Union officials entered a large discount store during business hours and staged a picket protest for about 30 minutes to demonstrate against dismissals and reassignments, following the store manager and other executives around the store. The Supreme Court held that entering a store that is open to the public through its normal entrance during business hours does not constitute building trespass (건조물침입), and that a peaceful, roughly 30-minute picketing protest does not amount to 'force' (위력) sufficient to constitute obstruction of business. The Court reversed the lower court's guilty verdict and remanded the case.

Key takeaways
  • CaseUnion members entered a large discount store during business hours and followed store executives for about 30 minutes while holding picket signs to protest dismissals and reassignments.
  • OutcomeThe Supreme Court ruled that entering an open store through its normal entrance is not trespass, and a peaceful, distanced picket protest does not amount to 'force' under the obstruction of business statute.
  • LessonEmployers and courts should distinguish between disruptive or coercive conduct and peaceful protest activity conducted through normal access points, as the latter generally does not meet the criminal thresholds for trespass or obstruction of business.
Issues
  • Whether entering an open retail store during business hours constitutes the crime of building trespass (건조물침입죄)
  • Whether a union's picket protest constitutes 'force' (위력) sufficient to establish the crime of obstruction of business (업무방해죄)
Key reasoning

The Court reasoned that where a person enters a building that is generally open to the public using an ordinary method of entry, this does not disturb the de facto peace of the premises, and therefore does not constitute building trespass. For the crime of obstruction of business, the 'force' (위력) element requires conduct sufficient to overpower a victim's free will, not merely inconvenience or discomfort. Because the picketers maintained physical distance and conducted the protest peacefully without any violence, threats, or blocking of movement, their conduct did not rise to the level of 'force' required under the statute. Accordingly, both charges were found to be unsupported by the facts as established, and the lower court's judgment was reversed.

Summary of Decision (English, AI translation)

[1] Where a person enters a structure that is generally open to public access, using an ordinary method, in a state in which there is no restriction on entry or objection by the manager, such conduct cannot be regarded as entering the structure in a manner that disturbs the de facto peaceful state of the premises, and therefore does not constitute the act of intrusion prescribed under the crime of intrusion upon a structure (건조물침입죄).

[2] In a case where the defendants, who were officers and members of the Mart Industry Labor Union (마트산업노동조합), acting jointly, were indicted for violation of the Act on the Punishment of Violences, etc. (폭력행위 등 처벌에 관한 법률) (joint intrusion upon a habitation) on the ground that they entered the second-floor sales area of a large mart branch through the front entrance against the will of the branch manager 甲, in order to protest the dismissal and personnel transfer orders to the CEO and others visiting the branch, the Supreme Court held as follows: given that (i) the second-floor sales area of the branch that the defendants entered was a place generally open to the public without restriction on eligibility to enter during business hours, and (ii) the defendants entered the second-floor sales area by passing through the front entrance and store entrance used by customers during business hours in sequence, without being stopped by security personnel or taking any special measures such as sneaking in while security personnel were away, it cannot be said that they entered in a manner disturbing the de facto peaceful state of the premises, inasmuch as they entered the branch's sales area—generally open to the public—by an ordinary method without any restriction on entry or objection by the manager; therefore, such conduct does not constitute the act of intrusion prescribed under the crime of intrusion upon a structure. Moreover, there is no confirmation of any explicitly expressed intention by the branch manager to prohibit entry, and even if the defendants' act of entering the branch's sales area was contrary to the manager's presumed intention, such circumstance alone cannot be evaluated as entry in a manner disturbing the de facto peaceful state of the premises; accordingly, the crime of intrusion upon a structure is not established as to the defendants. The Supreme Court held that the lower court, which had recognized the establishment of the crime of intrusion upon a structure mainly on the basis of the manager's presumed intention, erred in its misunderstanding of the applicable legal principles.

