This is a criminal case involving a violation of the Child Welfare Act (아동복지법), not a labor law case. The issue was whether sexual abuse occurred against a 15-year-old child victim. The Supreme Court (대법원) established the legal principle that even if a child appears to have consented on the surface, such apparent consent cannot be regarded as a genuine exercise of sexual self-determination. The lower court's judgment was reversed and remanded to the Seoul High Court (서울고등법원).

Key takeaways
  • CaseThis case is a criminal matter under the Child Welfare Act (아동복지법), not a labor law case — an adult committed sexual abuse against a 15-year-old child during a video call.
  • OutcomeThe Supreme Court reversed and remanded the lower court's decision, ruling that even apparent consent by the child cannot be treated as a genuine exercise of sexual self-determination.
  • LessonSince this is not a labor law precedent, it does not provide guidance on employment practice; anyone facing a similar issue should consult a Child Welfare Act (아동복지법) specialist.
Issues
  • Whether an act constitutes sexual abuse of a child even when the child appears, on the surface, to have consented
  • The standard for assessing a child or adolescent's capacity to exercise genuine sexual self-determination
Key reasoning

The Supreme Court held that children and adolescents generally lack the full capacity to exercise genuine sexual self-determination. Even if a child's words or conduct appear, on their face, to constitute consent, such apparent consent cannot be treated as a true exercise of self-determination if it results from deception or a distorted relationship of trust between the child and the offender. Applying this standard, the Court found that the video call in which the defendant induced the 15-year-old victim to expose her body and showed her his own masturbation constituted sexual abuse under the Child Welfare Act, regardless of any outward appearance of the child's agreement. This reasoning reflects a protective standard designed to account for children's vulnerability to manipulation and unequal power dynamics with adults.

Summary of Decision (English, AI translation)

[1] The State and society bear various protective obligations toward children and adolescents. The courts have rendered judgments in cases involving child and adolescent victims on the premise that children and adolescents are subjects requiring special protection. In determining whether an act constitutes sexual abuse of a child under the Child Welfare Act (아동복지법), even where the child has not expressed explicit opposition, it must be examined whether this stems from the child's insufficient capacity to exercise sexual self-determination to protect himself or herself, and under the crime of child trafficking under the Child Welfare Act, guilt is recognized even if the child himself or herself consented. Even where a child or adolescent has consented to the production of obscene material featuring himself or herself, this in principle constitutes the crime of producing obscene material using a child or adolescent under the Act on the Protection of Children and Youth from Sexual Abuse

[2] Children and adolescents not only find it difficult to fully exercise sexual self-determination due to social and cultural constraints, but are also in a position where they find it difficult to defend themselves from sexual infringement or exploitation by others due to insufficient cognitive, psychological, and relational resources. Furthermore, since children and adolescents are in the process of forming their sexual values and completing their sexual health, sexual infringement or exploitation against children and adolescents may have serious and lasting negative effects on their pursuit of mental and physical health related to sexuality and on the formation and development of their autonomous personality. Therefore, even if a child or adolescent has engaged in conduct that outwardly appears to be a sexual decision or consent, if this results from another person's deception or exploitation of a distorted relationship of trust, it is difficult to evaluate this as an exercise of the child or adolescent's full sexual self-determination.

[Defendant] Defendant
[Appellant] Military Prosecutor
[Defense Counsel] Attorney Hwang Yun-sang of Justice Law Firm
[Judgment Below] Judgment of the High Military Court dated August 27, 2020, Case No. 2020No18

[Order]

The judgment below is reversed, and the case is transferred to the Seoul High Court.

[Reasoning]

The grounds of appeal are examined.

1. The Facts Charged and the Judgment Below

A. The facts charged in this case are that the Defendant, while engaged in a video call with the victimized child (female, 14 years old) on her mobile phone on or about March 14, 2018, said to the victimized child, "I want to see your breasts," thereby causing the victimized child to show her breasts on the video call screen, and while watching this, showed the victimized child a scene of himself masturbating; and that, in this manner, from around that time until around April 2018, the Defendant committed sexual abuse against the victimized child on a total of five occasions.

