This case addressed whether an adult's continuation of sexual intercourse with a 15-year-old child, despite the child's request to stop, constituted sexual abuse (성적 학대) under the Child Welfare Act (아동복지법). The Supreme Court (대법원) reversed and remanded the case, finding that the lower court had failed to properly assess whether the child actually possessed the capacity to exercise sexual self-determination (성적 자기결정권).

Key takeaways
  • CaseAn adult continued sexual intercourse with a 15-year-old child even after the child asked him to stop.
  • OutcomeThe Supreme Court reversed and remanded the case, ruling that the lower court had not properly evaluated the child's actual capacity to exercise sexual self-determination.
  • LessonEven when a child appears to consent, courts and individuals must carefully consider whether the child truly has the capacity to exercise genuine sexual self-determination before assuming consent is valid.
Issues
  • The standard for determining whether a child possesses the capacity to exercise sexual self-determination
  • The requirements for establishing sexual abuse (성적 학대행위) under the Child Welfare Act (아동복지법)
  • The legal basis for the protection of children and youth in cases involving apparent consent
Key reasoning

The Supreme Court emphasized that children and youth are generally in a vulnerable position, often unable to fully exercise their right to sexual self-determination or effectively defend themselves against sexual violations. Therefore, even when a child appears to have given consent on the surface, courts must carefully examine whether the child truly possessed the capacity to meaningfully exercise that right. The lower court's failure to conduct this careful assessment—particularly in light of the child's explicit request to stop during the act—was deemed a legal error requiring reversal. This reasoning underscores that apparent consent alone is insufficient to negate a finding of sexual abuse when the child's actual decision-making capacity is in question.

Summary of Decision (English, AI translation)

[1] The State and society bear various protective duties toward children and adolescents. The State must implement policies to enhance the welfare of adolescents (Article 34(4) of the Constitution) and bears the duty to provide elementary and secondary education (Article 8 of the Framework Act on Education (교육기본법)). The same holds true in the judicial sphere: a person with parental authority must protect and raise a minor (Article 913 of the Civil Act (민법)), and a juristic act performed by a minor without the consent of his or her legal representative may, in principle, be rescinded without limitation as to the grounds therefor (Article 5 of the Civil Act).

The courts, too, have rendered judgments in cases involving child or adolescent victims on the premise that children and adolescents are subjects requiring special protection. The Supreme Court has held, in determining whether an act constitutes sexual abuse of a child under the Child Welfare Act (아동복지법), that even where the child did not express explicit opposition, it must be examined whether this stemmed from a lack of ability to exercise sexual self-determination and protect oneself, and has also held that, with respect to the crime of trafficking in children under the Child Welfare Act, a conviction may be sustained even where the child himself or herself consented. The holding that, in principle, the crime of producing obscene material using a child or adolescent under the Act on the Protection of Children and Youth against Sex Offenses (아동·청소년의 성보호에 관한 법률) is established even where the child or adolescent consented to being the subject of the production of such obscene material, is to the same effect.

The reason for protecting children and adolescents in this manner is that children and adolescents, due to social and cultural constraints, are not yet in a position to fully exercise their right to self-determination, and, owing to a lack of cognitive, psychological, and relational resources, are in a position where it is difficult for them to defend themselves against sexual infringement or exploitation by others. Furthermore, since children and adolescents are in the process of forming their sexual values and completing their sexual health, sexual infringement or exploitation of children and adolescents may have a serious and continuing negative impact on their pursuit of mental and physical health related to sexuality and on the formation and development of their autonomous personality. Accordingly, even where a child or adolescent has engaged in conduct that outwardly appears to be a sexual decision or consent, if such conduct resulted from another person's deception or exploitation of a distorted relationship of trust, it is difficult to evaluate this as the exercise of the child's or adolescent's full right to sexual self-determination.

[2] The right to sexual self-determination is understood as the right of each person, based on his or her own chosen outlook on life, to independently establish sexual concepts within the community, and, in accordance therewith, within the realm of private life, to choose a partner and engage in sexual relations under his or her own responsibility based on sexual decisions made by himself or herself. This right encompasses both a positive aspect—the right to decide on the sexual conduct one wishes to engage in—and a negative aspect—the right to refuse unwanted sexual conduct. The crimes of rape and indecent act, including the crime of sexual intercourse through deceptive means, are concerned with the infringement of the negative aspect of the right to sexual self-determination.

