In this case, a company refused to allow employees to work overtime and subsequently dismissed them because of their labor union activities. The Supreme Court ruled that these actions constituted an unfair labor practice (부당노동행위). The Court also held that even an employer's exercise of free speech can amount to an unfair labor practice if it reveals an intent to dominate or interfere with union operations, and clarified that an indictment is sufficiently specific if it distinguishes the alleged conduct from other facts.

Key takeaways
Issues
  • Whether refusing overtime work and dismissing employees because of union activities constitutes an unfair labor practice (부당노동행위)
  • Under what circumstances an employer's expression of opinion, such as speeches or in-house broadcasts, constitutes an unfair labor practice
  • The degree of specificity required in an indictment concerning interference with union operations
Key reasoning

Refusing overtime work or dismissing employees because of their union activities constitutes an unfair labor practice, as it imposes economic and job-related disadvantages on workers. Even when an employer expresses opinions—such as through speeches or in-house broadcasts—such statements can still amount to an unfair labor practice if, considering their content and context, they reveal an intent to dominate or interfere with the union's operation. The Court emphasized that the employer's subjective intent must be assessed based on the overall circumstances surrounding the statements. Additionally, for an indictment concerning interference with union management, it is sufficient that the facts constituting the offense are described in a way that distinguishes them from other facts, without requiring excessive detail. Based on these principles, the Court found the employer's conduct to be unlawful.

Summary of Decision (English, AI translation)

[1] The purpose of requiring the specification of the date, place, and method of the crime in stating the facts charged is to limit the object of trial for the court and to specify the scope of defense for the defendant so as to facilitate the exercise of the defendant's right of defense. Therefore, it is sufficient if the facts charged are stated to a degree that allows the facts corresponding to the elements of the offense to be distinguished from other facts by comprehensively taking these elements into account. Accordingly, even if the date, place, method, etc. of the crime are not specifically indicated in the indictment, this does not contravene the purpose of the law requiring specification of the facts charged, and where a general or comprehensive description is unavoidable in light of the nature of the offense charged, the prosecution cannot be deemed unlawful on the ground that the content of the charge is not specified. In particular, in the case of a comprehensive single offense (포괄적 일죄), even if the individual acts constituting part of that single offense are not specifically particularized, the facts of the crime should be deemed specified if the beginning and end of the entire criminal conduct, the method of the offense, the victim or the other party, the number of offenses, or the total amount of damage, etc. are indicated.

[2] A case holding that, with respect to the facts charged corresponding to the element of the offense under the Trade Union and Labor Relations Adjustment Act (노동조합 및 노동관계조정법), namely "interference with the operation of a trade union," the facts charged specifically indicated the date and the method (the specific instructions given to on-site managers for persuading union members), such that the facts corresponding to the elements of the offense could be sufficiently distinguished from other facts, and that even though the specific content of the persuasion subsequently carried out by the on-site managers pursuant to the defendants' instructions, and the persons targeted thereby, were not itemized one by one in the facts charged, this did not impede the defendants' exercise of their right of defense, and thus this portion of the facts charged was held to be specified.

[3] Generally, a company is not necessarily obligated to approve overtime or holiday work even where an employee wishes to perform it; however, refusing to allow overtime work, etc. to a particular employee on the ground that the employee participated in a strike or was actively engaged in union activities constitutes an act that inflicts economic or work-related disadvantage on that employee, and may thus constitute an unfair labor practice. Meanwhile, where it is recognized that an employer, in dismissing an employee, has, contrary to the ostensible grounds for dismissal put forward, in substance dismissed the employee because of the employee's legitimate trade union activities, such dismissal must be regarded as an unfair labor practice. Whether the substantial ground for dismissal was the employee's legitimate act for trade union business must be determined by comparatively examining and weighing the grounds for dismissal asserted by the employer side against the content of the legitimate act for trade union business performed by the employee, the timing of the dismissal, the relationship between the employer and the trade union, whether there is any disparity in sanctions between union members and non-union members in similar cases, whether it conforms to past practice, the employer's words and conduct or attitude toward union members, and other circumstances from which the existence of an intent to commit an unfair labor practice may be inferred; and this applies equally to cases involving the act of refusing overtime work, etc. to an employee, thereby inflicting economic or work-related disadvantage on that employee.

