A worker was dismissed after his employer discovered that he had falsified his resume when applying for the job, including concealing a prior disciplinary dismissal (징계해고) from a previous employer. The Korean Supreme Court (대법원) upheld the dismissal as valid, ruling that disciplinary action based on falsified career history remains permissible even after the probationary period (시용기간) has ended. The Court also found that obtaining the labor union's implicit consent was sufficient for procedural fairness when disciplining a union official.

Key takeaways
Issues
  • Whether disciplinary dismissal based on falsification and concealment of career history is valid
  • Whether an employer can rely on falsified career information discovered after the probationary period as grounds for dismissal
  • Whether the worker's right to present a defense during disciplinary proceedings was adequately protected
  • Whether implicit agreement with the labor union satisfies procedural requirements for disciplining a union official
  • Whether invoking the expiration of the disciplinary statute of limitations constitutes a violation of the good faith principle
Key reasoning

Falsifying career information at the time of hiring distorts the comprehensive personal assessment necessary for building trust between labor and management and maintaining workplace order, making it a legitimate ground for disciplinary action (징계사유). This holds true even if the falsification is discovered only after the probationary period has passed, since the employer's ability to properly evaluate the worker's qualifications was compromised from the outset. Furthermore, because the employer was unaware of the false information and therefore could not have initiated disciplinary proceedings earlier, the worker's argument that the statute of limitations for disciplinary action (징계시효) had expired was held to violate the principle of good faith (신의칙). The Court reasoned that allowing such a defense would reward the very deception that caused the delay in the first place.

Summary of Decision (English, AI translation)

[1] The reason a company requires a resume stating educational background or career history when employing a worker is not merely to evaluate the worker's ability to work, i.e., labor capacity, but also because it is necessary, for the purpose of building trust between labor and management and maintaining corporate order, to make an employment decision through a comprehensive personal assessment of the worker's intelligence and experience, level of education, honesty, and settlement and adaptability in the workplace, and such resume serves as material for that judgment. Rules of employment or disciplinary regulations that provide for disciplinary dismissal on the ground of false statement of career or concealment of career at the time of hiring are, absent special circumstances, valid. Therefore, the act of concealing one's career or falsely stating one's career on the ground that disclosure of the true career would be expected to result in non-employment cannot be justified, and treating such false statement or concealment of career as grounds for discipline cannot be said to be unlawful as depriving the worker of the right to subsistence.

[2] Since an employer ordinarily trusts as true the career, etc. stated by a worker in a resume, etc., the employer cannot, absent special circumstances, be said to bear a general duty to verify the truthfulness of the contents stated in the worker's resume, etc. Furthermore, as long as false statement of career or concealment of career is provided for as grounds for discipline, it is only natural that such grounds may be relied upon for discipline even after the probationary period has passed, except where the rules of employment, etc. specifically provide that such grounds for discipline may only be invoked during the probationary period. Therefore, it cannot be said that false statement of career or concealment of career cannot be relied upon as grounds for discipline after the probationary period has passed.

[3] Where a request for a disciplinary resolution has been made, the provision of the disciplinary regulations requiring the personnel department to prepare, within five days from the date of receipt of the written request for disciplinary resolution, a written statement of the misconduct in question in a question-and-answer format regarding the person subject to discipline, and to refer it to the disciplinary committee, is a provision established merely for the convenience of the disciplinary committee's deliberation, even though the person subject to discipline may state his or her opinion regarding the suspected facts in the course of that questioning and answering; it is not a provision granting the person subject to discipline a right to present a defense. Accordingly, as long as the collective agreement, rules of employment, disciplinary regulations, etc. contain no provision whatsoever concerning the right of the person subject to discipline to present a defense, whether or not such an opportunity to present a defense was granted has no effect on the validity of the discipline.

