This case concerns a dispute over the scope of statutorily prescribed working hours (소정근로시간) under a wage agreement (임금협정) at a taxi company, which set basic working hours at 6 hours 30 minutes, overtime hours at 2 hours, and night-shift hours at 30 minutes. The lower court (원심) had ruled that the prescribed working hours totaled 9 hours, but the Supreme Court (대법원) reversed, holding that the prescribed working hours should be understood as only the basic working hours of 6 hours 30 minutes, and remanded the case for further review.

Key takeaways
  • CaseA taxi company's wage agreement set basic working hours at 6 hours 30 minutes and overtime hours at 2 hours, leading to a dispute over what counted as the legally prescribed working hours.
  • OutcomeThe Supreme Court ruled that only the basic working hours of 6 hours 30 minutes constituted the prescribed working hours, not the full 9 hours as the lower court had found.
  • LessonWithin the statutory working hour limits, employers and employees may freely agree on the scope of prescribed working hours, and such an agreement remains valid even if it includes a separate arrangement to pay premium wages for hours worked beyond the basic hours.
Issues
  • The scope of prescribed working hours (소정근로시간) under a wage agreement (임금협정)
  • The distinction between basic working hours and overtime working hours
  • The validity of an agreement to pay premium wages (가산임금) for work exceeding basic hours but within statutory limits (법내 초과근로)
Key reasoning

The Supreme Court reasoned that, within the statutory maximum working hours (기준근로시간), employers and employees are free to mutually agree on what constitutes the prescribed working hours (소정근로시간). Since the wage agreement explicitly distinguished basic working hours from overtime hours and provided for the payment of premium wages (가산임금) for work exceeding the basic hours, this arrangement could not be dismissed as a mere formality or an unlawful attempt to circumvent labor law (탈법행위). Therefore, the agreement to treat only the 6 hours 30 minutes as prescribed working hours, while compensating additional hours with premium pay, was valid and enforceable.

[Defendant, Appellant] ○○○ Limited Partnership Company (Attorney: Choi Seong-jin)
[Judgment Below] Daejeon High Court Decision 2021Na11938, 11945 decided March 10, 2022

[Order]

The part of the judgment below against which the Defendant lost is reversed, and this part of the case is remanded to the Daejeon High Court.

[Reasoning]

The grounds of appeal (to the extent that the statements in the brief submitted after the expiration of the period for submitting the grounds of appeal supplement the grounds of appeal) are examined.

1. Outline of the case
According to the reasoning of the judgment below and the records, the following facts can be known.
A. The Defendant is a limited partnership company engaged in the general taxi transportation business, and the Plaintiffs are workers employed by the Defendant who worked on an alternate-day basis.
B. Article 6(5) of the Minimum Wage Act (최저임금법), as amended by Act No. 8964 on March 21, 2008 (hereinafter “the special provision at issue”), took effect from July 1, 2010 in the Cheonan-si area where the Defendant is located, excluding “wages based on production output” from the scope of wages included in the minimum wage.
C. The Defendant concluded wage agreements with the following content with the Korean Federation of Transport, Public and Social Services Workers’ Unions Chapter △△△ Transportation (hereinafter “the instant chapter”).
1) The 2009 wage agreement set the dispatch (operating) hours at 15 hours per day (from 8:00 to 23:00), of which the basic working hours were set at 6 hours and 30 minutes, extended working hours at 2 hours, night working hours at 30 minutes, and meal and rest time at 6 hours, and provided that the basic wage calculated according to the ordinary hourly wage (4,120 won) would be paid for the basic working hours, 150% of the ordinary hourly wage for extended working hours, and an amount equivalent to 200% of the ordinary hourly wage for night working hours.
2) The 2016 wage agreement set the daily dispatch hours and basic working hours the same as the 2009 wage agreement, while changing the night working hours to 1 hour (payment of 150% of 6,140 won for workers with less than 1 year of service, and 150% of 6,900 won for workers with 1 year or more of service) and the meal and rest time to 7 hours and 30 minutes, and deleted the provisions on extended working hours.
3) The wage agreements for 2017, 2018, and 2019 successively shortened the daily basic working hours to 6 hours, 5 hours and 30 minutes, and 5 hours, respectively.