[3] In a case where the Defendant was indicted for violating the Child Welfare Act on the ground that, while engaging in sexual intercourse with the child victim Gap (female, 15 years old), the Defendant committed "sexual abuse" by continuing to have sexual intercourse with Gap even after Gap said, "Can't we stop? It's hard. Let's stop," the Supreme Court held that the lower court erred in its understanding of the law concerning "sexual abuse" as defined in Article 17, Subparagraph 2 of the Child Welfare Act. The Supreme Court reasoned that the lower court should have carefully determined whether Gap possessed sexual values and the capacity for judgment sufficient to properly exercise her right to sexual self-determination, whereas the lower court instead determined that the act did not constitute sexual abuse on the grounds that a 15-year-old such as Gap generally appears to be of an age capable of exercising voluntary, albeit immature, sexual self-determination, and that the military prosecutor likewise did not indict the Defendant for abuse with respect to the act of having sexual intercourse with Gap itself.

[Defendant] Defendant
[Appellant] Military Prosecutor
[Defense Counsel] Attorney Lee Won-gi
[Judgment Below] High Military Court Decision 2018No146, decided September 20, 2018

[Order]

The judgment below is reversed, and the case is remanded to the High Military Court.

[Reasoning]

The grounds of appeal are examined.

1. As to the violation of the Child Welfare Act (아동복지법) (compelling, mediating, sexually harassing a child into indecent acts, etc.)

A. The gist of this portion of the charge is that, while the Defendant was having sexual intercourse with the victim, Nonindicted 1 (pseudonym, female, 15 years old), on October 8, 2017, the victim said, "Can't we stop? It's hard. Let's stop," but the Defendant nevertheless continued to have sexual intercourse with the victim, a child, thereby committing an act of sexual abuse.

B. The court below, after citing the legal principles on determining whether an act constitutes sexual abuse, held that this did not constitute sexual abuse, citing circumstances such as the fact that the victim, being 15 years old, appears to be of an age generally capable of exercising sexual self-determination, albeit immaturely but voluntarily, and that the Military Prosecutor himself did not indict the Defendant for abuse with respect to the act of having sexual intercourse with the victim itself.

C. As the court below pointed out, whether an act constitutes sexual abuse must be determined objectively in accordance with the sound social norms of the times, by comprehensively considering specific circumstances such as the intent, sex, and age of the perpetrator and the victimized child; whether the victimized child possesses a sexual value system and judgment capacity sufficient to properly exercise sexual self-determination; the relationship between the perpetrator and the victimized child; the circumstances leading to the act; the specific manner of the act; and the effect the act may have on the victimized child's personality development and mental health (see Supreme Court Decision 2013Do7787, decided July 9, 2015, etc.).

D. However, it is difficult to accept as it stands the portion of the court below's determination that relied on the victim's age and the fact of sexual intercourse with the Defendant in finding that the victim was capable of exercising sexual self-determination.

1) The State and society bear various duties to protect children and youth. The State must implement policies to promote the welfare of youth (Article 34(4) of the Constitution) and bears the duty to provide elementary and secondary education (Article 8 of the Framework Act on Education). The same applies in the judicial sphere: a person with parental authority must protect and rear a minor (Article 913 of the Civil Act), and a juristic act performed by a minor without the consent of a legal representative may, in principle, be rescinded without limitation as to the grounds therefor (Article 5 of the Civil Act).

The courts, too, have adjudicated cases in which children and youth were victims on the premise that children and youth are subjects deserving special protection. The Supreme Court has held, with respect to determining whether an act against a child constitutes sexual abuse under the Child Welfare Act, that even where the child did not express explicit opposition, it must be examined whether this stemmed from the child's insufficient ability to protect himself or herself through the exercise of sexual self-determination (see the above Supreme Court Decision 2013Do7787), and has held that, in the crime of trafficking in children under the Child Welfare Act, guilt is recognized even where the child himself or herself consented (see Supreme Court Decision 2015Do6480, decided August 27, 2015). The holding that, even where a child or youth consented to the production of obscene material using himself or herself as the subject, this in principle constitutes the crime of producing obscene material using children or youth under the Act on the Protection of Children and Youth against Sex Offenses (아동·청소년의 성보호에 관한 법률, hereinafter referred to as the "Youth Sexual Protection Act") (see Supreme Court Decision 2014Do11501, 2014Jeondo197, decided February 12, 2015) is to the same effect.

