This precedent involves a truck driver at a transportation company who sought to include travel meal allowances (출장식대) and work-related travel expenses (작업출장비) in the calculation of his average wage (평균임금) for severance pay (퇴직금) purposes. The Korean Supreme Court ruled that these allowances were reimbursements for actual expenses rather than compensation for labor, and therefore should not be included in the average wage calculation. The Court also held that a one-time special performance bonus does not qualify as wages, and that if wages were artificially inflated during the three months before retirement, the average wage should instead be calculated based on an earlier period.

Key takeaways
  • CaseA truck driver at a transportation company demanded that travel meal allowances, work-related travel expenses, and a special bonus be included in his average wage for severance pay calculation.
  • OutcomeThe Court ruled that expense reimbursements and one-time special bonuses should not be included in average wage calculations, and that any wage increases intentionally made shortly before retirement must also be excluded.
  • LessonWhen calculating severance pay (퇴직금), only actual wages paid as compensation for labor should be included—expense reimbursements and one-time payments must be excluded, so employers should clearly distinguish between wage components in their regular pay structure.
Issues
  • Whether travel meal allowances and work-related travel expenses qualify as wages for average wage calculation purposes
  • The criteria for determining whether a special performance bonus qualifies as wages
  • How to calculate average wage when wages were intentionally inflated before retirement
Key reasoning

The Court reasoned that travel meal allowances and work-related travel expenses were reimbursements for actual costs incurred (실비변상) rather than payments made in exchange for labor, and thus do not qualify as 'wages' under labor law for average wage calculation purposes. Whether a bonus qualifies as wages depends on whether it was paid continuously and regularly (계속적·정기적 지급); a one-time special performance bonus lacking this regularity does not meet this standard. Additionally, the Court held that when wages are intentionally and artificially increased during the three-month period immediately preceding retirement—for example, to inflate severance pay—that period should be excluded from the average wage calculation, and an earlier, more representative period should be used instead.

Summary of Decision (English, AI translation)

[1] A case holding that the travel meal allowance and work travel expenses paid by a transportation company to its truck drivers cannot be regarded as wages constituting compensation for labor, and therefore should not be included in the average wage that serves as the basis for calculating retirement allowances.

[2] If a bonus is paid continuously and periodically and its payment amount is fixed, it has the nature of wages paid as compensation for labor; however, if the occurrence of the grounds for its payment is uncertain and it is paid on a one-time basis, it cannot be regarded as wages. In addition, whether such a bonus can be included in the average wage that serves as the basis for calculating retirement allowances should, absent special circumstances, be determined based on the time of retirement.

[3] A case holding that where a special performance bonus, paid according to the business performance of the relevant year around the time an employee retires, was paid only once and it is uncertain whether it will continue to be paid in the future, such that it cannot be said to have been paid continuously and periodically, the special performance bonus cannot be regarded as having been paid as wages constituting compensation for labor, and therefore should not be included in the average wage that serves as the basis for calculating retirement allowances.

[4] Since the retirement allowance system is intended to guarantee an employee's ordinary standard of living in the same manner as before, if, when the grounds for payment of a retirement allowance arise, "the wages paid to the employee during the three months prior to the date on which such grounds arose," which serves as the basis for calculating the amount to be paid, are significantly higher than in the ordinary case due to special reasons, using such wages as they are as the basis for calculating the average wage would be contrary to the fundamental purpose of the system, which is to guarantee the employee's ordinary standard of living as before. In such a case, the average wage must be calculated based on the wages for the three months immediately preceding the period during which the employee intentionally engaged in conduct to significantly increase the average wage, excluding that period.

[Lower Court Judgment] Seoul District Court Judgment of April 11, 1997, Case No. 96Na31146

[Order]

The part of the lower court judgment against the Defendant is reversed, and this part of the case is remanded to the Panel Division of the Seoul District Court.

[Reasoning]

The grounds for appeal (including the supplementary brief on the grounds for appeal filed after the deadline, to the extent it supplements the grounds for appeal) are examined.

