A taxi company sought to have an arbitration award (중재재정) revoked. The Supreme Court held that union activities conducted during working hours and the full-time union official system (노조전임제) are not 'working conditions' and therefore cannot be the subject of arbitration awards in labor disputes. However, it found that dismissal criteria and the awards/disciplinary committee (상벌위원회) do qualify as working conditions and can be subject to arbitration. The Court reversed and remanded the case for retrial in light of these standards, also noting that where an arbitration award has already lost effect, there is no legal interest in seeking its revocation.

Key takeaways
  • CaseA taxi company challenged an arbitration award that addressed union activities during work hours, the full-time union official system, dismissal criteria, and the awards/disciplinary committee.
  • OutcomeThe Supreme Court ruled that only dismissal criteria and the disciplinary committee qualify as 'working conditions' subject to arbitration, while union activity during work hours and full-time union positions do not, and remanded the case for retrial.
  • LessonEmployers and unions should understand that arbitration in labor disputes is strictly limited to genuine 'working conditions' (e.g., dismissal rules, disciplinary matters), not organizational or operational matters like union activity scheduling or full-time union roles.
Issues
  • What is the scope of matters that qualify as 'working conditions' subject to arbitration awards, and what does 'labor dispute' mean under Korean labor law?
  • Whether union activities conducted during working hours can be a valid subject of an arbitration award
  • Whether the full-time union official system (노조전임제) can be a valid subject of an arbitration award
  • Whether a party has legal interest in seeking revocation of an arbitration award that has already become ineffective
Key reasoning

Labor disputes subject to arbitration under Korean labor law are limited to disputes concerning 'working conditions' (근로조건). Union activities conducted during working hours and the full-time union official system conflict with an employee's basic duty to provide labor, and therefore do not constitute working conditions eligible for arbitration. By contrast, dismissal criteria relate to termination of employment, and the awards/disciplinary committee relates to commendations and sanctions—both of which fall within the scope of working conditions and are properly subject to arbitration. Additionally, once an arbitration award has become ineffective, a party generally lacks the legal interest necessary to pursue its revocation in court.

Summary of Decision (English, AI translation)

[1] Arbitration proceedings are, in principle, conducted with respect to matters that constitute the subject of a labor dispute where such a labor dispute has arisen. Article 2 of the Labor Dispute Adjustment Act (노동쟁의조정법) defines a labor dispute as "a state of conflict arising from disagreement between the parties to a labor relationship over working conditions, such as wages, working hours, welfare, dismissal, and other treatment." Working conditions refer to the conditions set concerning the treatment of employees within the labor contract relationship between the employer and the employee, and specifically include not only wages, working hours, welfare, and dismissal as provided in the Labor Standards Act (근로기준법), but also the matters set forth in Article 94, Subparagraphs 1 through 11 of the same Act and Article 7, Subparagraphs 1 and 3 of the Enforcement Decree of the same Act (같은법시행령). Accordingly, a state of conflict arising from disagreement between the parties to a labor relationship with respect to matters other than such working conditions is not a dispute concerning working conditions, and therefore cannot be deemed a labor dispute under the current law, and, absent special circumstances, such matters cannot be made the subject of an arbitration award.

[2] Since the criteria for dismissal determine the grounds for termination of the labor contract relationship, they fall under "matters concerning retirement" as provided in Article 94, Subparagraph 4 of the Labor Standards Act, and thus constitute working conditions; consequently, disagreement between the parties as to such matters ultimately amounts to a labor dispute and may therefore be made the subject of an arbitration award. Likewise, matters relating to the establishment and composition of a commendation and disciplinary committee, to the extent necessary for promoting reasonable and fair personnel management or sanctions within the workplace, fall under "matters concerning commendation and sanctions" as provided in Article 94, Subparagraph 10 of the same Act, and thus constitute working conditions, and for the same reason may be made the subject of an arbitration award. However, union activities by union members during working hours are, in principle, incompatible with the employee's duty to provide labor and are therefore not permissible; such activities cannot be deemed to constitute working conditions concerning the treatment of employees within the labor contract relationship between the employer and the employee. Even if provisions concerning such matters exist in a previous collective agreement or in the draft collective agreements of both parties during collective bargaining, this does not necessarily mean that such matters automatically become working conditions. Therefore, disagreement between the parties to a labor relationship regarding such matters cannot be deemed a labor dispute, and, absent special circumstances, cannot be made the subject of an arbitration award. Furthermore, the full-time union officer system is merely a form of convenience provided to the labor union, recognized only where the employer approves it through a collective agreement or otherwise, and cannot be deemed a working condition concerning the treatment of employees within the labor contract relationship between the employer and the employee. It is merely a matter subject to voluntary bargaining, and disputes concerning it likewise cannot be deemed a labor dispute; therefore, absent special circumstances, this too cannot be made the subject of an arbitration award.