[3] "Force" (위력) in the crime of obstruction of business (업무방해죄) refers to any force capable of suppressing or confusing a person's free will, regardless of whether it is tangible or intangible; it is not necessary that the victim's free will actually be suppressed, but the force must be sufficient, in light of the offender's standing, the number of persons involved, the surrounding circumstances, etc., to suppress the victim's free will. Whether such force is present must be objectively determined by considering all relevant circumstances, including the date and place of the offense, the motive and purpose of the offense, the number of persons involved, the nature of the force exercised, the type of business, and the status of the victim, and is not to be determined by the victim's own subjective intention.

[4] In a case where the defendants, who were officers and members of the Mart Industry Labor Union, conspiring together, were indicted on the charge of having obstructed, for about 30 minutes, the on-site inspection duties of branch manager 甲 by holding a picket reading "Unfair Dismissal" and following 甲, the CEO, and other executives and employees around the second-floor sales area of a large mart branch while shouting loudly, "Stop the forced transfer, do not implement integrated operation, the employees are suffering, stop the unfair dismissal," the Supreme Court held as follows: the defendants' conduct occurred around 11 a.m. on a weekday at the large mart's sales floor, after the defendants (some of whom had been dismissed several months earlier for failing to comply with personnel transfer orders) learned that the CEO and other executives were coming for an on-site inspection of the branch, and was intended to directly request the CEO to reinstate them and withdraw the personnel transfer orders in relation to the dismissals and transfer orders; whether the defendants' conduct was sufficient to suppress 甲's free will should not be determined solely by relying on 甲's own intention or statements, but must be objectively assessed by considering the manner of the defendants' conduct, the number of the defendants, their gender and age, as well as the number and status of the persons on 甲's side. Considering that, of the seven defendants, four were women and, among the three male defendants, one was in his 50s, whereas the personnel participating in the on-site inspection numbered about 20 or more, including 甲, most of whom were senior management including the CEO; that the defendants followed 甲 and others who were conducting the inspection duties at the store while keeping a distance of about 1 to 2 meters or more, standing nearby holding pickets or shouting phrases such as "Stop the forced transfer" and "We want to work," but did not approach 甲 and others any closer or physically obstruct their movement or duties, and did not use abusive language or threats against 甲 and others; and that 甲 and others continued the on-site inspection duties for about 30 minutes—in light of all these circumstances taken together, it is difficult to conclude that the defendants exercised force sufficient to suppress the free will of 甲 and others. The Supreme Court held that the lower court, which had found otherwise and recognized the establishment of the crime of obstruction of business, erred in its misunderstanding of the legal principles regarding "force" under the crime of obstruction of business.

[Judgment Below] Seoul Southern District Court Decision 2020No2600 rendered on July 6, 2021

[Order]

The judgment below is reversed, and the case is remanded to the Seoul Southern District Court.

[Reasoning]

The grounds of appeal are examined.

1. Regarding the Violation of the Act on the Punishment of Violences, etc. (Joint Trespass on Residence)

A. The crime of trespass on a residence protects, as its legal interest, the de facto peace of a residence. Since the constituent element of "intrusion" in the crime of trespass on a residence must be interpreted in relation to the legal interest protected by the crime, "intrusion" means entering a residence in a manner that undermines the de facto state of peace of the residence, and whether an act constitutes intrusion should, in principle, be determined based on the mode of conduct objectively and externally revealed at the time of entry. While entering a residence in a manner that undermines the de facto state of peace will generally be contrary to the resident's intention, the mere subjective circumstance that the act of entering a residence itself is contrary to the resident's intention does not immediately constitute intrusion (see Supreme Court en banc Decision 2020Do12630 delivered on September 9, 2021). Therefore, whether an act constitutes intrusion should be determined not by whether it is contrary to the resident's intention, but by whether the mode of conduct undermines the de facto state of peace.

