The plaintiff obtained a garnishment and collection order (채권압류 및 추심명령) against the wages of a Korean employee working for the United States Forces Korea (USFK), naming the United States as the third-party debtor (제3채무자). However, because the United States did not consent to the enforcement of this order, the Korean court held that it lacked jurisdiction over the matter, and the plaintiff's claim for collection was dismissed.

Key takeaways
  • CaseA creditor tried to collect wages owed by USFK to a Korean employee by obtaining a garnishment order against the United States as third-party debtor.
  • OutcomeThe Korean Supreme Court ruled that without the U.S. government's explicit consent to enforcement, Korean courts have no jurisdiction, so the collection claim was dismissed.
  • LessonWhen seeking enforcement against a foreign government or its agencies in Korea, creditors must first confirm whether that state has waived sovereign immunity or consented to enforcement, since Korean courts cannot compel compliance otherwise.
Issues
  • The scope of Korean court jurisdiction over garnishment and collection orders where a foreign state is named as the third-party debtor
  • Whether enforcement is possible when the claim does not fall under the categories covered by the Korea-U.S. Status of Forces Agreement (SOFA,
  • The standard for determining whether a foreign state has waived its jurisdictional immunity
Key reasoning

Under principles of sovereign immunity, a garnishment and collection order targeting a foreign state as the third-party debtor can only be enforced if that foreign state explicitly consents to the enforcement or waives its jurisdictional immunity (재판권 면제). In this case, the United States did not give such consent, meaning Korean courts had no jurisdiction to enforce the order against it. Since jurisdiction is a threshold requirement for any binding judgment, the absence of U.S. consent rendered the entire garnishment and collection procedure legally ineffective. Consequently, the court could not proceed to rule on the merits of the collection claim.

Summary of Decision (English, AI translation)

[1] Unless there are special circumstances such that a foreign state's private-law act performed within the territory of our country belongs to sovereign activity or is closely related thereto, such that the exercise of adjudicative jurisdiction over it would risk constituting undue interference with the foreign state's sovereign activities, our courts may exercise adjudicative jurisdiction over a foreign state's private-law act by naming that state as the defendant.

[2] An order of attachment and collection of a claim is one in which the enforcement court unilaterally orders the third-party obligor to refrain from paying the obligation owed to the obligor, and grants the authority to collect the attached claim to the execution creditor; accordingly, even if the third-party obligor pays the obligation to the execution obligor, such payment cannot be asserted against the execution creditor, and the third-party obligor remains obligated to pay the obligation to the execution creditor who has obtained the collection order. In this way, an order of attachment and collection of a claim is not an execution against property owned by the third-party obligor, and although the third-party obligor is not a party to the execution proceedings, once such an order is issued, the third-party obligor becomes the direct target of the enforcement court's exercise of compulsory power, such as the payment-prohibition order and the collection order, and is thereby subjected to compliance therewith. In light of these considerations, the exercise of adjudicative jurisdiction over an order of attachment and collection of a claim in which a foreign state is the third-party obligor is required to be exercised with even greater caution than the exercise of adjudicative jurisdiction in judgment proceedings in which a foreign state is the defendant. This is all the more so considering that an order of attachment and collection of a claim is issued unilaterally based solely on the execution creditor's title of execution against the obligor, without any title of execution against the third-party obligor. Therefore, even if the attached claim arose from a foreign state's private-law act, and even if our courts may exercise adjudicative jurisdiction over that private-law act by naming the relevant state as defendant, when an execution creditor who is not a party to the attached claim applies for an order of attachment and collection naming that state as the third-party obligor, our courts shall be deemed to have adjudicative jurisdiction to issue an order of attachment and collection of a claim naming that state as the third-party obligor only in limited circumstances, such as where the relevant state has explicitly consented, by means of an international treaty, an arbitration agreement, a written contract, a statement in court, or otherwise, that the state's obligation incurred through its private-law act may be subject to attachment or other compulsory execution ordered by our courts, or where the state may be deemed to have waived its claim to immunity from jurisdiction with respect to compulsory measures such as attachment by our courts, for example by separately allocating property within our country for payment of that obligation. Furthermore, in cases where our courts may thus exercise adjudicative jurisdiction over a collection order naming a foreign state as the third-party obligor, our courts may likewise exercise adjudicative jurisdiction over a collection-of-funds lawsuit against the foreign state as defendant based on that collection order; conversely, where adjudicative jurisdiction over the collection order is not recognized, adjudicative jurisdiction over the collection-of-funds lawsuit must likewise be denied.

