The Supreme Court of Korea (대법원) ruled that applying a 1-hour deduction rule to the overtime hours of part-time public officials (시간선택제채용공무원, who work 4 hours per day) when they perform overtime work during the standard working hours of full-time officials (9 AM to 6 PM) violates the constitutional right to equality. Since full-time officials do not have a dinner break or rest period during their regular working hours, there was no valid basis for applying the 1-hour deduction during that time slot. The Court reversed the lower court's decision and remanded the case to the Seoul High Court (서울고등법원) to re-examine the plaintiffs' (part-time officials') claims for additional overtime pay.

Key takeaways
  • CasePart-time public officials working 4-hour days performed overtime during the standard 9-to-6 working hours of full-time officials, but the government deducted 1 hour from their overtime pay calculation based on a rule meant for after-hours overtime.
  • OutcomeThe Supreme Court held that this deduction was discriminatory and unconstitutional since no dinner break or rest period exists during standard working hours, and sent the case back for recalculation of unpaid overtime wages.
  • LessonEmployers and government agencies must ensure that deduction rules designed for break times during off-hours overtime are not mechanically applied to overtime performed during normal business hours, as doing so may violate equality principles for part-time workers
Issues
  • Whether the 1-hour deduction clause under Article 15(5)(2)(b) of the Regulation on Allowances for Public Officials (공무원수당 등에 관한 규정) can be applied to overtime work performed by part-time public officials during the standard working hours (9 AM to 6 PM)
  • Whether uniformly applying the 1-hour overtime deduction rule to overtime worked during standard hours infringes upon the equality rights and property rights of part-time public officials
Key reasoning

The 1-hour deduction clause (공제조항) was originally designed to subtract time periods—such as dinner breaks or rest periods—during which an employee is not actually performing work, which typically occur when overtime is worked outside of normal business hours. However, during the normal working hours of full-time officials (9 AM to 6 PM), there is no probability of such idle or break time existing. Therefore, applying the same deduction rule to part-time officials who perform overtime work within this normal time slot (9 AM to 6 PM) constitutes discrimination without reasonable justification, violating the principle of equality. The Court concluded that the deduction clause should only apply to overtime work performed by part-time officials outside of the standard 9-to-6 working hours.

Summary of Decision (English, AI translation)

Article 15(5)(2)(b) of the Regulation on Allowances, etc. for Public Officials (공무원수당 등에 관한 규정), which provides that where a public official other than an on-duty public official, etc. performs overtime work on a day other than a public holiday or Saturday, the monthly overtime work hours shall be calculated by adding the overtime work hours for that day minus one hour (hereinafter the “Deduction Clause”), does not apply to overtime work performed by a time-selective employed public official during his or her regular working hours (referring to the eight hours excluding the one-hour lunch break, out of the period from 9:00 to 18:00; the same shall apply hereinafter). The reasons are as follows.

① In the case of overtime work performed outside regular working hours, it is common practice that, even where an employee reports to work early, there is often a certain period of time before the official start of business during which no actual work is performed, or a certain period of time after the official end of business before overtime work actually begins during which no actual work is performed, and it can be seen that, in most cases, employees take a dinner break or a rest period while performing overtime work. The Deduction Clause is intended to deduct such periods during which no actual work is performed, so that overtime work allowance is paid only for the time during which work is actually performed.

② In the case of a time-selective employed public official who is scheduled to work only part of the regular working hours, most of the four hours of daily overtime work for which overtime work allowance is paid will occur within the regular working hours. During the regular working hours in which full-time public officials work normally, there is no need for a dinner break, and it does not appear that it would commonly occur that only the time-selective employed public official takes a rest period while the organized work of full-time public officials continues under the direction and supervision of superiors.

③ There exists a considerable difference between overtime work performed during regular working hours and overtime work performed outside such hours, in terms of the likelihood that no actual work is performed during certain periods, the possibility of direction and supervision by superiors, the intensity of work, and the like. Nevertheless, it is difficult to find a reasonable basis for applying the Deduction Clause equally to overtime work performed by a time-selective employed public official during regular working hours. This conclusion remains the same even taking into account that Article 47(1)(2) of the State Public Officials Act (국가공무원법), by providing that “matters concerning allowances for public officials shall be prescribed by Presidential Decree,” grants broad discretion to the Presidential Decree regarding the specific content of allowances paid to public officials.

④ Where a time-selective employed public official performs continuous overtime work until around 19:00 without actually having dinner and then leaves work, applying the Deduction Clause in such a case does produce a result contrary to the legislative purpose of the Deduction Clause. However, since this problem arises equally for full-time public officials, it cannot be regarded as discrimination against time-selective employed public officials, and given that, under the current attendance management system, it is realistically difficult to individually ascertain whether actual work was performed during each period of overtime work, the necessity of calculating overtime work hours uniformly according to certain standards, without considering the specific circumstances of each individual public official, cannot be denied. Accordingly, applying the Deduction Clause to overtime work performed by a time-selective employed public official during regular working hours infringes the right to equality of time-selective employed public officials, but applying it to overtime work performed during other hours cannot be regarded as infringing their rights (if the overtime work hours performed outside regular working hours are less than one hour, only that amount of time should be deducted).