1. As to the First Ground for Appeal

A. Regarding the Travel Meal Allowance

According to the reasoning of the lower court judgment, the lower court found, based on the evidence it cited, the following facts: the Plaintiff, as a truck driver for the Defendant company, ordinarily began cargo transport work in the early morning and did not finish until the following morning, though he sometimes worked shorter hours; unlike other regular employees, he did not eat at the company cafeteria but instead ate at general restaurants along the highway; the Defendant paid such truck drivers, when they worked 24 hours, a meal allowance of KRW 4,000 per meal for five meals (breakfast, lunch, dinner, night meal, and breakfast again), totaling KRW 20,000, and for shorter working hours, paid a corresponding meal allowance of KRW 4,000 per meal according to the number of meals; as a result, the meal allowances paid to the Plaintiff amounted to KRW 320,000 in January 1995, KRW 266,000 in February of the same year, and KRW 332,000 in March of the same year, whereas regular employees received only KRW 82,500 per month; meanwhile, this meal allowance, called the "meritorious business trip meal allowance" under the Defendant company's regulations, was first established and implemented for the Obong area of the Defendant company on September 20, 1993, and by 1994 was provided for in the wage agreement between labor and management under the collective bargaining agreement and implemented nationwide. Based on these findings, the lower court determined that, although this meal allowance was not applied to all employees of the Defendant company, it could not be said to depend on the special or incidental circumstances of individual workers, nor could it be regarded as compensation for additional expenses incurred due to performing duties under special working conditions or environment; rather, it was reasonable to view it as consideration paid to the Plaintiff for having fulfilled his duty of cargo transport, and thus as wages.

However, even according to the facts found by the lower court, it can be readily discerned that the reason for paying the above travel meal allowance was to reimburse the actual cost of meals when workers, having to work outside the Defendant company's premises, were unable to eat at home or at the company cafeteria and had to purchase meals with their own money. According to the record, regular workers were uniformly paid only KRW 3,300 per meal, totaling KRW 82,500 per month. The difference in the amount of the meal allowance between workers on company premises and workers on business trips reflects a difference in working conditions, not a difference in the quality or quantity of labor; from this perspective, it is difficult to view the travel meal allowance as reflecting compensation for labor. Furthermore, considering that the amount of the travel meal allowance, in the case of the Obong area where the Seoul branch is located, was set based on the prices of restaurants along the Gyeongin Expressway, where drivers mostly ate meals, it is difficult to regard this as compensation for labor rather than as reimbursement of actual expenses. Therefore, of the amount the Plaintiff received as travel meal allowance, the portion exceeding the uniform monthly amount of KRW 82,500 paid to all workers should not be included in the average wage.

B. Regarding the Work Travel Expenses

The lower court found, based on the evidence it cited, the following facts: the Defendant company established and implemented, from September 20, 1993, standards for paying work travel expenses for short- and medium-distance work in the Obong area to truck drivers there, according to daily transport performance by type of work; under these standards, transport performance was evaluated based on the amount of work performed from the start time to the end time of work, and the higher the performance, the higher the work travel expenses; the work travel expenses were, in principle, calculated and paid daily after the completion of work, with detailed amounts calculated according to a work travel expense payment schedule; work travel expenses were implemented not only in the Obong area but nationwide, with separate payment standards established for each region; and the amounts the Plaintiff received as work travel expenses were KRW 363,000 in January 1995, KRW 362,000 in February of the same year, and KRW 392,000 in March of the same year. Based on these findings, the lower court determined that, although these work travel expenses were likewise not paid to all employees of the Defendant company, they could not be regarded as depending on the special or incidental circumstances of individual workers, nor as compensation for additional expenses incurred due to performing duties under special working conditions or environment; rather, it was reasonable to view them as consideration paid to the Plaintiff for having fulfilled his duty of cargo transport, and thus as wages.

However, according to the record, the reason the Defendant company paid such work travel expenses was to enhance the work motivation of its truck drivers under the hourly wage system, thereby improving work efficiency, to correct the practice of improperly demanding money or goods from cargo owners, and, on the other hand, to relieve the burden of expenses individually incurred by drivers during business trips, such as the cost of repairing minor accidents or breakdowns that may occur during operation, or the cost of encouraging on-site staff at cargo owners' factories during container loading and unloading. Accordingly, drivers, each time they finished work and returned to the company, calculated and were paid, as operating expenses, the above-mentioned travel meal allowance, highway tolls, and the work travel expenses together. In the Defendant company's accounting treatment as well, these work travel expenses were treated as an item of operating expenses. Furthermore, the work travel expenses were paid separately from overtime allowances such as overtime work allowance or night work allowance; the specific payment standards appear to vary depending on the characteristics of the region or branch; and the amount, exceeding a monthly average of KRW 300,000, is excessively large compared to that of driving workers who do not receive it. Therefore, it is difficult to regard this as compensation for labor.

C. Nevertheless, the lower court's determination that both the travel meal allowance and the work travel expenses should be regarded as wages and included in the average wage, which is the basis for calculating retirement allowance, constitutes an error of misunderstanding the legal principles concerning average wage, which affected the outcome of the judgment. Therefore, the argument pointing this out has merit.

