Workers at a salt production company sued their employer seeking payment of holiday work allowance, monthly leave allowance, and severance pay (퇴직금). The Supreme Court (대법원) ruled that if a fixed work allowance already paid by the employer covers statutory allowances, workers cannot separately claim additional holiday work allowance, while monthly leave allowance may still be claimed under the company's employment rules (취업규칙). The Court also clarified which types of pay should be included in the calculation of 'ordinary wages' (통상임금).

Key takeaways
  • CaseIncident: Workers at a salt production company sued their employer demanding holiday work allowance, monthly leave allowance, and severance pay (퇴직금).
  • OutcomeResult: The Supreme Court (대법원) ruled that no separate allowance is owed if the fixed work allowance already covers statutory allowances, and that performance-based bonuses and actual-performance allowances must be excluded from ordinary wage (통상임금) calculations.
  • LessonLesson: When adopting a comprehensive wage system (포괄임금제), employers must clearly specify whether statutory allowances are included, and must correctly distinguish which payments are made regularly and uniformly when calculating ordinary wages (통상임금).
Issues
  • Scope of holiday work allowance claims for on-duty employees
  • Whether separate statutory allowances can be claimed when a fixed work allowance has already been paid
  • Monthly leave allowance claims for workers in the fisheries/salt production industry
  • Proper scope of items included in the calculation of ordinary wages (통상임금)
  • Reference date for calculating average wages (평균임금) for severance pay purposes
  • Whether unfavorable changes to employment rules (취업규칙) can be applied retroactively
Key reasoning

When a fixed work allowance is paid in lieu of actual overtime, night work, and holiday work allowances, workers cannot make a separate claim for statutory allowances beyond what has already been compensated through that fixed sum. Ordinary wages (통상임금) refer only to compensation paid regularly and uniformly for an employee's prescribed work, so allowances tied to actual work performance or bonuses linked to performance outcomes are excluded from this calculation. The Court reasoned that including such variable or performance-based payments would distort the purpose of ordinary wages, which is meant to reflect a stable baseline of compensation used to calculate other statutory benefits such as overtime pay and severance pay. This reasoning also affects how average wages (평균임금) are calculated for severance pay purposes, since only qualifying regular payments should be factored in.

Summary of Decision (English, AI translation)

[1] Although the rules of employment (취업규칙) of a salt farm company exclude, with respect to employees engaged in the actual salt-field work (current employees, 현업원), the application of the provision granting holiday work allowance equivalent to 150/100 of ordinary wages in case of holiday work, in light of the fact that another provision recognizes certain specific days of the year as paid holidays even for such current employees, the provision excluding the payment of holiday work allowance should be construed as excluding only the additional payment provision requiring payment of 150/100 of ordinary wages, and the right of current employees to claim holiday work allowance within the scope of ordinary wages should still be recognized.

[2] Where the salary regulations (직원보수규정) of a salt farm company provide that, for employees who have an actual work record of 20 days or more per month, a fixed amount according to rank is paid as a lump sum under the name of "work allowance" (근무수당) in lieu of overtime, night, and holiday work allowances, and for employees who fall short of such work record, the amount is calculated on a pro-rata daily basis or at a certain rate according to time, the above work allowance is to be regarded, for the convenience of calculation and in order to encourage employees' motivation to work, as an amount fixed monthly or adjusted downward on the basis of a certain actual working hours, in lieu of the overtime, night, and holiday work allowances that would otherwise be paid according to actual work performance, and as such it shall be deemed valid so long as it is not disadvantageous to the employees; therefore, if an employee has already received such work allowance, he/she may not separately claim holiday work allowance in addition thereto.

[3] Even though Article 49, Item 2 of the Labor Standards Act (근로기준법) provides that Article 47 of the same Act concerning monthly paid leave shall not apply to workers engaged in the fishery industry, where the employer's rules of employment contain a provision concerning the amount of monthly leave allowance payment, the worker may claim monthly leave allowance in accordance with what is prescribed in such rules of employment; therefore, if the rules of employment of a salt farm company provide that one day of monthly paid leave shall be granted per month to employees who have worked a full month without absence according to the regular monthly working days, and there is no other provision indicating that the scope of application is limited to employees other than the current employees engaged in the actual salt-field work, the above provision should be construed as intending to pay monthly leave allowance to current employees as well, notwithstanding the provision of Article 49 of the Labor Standards Act.

[4] Under the Labor Standards Act, ordinary wages, which form the basis for calculating overtime, night, and holiday work allowances as well as annual and monthly leave allowances, refer, unlike average wages, to the hourly wage amount, daily wage amount, weekly wage amount, monthly wage amount, or piece-rate amount that is determined to be paid regularly and uniformly as consideration for the prescribed work or total work, without regard to the actual number of working days or the actual wages received.

[5] Even though the "work allowance" referred to in item "[2]" above has been paid as a fixed amount according to rank where the number of monthly working days is 20 or more, since it bears the character of various statutory allowances based on actual work performance, it may not be included in ordinary wages.