2. Judgment of the court below
A. The court below held that the daily prescribed working hours under the 2009 wage agreement were 9 hours, the sum of the basic working hours of 6 hours and 30 minutes and the 2 hours of extended working hours and 30 minutes of night working hours (hereinafter the extended working hours and night working hours are collectively referred to as “the instant excess working hours”), for the following reasons.
1) Of the 15 hours of dispatch time, the basic working hours amounted to only 6 hours and 30 minutes, and the remainder consisted of the instant excess working hours and the like.
2) Before and after the enforcement of the special provision at issue, the average daily working hours required to earn the quota (사납금) in Cheonan-si were approximately 11 hours, and if only the basic working hours were recognized as the prescribed working hours, a significant discrepancy would arise between the actual working hours and the prescribed working hours.
3) The basic working hours appear to be, in substance, merely a standard for calculating the fixed basic wage rather than actually agreed-upon working obligation hours. The Defendant paid wages corresponding to the instant excess working hours without measuring the Plaintiffs’ actual extended and night working hours.
B. The court below held that the agreements on prescribed working hours in each of the wage agreements from 2016 onward, which shortened the 9-hour daily prescribed working hours under the 2009 wage agreement, constituted an unlawful act intended to circumvent the application of the special provision at issue and are therefore void, and that the Plaintiffs’ prescribed working hours should be regarded as 9 hours per day.

3. Judgment of the Supreme Court
A. Examining the aforementioned facts in light of the relevant legal principles, it is difficult to accept the court below’s determination that the daily prescribed working hours under the 2009 wage agreement were 9 hours, and there is substantial ground to view that the 2009 prescribed working hours were the basic working hours of 6 hours and 30 minutes per day. The reasons are as follows.
1) In the case of a disposal document such as a collective agreement, absent special circumstances, the existence and content of the declaration of intent indicated in the document must be recognized based on its stated content (see Supreme Court Decision 86Daka306 delivered on April 14, 1987).
The 2009 wage agreement distinguishes between the basic working hours of 6 hours and 30 minutes per day and the instant excess working hours of 2 hours and 30 minutes exceeding that. Work exceeding the prescribed working hours but within the statutory working hours (so-called intra-statutory excess work) does not constitute extended work as defined in Article 56(1) of the Labor Standards Act (근로기준법), and is thus not subject to the payment of premium wages (see Supreme Court Decision 97Da14200 delivered on June 26, 1998); nevertheless, the Defendant and the instant chapter agreed, at the time of the 2009 wage agreement, to pay premium wages for extended work for the entirety of the instant excess working hours, including the intra-statutory excess work.
2) A worker bears the obligation to work during the agreed prescribed working hours, and the employer pays wages for the performance of that work obligation; and the employer and worker may, in principle, freely agree upon the prescribed working hours by mutual consent, so long as they do not exceed the statutory working hours. However, where the determination of prescribed working hours can be evaluated as being merely a matter of form, or where there are special circumstances such that the prescribed working hours were set with the intent to circumvent mandatory provisions of labor-related statutes, the effect of the agreement as to the prescribed working hours must be denied (see Supreme Court en banc Decision 2016Da2451 delivered on April 18, 2019).
The Defendant agreed to pay premium wages for the entirety of the instant excess working hours, and this is not disadvantageous to the workers. Given that premium wages were agreed to be paid even for work exceeding the basic working hours, it is difficult to conclude, merely from the fact that the basic working hours under the 2009 wage agreement fell short of the actual working hours, that the agreement setting the basic working hours as the prescribed working hours was merely a matter of form, or that it constituted an unlawful act to evade violation of the Minimum Wage Act, including the special provision at issue.
3) Taking these circumstances together, it can be seen that the Defendant and the instant chapter agreed to set the basic working hours of 6 hours and 30 minutes, within the scope of the statutory working hours, as the prescribed working hours, and to treat the instant excess working hours as work exceeding the prescribed working hours. Meanwhile, the portion of the 2009 wage agreement concerning the instant excess working hours may be viewed as an agreement deeming the instant excess working hours to be the time ordinarily required to perform the duties, regardless of the actual extended working hours, etc., in consideration of the difficulty of calculating working hours exceeding the prescribed working hours due to the nature of the business operations of taxi driver-workers. Even if the Defendant paid amounts corresponding to the pre-agreed excess work to the taxi driver-workers under its employ without measuring the actual excess working hours, this circumstance alone does not require that the instant excess working hours be regarded as prescribed working hours, given the existence of the agreement to pay premium wages.
B. Nevertheless, the court below determined that the agreements on prescribed working hours in each of the wage agreements from 2016 onward were void, premised on the assumption that the 2009 prescribed working hours were 9 hours. Such determination by the court below contains an error affecting the judgment by failing to conduct the necessary examination due to a misunderstanding of the legal principles concerning prescribed working hours under the Labor Standards Act. The ground of appeal pointing this out has merit.

4. Conclusion
Accordingly, without determining the remaining grounds of appeal, the part of the judgment below against which the Defendant lost is reversed, and this part of the case is remanded to the court below for further examination and determination. This judgment is rendered as set forth in the Order by the unanimous opinion of the Justices participating in the adjudication.
