In a case where truck/bus drivers at a transportation company sought a court declaration that their dismissals were invalid, the Supreme Court of Korea (대법원) ruled that the disciplinary dismissals (징계해고) were justified based on unauthorized absence from work, falsification of work history on resumes, and refusal to accept dispatch assignments. The Court held that where an employer would not have hired an employee had it known the true facts, false statements about prior work experience on a resume constitute valid grounds for dismissal. The Court also found that the existence of legitimate grounds for dismissal meant the terminations did not constitute unfair labor practices (부당노동행위), even though the drivers had engaged in union activities.

Key takeaways
  • CaseIncident: Drivers at a transportation company were disciplinarily dismissed for unauthorized absence, falsifying their resumes, and refusing dispatch assignments, and subsequently sought a court declaration that the dismissals were invalid.
  • OutcomeResult: The Supreme Court ruled that resume falsification serious enough that the company would not have hired the employee had it known the truth, combined with unauthorized absence and refusal of assignments, constituted legitimate grounds for dismissal.
  • LessonLesson: Falsifying a resume at the time of hiring or being absent without authorization can constitute valid grounds for dismissal even if the employee was involved in union activities, so employees must fulfill their duty of good faith and honesty.
Issues
  • The legal nature and required procedure for standby assignment (대기발령) prior to dismissal
  • Whether false statements in a resume constitute valid grounds for dismissal
  • Whether refusal to accept dispatch/work assignments constitutes valid grounds for dismissal
  • The standard for determining unfair labor practices (부당노동행위) in relation to union activities
Key reasoning

The Supreme Court confirmed that unauthorized absence, resume falsification, and refusal of work dispatch orders are all legitimate grounds for disciplinary dismissal. The Court applied the established legal principle that even where an employee has engaged in labor union activities, a dismissal does not become an unfair labor practice (부당노동행위) as long as legitimate, independent grounds for the dismissal exist. Regarding the resume falsification specifically, the Court held that if the employer would not have hired the employee had it known the truth about the employee's prior experience, such falsification is a valid basis for dismissal, separate from any union-related motive.

Summary of Decision (English, AI translation)

[1] As long as the rules of employment or personnel management regulations do not provide for a stand-by order (待期發令) as a form of disciplinary action, it is not necessary to go through disciplinary procedures, such as giving the person concerned an opportunity to explain, in issuing such an order.

[2] Where an employer's personnel regulations, etc. provide for the grounds for placing an employee on stand-by order, and the employer places an employee on stand-by order pursuant to such regulations, the propriety of the stand-by order must be judged based on the grounds relied upon as the reason for the stand-by order in that particular action, and the propriety of the stand-by order cannot be judged by including entirely separate grounds.

[3] The reason an enterprise requires a resume stating educational background or work experience, or certificates thereof, when hiring an employee is not merely to evaluate the employee's working ability, but also because, for the formation of trust between labor and management and the maintenance of corporate order, it is necessary to determine whether to hire the person based on a comprehensive assessment of the employee's whole character, including intelligence, experience, level of education, honesty, and settledness and adaptability to the workplace, and such information is used as material for that judgment. Therefore, so long as it appears that the company would not have hired the employee had it known of such false statements at the time, it cannot be said that it is unjust to dismiss the employee citing such false statements as the grounds for dismissal.

[4] Rules of employment, etc. that provide that an act of falsely stating one's career history or concealing one's career history at the time of hiring constitutes grounds for disciplinary dismissal are valid as prescribing legitimate grounds for dismissal, and a disciplinary dismissal made pursuant to such rules is justified, unless there exist special circumstances such that the false statement was due to the drafter's mistake or the content thereof is extremely trivial, such that it would not be reasonable under generally accepted social norms to treat it as grounds for disciplinary dismissal, in which case such rules do not apply.