[6] A bonus allowance which, under the rules of employment or the like, is to be paid twice a year according to the company's annual business performance and the employee's work performance, may not be included in ordinary wages in light of the concept of ordinary wages set forth in item "[3]" above.

[7] In calculating the average wage that forms the basis for computing the retirement allowance of a worker who, in the course of a continuing employment relationship, was formally treated as retired and immediately rehired, and who thereafter actually retired, the lower court's disposition of calculating the retirement allowance by treating the employment relationship as having continued without the effect of retirement arising from the said formal retirement processing, and treating the date of actual retirement as the date on which the cause for calculation arose, is justified.

[8] Where the rules of employment concerning the retirement allowance payment rate were changed from a progressive system based on length of service to a flat-rate system, even if the workers consented to the disadvantageous change of the rules of employment, this alone does not mean that the disadvantageously changed rules of employment retroactively apply to the previous period of service; therefore, in calculating the retirement allowance of a worker who was hired before the change of the rules of employment and retired after such change, the retirement allowance payment rate for the period of service from the date of hire until before the change of the retirement allowance payment rate should be calculated by applying the former rules of employment, and the retirement allowance payment rate for the period of service thereafter until the date of retirement should be calculated by applying the changed rules of employment.

[Judgment Below] Seoul High Court Judgment 88Na24429, rendered on May 17, 1989

[Order]

The part of the judgment below concerning the Defendant's loss on the claims for various allowances is reversed, and this part of the case is remanded to the Seoul High Court.
The Defendant's remaining appeal is dismissed, and the costs of the appeal relating to this dismissed portion shall be borne by the Defendant.

[Reasoning]

1. We examine Ground of Appeal 1 raised by the Defendant's attorneys.
(1) According to the reasoning of the judgment below, the court below determined as follows: Article 33, Paragraph 1 of the Defendant company's employment rules excludes, with respect to employees engaged in salt field field-work (field workers), the application of Article 31 of the same rules, which provides for the payment of holiday work allowance equivalent to 150/100 of ordinary wages in cases of holiday work; however, in light of the fact that Article 29 of the same rules recognizes certain specific days of the year as paid holidays even for field workers, the provision excluding the payment of holiday work allowance should be construed as excluding only the additional-payment provision requiring payment of 150/100 of ordinary wages, and that field workers must also be recognized as having a right to claim holiday work allowance within the scope of ordinary wages. Upon examination of the record, the above determination of the court below is justified, and there is no illegality of misunderstanding the legislative purpose of the Labor Standards Act (근로기준법) or the contents of the Defendant company's employment rules and collective agreement, as argued in the grounds of appeal. Therefore, this argument is without merit.
(2) However, according to the reasoning of the judgment below, the court below, while acknowledging that the Plaintiffs had received work allowance (근무수당) during their period of employment, nevertheless ordered the Defendant to pay holiday work allowance separately from this work allowance. However, according to the description in Defendant's Exhibit No. 1 (Employee Compensation Rules) adopted by the court below, under the Defendant's employee compensation rules, "compensation" refers to all money and goods paid to employees pursuant to these rules as consideration for labor (Article 3); the compensation system of employees consists of standard wages (basic pay), non-standard wages (work allowance, production incentive allowance, driving allowance, annual leave allowance, bonus, and daily/night duty allowance), and other wages (leave-of-absence allowance, severance pay) (Article 4); among these, work allowance is a fixed amount paid, set by rank, as an allowance for overtime, night, and holiday work to those with an actual work record of 20 days or more per month, and for employees who fall short of this work record, it is calculated on a daily basis at 1/20 of the amount per day of work in the month for field workers, and on an hourly basis at 1/40 of the amount per hour of overtime, night, or holiday work in the month for general employees (Article 8). Accordingly, it can be seen that this work allowance was designed to be paid as a fixed amount or a reduced adjusted amount each month based on a certain actual period of work, for the sake of convenience in calculation and to encourage employees' motivation to work, in lieu of overtime, night, and holiday work allowances that would otherwise be paid according to actual work performance; and such a provision is valid so long as it is not disadvantageous to employees. Therefore, if the Plaintiffs have already received this work allowance, they cannot separately claim holiday work allowance in addition thereto.

The court below's order to pay holiday work allowance, having overlooked the above point, constitutes an illegality affecting the judgment due to a misinterpretation of the Defendant's employment rules and a failure to exhaust deliberation. This argument regarding this point is with merit.

2. We examine Ground of Appeal 2.
Even though, pursuant to Article 49, Item 2 of the Labor Standards Act (근로기준법), the provisions of Article 47 of the same Act concerning monthly paid leave do not apply to workers engaged in the fisheries industry, if the employer's employment rules contain provisions concerning the payment of monthly leave allowance, workers may claim monthly leave allowance in accordance with the provisions of those employment rules.