[Order]

The judgment of the court below is reversed, and the case is remanded to the Seoul High Court.

[Reasoning]

The grounds of appeal are examined.

1. Outline of the Case
A. The Plaintiffs are civil servants employed under the part-time employment system (시간선택제채용공무원), appointed to work shorter hours than the ordinary working hours of full-time civil servants (8 hours per day, 40 hours per week). They were appointed to work 4 hours per day (excluding lunch time), from 9:00 to 14:00, 20 hours per week.

B. Article 15 of the Regulation on Civil Servants' Allowances, etc. (공무원수당 등에 관한 규정) provides that overtime work allowance shall be paid, within budgetary limits, to a person who works outside the prescribed working hours pursuant to a work order (main text of paragraph 1); that, in principle, the hours of the work order for which overtime work allowance is paid shall not exceed 4 hours per day and 57 hours per month (paragraph 4); and that where a civil servant other than an on-duty civil servant, etc. performs overtime work on a day other than a public holiday or Saturday, the monthly overtime work hours shall be calculated by adding the hours obtained after subtracting 1 hour from the overtime work hours of that day [Item (b) of Subparagraph 2 of Paragraph 5, hereinafter referred to as "the deduction clause at issue"].

C. The Plaintiffs performed overtime work as stated in the "Overtime Work Details" attached to the judgment of the court below, and the Defendant calculated the monthly overtime work hours by subtracting 1 hour from the Plaintiffs' overtime work hours for the relevant day pursuant to the deduction clause at issue, and paid the Plaintiffs overtime work allowance calculated accordingly.

D. The Plaintiffs filed the instant lawsuit claiming overtime work allowance for the overtime work hours deducted by the Defendant pursuant to the deduction clause at issue, asserting as follows.

1) The deduction clause at issue presupposes the work practice whereby a full-time civil servant's overtime work is performed outside the ordinary working hours (referring to the 8 hours excluding the 1-hour lunch break out of the period from 9:00 to 18:00; the same shall apply hereinafter), such that the civil servant has dinner time or rest time during the overtime work hours.

2) However, part-time employment civil servants such as the Plaintiffs cannot have separate meal time or rest time even when performing overtime work after 14:00 falling within the ordinary working hours of full-time civil servants.

3) Nevertheless, applying the deduction clause at issue as is to overtime work performed during ordinary working hours infringes upon the Plaintiffs' right to equality and property rights, and therefore the deduction clause at issue should not be applied to such overtime work.

E. The court below rendered a judgment dismissing all of the Plaintiffs' claims on the ground that it is difficult to view the application of the deduction clause at issue to the overtime work of the Plaintiffs, who are part-time employment civil servants, as infringing upon the Plaintiffs' right to equality or property rights, and the Plaintiffs appealed.

2. Whether the Deduction Clause at Issue May Be Applied to Overtime Work Performed by Part-Time Employment Civil Servants During Ordinary Working Hours

A. The principle of equality set forth in Article 11(1) of the Constitution essentially prohibits arbitrarily treating what is essentially the same differently and what is different the same, and means relative equality, whereby discrimination without reasonable grounds is prohibited in legislating and applying the law (see Supreme Court en banc Decision 2005Du14417, Decided October 29, 2007, etc.).

B. It is reasonable to view that the deduction clause at issue does not apply to overtime work performed by part-time employment civil servants during ordinary working hours. The reasons are as follows.

1) In the case of overtime work performed outside ordinary working hours, due to work practices, there are many cases where, even when a civil servant reports to work early, no actual work is performed before the official start time, or where, even after the official end-of-work time, there exists some period during which no actual work is performed before the overtime work begins, and it can generally be viewed that dinner time or rest time is taken during the performance of overtime work in most cases. The deduction clause at issue is intended to deduct such time during which no actual work is performed, so that overtime work allowance is paid only for time during which actual work is performed (see Constitutional Court en banc Decision 2002Hun-Ra2, Decided October 31, 2002).

2) In the case of a part-time employment civil servant who is scheduled to work only part of the ordinary working hours, the 4 hours of daily overtime work for which overtime work allowance is paid will mostly be performed within the ordinary working hours. During the ordinary working hours in which full-time civil servants normally work, dinner time is not necessary, and it does not appear that it would commonly occur that only the part-time employment civil servant takes rest time while the organizational performance of duties by full-time civil servants continues under the supervision and direction of superiors.

3) There exist considerable differences between overtime work performed during ordinary working hours and overtime work performed at other times, in terms of the likelihood of periods during which no actual work is performed, the possibility of supervision and direction by superiors, the intensity of work, and so forth. Nevertheless, it is difficult to find a reasonable basis for applying the deduction clause at issue identically to overtime work hours performed by part-time employment civil servants during ordinary working hours. This holds true even considering that Article 47(1)(2) of the State Public Officials Act (국가공무원법) provides that "matters concerning allowances for civil servants shall be determined by Presidential Decree," thereby granting broad discretion to the Presidential Decree with respect to the specific content of allowances paid to civil servants.