[5] Article 42(1) of the former Labor Standards Act (근로기준법) (before amendment by Act No. 5245 of December 31, 1996) permits extended work by agreement of the parties as one of the exceptions to the eight-hour workday system. Here, "agreement between the parties" means, in principle, an individual agreement between the employer and the employee, and such an agreement between an individual employee and the employer regarding extended work need not be made each time extended work is to be performed, but may also be agreed upon in advance through an employment contract, etc.

[6] Whether an act constitutes a "legitimate act for the business of a labor union" as provided in Article 39, Subparagraph 1 of the former Trade Union Act (노동조합법) (abolished by Article 3 of the Addenda to Act No. 5244 of December 31, 1996) must be judged in accordance with generally accepted social norms, comprehensively considering, in the specific case, the attitude of both labor and management, and the type and degree of the disadvantageous treatment to be imposed by the employer. Where the employee's act cited by the employer as the grounds for disadvantageous treatment is the distribution of leaflets, the content of the leaflets, the number distributed, the timing, targets, and method of distribution, and the resulting impact on the enterprise or its business serve as the standards for determining legitimacy.

[7] A case holding that, where employees, after forming a labor union, posted bills or banners regarding the establishment of the labor union and distributed leaflets to employees of the principal contractor at the workplace of the principal contractor, to the extent that the principal contractor gave notice of termination of the subcontract, such acts of distributing leaflets, etc. by the employees cannot be deemed to have possessed social reasonableness, and thus cannot be considered legitimate labor union activities.

[8] Where it is recognized that, contrary to the grounds for dismissal ostensibly asserted by the employer, the employer in substance dismissed the employee because of the employee's legitimate labor union activities, such dismissal must be regarded as an unfair labor practice. However, where an employee is dismissed for legitimate grounds for dismissal, even if there are traces that the employer viewed the employee's labor union activities with displeasure, or an anti-union intent on the part of the employer is presumed, it cannot be said that the grounds for dismissal in question are merely a pretext on the surface, and therefore it cannot be held to constitute an unfair labor practice.

[9] In a business entity engaged in automobile transportation, the act of dispatching or the instruction to dispatch given by the employer to a driver falls under an ordinary work performance order. Therefore, absent special circumstances, an employee who is a driver must comply with such dispatch instructions from the employer, and refusal to do so constitutes a failure to perform the duty to provide labor, which is the essential and fundamental obligation of an employee under the employment contract; this not only constitutes a default (non-performance of obligation) but also generally constitutes grounds for dismissal.

[Defendant, Appellee] Defendant Co., Ltd. (Attorney: Won Kang-hee)
[Lower Court Judgment] Seoul High Court Judgment of October 2, 1998, Case No. 98Na18331

[Order]

All appeals are dismissed.
The costs of appeal shall be borne by the Plaintiffs.

[Reasoning] The grounds of appeal are examined as follows.

1. On the First Ground

Insofar as the Defendant Company's rules of employment (취업규칙) or personnel management regulations do not provide for a standby order (대기발령, suspension pending reassignment) as a form of disciplinary action, there is no need to follow disciplinary procedures, such as granting the person concerned an opportunity to explain, in issuing such an order (see Supreme Court Decision 94Nu11880 delivered on March 10, 1995). Moreover, the Defendant Company's rules of employment provide that a person who has not been reinstated even after three months or more have elapsed since being placed under a standby order may be dismissed; and even considering that the grounds for a standby order are similar to grounds for discipline, and that a person under a standby order suffers a disadvantage in monthly salary, this does not mean that a standby order is included within disciplinary action. The lower court's determination to this effect is correct, and there is no error of misunderstanding the legal nature of and procedures for standby orders.

This ground of appeal cannot be accepted.