[4] While it is self-evident that an employer has the freedom of speech to express opinions through speeches, in-house broadcasts, notices, letters, and the like, where, upon comprehensive consideration of the content of the opinion expressed together with the circumstances, timing, place, and method in which it was expressed, and the effect it has had or may have on the organization or activities of the trade union, an intent to dominate or interfere with the organization, operation, or activities of the trade union is recognized, this constitutes "an act of dominating or interfering with employees' organizing or operating a trade union," and thus an unfair labor practice is established; moreover, the establishment of an unfair labor practice by way of such domination or interference does not necessarily require the occurrence of a result of infringement of employees' right to organize.

[Defendant] Defendant 1 and 4 others
[Appellant] Defendants
[Defense Counsel] Kim Jae-ho, Attorney at Law, Bareun Law Firm
[Judgment Below] Changwon District Court Decision 2004No2001, decided December 27, 2005

[Order]

All appeals are dismissed.

[Reasoning]

We examine the grounds of appeal.

1. As to Item 1 of the Facts of the Crime in the Judgment Below

A. Regarding whether the facts charged are specified

The purpose of requiring that the date, place, and method of the crime be specified in stating the facts charged is to limit the object of the court's adjudication and to specify the scope of defense for the defendant so as to facilitate the exercise of the right of defense. Therefore, it is sufficient if the facts charged, taken together with these elements, are stated to a degree that allows the facts satisfying the elements of the offense to be distinguished from other facts. Accordingly, even if the date, place, method, etc. of the crime are not specifically indicated in the indictment, this does not violate the purpose of the law requiring that the facts charged be specified, and where, in light of the nature of the offense charged, a general description thereof is unavoidable, the institution of the prosecution cannot be deemed unlawful on the ground that the content of the charge is not specified. In particular, in the case of a comprehensive single crime (포괄적 일죄), even if each individual act constituting part of that single crime is not specifically identified, the facts of the crime shall be deemed specified so long as the beginning and end of the entire criminal act, the method of the crime, the victim or counterpart, and the total number of offenses or amount of damage, etc. are indicated (see Supreme Court Decision 99Do2934, delivered November 12, 1999; Supreme Court Decision 2004Do1164, delivered November 10, 2005, etc.).

Premised on the same legal principle, the court below rejected the defendants' ground of appeal that, because Items 1(a), (b), and (d) of the facts charged in this case do not specifically indicate the content of the persuasion activities conducted toward the members of the Gyeongnam 1 Branch, (Company Name Omitted) Chapter of the Korean Metal Workers' Union (hereinafter referred to as the "Chapter"), which is the labor union of the Defendant Company, by the side of Defendant 5 Co., Ltd., the institution of the prosecution as to this part is invalid as being in violation of statutory procedure. The court below held as follows: Items 1(a), (b), and (d) of the facts charged specifically indicate the date, time, and method (specific instructions given to field managers for the purpose of persuading union members) with respect to the facts constituting "intervention in the operation of a labor union," which is an element of the offense under the Act on the Establishment, Operation, etc. of Trade Unions and Labor Relations Adjustment (노동조합 및 노동관계조정법, hereinafter the "Trade Union and Labor Relations Adjustment Act") at issue in this case, and that these facts satisfying the elements of the offense can be sufficiently distinguished from other facts; and that even if the content of the persuasion subsequently carried out by field managers pursuant to the defendants' instructions, and the persons subject thereto, are not itemized one by one in the facts charged, this does not impede the defendants' exercise of their right of defense, and therefore this part of the facts charged should be deemed specified. This determination by the court below, rejecting the defendants' argument, is justified, and there is no error of law, such as a misapprehension of legal principles concerning the specification of facts charged, that has affected the outcome of the judgment, as alleged in the grounds of appeal.

B. Regarding whether a conspiracy relationship is established

In a relationship of accomplices in which two or more persons jointly participate in a crime, a conspiracy does not require any legally prescribed form; it is sufficient that there is a meeting of minds among two or more persons to jointly participate in and realize a certain crime through conspiracy. Even where there has been no comprehensive process of collusion, a conspiracy relationship is established if a meeting of minds is achieved among several persons sequentially or implicitly through mutual communication, and once such a conspiracy is formed, even a person who did not directly participate in the act of execution bears criminal responsibility as a joint principal offender for the acts of other co-conspirators (see Supreme Court Decision 99Do636, delivered April 23, 1999; Supreme Court Decision 2004Do7511, delivered January 27, 2005, etc.).

