AI-generated summary for reference only — the Korean original below is authoritative.

This case, unrelated to labor law, involved a former romantic partner who trespassed into the common areas of the victim's multi-unit residential building for stalking purposes. The key issue was whether unauthorized entry into shared common areas of a multi-unit dwelling constitutes trespass (주거침입) under Korean criminal law. The Supreme Court reversed the lower court's ruling, holding that common areas of multi-unit housing are protected objects under the trespass statute, and that the totality of circumstances indicated an unlawful intrusion.

Key takeaways
  • CaseA former romantic partner unlawfully entered the common areas of the victim's multi-unit building at night for stalking purposes.
  • OutcomeThe Supreme Court ruled that common areas of shared housing are protected under trespass law and reversed the lower court's acquittal.
  • LessonUnauthorized entry into shared spaces of residential buildings—even common hallways or entrances—can constitute criminal trespass if done to disturb a resident's peace, particularly in stalking-related contexts.
Issues
  • Whether common areas of multi-unit residential buildings qualify as protected premises under the crime of trespass (주거침입)
  • The standard for determining what constitutes an 'intrusion' under the trespass statute
  • Whether entry against the will of the resident constitutes an act of trespass
Key reasoning

The Supreme Court held that common areas of multi-unit residential buildings (such as stairwells, hallways, and building entrances) qualify as protected premises under the crime of trespass (주거침입), just as private living spaces do. Whether an 'intrusion' has occurred must be judged from the standpoint of whether the actual peaceful state of the residence was disturbed, taking into account the purpose of entry, the manner of entry, and the degree of access control or management over the area. In this case, the defendant entered at night without authorization for the purpose of stalking the victim, which the Court found to constitute conduct that disturbed the peaceful and secure state of the residence, satisfying the elements of trespass.

Summary of Decision (English, AI translation)

[1] The common areas within multi-family houses for multiple households or multi-unit residential buildings such as multi-household houses, row houses, and apartments—including elevators, common stairways, and corridors—also require protection of the residents' actual peace of habitation, and thus constitute "a person's dwelling," which is the object of the crime of trespass into a dwelling (주거침입죄). In determining whether an outsider's, who is not a resident's, entry into the common areas of a multi-unit residential building constitutes trespass against the residents of the building, the following matters must be comprehensively considered and objectively and formally evaluated from the perspective of "whether the actual peaceful state of the dwelling has been infringed": whether the common area is a space not generally open to public access, but rather a part indispensable to and attached to the exclusively used sections of each household or unit used as a dwelling, such that it is a part where control and management of outsiders' access by residents or managers is anticipated and where there is a need to protect the residents' actual peace of habitation; whether the residents or manager of the multi-unit residential building have ordinarily controlled and managed outsiders' access to that area; and the purpose and circumstances of the outsider's entry, the manner of entry, and the time of entry.

[2] The mere subjective circumstance that the act of entering a dwelling itself is contrary to the resident's will does not by itself constitute trespass. This is because whether an act constitutes trespass must ultimately be determined according to whether the manner of the act undermines the actual peaceful state of the dwelling. However, whether the act is contrary to the resident's will may be one factor to consider in evaluating whether the manner of the act undermines the actual peaceful state. The degree to which this factor is to be considered may be evaluated differently depending on the circumstances at the time of entry, such as the form, use, and nature of the dwelling, and the method and status of control and management of outsiders' access.