2. On the Second Ground

A. On the Grounds for the Standby Order

According to the record, the lower court found that although the Defendant Company's rules of employment require an employee who wishes to be absent from work for an unavoidable reason to submit an absence report at least one day in advance, Plaintiff 1, around the time of leaving work on May 30, 1996, unilaterally told Deputy Manager (non-party) ○○○, the employee in charge of vehicle dispatch at the Defendant Company, "My uncle has died, so I cannot come to work starting tomorrow," and then, without obtaining the Company's permission, was absent without leave for two days, namely the 31st of the same month and the following day; the Defendant Company treated one of those two days as the Plaintiff's monthly leave and treated the other day as unauthorized absence. The lower court further found that on July 16 of the same year, after the Defendant Company received an urgent notice from non-party Ssangyong Motor Co., Ltd. (hereinafter "Ssangyong Motor") requesting transport of vehicles released from the factory on the following day (Constitution Day, a paid holiday), Deputy Manager ○○○ informed the Plaintiff and seven other drivers (eight in total) of this fact and requested them to come to work the following day. The Plaintiff refused, saying that his friend's grandmother had died and he could not come to work, while the other drivers promised to come to work; however, because the Plaintiff incited the other drivers by saying things such as "What's the point of working for only 54,000 won on a holiday? Why come to work on a holiday?", in the end only four persons, including non-party ○○○, came to work the following day, while the remaining drivers did not. Based on these findings, the lower court determined that, in light of the Defendant Company's rules of employment, the standby order against the Plaintiff was justified. This fact-finding and determination by the lower court are correct, and there is no error of misapprehending the facts in violation of the rules of evidence, nor any error of misunderstanding the legal principles regarding the interpretation of unauthorized absence under the Defendant Company's rules of employment.

However, where an employer's personnel regulations, etc., provide for the grounds for placing an employee under a standby order, and the employer has placed an employee under a standby order pursuant to such regulations, the propriety of the standby order must be judged based on the grounds actually relied upon as the grounds for the standby order in that disposition, and the propriety of the standby order cannot be judged by including entirely separate grounds (see Supreme Court Decision 94Nu11880 delivered on March 10, 1995). According to the record, it is clear that the Defendant Company did not specify, among the grounds for the standby order against the Plaintiff, the matter of "the incident in which the Plaintiff, around January 1996, assaulted Non-party 1 and two others under the pretext of disciplining them on the ground that he was senior in age." Nevertheless, the lower court erred in judging the propriety of the standby order in this case by including even this ground.

However, as seen above, even considering only the remaining grounds among the grounds for the standby order against the Plaintiff, the standby order against the Plaintiff is justified; therefore, the above error of the lower court cannot have affected the outcome of the judgment dismissing the Plaintiff's claim.

This ground of appeal cannot be accepted.

B. On False Statement of Career History in the Resume Among the Grounds for Disciplinary Dismissal

The reason a company requires a resume or certificates stating educational background or career history when hiring an employee is not merely to evaluate the employee's work capability, but also because, for the formation of trust between labor and management and the maintenance of corporate order, it is necessary to decide whether to hire based on a comprehensive assessment of the employee's intelligence, experience, level of education, honesty, and settledness and adaptability with respect to the workplace, and the resume serves as material for such judgment. Therefore, so long as it appears that the company would not have hired the employee had it known of such false statements at the time, it cannot be deemed unjust to dismiss the employee citing this as a ground for dismissal (see Supreme Court Decision 95Da45903 delivered on May 28, 1997). Moreover, rules of employment, etc., that provide for an employee's false statement or concealment of career history at the time of hiring as a ground for disciplinary dismissal are valid as providing a legitimate ground for dismissal, and disciplinary dismissal based thereon is justified, unless there are special circumstances such that the false statement resulted from the drafter's mistake or the content is so trivial that treating it as a ground for disciplinary dismissal would be unreasonable under generally accepted social norms (see Supreme Court Decision 98Du4672 delivered on March 26, 1999).