2. As to the Second Ground for Appeal

If a bonus is paid continuously and periodically and the amount to be paid is fixed, it has the nature of wages paid as consideration for labor (see this Court's Decisions 81Daka1140, delivered February 8, 1983, and 81Daka1275, delivered November 23, 1982, among others); however, if the occurrence of the grounds for payment is uncertain and it is paid only on a one-time basis, it cannot be regarded as wages (see this Court's Decision 82Daka342, delivered October 26, 1982). Moreover, whether such a bonus may be included in the average wage, which is the basis for calculating retirement allowance, must, absent special circumstances, be determined based on the time of retirement (see this Court's Decision 95Da19256, delivered May 14, 1996).

According to the reasoning of the lower court judgment, the lower court found, based on the evidence it cited, the following facts: at the Defendant company, an agreement between labor and management on wages and improvement of working conditions for 1994 was concluded, under which a regular bonus of 500% and a performance bonus of 50% were set as the base, and in addition, an additional special performance bonus of 50% was to be paid within the year depending on the 1994 business performance, and this was paid to all employees in July 1994; thereafter, in the wage agreement on wages and improvement of working conditions for 1995, concluded on July 25, 1995, an agreement was made setting a base bonus of 600%, including the above 50% special performance bonus, and providing for an additional special bonus of 30% to be paid within the year depending on the 1995 business performance, so that in 1995 a total bonus of 630% was paid to all employees. Based on these findings, the lower court determined that the above special performance bonus was not a one-time, incidental, gratuitous, or discretionary payment, but had the nature of wages, being consideration for labor.

However, the condition for payment of the special performance bonus provided for in the 1994 wage agreement was that the special performance bonus of 50% would be paid within the year "depending on the 1994 business performance," and thus it cannot be said that whether it would be paid was fixed.

Furthermore, since the Plaintiff retired on April 22, 1995, whether the above special performance bonus falls within the average wage must also be determined based on the time of the Plaintiff's retirement; at the time the Plaintiff retired, the said special performance bonus had been paid only once, and whether it would continue to be paid in the future was uncertain, so it cannot be said to have been paid continuously and periodically.

Therefore, the special performance bonus that the Plaintiff received in 1994 cannot be regarded as having been paid as wages, that is, as consideration for labor, and thus should not be included in the average wage, which is the basis for calculating retirement allowance.

Nevertheless, the lower court's determination, based solely on the reasoning set forth in its judgment, that the above special performance bonus should be included in the average wage, which is the basis for calculating retirement allowance, constitutes an error of misunderstanding the legal principles concerning wages, which affected the outcome of the judgment. Therefore, the argument pointing this out also has merit.

3. As to the Third Ground for Appeal

Since the retirement allowance system is intended to guarantee the ordinary living standard of the worker in the same manner as before, if "the wages paid to the worker during the three months prior to the date on which the grounds for payment arose," which serves as the basis for calculating the amount to be paid when the grounds for payment of retirement allowance arise, is, due to special circumstances, remarkably greater than in the ordinary case, then using this as it is as the basis for calculating the average wage would run contrary to the fundamental purpose of the system, which is to guarantee the ordinary living standard of the worker as before. In such a case, the average wage must be calculated based on the wages of the three months immediately preceding the period during which the worker intentionally engaged in conduct to significantly raise the average wage, excluding that period (see this Court's Decision 94Da8631, delivered February 28, 1995).

According to the record, the monthly average of the various allowances the Plaintiff received from July to December 1994 was KRW 870,553, whereas the monthly average of the various allowances received during the three months prior to retirement was KRW 1,047,520, a difference of KRW 176,967. Considering the proportion this amount occupies in the Plaintiff's monthly average wage, it cannot be said that the Plaintiff's average wage for the three months prior to retirement was remarkably greater than in the ordinary case, and there is no other evidence to show that the Plaintiff intentionally engaged in conduct to raise the average wage. Therefore, the lower court's rejection of the Defendant's argument that, because the Plaintiff intentionally raised the average wage during the three months prior to retirement in order to obtain an individual taxi license, calculating the retirement allowance based on the thus-raised average wage would violate the principle of good faith, is justified, and there is no error of misunderstanding the legal principles concerning the principle of good faith in calculating the average wage. This argument is without merit.

4. Therefore, the part of the lower court judgment against the Defendant is reversed, and this part of the case is remanded to the lower court, this judgment being rendered in accordance with the unanimous opinion of the participating Justices, as set forth in the Order.