[4] The provision of a collective agreement stating that "discipline against union officers shall be subject to prior agreement with the union" clearly means that, in taking a personnel action against a union officer, the employer must, in some form, sincerely exchange opinions with the labor union and exercise its personnel authority only upon reaching "agreement of opinion" between labor and management; a personnel action taken without going through such a procedure is, in principle, void. However, the existence of such a provision cannot be understood as denying the employer's disciplinary authority over its employees itself, nor can it be understood to mean that, whenever grounds for discipline are found to exist with respect to an employee who is a union officer, the disciplinary authority may be exercised only with the union's active consent, in every case without exception. It suffices that an opportunity was afforded for the company and the union to exchange opinions regarding the discipline, and that some form of agreement, whether express or implied, can be found to have been reached.

[5] Where, in commencing disciplinary proceedings against a person subject to discipline, the company gave notice to the labor union, and the union chairman and one other union officer attended the personnel committee meeting convened for the disciplinary resolution on behalf of the union but raised no particular objection to the discipline of the person concerned, such that the disciplinary resolution was reached, it is clear that at least an implied agreement was reached with the labor union regarding the discipline of the person subject to discipline.

[6] Where it is clear that an employee, at the time of joining the company, concealed or falsely stated in the resume an important career matter that would affect the decision on whether to hire him, and that the company, through no fault of its own, failed to become aware of this fact and thus could not exercise its disciplinary authority, such that the disciplinary limitation period elapsed before the company learned of the employee's false statement of career, and that the company, upon learning of it, immediately took disciplinary action against the employee, the employee is a person who, from the time of hiring, concealed his career and falsely stated it in a manner that could significantly affect the decision on his employment, thereby entering into the employment contract in violation of the duty of good faith required between employer and employee. Held: In such a case, for the employee to dispute the validity of the disciplinary action against him on the ground that the disciplinary limitation period had elapsed, even though it was the company's blameless ignorance of the grounds for discipline that caused the period to elapse, is contrary to the principle of good faith and cannot possibly be permitted, when viewed in light of the ordinary person's sense of justice.

[Plaintiff, Appellant] Plaintiff, Counsel Kim Jun-gon and 2 others
[Defendant, Appellee] Daedong Industrial Co., Ltd., Counsel Na Tae-yeong
[Judgment Below] Daegu High Court Decision 93Na2460 delivered on February 17, 1994

[Order]

The appeal is dismissed.
The costs of the appeal are to be borne by the Plaintiff.

[Reasoning]

The grounds of appeal are examined.

1. As to Ground No. 1
Upon examining the reasoning of the judgment below in light of the record, it is determined that the court below's finding of the facts set forth in its judgment, based on a comprehensive consideration of the evidence cited therein, was proper, and no error violating the rules of evidence as pointed out in the grounds of appeal can be found therein. The mere point of misapprehension of facts constitutes a challenge to the lawful fact-finding that falls within the exclusive authority of the court below, which is a fact-finding court, and thus does not constitute a legitimate ground of appeal. The ground of appeal pointing this out cannot be accepted.

2. As to Ground No. 2(a)
The reason an enterprise requires a resume or similar document stating educational background or work experience when hiring a worker is not merely to evaluate the worker's working ability, i.e., labor capacity, but also because, for the formation of trust between labor and management and the maintenance of order within the enterprise, it is necessary to decide whether to employ the person after a comprehensive assessment of the worker's whole character, including intelligence, experience, level of education, honesty, and settledness and adaptability in the workplace; the resume, etc., serves as material for such judgment. Therefore, rules of employment or disciplinary regulations that provide for disciplinary dismissal on grounds of false statement of career history or concealment of career history at the time of hiring are, absent special circumstances, valid (see Supreme Court Decision 90Daka23912 delivered on December 7, 1990; Supreme Court Decision 92Da18542 delivered on September 25, 1992, etc.). Accordingly, the act of concealing one's career history or falsely stating one's career history on the ground that disclosure of such career history would be expected to result in non-employment cannot be justified, and treating such act of false statement of career history or concealment of career history as grounds for discipline cannot be deemed to deprive the worker of his right to subsistence; therefore, there is no illegality in treating this as grounds for discipline. Meanwhile, since an employer ordinarily trusts that the career history, etc., stated by a worker in a resume, etc., is true, absent other special circumstances, the employer cannot be said to have a general duty to verify the truthfulness of the contents stated in the worker's resume, etc. Furthermore, insofar as false statement of career history or concealment of career history is provided as grounds for discipline, it is only natural that, except in cases where the rules of employment, etc., contain a special provision stating that such grounds may be invoked as grounds for discipline only during the worker's probationary period, such grounds may also be relied upon as grounds for discipline even after the probationary period has passed. Therefore, it cannot be said that false statement of career history or concealment of career history cannot be treated as grounds for discipline after the probationary period has passed. The ground of appeal pointing this out also cannot be accepted.