According to the record, before joining the Defendant Company, Plaintiff 1 worked at three different companies for less than two years each, and at the last of these, Non-party 2 Company, he was dismissed while employed there, filed a petition for remedy against unfair dismissal, but withdrew the petition upon reaching an agreement with the employer and voluntarily resigned. Nevertheless, in order to intentionally conceal this fact, he stated in the career section of the resume he submitted upon joining the Defendant Company that he had worked at two companies for approximately seven years and three years respectively, and falsely stated as though he had never worked at Non-party 2 Company. Given that the Defendant Company, as a transport business, places the highest importance on a driver-employee's transport work experience and work attitude at other companies when hiring, it can be sufficiently inferred that, had the Defendant Company known of such false statements, it would not have hired the Plaintiff; and since such false statement cannot be deemed to have resulted from the Plaintiff's mistake nor to be of an extremely trivial nature, the Defendant Company's disciplinary dismissal of the Plaintiff on these grounds was justified. The lower court's determination to this effect is correct, and there is no error of misunderstanding the legal principles on disciplinary dismissal.

This ground of appeal cannot be accepted.

3. On the Allegation of Mistake of Fact Regarding Plaintiff 1's Refusal of Work Orders Under the Second Ground, and the Allegation of Misunderstanding of Legal Principles Regarding Night-time Overtime Work of Plaintiff 1 Under the Second Ground and of Plaintiff 2 Under the Third Ground

A. On the Allegation of Mistake of Fact

According to the record, the lower court found that, although Plaintiff 1, as a standby driver following the standby order, was required to work in accordance with the Defendant Company's transport orders even when there was no vehicle dispatch assigned for the day, he refused, on eight occasions from July 22, 1996 to August 20 of the same year, to comply with the Defendant Company's work order to transport Istana vehicles released by Ssangyong Motor by road delivery from Pyeongtaek to Incheon, on the ground that he was a fixed driver of car-carrier vehicles; and further, on four occasions from around 16:00 on August 23 of the same year to around 19:15 on September 13 of the same year, he refused to comply with the Defendant Company's work order to transport released vehicles by car carrier from Pyeongtaek to Incheon or to the Samjuk release office, on the ground that he could not perform overtime work because the Defendant Company did not properly pay overtime allowance for night work. This fact-finding by the lower court is correct, and there is no error of misapprehending the facts in violation of the rules of evidence.

This ground of appeal cannot be accepted.

B. On the Allegation of Misunderstanding of Legal Principles

Article 42, Paragraph 1 of the former Labor Standards Act (근로기준법, prior to the amendment by Act No. 5245 of December 31, 1996) allows overtime work by agreement of the parties as one exception to the eight-hour workday system; the "agreement between the parties" here means, in principle, an individual agreement between the employer and the employee, and such agreement concerning overtime work with an individual employee need not be made on each occasion that overtime work is performed, but may also be agreed upon in advance through an employment contract, etc. (see Supreme Court Decision 94Da19228 delivered on February 10, 1995).

According to the facts established by the lower court and the record, the Defendant Company's principal business is to transport vehicles released from the factory immediately upon Ssangyong Motor's instruction pursuant to a subcontract with Ssangyong Motor; and owing to the nature of this transport business, it is difficult for the Defendant Company to fix dispatch times for its drivers, and in order to respond flexibly to Ssangyong Motor's sudden transport requests, the Defendant Company, at the time of hiring employees including Plaintiff 1 and Plaintiff 2, notified the employees of the possibility of such regular overtime work, and the employees were hired having agreed to perform overtime work. It is also found that most of the work orders refused by the Plaintiffs involved transporting vehicles released from the factory one additional time from the Pyeongtaek release yard to the Samjuk release yard, taking about 150 minutes round trip, such that the overtime hours did not exceed 12 hours per week; and that the Defendant Company had uniformly paid drivers a night allowance of 250,000 won per month regardless of actual overtime hours worked. Given these circumstances, if the Plaintiffs refused the Defendant Company's dispatch orders, in breach of this overtime work agreement, merely because the overtime allowance was small, this constitutes a case of failing to comply with a legitimate work order under the rules of employment and failing to follow a legitimate order of the Company.