[3] In a case where Eul, a creditor of Gap, who resides in the Republic of Korea and works at the United States Forces Korea headquarters, obtained from our court an order of attachment and collection naming the United States of America as the third-party obligor with respect to Gap's retirement pay, wages, and other claims against the United States of America, and thereafter sought payment of the collected funds: there being no private-law contractual relationship whatsoever between Eul and the United States of America, our courts do not automatically have adjudicative jurisdiction over the collection-of-funds lawsuit filed by Eul against the United States of America. Moreover, the claim held by Eul against Gap is not a claim arising from an unlawful act or omission of an employee as provided in Article 23, paragraphs 5 and 6 of the "Agreement Under Article IV of the Mutual Defense Treaty Between the Republic of Korea and the United States of America, Regarding Facilities and Areas and the Status of United States Armed Forces in the Republic of Korea" (hereinafter the "SOFA"); furthermore, since Gap is a person residing in the Republic of Korea, which is a ground for exclusion of application under Article 23, paragraph 6 of the SOFA, the claim held by Eul against Gap does not fall under the claims provided for in Article 23, paragraph 5 or 6 of the SOFA. Accordingly, "Joint Committee Agreed Minute No. 1 on Non-Criminal Judicial Procedures Under Article XXIII of the Agreement," which is a provision concerning the procedure for enforcement of claims under Article 23, paragraph 5 or 6 of the SOFA, does not apply to compulsory execution for the satisfaction of the claim held by Eul against Gap. Furthermore, there is no material showing that the United States of America explicitly consented that its obligations, such as wages, owed to its employee Gap may be subject to attachment or other compulsory execution ordered by our courts, or that it waived its claim to immunity from jurisdiction with respect to compulsory measures such as attachment by our courts, for example by separately allocating property within our country for the payment of such obligation. Consequently, our courts do not have adjudicative jurisdiction to issue an order of attachment and collection of a claim naming the United States of America as the third-party obligor, and therefore the said order of attachment and collection, having been issued by a court lacking adjudicative jurisdiction, is void, and our courts likewise do not have adjudicative jurisdiction over the collection-of-funds lawsuit.

[Defendant, Appellee] United States of America
[Judgment Below] Seoul High Court Decision 2004Na43604, decided January 21, 2009

[Order]

The appeal is dismissed. The costs of the appeal shall be borne by the Plaintiff.

[Reasoning]

The grounds of appeal are examined.

1. Unless there are special circumstances such that a private-law act of a foreign state performed within the territory of the Republic of Korea belongs to sovereign activities or is closely related thereto, so that the exercise of adjudicative jurisdiction over such act may amount to undue interference with the sovereign activities of the foreign state, the courts of the Republic of Korea may exercise adjudicative jurisdiction over the private-law acts of a foreign state, with that state as the defendant (see, e.g., Supreme Court en banc Decision 97Da39216, delivered December 17, 1998).

However, an order of attachment and collection of claims is one whereby the enforcement court unilaterally orders the garnishee (third-party obligor) to refrain from paying the debt owed to the obligor, and confers upon the executing creditor the power to collect the attached claim; accordingly, even if the garnishee pays the debt to the executing debtor, it cannot assert this against the executing creditor, and the garnishee remains obligated to pay the debt to the executing creditor who has obtained the collection order. Thus, although an order of attachment and collection of claims is not an execution against property owned by the garnishee, and although the garnishee is not a party to the enforcement proceedings, once such an order is issued, the garnishee becomes the direct object of the enforcement court's exercise of compulsory power, such as the order prohibiting payment and the collection order, and is thereby subjected to it. In light of this, the exercise of adjudicative jurisdiction over an order of attachment and collection of claims where the garnishee is a foreign state requires even greater caution than the exercise of adjudicative jurisdiction in a judgment procedure where a foreign state is the defendant. This is all the more so considering that an order of attachment and collection of claims is unilaterally issued not on the basis of a title of execution against the garnishee, but solely on the basis of the executing creditor's title of execution against the debtor. Therefore, even where the attached claim arose from a private-law act of a foreign state, and even where the courts of the Republic of Korea may exercise adjudicative jurisdiction over that state as defendant with respect to such private-law act, in a case where an executing creditor who is not a party to the attached claim applies for an order of attachment and collection against that state as garnishee, the courts of the Republic of Korea have adjudicative jurisdiction to issue an order of attachment and collection of claims against that state as garnishee only in limited circumstances: namely, where the state has expressly consented, whether through an international treaty, an arbitration agreement, a written contract, or statements made in court, to the effect that the state's debt arising from such private-law act may be subject to attachment or other compulsory execution ordered by the courts of the Republic of Korea, or where it can be viewed that the state has waived its claim to immunity from jurisdiction with respect to compulsory measures such as attachment by the courts of the Republic of Korea, such as by separately allocating property within the Republic of Korea for payment of that debt. Moreover, where the courts of the Republic of Korea may thus exercise adjudicative jurisdiction over a collection order with a foreign state as garnishee, it follows that the courts may likewise exercise adjudicative jurisdiction over a collection action against the foreign state as defendant based on such collection order; conversely, where adjudicative jurisdiction over the collection order is not recognized, it is likewise appropriate to hold that adjudicative jurisdiction over the collection action is not recognized either.