Where an actor entered a residence with the consent of the resident, but the entry was for a criminal purpose or under circumstances where the resident would not have consented to the entry had the resident known the actor's actual purpose of entry, in order for the actor's act of entry to constitute intrusion as defined in the crime of trespass on a residence, it must be evaluated, in light of the mode of conduct objectively and externally revealed at the time of the actor's entry, considering comprehensively the form, use and nature of the residence or building sought to be entered, the manner and status of control and management of entry by outsiders, and the actor's circumstances and method of entry, that the de facto state of peace of the residence was infringed (see Supreme Court en banc Decision 2017Do18272 delivered on March 24, 2022; Supreme Court Decision 2021Do7087 delivered on June 16, 2022, etc.).

Therefore, if a person enters a building that is generally open to the public and permits entry, in an ordinary manner and without any restriction or prevention of entry by the manager, it cannot be said that the person entered the building in a manner that undermines the de facto state of peace, and thus such entry does not constitute intrusion as defined in the crime of trespass on a building (see Supreme Court Decision 2022Do2907 delivered on May 12, 2022; Supreme Court Decision 2021Do7087 delivered on June 16, 2022, etc.).

B. The facts charged in this part are that the Defendants, acting jointly, at around 11:00 on May 28, 2020, in order to protest against dismissals and reassignment personnel orders to the representative director of ○○○○ and others who visited the ○○○○△△ branch located in Gangseo-gu, Seoul, entered the second floor of the ○○○○△△ branch through the front entrance against the will of the victim, who was the manager of the said ○○○○△△ branch, thereby trespassing on a building.

C. The court below upheld the first instance court's judgment, which found this part of the charges guilty on the ground that the Defendants entered the ○○○○△△ branch against the manager's presumed intention, thereby undermining the de facto peace of the building.

D. However, according to the reasoning of the judgment below and the record, the following facts are recognized.

1) The second-floor sales area of the ○○○○△△ branch, which the Defendants, who were officers and members of the Mart Industry Labor Union, entered, is a place generally open to the public without restriction on eligibility to enter during business hours.

2) As alleged in the facts charged, the Defendants entered the second-floor sales area by passing successively through the front entrance and the store entrance used by customers during business hours, without being stopped by security personnel or taking any special measure such as sneaking in while security personnel were away from their posts.

E. Examining the above facts in light of the legal principles set forth above, insofar as the Defendants entered the ○○○○△△ branch's sales area, which was generally open to the public and permitted entry, in an ordinary manner and without any restriction or prevention of entry by the manager, it cannot be said that they entered in a manner that undermines the de facto state of peace, and thus such entry does not constitute intrusion as defined in the crime of trespass on a building. There is no confirmed explicit intention of the manager of the ○○○○△△ branch to prohibit entry, and even if the Defendants' act of entering the sales area of the ○○○○△△ branch as alleged in this part of the facts charged was contrary to the manager's presumed intention, such circumstance alone cannot be evaluated as entry in a manner that undermines the de facto state of peace. Therefore, the crime of trespass on a building is not established against the Defendants.

F. Nevertheless, the judgment below, which recognized the establishment of the crime of trespass on a building mainly on the ground of the manager's presumed intention, erred by misapprehending the legal principles concerning the establishment of this crime, thereby affecting the judgment. The ground of appeal pointing this out is well-founded.

2. Regarding the Obstruction of Business Part

A. "Force" in the crime of obstruction of business refers to any force, whether tangible or intangible, sufficient to suppress or confuse a person's free will, and it need not actually suppress the victim's free will; however, it must be of a degree sufficient to suppress the victim's free will in light of the offender's power, number of persons, surrounding circumstances, etc. Whether such force applies must be objectively determined by considering all relevant circumstances, including the date, time, and place of the offense, the motive and purpose of the offense, the number of persons involved, the mode of the force, the type of business, and the status of the victim (see Supreme Court Decision 2016Do10956 delivered on October 27, 2016, etc.), and it is not determined by the intention of the victim, etc.

B. The facts charged in this part are that the Defendants, having entered the second-floor sales area of the ○○○○△△ branch as described above, conspired to carry picket signs reading "unjust dismissal," followed the victim (the branch manager of the △△ branch) and executives and employees including the representative director of ○○○○ (hereinafter collectively referred to as "the victim, etc."), and shouted loudly, "Stop the forced transfers, do not conduct integrated operations, employees are suffering, stop the unjust dismissals," for about 30 minutes, thereby obstructing the victim's on-site inspection business by force.