The reason for protecting children and youth in this manner is that children and youth are not yet able to fully exercise self-determination due to social and cultural constraints, and moreover are in a position where it is difficult for them to defend themselves against sexual infringement or exploitation by others due to a lack of cognitive, psychological, and relational resources. Furthermore, since children and youth are in the process of forming their sexual value system and completing their sexual health, sexual infringement or exploitation against children and youth may have a serious and lasting negative impact on their pursuit of mental and physical health related to sexuality and on the formation and development of their autonomous personality. Therefore, even where a child or youth engaged in words or conduct that outwardly appears to be a sexual decision or consent, if this resulted from another person's deception or exploitation of a distorted relationship of trust, it is difficult to evaluate this as the exercise of the child's or youth's full sexual self-determination (see Supreme Court en banc Decision 2015Do9436, decided August 27, 2020).

2) Meanwhile, sexual self-determination is understood as the right to establish one's own sexual concepts independently within the community, based on a view of life one has chosen for oneself, and, in accordance with sexual decisions made by oneself in the realm of private life pursuant thereto, to choose a partner and have sexual relations under one's own responsibility (see Constitutional Court en banc Decision 99Hunba40, decided October 31, 2002, etc.). This includes both a positive aspect, namely the right to decide on the sexual activity one wishes to engage in, and a negative aspect, namely the right to refuse unwanted sexual activity, and crimes of rape and indecent act, including the crime of sexual intercourse by fraudulent means, are premised on infringement of the negative aspect of sexual self-determination (see Supreme Court Decision 2019Do3341, decided June 13, 2019, and the above Supreme Court en banc Decision 2015Do9436).

3) The court below should have carefully determined, based on the foregoing legal principles, whether the victim possessed a sexual value system and judgment capacity sufficient to properly exercise sexual self-determination; however, it determined that the victim was capable of exercising sexual self-determination based solely on the circumstances set forth in its holding. Thus, the determination of the court below contains an error of law by misapprehending the legal principles regarding sexual abuse under Article 17, Subparagraph 2 of the Child Welfare Act. The Military Prosecutor's ground of appeal pointing this out has merit.

2. As to the violation of the Youth Sexual Protection Act

A. The gist of the portion of the charge concerning rape by intimidation is as follows: On October 13, 2017, the Defendant sent a Facebook message to the victim, Nonindicted 2 (pseudonym, female, 15 years old), stating, "○○, you are now my slave for life... the moment you block me or read and ignore me, it will spread nationwide...," thereby intimidating the victim by threatening to post online, together with the victim's name, photographs exposing the victim's breasts, genitals, and other body parts. Having thus intimidated the victim into sending such photographs exposing body parts every day via Facebook and Naver Line, the Defendant decided to use these to rape the victim, and on October 16, 2017, sent the victim a Facebook message stating, "If we do it just once you don't have to send them anymore," and on October 17, 2017, sent messages stating, "You're making me angry again," "If we meet and do it I'll delete everything," "Shall I release the photos?," and "If this fails you'll really become a slave, lol," thereby intimidating the victim into believing that unless she had sexual intercourse with him, he would post the photographs and that she would have to send photographs every day, rendering her unable to resist, and thereby attempting to rape the victim, a youth, but failing to consummate the crime because he became frightened when an investigation into the offense against the victim Nonindicted 1 (pseudonym) commenced. Meanwhile, the gist of the portion of the charge concerning sexual intercourse by abuse of power is that the Defendant, by intimidating the victim in the same manner, attempted to have sexual intercourse with the victim, a youth, but failed to consummate the crime.

B. The court below determined that, although the Defendant had a vague intention to have sexual intercourse with the victim at the time he intimidated the victim around October 17, 2017, there was a considerable time gap until the end of December 2017, when he planned to meet the victim to carry out the act of sexual intercourse; that he did not reveal a specific plan or intention to reach the point of sexual intercourse; and that he did not make any further threats after the above intimidation. Based on these and other reasons, the court below found it difficult to conclude that it was proven beyond reasonable doubt that the Defendant had the intent to use the above intimidation for the purpose of sexual intercourse, or that the above intimidation was carried out as a means of sexual intercourse.

