Company A held a registered trademark (등록상표) related to cosmetics but had not used it for over three years, citing concerns about infringing on Company B's trademark rights as its reason for non-use. Company B subsequently filed a petition to cancel A's trademark registration on grounds of non-use (불사용). The Supreme Court held that a mere concern about infringing another party's trademark rights does not constitute an objective, external factor sufficient to establish a 'justifiable reason (정당한 이유)' for non-use, and reversed and remanded the lower court's ruling, which had found such a justifiable reason based on a misapplication of the law.

Key takeaways
  • CaseCompany A did not use its registered cosmetics trademark for over three years out of fear that using it might infringe on Company B's trademark rights, prompting Company B to seek cancellation of A's registration for non-use.
  • OutcomeThe Supreme Court ruled that fear of infringing another's trademark is a subjective, internal concern—not an objective, external factor—and therefore cannot justify non-use, reversing the lower court's decision.
  • LessonTrademark holders cannot avoid cancellation for non-use by citing internal business concerns or litigation risk; only genuinely external, uncontrollable obstacles qualify as a justifiable reason under Korean trademark law.
Issues
  • The scope and requirements for a 'justifiable reason (정당한 이유)' excusing non-use of a registered trademark, and whether it must stem from an objective, external factor
  • Whether a trademark holder's concern about infringing another party's trademark rights (i.e., fear of legal disputes) qualifies as a justifiable reason for non-use
  • Whether mere preparatory actions toward using a registered trademark, without actual use, can establish a justifiable reason for non-use
Key reasoning

Under Article 119(1)(3) of the Trademark Act (상표법), a 'justifiable reason' for non-use that shields a trademark from cancellation is limited to unavoidable circumstances arising from objective, external factors beyond the control of the party entitled to use the mark—such as force majeure, legal restrictions, or sales bans. Subjective, internal factors, such as poor business performance or fear of potential legal disputes, cannot, in principle, qualify as a justifiable reason. The Court reasoned that concern over infringing another party's trademark rights is inherently a subjective, internal consideration of the trademark holder, not an external constraint imposed by outside forces. Furthermore, the Court clarified that merely engaging in preparatory steps toward eventual use of the mark, without actual use, is insufficient to establish a justifiable reason for non-use.

Summary of Decision (English, AI translation)

[1] Article 119(1)3 of the Trademark Act (상표법) provides, as one of the grounds for a trial to cancel trademark registration, the case where none of the trademark holder, the exclusive licensee, or the non-exclusive licensee has used the registered trademark in Korea on its designated goods continuously for three or more years prior to the filing date of the request for the cancellation trial, without justifiable reason. This provision imposes on the trademark holder or the licensee an obligation to use the registered trademark on the designated goods, and allows the trademark registration to be cancelled as a sanction where the registered trademark has not been used for a certain period of time; its purport is to remedy the ills arising from adopting the registration system, under which a trademark may be registered regardless of use so long as certain requirements are met, and to expand the opportunity for other persons to select trademarks.

Article 119(3) of the Trademark Act provides that unless the respondent in a trial to cancel trademark registration proves that the registered trademark was legitimately used in Korea, within three years prior to the filing date of the request for the trial, on at least one of the designated goods relating to the request for the cancellation trial, the trademark holder cannot avoid cancellation of the trademark registration with respect to the designated goods relating to the request for the cancellation trial; however, where the respondent proves a justifiable reason for the non-use, the trademark registration may be exempted from cancellation.

In order to be exempted from cancellation of trademark registration on the ground that such a justifiable reason is recognized, the respondent in the trial to cancel trademark registration must prove not only that the business could not be conducted due to force majeure such as disease or other natural disaster, but also that a situation in which the registered trademark could not be used on the designated goods continued due to an unavoidable cause attributable to an objective and external factor beyond the control of the person entitled to use the registered trademark, such as a situation in which the designated goods of the registered trademark could not be generally and normally traded in Korea due to legal regulation, prohibition of sale, or a national import restriction measure. Absent special circumstances, a cause attributable merely to a subjective and internal factor, such as sluggish business of the person entitled to use the registered trademark or concern over legal disputes, cannot exempt the trademark registration from cancellation.