3. As to Ground No. 2(b)
According to the record, it can be discerned that the circumstance that led the Defendant company to look into the Plaintiff's past career history was the Plaintiff's active labor union activities; however, considering that the Defendant company had also dismissed a non-party on November 5, 1989, on the ground of false statement in a resume, in addition to the Plaintiff, it cannot be said that the grounds for discipline asserted by the Defendant against the Plaintiff in this case were merely superficial and that the dismissal was in substance an unfair labor practice carried out due to aversion to the Plaintiff's legitimate labor union activities. Therefore, the court below's finding that the Plaintiff's act of false statement of career history or concealment of career history constitutes grounds for dismissal under the Defendant company's collective bargaining agreement, rules of employment, and disciplinary regulations, and its rejection of the Plaintiff's assertion regarding unfair labor practice, is proper, and there is no error of misapprehension of legal principles as pointed out in the grounds of appeal. Moreover, since a person who engaged in legitimate labor union activities would not be subject to disciplinary dismissal, treating the act of concealing a history of disciplinary dismissal as grounds for disciplinary dismissal cannot be said to deny the three labor rights guaranteed under the Constitution. The ground of appeal pointing this out also cannot be accepted.

4. As to Ground No. 2(c)
According to the record, in the case of the Defendant company, the right of the person subject to discipline to present a defense is not provided for in the collective bargaining agreement, rules of employment, or disciplinary regulations; rather, Article 14, Item 3 of the collective bargaining agreement merely provides, with respect to disciplinary procedures, that the labor union chairman and one other person may attend as observers and present arguments, and Article 13, Item 3 of the disciplinary regulations provides that, upon receipt of a request for disciplinary resolution, the personnel department shall, within 5 days from the date of receipt of the request for disciplinary resolution, prepare a statement record in question-and-answer format regarding the misconduct of the person subject to discipline and submit it to the disciplinary committee. In light of its content, this provision of the collective bargaining agreement is clearly not a provision granting the person subject to discipline the right to present a defense, and the provision in the disciplinary regulations regarding the preparation of a statement record, although the person subject to discipline may state his opinion regarding the alleged misconduct in the course of the question-and-answer process, is merely a provision established for the convenience of the disciplinary committee's deliberation, and is not a provision granting the person subject to discipline the right to present a defense. Therefore, insofar as the collective bargaining agreement, rules of employment, disciplinary regulations, etc., contain no provision regarding the right of the person subject to discipline to present a defense, whether or not such an opportunity to present a defense was granted has no effect on the validity of the discipline (see Supreme Court Decision 85Da375, 85Daka1591 delivered on July 8, 1986; Supreme Court Decision 91Da4775 delivered on April 14, 1992; Supreme Court Decision 91Da14406 delivered on October 9, 1992, etc.). Therefore, whether or not the Defendant deprived the Plaintiff of the right to present a defense in imposing the discipline at issue in this case has no bearing on the validity of the discipline at issue in this case, and the ground of appeal disputing this point likewise cannot be accepted.

