The Supreme Court ruled that, in determining whether an employer exceeded the statutory 12-hour weekly limit on overtime work (연장근로), the calculation should be based on the total weekly working hours exceeding 40 hours—not by adding up the daily hours worked beyond 8 hours each day. The Court also confirmed that when overtime work lasts 4 hours or more, the employer must provide an additional rest break (휴게시간) of at least 30 minutes during that overtime period. Because the lower court applied the wrong calculation method, the Supreme Court reversed and remanded the case.

Key takeaways
  • CaseIncident: An employer had a worker work overtime beyond the 12-hour weekly limit and failed to provide proper rest breaks during that overtime work.
  • OutcomeResult: The Supreme Court ruled that the 12-hour overtime limit must be calculated based on total weekly hours exceeding 40 hours (not the sum of daily hours over 8 hours), and that a 30-minute rest break is mandatory whenever overtime reaches 4 hours or more.
  • LessonLesson: Under the 52-hour workweek system, employers must manage overtime based on total weekly working hours, and must always provide a 30-minute rest break for every 4 hours of overtime work.
Issues
  • What is the correct standard for determining whether the 12-hour weekly overtime limit has been violated?
  • Does the employer have an obligation to provide additional rest breaks during overtime work?
Key reasoning

Under Korean labor law, weekly overtime is capped at 12 hours. The Supreme Court clarified that this limit must be assessed by looking at the total number of hours worked in a week that exceed the standard 40-hour workweek, rather than summing each day's hours that exceed the standard 8-hour workday. Using the daily-based method could produce inaccurate or inflated overtime calculations. The Court further held that the same rest-break rules applicable to regular work hours also apply to overtime: if overtime work reaches 4 hours or more, the employer must give the worker at least 30 minutes of rest during that overtime period, separate from any breaks already given during regular working hours. Since the lower court had used the incorrect daily-accumulation method to determine whether the 12-hour overtime cap was violated, its judgment could not stand.

Summary of Decision (English, AI translation)

[1] Article 50 of the former Labor Standards Act (근로기준법) (before the amendment by Act No. 15108 of November 28, 2017; hereinafter the same) provides that working hours per week shall not exceed 40 hours, excluding rest hours (paragraph 1), and that working hours per day shall not exceed 8 hours, excluding rest hours (paragraph 2), and Article 53 (1) provides that where the parties agree, the working hours under Article 50 may be extended by up to 12 hours per week. Since Article 53 (1) of the former Labor Standards Act sets the limit on extended working hours based on a weekly standard, not a daily standard, whether extended working hours per week exceed 12 hours must be determined based on the working hours exceeding 40 hours among the working hours per week, without considering whether the working hours exceeded 8 hours per day. The reasons are as follows.

(A) Since Article 53 (1) of the former Labor Standards Act sets the limit on extended working hours at 12 hours on a weekly basis, it is natural to interpret "extended working hours" referred to therein as work exceeding the standard working hours "per week" under Article 50 (1) of the same Act. The fact that Article 53 (1) of the former Labor Standards Act provides that "the working hours under Article 50" may be extended, thereby including the working hours under Article 50 (2) within its scope of regulation, means that extended work exceeding 8 hours per day is possible where the parties agree, not that it separately regulates the limit on extended work per day.

(B) The former Labor Standards Act has provisions that set "12 hours per week" as the standard for limiting extended working hours per week in the flexible working hour system or selective working hour system, etc. (Article 53 (2), Article 51, Article 52), but there is no provision setting a weekly total for extended working hours exceeding 8 hours per day.

(C) For extended work exceeding 8 hours per day or exceeding 40 hours per week, wages with an addition of at least 50% of the ordinary wage must be paid (Article 56 of the former Labor Standards Act). The provision requiring the payment of additional wages for extended work is intended to deter extended work by imposing a monetary burden on the employer, while also providing corresponding monetary compensation because extended work causes greater fatigue and tension to the worker and restricts the worker's free time in daily life; it is not a provision aimed at prohibiting extended work itself. By contrast, Article 53 (1) of the former Labor Standards Act, in principle, prohibits having a worker perform extended work exceeding 12 hours per week even where the parties agree, and imposes criminal punishment on violators (Article 110 (1)), thereby aiming to prohibit extended work exceeding 12 hours per week itself. Therefore, the standard for determining extended work subject to additional wage payment need not be the same as the standard for determining extended work exceeding 12 hours per week.

