, by excluding excess transport revenue from the wage used for comparison. This had a direct effect on the setting of the agreed working hours, which is closely related to the fixed quota amount, and thus in itself brought about a significant change in the actual working pattern or driving hours of the taxi drivers.

3. However, the judgment of the court below is difficult to uphold as it stands, for the following reasons.

A. When the special provision at issue took effect on July 1, 2010 in ○○-si, where the Defendant is located, the Defendant, approximately six months later, on January 14, 2011, concluded the 2011 wage agreement with the labor union, under which the daily agreed working hours were reduced by approximately 24%, from the existing 6.6 hours to 5 hours. The amount calculated by applying the previous agreed working hours (excluding weekly holiday hours) to the wage for comparison under the 2011 wage agreement falls short of the statutory minimum wage for 2011, so that had the Defendant not shortened the agreed working hours in 2011 as described above, it would have been in violation of the Minimum Wage Act. Thereafter, as the minimum wage continued to rise, the Defendant continuously shortened the daily agreed working hours through wage agreements every year except 2014, and the hourly wage for comparison calculated on that basis increased at a rate generally similar to the rate of increase of the statutory minimum wage. As a result, under the 2018 wage agreement the daily agreed working hours were reduced to as little as 2 hours and 50 minutes, which is not only a reduction of approximately 57% from the original agreed working hours of 6.6 hours, but is also a length of time that can hardly be regarded as the daily working hours of an ordinary worker.

B. The actual working hours of a taxi driver include, in addition to business hours, preparation time and waiting time. Considering the actual driving conditions of taxi drivers located in Gyeonggi-do, such as the Defendant’s drivers, the working pattern of the Plaintiff (Counterclaim Defendant, hereinafter “Plaintiff”) (alternate-day system, 복격일제), the level of the fixed wage, and the rate of increase in consumer prices, it may be inferred that there was a substantial discrepancy between the Plaintiff’s actual working hours and the agreed working hours shortened by the above agreement. Meanwhile, circumstances such as the increase in taxi fares in the Gyeonggi-do region or the decrease in the average daily number of trips during the above period relate only to the decrease in working hours or business hours spent earning the fixed quota amount by taxi drivers working under the fixed-amount quota system, and do not necessarily lead to a decrease in the taxi drivers’ actual working hours; therefore, such circumstances do not in themselves signify a change in the actual working pattern or working hours. Furthermore, in light of the ratio and abruptness of the shortening of the agreed working hours as discussed above, even if the Plaintiff’s actual working hours had partially decreased, it cannot be said that such a change in working hours and working pattern was sufficient to correspond to the shortened agreed working hours.

C. The special provision at issue merely excluded excess transport revenue from the wage used for comparison; it did not exclude, from working hours, the driving hours spent earning such excess transport revenue. Nevertheless, the court below found that the mere implementation of the special provision at issue itself brought about a significant change in the taxi drivers’ actual working pattern or driving hours, and this determination is erroneous.

D. It is true that the Defendant’s taxi drivers and the labor union consistently and firmly opposed the introduction of the full-amount management system, demanding the maintenance of the fixed-amount quota system on the premise of limiting increases in the quota amount and shortening the agreed working hours, and that the Defendant accepted these demands from the workers’ side and thereby made the agreements to shorten the agreed working hours at issue in this case. However, the validity of the agreements to shorten the agreed working hours at issue in this case must be determined by focusing on whether there was an intent to avoid the application of the Minimum Wage Act, together with whether there is a substantial discrepancy between the actual working hours and the agreed working hours shortened by the agreement; the circumstance that the labor union voluntarily concluded each of the wage agreements at issue in this case with the Defendant does not, by itself, render the agreements to shorten the agreed working hours at issue in this case valid.

E. Examining the above circumstances in light of the legal principles set out above, there is substantial room to view the agreements to shorten the agreed working hours at issue in this case as acts of circumvention aimed at evading the application of the special provision at issue. Nevertheless, the court below determined that all of the agreements to shorten the agreed working hours at issue in this case were valid, relying solely on the circumstances stated in its reasoning. This determination by the court below contains an error, which affected the judgment, of misunderstanding the legal principles concerning the validity of an agreement on agreed working hours and thereby failing to conduct the necessary examination.

4. Conclusion

Therefore, the judgment below is reversed, and the case is remanded to the court below for further examination and determination. This Decision is rendered as set forth in the Order, with the unanimous consent of the participating Justices.