Examining the record, the court below, premised on the same legal principle, comprehensively considered the evidence lawfully adopted and examined by the first instance court and the facts recognized thereby as stated in its judgment, and found that, in connection with the labor union activities of the Defendant Company, discussions of measures for controlling labor union activities on the part of the employer, the drafting and reporting of documents, and various instructions, as described in the facts charged in this case, can be sufficiently acknowledged; that such acts were a series of acts carried out with the intent of the employer's side of the Defendant Company to influence the activities of the labor union; that, even if the defendants did not actually participate in all such acts, it is reasonable to view that the defendants, who held senior managerial positions in the company, had an implicit or sequential meeting of minds with those who actually carried out such acts; and that it can thus be sufficiently acknowledged that the defendants conspired to commit the unfair labor practices as described in the facts charged in this case. The court below's rejection, on this basis, of the defendants' argument that there was no conspiracy with respect to the violation of the Trade Union and Labor Relations Adjustment Act in this case, is justified, and there is no error of law, such as a violation of the rules of evidence or a misapprehension of the facts due to incomplete deliberation, that has affected the outcome of the judgment, as alleged in the grounds of appeal.

C. Regarding whether the acts of execution are established

Examining the record, according to the evidence lawfully adopted and examined by the first instance court, the court below found that it can be sufficiently acknowledged that the defendants, in sequential conspiracy with managerial employees, intervened in the operation of the labor union as stated in each item of the first instance judgment. In particular, although the defendants argued that some of the acts of managerial employees were personal activities carried out without instruction from, or report to, the company, the court below determined, considering the timing and method of such acts, and the circumstances such as the fact that the status of such acts was reported to superiors after they were carried out, that it is reasonable to view that such acts were carried out at the company level. The court below's rejection, on this basis, of all of the defendants' arguments of mistake of fact on this point is likewise justified, and there is no error of law, such as a violation of the rules of evidence or a misapprehension of the facts due to incomplete deliberation, that has affected the outcome of the judgment, as alleged in the grounds of appeal.

2. As to Items 2, 3, and 4 of the Facts of the Crime in the Judgment Below

A. In general, where an employee desires to perform overtime work or holiday work (hereinafter "overtime work, etc."), the company is not necessarily obligated to permit such work; however, refusing to permit overtime work, etc. for a particular employee on the ground that the employee participated in a strike or was active in union activities constitutes an act causing economic or work-related disadvantage to that employee, and may thus constitute an unfair labor practice.

Meanwhile, where it is recognized that an employer, in dismissing an employee, actually dismissed the employee because of the employee's legitimate labor union activities, notwithstanding the reason for dismissal ostensibly asserted, such dismissal must be regarded as an unfair labor practice. Whether an employee's legitimate act for the business of the labor union was the actual reason for dismissal must be determined by comparatively examining the reason for dismissal asserted by the employer, the content of the legitimate act performed by the employee for the business of the labor union, the timing of the dismissal, the relationship between the employer and the labor union, whether there is an imbalance in sanctions between union members and non-union members in similar cases, whether the dismissal conforms to past practice, the employer's words and conduct and attitude toward union members, and other circumstances from which the existence of an intent to commit an unfair labor practice may be inferred (see Supreme Court Decision 94Nu3001, delivered December 23, 1994; Supreme Court Decision 99Du2963, delivered April 11, 2000, etc.), and the same applies to acts causing economic or work-related disadvantage to an employee by refusing to permit overtime work, etc.