Meanwhile, Article 23, paragraph 5 of the Agreement Under Article IV of the Mutual Defense Treaty Between the Republic of Korea and the United States of America, Regarding Facilities and Areas and the Status of United States Armed Forces in the Republic of Korea (hereinafter the "SOFA") provides for the procedures for handling claims arising from acts or omissions of members or employees of the United States armed forces done in the performance of official duty, or from any other act, omission, or occurrence for which the United States armed forces are legally responsible, and which causes damage in the Republic of Korea to a third party other than the Government of the Republic of Korea; however, it provides that even such claims, if they are contractual claims, shall be excluded from the application of Article 23, paragraph 5. Article 23, paragraph 6 of the SOFA provides for the procedures for handling claims against members or employees of the United States armed forces arising from unlawful acts or omissions done in the Republic of Korea which were not done in the performance of official duty, but provides that employees of the United States armed forces who are nationals of the Republic of Korea or who are ordinarily resident in the Republic of Korea shall be excluded from the application of Article 23, paragraph 6. Furthermore, the Understandings with Respect to the Agreement Under Article IV of the Mutual Defense Treaty Between the Republic of Korea and the United States of America, Regarding Facilities and Areas and the Status of United States Armed Forces in the Republic of Korea, and the Agreed Minutes Relating Thereto, concluded on January 18, 2001 (hereinafter the "Understandings"), provide, in connection with Article 23, paragraphs 5 and 6 of the SOFA, that "the Joint Committee shall establish procedures for the exercise of civil adjudicative jurisdiction by the courts of the Republic of Korea." Pursuant thereto, Article 4(d) of Joint Committee Agreement No. 1 Concerning Non-Criminal Judicial Procedures under Article 23 of the Agreement (hereinafter the "Agreement Item"), established accordingly, provides that "monies payable by the United States Government to a member, civilian component, or employee of the United States armed forces may, to the extent permitted by United States law, be subject to attachment or other compulsory execution ordered by a court having jurisdiction in the Republic of Korea." In light of the structure and wording of these provisions, the above Agreement Item is a provision concerning, inter alia, the procedures for enforcement of claims under Article 23, paragraph 5 or paragraph 6 of the SOFA.

2. According to the reasoning of the judgment below and the record, the following facts may be ascertained: the non-party individual (hereinafter "Non-party") is a person residing in the Republic of Korea who worked as a high-voltage electrical technician at the United States Forces Korea headquarters; pursuant to the judgment in Seoul District Court Case No. 99Na85700 (damages (automobile)), the Plaintiff holds a claim against the Non-party for restitution of provisionally paid amounts; the Plaintiff applied to the Seoul District Court, Eastern Branch, for an order of attachment and collection of claims, designating the Non-party as the obligor and the Defendant as the garnishee, with respect to the Non-party's claim against the Defendant for retirement allowance, wages, and the like, and the said court granted the application and issued the order of attachment and collection of claims in Seoul District Court, Eastern Branch, Case No. 2001Taki3495 (hereinafter "the instant order of attachment and collection of claims").

Examining the above facts in light of the legal principles set forth above, first, since there is no private-law contractual relationship between the Plaintiff and the Defendant, it does not follow that the courts of the Republic of Korea may as a matter of course exercise adjudicative jurisdiction over the instant lawsuit brought by the Plaintiff against the Defendant.

Furthermore, as to whether the courts of the Republic of Korea have adjudicative jurisdiction to issue an order of attachment and collection of claims, with the Defendant as garnishee, over the Non-party's claim for wages and the like against the Defendant, for the satisfaction of the Plaintiff's claim against the Non-party for restitution of provisionally paid amounts: the Plaintiff's claim against the Non-party for restitution of provisionally paid amounts is not a claim arising from an unlawful act or omission of an employee as provided under Article 23, paragraphs 5 and 6 of the SOFA; moreover, since the Non-party is a person residing in the Republic of Korea, which is a ground for exclusion from application under Article 23, paragraph 6 of the SOFA, the Plaintiff's claim against the Non-party for restitution of provisionally paid amounts does not fall under the claims provided for in Article 23, paragraph 5 or paragraph 6 of the SOFA. Therefore, the above Agreement Item, which is a provision concerning the procedures for enforcement of claims under Article 23, paragraph 5 or paragraph 6 of the SOFA, does not apply to compulsory execution for the satisfaction of the Plaintiff's claim against the Non-party for restitution of provisionally paid amounts. Furthermore, there is no material to show that the Defendant expressly consented that the wage and other debts owed to its employee, the Non-party, could be subject to attachment or other compulsory execution ordered by the courts of the Republic of Korea, or that the Defendant otherwise waived its claim to immunity from jurisdiction with respect to compulsory measures such as attachment by the courts of the Republic of Korea, such as by separately allocating property within the Republic of Korea for payment of such debt. Accordingly, the courts of the Republic of Korea do not have adjudicative jurisdiction to issue the instant order of attachment and collection of claims with the Defendant as garnishee. Therefore, the instant order of attachment and collection of claims, having been issued by a court lacking adjudicative jurisdiction, is void, and the courts of the Republic of Korea likewise do not have adjudicative jurisdiction over the instant collection action.

Accordingly, the judgment below, which held that the instant lawsuit is unlawful because the courts of the Republic of Korea lack adjudicative jurisdiction, is justifiable in its conclusion, and there is no error of law, such as a misapprehension of legal principles, as alleged in the grounds of appeal.

3. Therefore, the appeal is dismissed, and the costs of the appeal are assessed against the losing party. This decision is rendered as set forth in the Order, with the unanimous concurrence of the Justices involved.