C. The court below upheld the first instance court's judgment, which found this part of the charges guilty on the ground that a large number of Defendants carried picket signs in the store, continuously followed the victim, etc., shouted loudly, and filmed this with a camera, which constituted the exercise of force sufficient to suppress the victim's free will.

D. However, according to the reasoning of the judgment below and the record, the following facts are recognized.

1) The acts alleged in the facts charged took place at around 11:00 a.m. on a weekday in the food section of a large discount store, and upon hearing news that the representative director of ○○○○ and other executives and employees would visit the ○○○○△△ branch for an on-site inspection, the Defendants, who were officers and members of the labor union (some of whom had been dismissed several months earlier for failing to comply with reassignment personnel orders), attempted to directly request the representative director to reinstate them and withdraw the reassignment personnel orders, in connection with the dismissals and reassignment personnel orders, etc.

2) The total number of persons who committed the acts alleged in the facts charged was the 7 Defendants, of whom 4 were women, and among the 3 male Defendants, 1 was in his 50s. In contrast, the number of persons who participated in the on-site inspection of the store at the time was about 20 or more, including the victim, etc., most of whom were executive-level management including the representative director.

3) The Defendants followed the victim, etc., who were conducting inspection work in the food section, while maintaining a distance of about 1 to 2 meters or more, standing nearby holding picket signs or shouting "Stop the forced transfers" and "We want to work," etc., but the victim, etc. continued the on-site inspection work for about 30 minutes.

4) Defendant 2 filmed the activities of the other Defendants in order to inform the labor union members of the news, and did not attempt to film the appearance of the victim, etc.

E. Examining the above facts in light of the legal principles set forth above, it is difficult to conclude that the Defendants, by conspiracy, exercised force sufficient to suppress the free will of the victim, etc. The reasons are as follows.

1) Whether the Defendants' acts were sufficient to suppress the victim's free will should be objectively determined not solely based on the victim's intention or statement, but by also considering the mode of the Defendants' conduct, the number of Defendants, their gender and age, and the number and status of persons on the victim's side.

2) While committing the acts alleged in the facts charged, the Defendants stood holding picket signs at a distance of about 1 to 2 meters or more from the victim, etc., and followed them as they moved, but did not approach the victim, etc. any closer than that, nor did they physically obstruct the movement or work of the victim, etc.

3) The Defendants did not use abusive language or make threats against the victim, etc., and, contrary to the facts charged, even used honorific language while shouting their demands. There is no objective evidence to suggest that the Defendants' vocal utterances constituted noise sufficient to hinder the victim's on-site inspection work in the food section of a large discount store, which is visited by many customers and where sales promotion events are also held.

4) The Defendants sought, upon the opportunity to directly meet with the representative director, who held the authority to decide personnel policy and personnel discretion, to protest the dismissals and reassignment personnel orders, etc., and to request reinstatement and withdrawal of the reassignment personnel orders; it is difficult to view that the Defendants committed the acts alleged in the facts charged with the intent to obstruct or halt the victim's management duties as the manager of the △△ branch.

5) Despite the Defendants' acts as alleged in the facts charged, the representative director's on-site inspection work continued for about 30 minutes.

6) In the court below, the Defendants' defense counsel also argued that, at other branches of ○○○○, union members engaged in similar activities in accordance with the representative director's on-site inspection schedule, but no particular measures such as filing complaints were taken there.

F. Nevertheless, the judgment below, which found that the Defendants exercised "force" and recognized the establishment of the crime of obstruction of business, erred by misapprehending the legal principles concerning "force" in the crime of obstruction of business, thereby affecting the judgment. The ground of appeal pointing this out is well-founded.

3. Conclusion

The judgment below is reversed, and the case is remanded to the court below for further hearing and determination. This judgment is rendered as stated in the Order by the unanimous consent of the Justices participating in the decision.