Examining the record, the court below, generally premised on the same legal principle, comprehensively considered the evidence lawfully adopted and examined by the first instance court, and found, as stated in its judgment, the following facts: that Nonindicted 1 was actively engaged in labor union activities, including serving as a union delegate at the time, and was classified in a low grade under the company's classification of employees' dispositions at the time; that, according to the monthly work status record of Main Machine Team 1 from August 2001 to January 2002, Nonindicted 2, who, unlike Nonindicted 1, had no prior experience as a union officer, performed 513.4 hours of overtime work, whereas Nonindicted 1 performed only 168 hours of overtime work; that although Nonindicted 1's inspection duties differed from those of other employees at the nuclear power plant, and overtime work, etc. was necessary for work efficiency, the company, unlike in the case of other employees, questioned Nonindicted 1 in an excessively strict manner as to why overtime work, etc. was necessary and applied strict standards in granting permission therefor, causing Nonindicted 1 to give up on overtime work, etc., which in turn resulted in inefficiency in the performance of work. Based on a comprehensive consideration of these facts, the court below determined that it can be sufficiently acknowledged that Defendant 1, Defendant 2, and others discriminated against Nonindicted 1 as compared to other employees, from around October 2001 to around August 2002, by applying excessively strict standards in granting permission for overtime work, etc. to Nonindicted 1 on the ground that he was active in labor union activities, thereby causing him to give up such work, and that this caused work-related or economic disadvantage to Nonindicted 1, constituting an unfair labor practice. The court below's rejection, on this basis, of the above defendants' argument of mistake of fact on this point is justified, and there is no error of law, such as a violation of the rules of evidence or a misapprehension of the facts due to incomplete deliberation, that has affected the outcome of the judgment, as alleged in the grounds of appeal.

B. Examining the record, according to the evidence lawfully adopted and examined by the first instance court, the court below found that it is acknowledged that Nonindicted 3, using personal information records kept at the Defendant Company, made a telephone call to Nonindicted 5, the older brother of Nonindicted 4, with the content described in the facts charged; that it is reasonable to view that Nonindicted 3 made such a call not in a personal capacity but as part of the so-called "persuasion campaign" of the Defendant Company; and further, that it can be sufficiently acknowledged that Defendant 1, Defendant 2, and other company executives conspired with respect to the above act of Nonindicted 3, which was carried out at the company level. The court below's rejection, on this basis, of the above defendants' argument of mistake of fact on this point is also justified, and there is no error of law, such as a violation of the rules of evidence or a misapprehension of the facts due to incomplete deliberation, that has affected the outcome of the judgment, as alleged in the grounds of appeal.

C. It is a matter of course that an employer has the freedom of speech to express opinions through speeches, in-house broadcasts, notices, letters, etc.; however, where, comprehensively considering the content of the opinion expressed, together with the circumstances, timing, place, and method in which it was expressed, and the effect or potential effect on the organization or activities of the labor union, an intent to dominate or intervene in the organization, operation, or activities of the labor union is recognized, this constitutes "an act dominating or intervening in the organization or operation of a labor union by employees," and thus constitutes an unfair labor practice (see Supreme Court Decision 97Nu8076, delivered May 22, 1998, etc.). Moreover, the establishment of an unfair labor practice by way of such domination or intervention does not necessarily require the occurrence of a result of infringement of employees' right to organize (see Supreme Court Decision 96Nu2057, delivered May 7, 1997, etc.).

Examining the record, the court below, premised on the same legal principle, found, based on the evidence lawfully adopted and examined by the first instance court, that when the Chapter, which was experiencing financial difficulties due to the provisional attachment of union dues by the company, decided to issue bonds as a means of overcoming such difficulties, Defendant 1, Defendant 2, and others, on two occasions, urged the Chapter to suspend the bond issuance and sent official documents stating that strict measures would be taken against the issuance of bonds that interfered with work or the issuance of bonds during working hours. In light of the labor union's economic situation at the time and the content of the company's official documents, the court below determined that such acts went beyond the level of the employer merely expressing an opinion on labor-management issues, and constituted an attempt to influence the judgment and conduct of individual union members and even the operation of the labor union itself, and thus can be sufficiently acknowledged as an act of intervention in the operation of the labor union. The court below further determined that even if, in this case, the Chapter actually proceeded with the bond issuance in disregard of the company's opinion, such that the employer's expression of opinion as described above had no effect whatsoever on the union's activities, this does not constitute an obstacle to finding this part of the facts charged guilty. This determination is justified, and there is no error of law, such as a misapprehension of legal principles, a violation of the rules of evidence, or a misapprehension of the facts due to incomplete deliberation, that has affected the outcome of the judgment, as alleged in the grounds of appeal.

3. Conclusion

Accordingly, all appeals are dismissed, and this judgment is rendered as stated in the Order by the unanimous opinion of the participating Justices.

Justice Ahn Dae-hee (Presiding Justice), Kim Young-ran, Kim Hwang-sik (Justice in Charge), Lee Hong-hoon