[2] An employer must give a rest period of at least 30 minutes during working hours of 4 hours, and at least 1 hour during working hours of 8 hours [Article 54 (1) of the former Labor Standards Act (근로기준법) (before the amendment by Act No. 15108 of November 28, 2017)], and since the same rest periods must also be given for extended work, where a worker is made to perform 4 hours of extended work in excess of 8 hours per day, a rest period of at least 30 minutes must be given during the extended working hours.

[Judgment Below] Seoul Southern District Court Judgment 2019No2771, decided October 19, 2020

[Order]

The judgment below is reversed, and the case is remanded to the Seoul Southern District Court.

[Reasoning]

The grounds of appeal are examined.

1. Summary of the Charges and the Judgment Below

A. Summary of the Charge of Violation of the Labor Standards Act (근로기준법) Due to Violation of the Restriction on Extended Work

The gist of this part of the charge is that the Defendant, as the representative director of the company involved in this case, which regularly employs 500 workers, caused the non-indicted person, an employee, to perform extended work exceeding 12 hours per week on 48 occasions in 2014, 46 occasions in 2015, and 36 occasions in 2016.

B. Judgment Below

The court below, on the premise that, of the time between the start-of-work time under the rules of employment and the employment contract and the end-of-work time recorded in the work log, all time other than the one-hour rest period constitutes actual working hours, calculated, for each of the non-indicted person's working weeks, the sum of the "working hours exceeding 8 hours per day" for each working day within that week, and determined that where this summed figure for the relevant week exceeded 12 hours, this constituted a violation of Article 53(1) of the former Labor Standards Act (before amendment by Act No. 15108 of November 28, 2017; hereinafter the same), which sets the limit on weekly extended working hours at 12 hours. On this basis, the court below upheld the judgment of the court of first instance, which had found the Defendant guilty (with the remainder found not guilty in the reasoning) with respect to 34 occasions in 2014, 43 occasions in 2015, and 32 occasions in 2016 among the charges in this case.

2. Judgment of the Supreme Court

A. Relevant Legal Principles

1) Article 50 of the former Labor Standards Act provides that working hours per week shall not exceed 40 hours excluding rest time (paragraph 1), and that working hours per day shall not exceed 8 hours excluding rest time (paragraph 2), while Article 53(1) provides that, upon agreement between the parties, the working hours under Article 50 may be extended by up to 12 hours per week. Since Article 53(1) of the former Labor Standards Act sets the limit on extended working hours on a weekly basis only, and not on a daily basis, whether extended work in a given week exceeds 12 hours must be determined based on the working hours in that week that exceed 40 hours, without regard to whether the working hours on any given day exceeded 8 hours. The reasons are as follows.

A) Since Article 53(1) of the former Labor Standards Act sets the limit on extended work at 12 hours on a weekly basis, it is natural to interpret "extended work" as referred to therein as work exceeding the standard working hours "per week" under Article 50(1) of the same Act. The fact that Article 53(1) of the former Labor Standards Act provides that "the working hours under Article 50" may be extended, thereby including the working hours under Article 50(2) within its scope of regulation, means that extended work exceeding 8 hours per day is permissible upon agreement between the parties; it does not mean that a separate limit on daily extended work is thereby imposed.

B) While the former Labor Standards Act contains provisions that use "12 hours per week" as the standard for limiting weekly extended working hours in the context of the flexible working hour system or the selective working hour system, etc. (Article 53(2), Article 51, Article 52), there is no provision setting forth a weekly total for extended working hours exceeding 8 hours per day.

C) With respect to extended work exceeding 8 hours per day or 40 hours per week, the law requires payment of wages with an addition of at least 50% of the ordinary wage (Article 56 of the former Labor Standards Act). The provision requiring the payment of additional wages for extended work is intended, on the one hand, to deter extended work by imposing a monetary burden on the employer, and on the other hand, to provide monetary compensation corresponding to the fact that extended work causes greater fatigue and tension to workers and restricts the free time in their personal lives that workers may otherwise enjoy (see Supreme Court en banc Decision 2012Da89399, decided December 18, 2013); it is not a provision intended to prohibit extended work itself. By contrast, Article 53(1) of the former Labor Standards Act is intended to prohibit extended work exceeding 12 hours per week in itself, in principle prohibiting an employer from causing extended work exceeding 12 hours per week even where the parties have agreed thereto, and imposing criminal punishment on violators (Article 110, Item 1). Accordingly, the standard for determining extended work subject to additional wage payment need not be identical to the standard for determining extended work exceeding 12 hours per week.