A) The purpose of the deduction clause at issue is to pay overtime work allowance only for the time during which actual work was performed. However, as seen above, it is difficult to view that, unlike overtime work performed by a full-time civil servant outside ordinary working hours, overtime work performed by a part-time employment civil servant during ordinary working hours commonly includes dinner time or rest time. Nevertheless, applying the deduction clause at issue even to such cases cannot be viewed as conforming to the legislative purpose, and the purpose of the deduction clause at issue can be sufficiently achieved even if the deduction of 1 hour is applied only to overtime work performed by a part-time employment civil servant outside ordinary working hours.

B) Article 15(6) of the Regulation on Civil Servants' Allowances, etc. and the Business Guidelines on Civil Servants' Compensation, etc. (Ministry of Personnel Management Directive, 인사혁신처 예규) enacted pursuant to the delegation thereunder provide for the separate payment of a fixed amount of overtime work allowance equivalent to 10 hours per month, in order to compensate for the disadvantage suffered by a person who actually performed work as a result of the uniform deduction of 1 hour from overtime work hours under the deduction clause at issue. However, this is provided to be paid to "a civil servant whose number of days worked (or on business trip) per month based on regular working days is 15 days or more," and thus is paid identically even to a civil servant who has not performed any overtime work at all and thus suffers no disadvantage due to the deduction clause at issue. As such, the above regulation, which provides for the uniform payment of a fixed amount of overtime work allowance regardless of whether the deduction clause at issue applies due to overtime work, cannot by itself be deemed to fully compensate for the disadvantage suffered by part-time employment civil servants arising from the uniform application of the deduction clause at issue, despite the difference in the form of overtime work between part-time employment civil servants and full-time civil servants.

Furthermore, the separate fixed-amount overtime work allowance is paid to offset the disadvantage arising from the uniform application of the deduction clause at issue, and is not of a nature that should be paid in proportion to the prescribed working hours. Therefore, unless it is recognized that the overtime work hours of part-time employment civil servants are generally shorter than those of full-time civil servants, it is difficult to conclude that the relative disadvantage described above is offset merely because a part-time employment civil servant receives the same fixed-amount overtime work allowance as a full-time civil servant despite the difference in prescribed working hours.

C) Part-time employment civil servants are not the only civil servants who come to perform overtime work during ordinary working hours. However, unlike flexible-hour workers or civil servants who have converted to part-time employment (시간선택제전환공무원) among full-time civil servants, who choose such a working arrangement themselves and may leave it when they wish, part-time employment civil servants cannot arbitrarily change their working arrangement. Considering further that overtime work by part-time employment civil servants occurs frequently, and that there are cases where, including overtime work hours, the total working hours approach the regular working hours of a full-time civil servant, it is difficult to view that the disadvantage suffered by part-time employment civil servants due to the deduction clause at issue is justified.

4) Where a part-time employment civil servant does not actually have dinner and continues overtime work until around 19:00 before leaving work, applying the deduction clause at issue produces a result contrary to the legislative purpose of the deduction clause at issue. However, since this problem arises identically for full-time civil servants as well, it cannot be regarded as discrimination against part-time employment civil servants, and given that, under the current attendance management system, it is realistically difficult to individually ascertain whether actual work was performed during overtime work hours, the necessity of uniformly calculating overtime work hours according to certain standards without considering the specific circumstances of each individual civil servant cannot be denied. Therefore, applying the deduction clause at issue to overtime work performed by part-time employment civil servants during ordinary working hours infringes upon the part-time employment civil servants' right to equality, but applying it to overtime work performed at other times cannot be deemed to infringe upon their rights (if the overtime work hours performed outside ordinary working hours are less than 1 hour, only that amount of time should be deducted).

C. Therefore, the court below's determination that the deduction clause at issue applies even to overtime work performed by the Plaintiffs during ordinary working hours contains an error of misapprehending the legal principles concerning the right to equality and the scope of application of the deduction clause at issue as set forth above, which affected the judgment. However, the court below's determination that the deduction clause at issue applies to overtime work performed by the Plaintiffs after 18:00, although its reasoning is in part inappropriate, is acceptable as being ultimately justified, and there is no error therein of misapprehending the aforementioned legal principles that affected the judgment.

3. Scope of Reversal
Overtime work hours for which overtime work allowance is paid shall be calculated on a monthly basis, by adding daily overtime work hours down to the minute to calculate monthly overtime work hours and then discarding any fraction less than 1 hour, and the monthly overtime work hours shall not exceed 57 hours per month (Article 15(4) and (5) of the Regulation on Civil Servants' Allowances, etc.). Therefore, the specific scope to which the Plaintiffs' claims for overtime work allowance should be upheld must be recalculated in the court below after remand, in accordance with the above upper limit and calculation method, taking into account the purport of this reversal, and accordingly the judgment of the court below must be reversed in its entirety.

4. Conclusion
Without examining the remaining grounds of appeal, the judgment of the court below is reversed, and the case is remanded to the court below for further hearing and determination. This judgment is rendered as stated in the Order, with the unanimous consent of the participating Justices.