Although the lower court's reasoning—which, emphasizing that the Defendant Company had fixedly paid night-work allowances to the Plaintiffs, determined that the Plaintiffs' refusal of the work orders without following the procedures prescribed under the Labor Standards Act, etc. for claiming overtime allowance constituted non-compliance without justifiable cause with the transport work orders—is somewhat inappropriate in its reasoning, the conclusion reached is the same as this Court's determination, and is therefore correct; there is no error of misunderstanding the legal principles regarding the mandatory nature of the Labor Standards Act and overtime work.

This ground of appeal cannot be accepted.

4. On the Third Ground

A. On the Legitimacy of the Plaintiffs' Acts of Posting Bills and Banners and Distributing Leaflets

Whether an act falls under a "legitimate act for the business of a labor union" as provided in Article 39, Item 1 of the former Trade Union Act (노동조합법, prior to its abolition by the Act on the Organization and Operation of Trade Unions and Labor-Management Relations Adjustment (노동조합및노동관계조정법), enacted as Act No. 5244 of December 31, 1996) must be determined in light of generally accepted social norms, comprehensively considering, in the specific case, the attitudes of both labor and management and the manner and degree of the disadvantageous treatment to be imposed by the employer; and where the employee's act which formed the basis for the disadvantageous treatment is the distribution of leaflets, the content of the leaflets, their number, the timing, target, and method of distribution, and the effect thereof on the enterprise or its business will serve as the criteria for determining legitimacy (see Supreme Court Decision 91Nu5020 delivered on March 13, 1992).

According to the record, the lower court found that, after organizing a labor union at the Defendant Company on September 15, 1996, the Plaintiffs, without the prior approval of Ssangyong Motor, posted bills concerning the establishment of the union at the cafeteria and the main gate of Ssangyong Motor's Pyeongtaek plant on the 16th of the same month, and distributed leaflets concerning the union's establishment to Ssangyong Motor's employees at the main gate of the plant; that when Ssangyong Motor thereupon sent an official letter to the Defendant Company urging it to stop such acts, the Defendant Company requested the Plaintiffs to stop such acts; that around that time, although the Plaintiffs were in the process of mutual negotiations with the Defendant Company concerning the conclusion of a collective agreement, the Plaintiffs, on the ground that the negotiations were not proceeding smoothly, drove within Ssangyong Motor's plant premises vehicles owned by the Defendant Company (car carriers) with banners attached reading "Congratulations on the Founding of the Defendant Company Labor Union"; that Ssangyong Motor thereupon notified the Defendant Company that it would prohibit entry of vehicles bearing such banners, and when the Defendant Company requested the Plaintiffs to remove the banners, the Plaintiffs refused, asserting that this constituted an obstruction of legitimate union activities, and in opposition thereto, refused to comply with the Defendant Company's transport work orders. Based on these findings, the lower court determined that the Plaintiffs' acts were difficult to regard as legitimate union activities, and that the Plaintiffs' refusal to comply with the transport work orders in opposition to the Defendant Company's request to stop constituted grounds for the standby order and for dismissal.

According to the record, it is found that the Plaintiffs' acts led to a situation in which Ssangyong Motor notified the Defendant Company of its intent to terminate the vehicle transport subcontract. Taking together the above findings of the lower court and these circumstances, the Plaintiffs' above acts cannot be deemed to possess social reasonableness in light of the manner, location, and target of the acts and their effect on the Defendant Company's business, and thus cannot be deemed legitimate union activities.

The lower court's fact-finding and determination to this effect are correct, and there is no error of misapprehending the facts in violation of the rules of evidence, nor any error of misunderstanding the legal principles concerning legitimate acts for the business of a labor union.

This ground of appeal cannot be accepted.