According to the description in Plaintiffs' Exhibit No. 5-29 (Employment Rules) adopted by the court below, Article 37 of the Defendant company's employment rules provides that an employee who has worked without absence during the standard number of working days in a month shall be granted one day of monthly paid leave per month. As there is no other provision in these employment rules suggesting that the application of Article 37 is limited to employees excluding field workers engaged in salt field field-work, this provision must be construed as intending to pay monthly leave allowance even to field workers, notwithstanding the provisions of Article 49 of the Labor Standards Act.

The judgment below, having determined to the same effect and granted the Plaintiffs' claim for monthly leave allowance, is justified, and there is no illegality of misunderstanding the legal principles concerning the exclusion of monthly leave allowance for field workers, as argued in the grounds of appeal. Therefore, this argument is without merit.

3. We examine Ground of Appeal 3.
According to the reasoning of the judgment below, the court below, regarding the ordinary wages that form the basis for calculating each of the allowances at issue in this case, found the fact that the Plaintiffs received basic pay, work allowance, production incentive allowance (Plaintiff 1, Plaintiff 10), meal allowance (Plaintiff 4), annual leave allowance, and bonus allowance, etc., during their period of employment with the Defendant company, and then held that, in cases such as the Plaintiffs' where wages are determined according to fixed labor and work performance, "ordinary wages" refers to the amount obtained by dividing the total amount of wages calculated according to work performance during the wage calculation period by the total number of days in that wage calculation period. Accordingly, the court below held that the Plaintiffs' ordinary wages consist of the amount obtained by dividing the total wages—comprising the fixed pay (basic pay + work allowance) received by the Plaintiffs each month, plus the aforementioned production incentive allowance, meal allowance, bonus allowance, etc. received regularly and uniformly by the Plaintiffs as consideration for labor—by the total number of days in each month.

However, under the Labor Standards Act, the "ordinary wages" that form the basis for calculating overtime, night, and holiday work allowances, or annual/monthly leave allowances, etc., unlike average wages, refer to the hourly wage amount, daily wage amount, weekly wage amount, monthly wage amount, or piece-rate wage amount that is determined to be paid regularly and uniformly as consideration for prescribed work or total work, regardless of the actual number of work days or the actual amount of wages received. First, regarding the work allowance, as already noted above, this work allowance in this case is paid at a fixed amount, as an allowance in lieu of the various statutory allowances such as overtime, night, and holiday work allowances, to those with an actual monthly work record of 20 days or more, and for those falling short of this standard number of work days, is paid at a reduced adjusted amount based on the actual number of work days as an allowance in lieu of the aforesaid various statutory allowances. Therefore, even though it has been paid as a fixed amount according to rank when the monthly number of work days is 20 or more, since it bears the character of the various statutory allowances based on actual work performance, it cannot be included in ordinary wages.

Next, regarding the bonus allowance, according to the aforesaid employment rules of the Defendant company, the aforesaid employee compensation rules, and the collective agreement (Defendant's Exhibit No. 2), the bonus allowance is to be paid twice a year according to the Defendant company's annual business performance and the employees' work performance. Therefore, in light of the concept of ordinary wages set forth above, it is also clear that this cannot be included in ordinary wages.

In conclusion, the judgment below's inclusion of the work allowance and bonus allowance in ordinary wages when calculating the relevant amounts constitutes an illegality affecting the judgment due to a misunderstanding of the legal principles governing the calculation of ordinary wages. This argument regarding this point is with merit.

4. We examine Ground of Appeal 4.
According to the reasoning of the judgment below, the court below, as set forth in its holding, in calculating the average wage that forms the basis for calculating the severance pay of the Plaintiffs who, during the continuation of their employment relationship, formally retired once and immediately re-entered employment, and actually retired on the respective dates of departure set forth in the holding, held that the effect of retirement arising from the aforesaid formal retirement processing did not occur, treated the employment relationship as having continued, and calculated the severance pay by treating the actual date of retirement as the date on which the cause for calculation arose. Upon examination of the record regarding the evidence adopted and weighed by the court below, the above determination and disposition of the court below is acceptable, and there is no illegality of misunderstanding the legal principles as argued in the grounds of appeal.

Furthermore, the court below confirmed the fact that the Defendant company's employment rules concerning the severance pay rate were changed from a progressive system based on length of service to a flat-rate system, effective from May 1, 1972, and in calculating the severance pay of each of the Plaintiffs who joined the company before this change in employment rules and left the company after the change, applied the former employment rules to the severance pay rate for the period of service from the date of joining until April 30, 1972, and applied the changed employment rules to the severance pay rate for the period of service thereafter until the date of departure. Even if, as argued in the grounds of appeal, the workers consented to the disadvantageous change of the employment rules, this alone cannot be deemed to mean that the disadvantageously changed employment rules are retroactively applied even to the previous period of service. Therefore, the above disposition of the court below is justified, and there is no illegality of misunderstanding the legal principles as argued in the grounds of appeal.

5. Therefore, the part of the judgment below concerning the Defendant's loss on the claims for various allowances is reversed and remanded, the Defendant's remaining appeal is dismissed, and the costs of the appeal relating to this dismissed portion shall be borne by the losing party. This judgment is rendered as stated in the Order by the unanimous opinion of the participating Justices.