C. However, the above determination of the court below is difficult to accept as it stands. According to the reasoning of the judgment below and the evidence lawfully adopted, the following may be determined.

1) The Defendant created three Facebook accounts—his own account and accounts under the fictitious names of Nonindicted 3 and Nonindicted 4—and approached young women, agreeing to pay compensation in exchange for receiving photographs exposing their bodies or proposing sexual relations, using each account according to its designated role. That is, the Nonindicted 3 account was used to approach women, receive exposed photographs, and then use them as leverage to coerce sexual relations; the Defendant's own account played the role of Nonindicted 3's friend who served as the object of the sexual relations; and the Nonindicted 4 account played the role of a woman who had sent photographs to Nonindicted 3 and received compensation in the past. Thus, the Defendant played three roles using three accounts. The reason the Defendant used such a complicated and elaborate method was to, without paying the promised compensation to the women, persistently demand sexual relations through alternating deception and intimidation via the Nonindicted 3 account, while putting forward the Defendant's own account to lower the target woman's guard and thereby facilitate proceeding to sexual relations, the ultimate purpose being to satisfy the Defendant's own sexual desire. Accordingly, all of the threatening words and conduct that the Defendant directed at the target women throughout this series of processes may be viewed as means for achieving the purpose of sexual intercourse.

2) In this case as well, the Defendant approached the victim using the Nonindicted 3 account, proposing that she do a part-time job of taking and sending photographs that could comfort him, and thereby obtained exposed photographs of her body. Then, taking the opportunity of having learned the victim's address on the pretext of sending her money, the Defendant told her he would post her photographs and personal information online, thereby obtaining even more explicit exposed photographs. The Defendant then, presenting a wager with the Defendant, lured the victim into having sexual relations, telling her that if she had sexual relations with him she would no longer need to send photographs, that he would delete all the photographs, and that he would pay the promised money; or, alternatively, that if she did not have sexual relations with him he would post the photographs online. He continued to make the same demands despite the victim's refusals, and the victim eventually acceded to the Defendant's demands and came to contact him through the Defendant's account.

3) Therefore, once the victim, unable to withstand the Defendant's intimidation, came to contact the Defendant through the Defendant's account, it may be viewed that, absent other special circumstances, the stage was reached where the Defendant's act of sexual intercourse could be carried out as soon as the victim decided to have sexual relations. The time gap noted by the court below, and the fact that a specific plan for reaching sexual intercourse was not revealed at the time of the above intimidation, do not appear to be important factors in determining whether the Defendant had the intent to use the above intimidation for sexual intercourse and whether the above intimidation was carried out as a means of sexual intercourse.

D. If so, there is ample room to find that the Defendant intimidated the victim with the intent to use it for the purpose of sexual intercourse, and that the above intimidation was carried out as a means of sexual intercourse. Nevertheless, the court below found the Defendant not guilty of this portion of the charge based solely on the reasons set forth in its holding, and thus the determination of the court below contains an error of law by misapprehending the legal principles regarding the commencement of the execution of the crimes of rape by intimidation and sexual intercourse by abuse of power. The Military Prosecutor's ground of appeal pointing this out has merit.

3. As to the remainder of the appeal

The Military Prosecutor appealed against the entirety of the judgment below, but did not state specific grounds of objection with respect to the remaining portions in either the petition of appeal or the appellate brief.

4. Scope of Reversal

As discussed above, the portions of the judgment below finding the Defendant not guilty on the charges of violation of the Child Welfare Act (compelling, mediating, sexually harassing a child into indecent acts, etc.) and violation of the Youth Sexual Protection Act must be reversed. Since the crime of assault, which the court below found the Defendant guilty of, is in a relationship of a single crime with the above violation of the Youth Sexual Protection Act, the judgment below must be reversed in its entirety.

5. Conclusion

Therefore, the judgment below is reversed, and the case is remanded to the court below for further hearing and determination. This Decision is rendered by the unanimous opinion of the participating Justices, as set forth in the Order.