[3] Where the period of validity of an arbitration award is fixed by the award itself, the arbitration award loses its effect upon expiration of that period of validity. Once the arbitration award has thus lost its effect, the parties to the labor relationship have no legal interest in seeking the revocation of the arbitration award after the expiration of that period, unless there are special circumstances showing that some legal interest is being infringed by virtue of the arbitration award's continuing to exist in outward form.

[Lower Court Decision]

Seoul High Court Decision 93Gu30145, decided June 9, 1994

[Order]

The lower court's decision is reversed, and the case is remanded to the Seoul High Court.

[Reasoning]

The Court examines the Plaintiff's grounds of appeal.

1. According to the reasoning of the lower court's decision, the court below found that, with respect to union activities during working hours, both the draft collective agreement of the Plaintiffs and that of the Intervenors, as stated in the judgment, contained provisions on this matter in Article 8, differing only in content; and that, with respect to full-time union officials, although the Plaintiffs' draft collective agreement, as stated in the judgment, contained no provision thereon, the Intervenors' draft collective agreement, as stated in the judgment, contained provisions thereon in Articles 9 and 10. Based on these findings, the lower court determined that such matters were included among the issues in collective bargaining and thus were subject to arbitration; moreover, since the Defendant had recognized, in a limited manner, the time and number of persons permitted for union activities during working hours, and had ruled, in principle, that full-time union officials should be determined by agreement between labor and management, while providing that, because some workplaces recognized full-time officials and others did not, full-time officials would be recognized until such agreement was reached, this could not be regarded as an act in excess of authority. The lower court further determined, with respect to matters concerning the Disciplinary and Reward Committee and dismissal standards, that even though personnel authority in principle belongs to the employer, the employer may, of its own volition, place restrictions on that authority; therefore, if the employer, through a collective agreement concluded with the labor union, recognized the union's involvement in personnel matters concerning union members, the effect thereof is determined according to the purport of the agreement's provisions. Since both the Plaintiffs' and Intervenors' draft collective agreements, as stated in the judgment, as well as the existing collective agreement, all contained provisions on the Disciplinary and Reward Committee, and the parties had failed to reach mutual agreement only as to the specific content of such provisions, the Defendant's arbitration ruling that the existing collective agreement should apply could not be deemed unlawful or in excess of authority. Furthermore, since the Defendant's arbitration award set the dismissal standard as "physical assault against a superior in the course of duty," this did not exclude assault or battery against the employer (who is not a workers' representative) from the dismissal standards; rather, since mere verbal abuse alone could not be considered to constitute "justifiable cause" under Article 27 of the Labor Standards Act (근로기준법) as an objective standard that the law can accommodate for dismissal severing the labor-management relationship, the arbitration award was rendered using the term "physical assault." Meanwhile, the lower court held that an arbitration award may be contested only on the ground that its procedure was unlawful, or that its content was unlawful due to a violation of the Labor Standards Act or the like, or that the arbitration award was rendered in excess of authority with respect to matters not in dispute between the parties or matters exceeding the scope of the parties' dispute without justifiable cause; and that an objection is not permitted merely on the ground that the arbitration award is unfavorable to one of the labor or management parties. On this basis, the lower court held that the Plaintiffs' argument, as stated in the judgment, that the arbitration reexamination decision concerning this portion was unlawful or in excess of authority, was also without merit.