B. The court below, after citing the legal principles concerning whether an act constitutes sexual abuse, affirmed the judgment of the first instance court, which had found it difficult to conclude that the Defendant's conduct constituted "sexual abuse" as sexual violence or cruel treatment that could harm the victimized child's health and welfare or impede her normal development, on the grounds, among others, that the victimized child did not appear to be immature in exercising her right to sexual self-determination. In particular, the court below pointed out that the victimized child had previously engaged in consensual sexual intercourse with the Defendant prior to this incident, and that there were no circumstances suggesting that the video call at issue in this case was against the victimized child's will.

2. Judgment of the Supreme Court

A. As the court below pointed out, whether an act constitutes sexual abuse must be objectively determined in accordance with the sound social norms of the times, comprehensively considering specific circumstances such as the intentions, sex, and age of the actor and the victimized child; whether the victimized child possessed sexual values and judgment capacity sufficient to properly exercise the right to sexual self-determination; the relationship between the actor and the victimized child; the circumstances leading to the act; the specific manner of the act; and the impact the act may have on the victimized child's personality development and mental health (see Supreme Court Decision 2013Do7787, decided July 9, 2015, among others).

However, it is difficult to accept as it stands the portion of the judgment below that relied on the victimized child's sexual intercourse with the Defendant and her words and conduct at the time of this incident and the sexual intercourse in concluding that the victimized child had exercised her right to sexual self-determination.

B. The State and society bear various duties to protect children and adolescents. Courts have consistently rendered judgments in cases where children and adolescents are victims premised on the understanding that children and adolescents are subjects requiring special protection. In determining whether conduct constitutes sexual abuse of a child under the Child Welfare Act (아동복지법), even where the child did not express explicit opposition, it must be examined whether this stemmed from a lack of capacity to protect oneself by exercising the right to sexual self-determination (see the above Supreme Court Decision 2013Do7787). In the crime of child trafficking under the Child Welfare Act, a conviction is recognized even where the child himself or herself consented (see Supreme Court Decision 2015Do6480, decided August 27, 2015). Even where a child or adolescent consented to the production of obscene material depicting himself or herself, this in principle constitutes the crime of producing obscene material using children or adolescents under the Act on the Protection of Children and Youth against Sex Offenses (아동·청소년의 성보호에 관한 법률) (see Supreme Court Decision 2014Do11501, 2014Jeon-do197, decided February 12, 2015).

Children and adolescents find it difficult to fully exercise their right to sexual self-determination due to social and cultural constraints, and are also in a position where they find it difficult to defend themselves against sexual infringement or exploitation by others due to insufficient cognitive, psychological, and relational resources. Moreover, since children and adolescents are in the process of forming their sexual values and completing their sexual health, sexual infringement or exploitation against children and adolescents may have serious and lasting negative effects on their pursuit of mental and physical health related to sexuality and on the formation and development of their autonomous personality. Accordingly, even where a child or adolescent has engaged in words or conduct that outwardly appear to constitute sexual decision-making or consent, if such conduct resulted from another person's deception or exploitation of a distorted relationship of trust, it is difficult to evaluate this as the exercise of the child's or adolescent's full right to sexual self-determination (see Supreme Court en banc Decision 2015Do9436, decided August 27, 2020).

C. Based on the foregoing legal principles, the court below should have carefully determined whether the victimized child possessed sexual values and judgment capacity sufficient to properly exercise her right to sexual self-determination. Nevertheless, relying only on the circumstances stated in its judgment, the court below concluded that the conduct did not constitute sexual abuse on the premise that the victimized child had exercised her right to sexual self-determination. The judgment below thus contains an error of misapprehending the legal principles concerning sexual abuse as defined in Article 17, Item 2 of the Child Welfare Act. The military prosecutor's ground of appeal pointing this out is well-founded.

3. Conclusion

Accordingly, the judgment below is reversed, and the case is transferred to the Seoul High Court, which has jurisdiction equivalent to that of the court below, for retrial and determination. This judgment is rendered in accordance with the unanimous opinion of the Justices participating in the decision, as set forth in the Order.

Justice Cheon Dae-yeop (Presiding Justice), Jo Jae-yeon, Min Yu-suk (Justice in Charge), Lee Dong-won