2) An employer must provide a rest period of at least 30 minutes where the working hours are 4 hours, and at least 1 hour where the working hours are 8 hours, during the course of the working hours (Article 54(1) of the former Labor Standards Act). Since the same rest period requirement must also apply to extended work, where a worker is made to perform 4 hours or more of extended work in addition to 8 hours of work per day, a rest period of at least 30 minutes must be provided during the course of the extended working hours.

B. Judgment on This Case

Examining the reasoning of the judgment below and the record in light of the legal principles set forth above, the judgment below cannot be accepted.

1) The court below calculated the non-indicted person's actual working hours on the premise that a one-hour rest period was provided only with respect to the standard 8 working hours per day, and that no separate rest period was provided for extended work of 4 hours or more. However, according to the record, it can be seen that the company involved in this case and the labor union entered into labor-management agreements in 2013 and 2015 to the effect that "the Company shall provide an additional 30-minute rest period for extended work in addition to the rest period specified in the collective agreement, and this rest period shall be recognized as extended-work compensation." According to this, on days when the non-indicted person performed extended work of 4 hours or more, there appears to be a strong possibility that the extended working hours, which the court below regarded in their entirety as actual working hours, in fact included a 30-minute rest period.

2) In determining whether extended work in a given week exceeded 12 hours, the court below, rather than using as its standard the extended working hours exceeding 40 hours among the actual working hours for that week, instead summed the extended working hours exceeding 8 hours per day for each working day. This is contrary to the legal principles set forth above.

3) According to the record, the non-indicted person generally worked 5 days per week, on a basic pattern of 3 days of work followed by 1 day off, though in some weeks he worked 3, 4, or 6 days. It appears that on all working days, he worked 8 hours or more. However, as shown below, in some weeks in which he worked 4 days, the total actual working hours for that week did not exceed 52 hours, and thus the extended work did not exceed 12 hours; nevertheless, the court below, by calculating extended working hours through the method of summing the working hours exceeding 8 hours per day, erroneously found the Defendant guilty even with respect to this portion.

① For the week from Monday, April 14, 2014 to Sunday, April 20, 2014 (excluding holidays; the same applies hereinafter), the non-indicted person's total actual working hours, if the rest period for extended work of 4 hours or more is not taken into account, amount to 49 hours 30 minutes (= 12 hours on April 15 + 11 hours 30 minutes on April 16 + 14 hours 30 minutes on April 17 + 11 hours 30 minutes on April 20), and the total extended working hours amount to 9 hours 30 minutes, which does not exceed the 12-hour limit on weekly extended working hours. Moreover, if a 30-minute rest period was provided for each of April 15 and April 17, on which extended work of 4 hours or more was performed, the total actual working hours for the week would be further reduced to 48 hours 30 minutes, and the total extended working hours to 8 hours 30 minutes.

② The week from Monday, February 17, 2014 to Sunday, February 23, 2014, calculated in the same manner, likewise does not exceed 12 hours of weekly extended work. The same applies to the week from Monday, August 29, 2016 to Sunday, September 4, 2016, provided that a rest period of at least 30 minutes was given for extended work of 4 hours or more per day.

4) Accordingly, with respect to the 3 weeks corresponding to ① and ② above, including the third week of April 2014, it cannot be concluded that the Defendant violated the provisions of the former Labor Standards Act concerning restrictions on extended work; nevertheless, the court below, for the reasons stated in its judgment, found the Defendant guilty of this entire portion of the charges as well. This judgment of the court below contains an error, affecting the judgment, of misunderstanding the legal principles concerning the provision of rest periods and the restriction limiting extended work to 12 hours per week. The ground of appeal pointing this out is well-founded. Meanwhile, holiday work is not included in the "12 hours of extended work per week" under Article 53(1) of the former Labor Standards Act; however, since the maximum weekly working hours for the non-indicted person, who did not perform holiday work (the court below found, based on the defense counsel's arguments and other matters, that the non-indicted person did not perform holiday work), would still be 52 hours, not 68 hours, the judgment below to the same effect can be accepted.

3. Scope of Reversal

For the foregoing reasons, the portion of the judgment below concerning the violation of the Labor Standards Act due to violation of the restriction on extended work, insofar as it relates to the 3 weeks including the third week of April 2014, must be reversed. Since the remaining portion of the judgment below is in a relationship of single offense or concurrent offense under the first clause of Article 37 of the Criminal Code (형법) with the reversed portion, it must also be reversed together.

4. Conclusion

Therefore, the judgment below is reversed, and the case is remanded to the court below for further hearing and determination, this Judgment being rendered as stated in the Order by the unanimous opinion of the participating Justices.