2.
Arbitration proceedings are, in principle, conducted with respect to matters that are the subject of a labor dispute where a labor dispute has arisen. Article 2 of the Labor Dispute Adjustment Act (노동쟁의조정법) defines a labor dispute as "a state of dispute arising from a disagreement in the assertions between the parties to a labor relationship concerning working conditions such as wages, working hours, welfare, dismissal, and other treatment." "Working conditions" refers to the conditions set concerning the treatment of employees within the employment contract relationship between the employer and the employee (see this Court's Decision 91Da19210, decided June 23, 1992). Specifically, this includes not only wages, working hours, welfare, and dismissal as prescribed in the Labor Standards Act (근로기준법), but also the matters set forth in Article 94, Subparagraphs 1 through 11 of the same Act and Article 7, Subparagraphs 1 and 3 of the Enforcement Decree of the same Act. Accordingly, a state of dispute arising from a disagreement in the assertions between the parties to a labor relationship concerning matters other than such working conditions does not constitute a dispute concerning working conditions, and therefore cannot be deemed a "labor dispute" under the current law; absent special circumstances, such matters cannot be made the subject of an arbitration award (see this Court's Decision 93Nu11883, decided January 11, 1994).

Returning to examine this case: among the matters made the subject of the arbitration award in this case, first, the dismissal standard, since it determines the grounds for termination of the employment contract relationship, falls under "matters concerning retirement" as prescribed in Article 94, Subparagraph 4 of the same Act, and thus constitutes a working condition; accordingly, a disagreement in the assertions concerning this matter constitutes a labor dispute and is therefore subject to arbitration. Likewise, matters concerning the Disciplinary and Reward Committee, including its establishment and composition, to the extent necessary to promote reasonable and fair personnel management or sanctions in the workplace, fall under "matters concerning commendation and sanctions" as prescribed in Article 94, Subparagraph 10 of the same Act, and thus constitute working conditions; for the same reason, they are subject to arbitration.

However, union activities of union members during working hours are, in principle, incompatible with the employee's duty to provide labor and thus are not permitted as of right; such activities cannot be deemed to constitute working conditions set concerning the treatment of employees within the employment contract relationship between the employer and the employee. Even if provisions concerning such matters exist in the previous collective agreement or in the draft collective agreements of both parties to the labor relationship during the course of collective bargaining, this does not necessarily mean that such matters thereby become working conditions as a matter of course. Accordingly, a disagreement in the assertions between the parties to a labor relationship concerning this matter cannot be deemed a labor dispute, and therefore, absent special circumstances, this matter cannot be made the subject of an arbitration award.

Furthermore, the system of full-time union officials, whereby an employee is generally exempted from the duty to provide labor under the employment contract to the employer and engages solely in union business, is recognized only where the employer approves it through a collective agreement or otherwise, as a form of provision of convenience to the labor union; it cannot be deemed a working condition set concerning the treatment of employees within the employment contract relationship between the employer and the employee. As this is merely a discretionary bargaining matter, a dispute concerning it likewise cannot be deemed a labor dispute; accordingly, absent special circumstances, this matter, too, cannot be made the subject of an arbitration award.

Ultimately, the portion of the arbitration reexamination decision in this case, rendered with respect to the arbitration award issued in the ex officio arbitration proceedings in this case, concerning the above matters that cannot be made the subject of an arbitration award, must be deemed unlawful.

3. Meanwhile, where the period of validity of an arbitration award is fixed by the award itself, the arbitration award loses its effect upon the lapse of that period of validity. Once an arbitration award has thus lost its effect, the parties to the labor relationship have no legal interest in seeking the revocation of the arbitration award after the lapse of that period, absent special circumstances showing that some legal interest is being infringed due to the outward continued existence of the arbitration award (see this Court's Decision 91Nu10503, decided May 12, 1992). According to the record, the period of validity of the arbitration award in this case clearly expired on July 14, 1995, and thus the arbitration award in this case has, in principle, lost its effect upon the lapse of its period of validity.

Accordingly, the lower court should further examine, with respect to the portions of the arbitration reexamination decision in this case that the Plaintiff disputes as unlawful or in excess of authority, whether there exist special circumstances indicating a legal interest in seeking revocation even at present, after the lapse of the period of validity—such as whether the validity of a dismissal, commendation, or disciplinary action taken by the Plaintiff or the selected parties against an employee is being disputed in connection with the arbitration reexamination decision in this case, or whether there is a separate agreement concerning the payment of money or goods during the period of full-time union service, giving rise to a dispute as to whether a claim for payment of money or goods during that period has arisen. If, upon such examination, no such special circumstances are found, the lower court should dismiss the complaint in this case.

4. Accordingly, the lower court's decision is reversed, and the case is remanded to the court below. This judgment is rendered by the unanimous opinion of the Justices participating, as set forth in the Order.

Justice Cheon Gyeong-song (Presiding Justice), Ahn Yong-deuk, Ji Chang-kwon (Justice in Charge), Shin Seong-taek