B. Regarding the grounds for the standby order against Plaintiff 3 and Plaintiff 4, and the refusal of work orders dated October 28, 1996 by Plaintiff 2, Plaintiff 3, and Plaintiff 5, and the refusal of a work order dated October 29 of the same month by Plaintiff 4, examination of the record shows that the lower court's fact-finding regarding the refusal by Plaintiff 3, Plaintiff 4, Plaintiff 2, and Plaintiff 5 of the Defendant Company's transport work orders is correct, and there is no error of misapprehending the facts in violation of the rules of evidence.

This ground of appeal cannot be accepted.

5. On the Fourth Ground

Where, contrary to the ostensible grounds for dismissal asserted by the employer, it is found that the employer, in dismissing the employee, actually did so on account of the employee's legitimate union activities, such dismissal must be regarded as an unfair labor practice; however, where an employee is dismissed for a legitimate ground for dismissal, even if there are traces that the employer disapproved of the employee's union activities, or even if an anti-union intent is presumed on the part of the employer, the ground for dismissal cannot be deemed to be a mere pretext, and thus it cannot be regarded as an unfair labor practice (see Supreme Court Decision 96Nu6431 delivered on July 8, 1997).

According to the record, the lower court found that Plaintiff 1 was the chairman of the Defendant Company's labor union, Plaintiff 2 the vice-chairman, Plaintiff 3 the head of education and propaganda, Plaintiff 4 the head of industrial accident affairs, and Plaintiff 5 a member of the union; however, in this case where the Plaintiffs refused the Defendant Company's work orders without justifiable cause and the Defendant Company placed the Plaintiffs under a standby order and dismissed them on that ground (moreover, according to the record, Plaintiff 1 had already been placed under a standby order on July 18 of the same year, prior to the formation of the labor union on September 15, 1996, and Plaintiff 1 and Plaintiff 2 are found to have already refused the Defendant Company's transport orders twelve times and twice, respectively, before the labor union was formed), the circumstances asserted by the Plaintiffs alone are insufficient to deem the Defendant Company's standby order and dismissal an unfair labor practice, and there is no other evidence to prove this; on these grounds, the lower court rejected the Plaintiffs' assertion. This fact-finding and determination by the lower court are correct, and there is no error of misapprehending the facts in violation of the rules of evidence, no insufficiency of deliberation, and no error of misunderstanding the legal principles concerning unfair labor practices.

This ground of appeal cannot be accepted.

6. On the Fifth Ground

A. On the Allegation of Mistake of Fact

As seen above, the lower court's fact-finding regarding the Plaintiffs' acts, which the Defendant Company relied upon as grounds for the standby order and for disciplinary dismissal, is correct, and there is no error of misapprehending the facts in violation of the rules of evidence.

This ground of appeal cannot be accepted.

B. On the Allegation of Misunderstanding of Legal Principles

In an enterprise operating an automobile transport business, an employer's act of dispatching drivers or its dispatch orders constitute ordinary orders for the performance of work; therefore, a driver-employee must, absent special circumstances, comply with such dispatch orders of the employer, and refusal thereof constitutes a failure to perform the duty to provide labor, which is the essential and fundamental obligation of an employee under an employment contract; this not only constitutes non-performance of obligation but also generally constitutes a ground for dismissal (see Supreme Court Decision 97Da33119 delivered on November 28, 1997).

According to the record, the lower court, to this effect, determined that the Defendant Company's dismissal of the Plaintiffs could not be deemed to exceed the scope of its discretion in disciplinary action, and was therefore justified. Even taking into account, as the Plaintiffs assert, that the Plaintiffs had worked diligently at the Defendant Company and the number of times they refused dispatch orders was relatively small, the lower court's determination is correct, and there is no error of misunderstanding the legal principles concerning abuse of disciplinary discretion.

This ground of appeal cannot be accepted.

Therefore, all appeals are dismissed, and the costs of appeal shall be borne by the losing parties. This judgment is rendered as set forth in the Order, there being unanimous agreement among the Justices involved.

Justice Song Jin-hoon (Presiding Justice), Lee Don-hee (Justice in charge), Yoon Jae-sik