[2] In a case where Company A, while conducting business such as selling jewelry accessories using the marks "" and "", filed for and obtained registration of a trademark with the mark "" for designated goods including cosmetics, etc., after Company B had obtained registration of trademarks with the marks "" or "" for designated goods including cosmetics, etc., and then Company A requested a trial for invalidation of registration of Company B's trademarks while also taking preparatory actions to use its newly registered trademark, such as commissioning cosmetics packaging designs using the said trademark, and thereafter the ruling invalidating Company B's trademarks became final, but Company B filed a request for a trial to cancel the registration of Company A's above registered trademark on the ground of "non-use of trademark" under Article 119(1)3 of the Trademark Act—

the Supreme Court held as follows: ① although the above registered trademark and Company B's trademarks are similar trademarks, the above registered trademark was registered after having been examined through the examination procedure of an examiner of the Korean Intellectual Property Office (특허청) and determined not to fall under a trademark ineligible for registration, such as being identical with or similar to another person's trademark registered upon an earlier application; if Company A did not use the above registered trademark while accepting the consequences that might arise from such non-use, the responsibility for that should also be attributed to Company A; Company A could receive an objective legal determination on the liability for trademark infringement, for example, by raising a defense of abuse of rights based on the grounds for invalidation of Company B's trademarks, if it were disputed in litigation or otherwise whether the use of the above registered trademark constituted infringement of Company B's trademark rights; there was no specific determination by a court or the Intellectual Property Trial and Appeal Board (특허심판원), in the case concerning invalidation of registration of Company B's trademarks, that the use of the above registered trademark infringed Company B's trademark rights, nor can it be deemed that Company A was under an obligation to refrain from using the above registered trademark; and there are no circumstances suggesting that Company A's non-use of the above registered trademark on the designated goods was due to an inability to conduct business owing to force majeure such as disease or other natural disaster, or due to the designated goods being unable to be generally and normally traded in Korea owing to legal regulation, etc.; taken together, Company A's non-use of the above registered trademark after its registration, on the ground of concern that it might constitute infringement of Company B's trademark rights, cannot be deemed to be attributable to an unavoidable cause arising from an objective and external factor beyond Company A's control;

② if concern over the risk of infringing another person's trademark right were recognized as a justifiable reason for not using a certain trademark, this would result in the registration of that trademark being maintained without the trademark actually being used, which could be contrary to the purport of Article 119(1)3 and (3) of the Trademark Act; and

③ Company A's filing of a request for a trial to invalidate the registration of Company B's trademarks cannot be deemed an act of using a trademark under any item of Article 2(1)11 of the Trademark Act, and the mere fact that Company A took preparatory actions to use the above registered trademark cannot be deemed to constitute a justifiable reason for its non-use;

accordingly, the Supreme Court held that the court below erred in its understanding of the law by finding that there was a justifiable reason for Company A's non-use of the above registered trademark.

[Defendant, Appellant] △△△ Co., Ltd. (Attorneys Yang Young-jun and 4 others, counsel for the defendant)
[Judgment Below] Patent Court Judgment 2023Heo13971, decided May 9, 2024

[Order]

The judgment below is reversed, and the case is remanded to the Patent Court.

[Reasoning]

The grounds of appeal are examined.

1. Overview of the Case
According to the reasoning of the judgment below and the evidence lawfully adopted and examined by the court below, the following facts may be found.

A. Since 2014, the Plaintiff has operated a business selling jewelry accessories, etc., using the trademarks "" and "" (hereinafter referred to as the "Prior-Used Trademarks").

B. On December 6, 2017, the Defendant obtained registration of trademarks (hereinafter referred to as the "Defendant's Trademarks") designating cosmetics, etc. as the designated goods, with the marks "" (Registration No. 1 omitted) or "" (Registration No. 2 omitted).

C. On January 16, 2019, the Plaintiff filed an application for the trademark at issue in this case (hereinafter referred to as the "Registered Trademark at Issue"), designating cosmetics, functional cosmetics, etc. as the designated goods, with the mark "", and obtained trademark registration on August 26, 2019 (Registration No. 3 omitted).

D. On October 8, 2019, the Plaintiff filed a petition with the Korean Intellectual Property Trial and Appeal Board against the Defendant, requesting a trial for invalidation of the registration of the Defendant's Trademarks, asserting that the Defendant's Trademarks had grounds for invalidation of registration under Article 34(1)7, 12, and 13 of the Trademark Act (상표법), among others, in relation to the Prior-Used Trademarks. Thereafter, through the trial and litigation procedures related thereto, a trial decision invalidating the Defendant's Trademarks was finalized on July 27, 2023.

E. Since early 2022, the Plaintiff has commissioned packaging designs, etc. for cosmetic products using the mark of the Registered Trademark at Issue, completed registration as a cosmetics responsible seller under the laws and regulations of the Cosmetics Act (화장품법) with respect to the business of consigned manufacturing and distributing/selling imported cosmetics, held consultations with cosmetics manufacturing and wholesale/retail companies regarding manufacturing and distribution business by way of Original Equipment Manufacturing (OEM) for cosmetics bearing the Registered Trademark at Issue, and completed education as a cosmetics responsible sales manager (hereinafter collectively referred to as the "Preparatory Acts at Issue").