5. As to Ground No. 2(d)
According to the reasoning of the judgment below, it can be discerned that the collective bargaining agreement provides that discipline against labor union officers shall require prior agreement with the union. Such a provision of the collective bargaining agreement clearly means that, in taking personnel action against a labor union officer, the employer must, in whatever form, sincerely exchange opinions with the labor union and exercise its personnel authority upon reaching "agreement of opinion" between labor and management; personnel action taken without going through such a procedure is, in principle, invalid. However, the existence of such a provision cannot be deemed to negate the employer's disciplinary authority over employees itself (see Supreme Court Decision 92Da50263 delivered on July 13, 1993; Supreme Court Decision 92Da34926 delivered on August 24, 1993, etc.). Accordingly, it cannot be understood to mean that, whenever grounds for discipline are found to exist against an employee who is a labor union officer, the disciplinary authority may be exercised only upon the affirmative consent of the labor union side, regardless of the circumstances; it suffices if an opportunity was provided for the company and the labor union to exchange opinions regarding the discipline, and it can be found that agreement, whether express or implied, was reached in some form.

However, according to the record, it is clear that, in commencing the disciplinary procedure against the Plaintiff, the Defendant company gave notice to the labor union side, and the union chairman and one other officer of the labor union side attended the personnel committee meeting held to resolve on the discipline but raised no particular objection to the discipline against the Plaintiff, leading to the disciplinary resolution at issue in this case. Therefore, it can be found that at least an implied agreement was reached with the labor union side regarding the discipline against the Plaintiff at issue in this case, and the court below's determination to this effect is proper. The ground of appeal pointing this out cannot be accepted.

6. As to Ground No. 2(e)
Article 17 of the disciplinary regulations, which governs the disciplinary procedure for employees of the Defendant company, provides, under the heading "Prescription of Grounds for Discipline," that "a request for disciplinary resolution may not be made where one year has elapsed from the date on which the grounds for discipline arose." This provision is intended to prevent a worker from being placed in an unstable position for a considerable period due to the company's failure to determine whether to exercise its disciplinary authority despite the occurrence of grounds for discipline against the worker that would have allowed the company to unilaterally discipline the worker, and also, since it would be contrary to the principle of good faith for the company to newly exercise its disciplinary authority after having neglected to exercise such authority for a relatively long period, thereby causing the worker to develop an expectation that the company would no longer exercise its disciplinary authority, to place a limitation on the employer's exercise of disciplinary authority due to the passage of the aforementioned period. The starting point of this period is, in principle, the time when the grounds for discipline arose.

Therefore, while the court below interpreted the purport of the restrictive provision regarding the exercise of disciplinary authority under the disciplinary regulations in the manner set forth above, it erred in holding that the starting point of the aforementioned prescriptive period was the time when the Defendant company knew or could have known of the fact of the Plaintiff's false statement of career history, and in thus finding that the disciplinary dismissal at issue in this case was carried out within the prescriptive period. However, as found by the court below, the Plaintiff, at the time of joining the Defendant company, concealed important career history that would have affected the decision on his employment, etc., and falsely stated his career history in his resume, and the Defendant, through no fault of its own, was unaware of such fact and thus failed to exercise its disciplinary authority; it is clear that only on November 20, 1990, after the aforementioned prescriptive period for discipline had already elapsed, did the Defendant become aware of the fact of the Plaintiff's false statement of career history and immediately thereafter take disciplinary action against the Plaintiff. Given these circumstances, the Plaintiff, having from the time of his employment concealed career history that would have had an important effect on his employment, etc., and having entered into the employment contract by falsely stating his career history in violation of the duty of good faith required between employer and employee, cannot be permitted, in light of the ordinary person's sense of justice, to dispute the validity of the disciplinary action against him on the ground that the prescriptive period for discipline had elapsed, when it was rather the Defendant who, through no fault of its own, failed to learn of such grounds for discipline and thus allowed the prescriptive period for discipline to elapse; such conduct is contrary to the principle of good faith and cannot possibly be permitted. The court below's rejection of the Plaintiff's assertion regarding the extinguishment of the disciplinary authority is, as a result, proper, and thus the ground of appeal pointing this out likewise cannot be accepted.

7. Therefore, the appeal is dismissed, and the costs of the appeal are to be borne by the Plaintiff, the appellant. This judgment is rendered as set forth in the Order by the unanimous opinion of the participating Justices.