F. On August 29, 2022, the Defendant filed a petition against the Plaintiff, the trademark right holder of the Registered Trademark at Issue, for a trial for cancellation of trademark registration (hereinafter referred to as the "Cancellation Trial at Issue") on the ground that the Plaintiff had not used the Registered Trademark at Issue for functional cosmetics, eye cosmetics, lipstick, skin lotion, skin cosmetics, skin cream, plant-based cosmetics, facial lotion, skin whitening cream, hand cream, facial mask packs, facial serum, skin care lotion, cosmetic cream, cosmetic foundation, and cosmetics (hereinafter referred to as the "Designated Goods Subject to Cancellation"), among the designated goods thereof.

2. Judgment of the Court Below
The court below determined, for the following reasons, that the Plaintiff had a justifiable reason for not having used the Registered Trademark at Issue for the Designated Goods Subject to Cancellation within Korea within 3 years prior to the filing date of the Cancellation Trial at Issue, and that therefore the registration should not be canceled.

A. If the Plaintiff were to use the Registered Trademark at Issue for cosmetics, it would constitute use of a mark similar to the Defendant's Trademarks for designated goods identical or similar to those of the Defendant's Trademarks, which would have a high likelihood of constituting infringement of the trademark rights of the Defendant's Trademarks.

B. After obtaining trademark registration for the Registered Trademark at Issue, the Plaintiff filed a petition for a trial for invalidation of registration of the Defendant's Trademarks on October 8, 2019; however, until the trial decision invalidating the Defendant's Trademarks became final on July 27, 2023, it was impossible to predict with certainty whether the registration of the Defendant's Trademarks would be invalidated.

C. Compelling the Plaintiff to use the Registered Trademark at Issue while knowing that such use would constitute infringement of the trademark rights of the Defendant's Trademarks would be tantamount to forcing the Plaintiff to bear the risk of criminal punishment, and if the Plaintiff had used the Registered Trademark at Issue, this would have resulted in confusion of origin among ordinary consumers and traders, which would ultimately also be contrary to the public interest of protecting consumers.

D. The Plaintiff expressed its intent to use the Registered Trademark at Issue by filing a petition for a trial for invalidation of registration of the Defendant's Trademarks and by engaging in the Preparatory Acts at Issue related to the Registered Trademark at Issue.

3. Judgment of the Supreme Court

A. Article 119(1)3 of the Trademark Act provides, as one of the grounds for a trial for cancellation of trademark registration, that none of the trademark right holder, exclusive licensee, or non-exclusive licensee has, without justifiable reason, used the registered trademark in Korea for its designated goods continuously for 3 years or more prior to the filing date of the petition for the cancellation trial. This provision imposes on the trademark right holder or licensee an obligation to use the registered trademark for the designated goods, and allows for the cancellation of trademark registration as a sanction where the registered trademark has not been used for a certain period of time. Its purpose is to remedy the adverse effects arising from the adoption of the registration system, under which a trademark may be registered regardless of use so long as certain requirements are met, and to expand the opportunity for others to select trademarks (see Supreme Court en banc Decision 2012Hu2463, decided September 26, 2013, etc.).

Article 119(3) of the Trademark Act provides that unless the respondent in a trial for cancellation of trademark registration proves that the registered trademark was legitimately used in Korea for at least one of the designated goods subject to the petition for the cancellation trial within 3 years prior to the filing date of the petition for the trial, the trademark right holder cannot avoid cancellation of the trademark registration with respect to the designated goods subject to the petition for the cancellation trial; however, where the respondent proves a justifiable reason for the non-use, the trademark right holder may avoid cancellation of the trademark registration.

In order for such justifiable reason to be recognized and for the cancellation of trademark registration to be avoided, the respondent in the trial for cancellation of trademark registration must prove not only that the business could not be conducted due to force majeure such as illness or other natural disasters, but also that a situation continued in which the designated goods of the registered trademark could not be used therefor due to unavoidable circumstances arising from objective and external factors beyond the control of the person entitled to use the registered trademark, such as where, due to legal regulations, prohibition of sale, or national import restriction measures, the designated goods of the registered trademark could not be generally and normally traded in Korea. Reasons based solely on subjective and internal factors of the person entitled to use the registered trademark, such as sluggish business performance or concerns about legal disputes, cannot, absent special circumstances, avoid cancellation of the trademark registration.

B. Examining the reasoning of the judgment below in light of the above legal principles, the judgment of the court below is difficult to accept for the following reasons.

1) Article 3(1) of the Trademark Act provides that a person who uses or intends to use a trademark in Korea may obtain registration of its own trademark. The Defendant's Trademarks were registered on December 6, 2017. Notwithstanding the existence of the registration of the Defendant's Trademarks, the Plaintiff filed the application for the Registered Trademark at Issue on January 16, 2019, which may be seen as reflecting an intention to use the Registered Trademark at Issue in the future. However, the fact that there was an intention to use the trademark at the time of filing the application and the fact that there is a justifiable reason for not having used the registered trademark thereafter are matters that must be evaluated entirely separately.

2) Both the Registered Trademark at Issue and the Defendant's Trademarks are coined marks, from which no concept is evoked, making it difficult to compare their concepts, and their appearances are also not similar. However, the Registered Trademark at Issue is pronounced as "□□□", whereas the Defendant's Trademarks are pronounced as "△△△", and thus their pronunciations are similar to each other. The Registered Trademark at Issue and the Defendant's Trademarks are similar marks in that, based on the intuitive perception felt by ordinary consumers or traders, there is a likelihood of confusion as to the source.

However, the fact that the Plaintiff did not use the Registered Trademark at Issue due to concerns about possible trademark infringement cannot be regarded as attributable to unavoidable circumstances arising from objective and external factors beyond the Plaintiff's control, for the following reasons.

A) The Registered Trademark at Issue was registered after undergoing an examination procedure by an examiner of the Korean Intellectual Property Office, who determined, following the application, that it did not fall under a trademark that could not be registered on grounds such as being identical or similar to another person's registered trademark based on an earlier application and being used for goods identical or similar to the designated goods thereof.

B) The existence and content of trademark rights are publicly disclosed through the Trademark Gazette or the trademark registration register, etc., such that the general public may become aware thereof with ordinary care, and a business operator who uses or intends to use a trademark in the course of business bears a duty of care with respect to trademark infringement in the relevant business field (see Supreme Court Decision 2013Da21666, decided July 25, 2013). Since the Plaintiff engaged in the Preparatory Acts at Issue for the purpose of conducting business in the cosmetics field, it may be deemed to bear the aforementioned duty of care and to be capable of independently deciding whether to use the Registered Trademark at Issue. If the Plaintiff did not use the Registered Trademark at Issue while accepting the consequences that could arise from such non-use, then that responsibility should also be attributed to the Plaintiff.

C) If a dispute arose in litigation, etc. as to whether the use of the Registered Trademark at Issue constitutes infringement of the trademark rights of the Defendant's Trademarks, the Plaintiff could receive an objective legal determination regarding liability for trademark infringement by, for example, raising a defense of abuse of rights based on grounds for invalidation of registration of the Defendant's Trademarks or filing a separate petition for a trial for invalidation of registration of the Defendant's Trademarks.

D) The content determined in the judgment or trial decision concerning the case of invalidation of registration of the Defendant's Trademarks pertains to whether there existed grounds for invalidation of registration with respect to the Defendant's Trademarks themselves; therefore, this cannot immediately be regarded as constituting a specific determination by a court or the Korean Intellectual Property Trial and Appeal Board that the use of the Registered Trademark at Issue infringes the trademark rights of the Defendant's Trademarks, nor can it be regarded as having imposed on the Plaintiff an obligation to refrain from using the Registered Trademark at Issue.

E) There are also no circumstances suggesting that the Plaintiff's non-use of the Registered Trademark at Issue for its designated goods was due to an inability to conduct business owing to force majeure such as illness or other natural disasters, or due to an inability of the designated goods to be generally and normally traded in Korea owing to legal regulations, etc.

3) If a concern that the use of one trademark might infringe the trademark rights of another trademark were to be recognized as a justifiable reason for non-use of that trademark, this would result in the maintenance of registration of a trademark that is not actually used, which could be contrary to the purpose of Article 119(1)3 and (3) of the Trademark Act.

4) The Plaintiff's filing of a petition for a trial for invalidation of registration of the Defendant's Trademarks cannot be regarded as an act of use of the trademark under any of the items of Article 2(1)11 of the Trademark Act (see Supreme Court Decision 2001Hu188, decided April 24, 2001, etc.), and even if the Plaintiff engaged in the Preparatory Acts at Issue in order to use the Registered Trademark at Issue, such circumstances alone cannot be regarded as establishing a justifiable reason for the non-use of the Registered Trademark at Issue (see Supreme Court Decision 97Hu3920, decided April 25, 2000, etc.).

C. Nevertheless, the court below determined, based solely on the reasons set forth in its judgment, that the Plaintiff had a justifiable reason for not having used the Registered Trademark at Issue. Such determination by the court below contains an error that misapprehends the legal principles regarding "justifiable reason" under Article 119(1)3 and the proviso of Article 119(3) of the Trademark Act, thereby affecting the judgment.

4. Conclusion
The judgment below is reversed, and the case is remanded to the court below for further examination and determination, by the unanimous opinion of the Justices participating in the decision, as set forth in the Order.