[3] In a case where the defendant, on three occasions at night, entered through the common entrance and stairway of the villa building in which Gap, his former girlfriend with whom he had previously dated and broken up, resided, and proceeded to the front of the entrance door of Gap's second-floor residence, with the intent to secretly record Gap's private conversations, or to hang a mask bearing words capable of causing Gap anxiety on the front door, or to place a photograph of Gap taken with another man—the Supreme Court held as follows. The villa building was a typical multi-household house in which approximately ten households, including Gap, resided. In light of the form, use, and nature of the common entrance, common stairway, and the area in front of each household's front door which the defendant entered, these areas had a strong character as an extended residential space of the residents, such that it would be difficult to view them as generally open to outsiders' access. On the first floor of the villa building, there was a parking lot and common entrance for the residents, and a person seeking to visit any household would proceed from outside through the parking lot to the common entrance, and then reach each household's front door via the internal stairway connecting to the upper floors; at least two CCTV cameras were installed on the ceiling of the parking lot, and on the pillar wall beneath them were written the phrases "CCTV in operation" and "No parking for outside vehicles." Although the CCTV was not actually operating at the time of the defendant's entry, and no separate locking device such as a door lock was installed at the common entrance, it can be evaluated that the residents or manager of the villa building, through the installation of the CCTV and the wording on the pillar wall, externally expressed their intent to control and manage not only unauthorized parking by outside vehicles but also unauthorized entry by outsiders into the parking lot and the entire villa building, which is the residential space connected thereto. Considering these circumstances together with the nature of the common areas of the villa building, the method and status of control and management over outsiders' unauthorized entry, the relationship between the defendant and Gap, the purpose and circumstances of the defendant's entry and the time of entry, the defendant's conduct before and after the act of entry, Gap's intent and conduct, and prevailing social norms regarding unauthorized entry into residential spaces, there is sufficient room to find that the defendant entered the villa building in a manner that undermined the actual peaceful state of Gap's dwelling. The Supreme Court held that the court below, which found otherwise and rendered a not-guilty verdict on the charged facts, erred in its legal interpretation of "trespass" under the crime of trespass into a dwelling and failed to sufficiently examine the case.

[Defendant] Defendant
[Appellant] Prosecutor
[Judgment Below] Seoul Northern District Court Judgment 2023No633, decided September 21, 2023

[Order]

The judgment below is reversed, and the case is remanded to the Seoul Northern District Court.

[Reasoning]

The grounds of appeal are examined.

1. Summary of the Facts Charged in This Case
The Defendant is charged as follows: ① On June 12, 2021, at approximately 22:00, at the residence of the victim, Nonindicted Person (female, 37 years old), who was the Defendant's former girlfriend with whom he had previously dated and broken up, the Defendant went up to the second floor via the stairs in order to record conversations, etc. taking place inside the victim's home, thereby intruding into the victim's residence; ② On July 20, 2021, at approximately 21:00, at the same victim's home, the Defendant intruded into the victim's residence in the same manner in order to hang a mask on the front door bearing the phrase "The game has begun"; and ③ On July 22, 2021, at approximately 22:00, at the same victim's home, the Defendant intruded into the victim's residence in the same manner in order to place a photograph of the victim on the front door.

2. Judgment of the Court Below
The court below reversed the judgment of the first instance court, which had found the Defendant guilty of the facts charged in this case, and rendered a not-guilty verdict, for the following reasons.

A. It is difficult to view that unauthorized entry by outsiders was being controlled and managed in an outward, visible manner, given that there was no door lock installed at the common entrance of the villa building where the victim resided (hereinafter referred to as "the building in this case"), there was no security guard, and although a CCTV camera was installed on the ceiling of the parking lot connected to the common entrance on the first floor of the building, it was not operating.

B. The Defendant stated that he simply entered because the common entrance of the building was always open, and since the Defendant did not engage in any particular conduct such as attempting to open the victim's front door at the time, the victim was completely unaware of this.

C. In light of these circumstances, it is difficult to conclude that the Defendant's act in this case constitutes "intrusion," which is the type of conduct that infringes upon the de facto peace of residence of the residents of the multi-unit dwelling that is the building in this case.

3. Judgment of the Supreme Court
However, it is difficult to accept the judgment of the court below that the Defendant's act in this case does not constitute "intrusion." The specific reasons are as follows.

A. Common areas within multi-household detached houses or multi-unit residential buildings such as multi-family houses, row houses, and apartments—including elevators, common stairways, and corridors—also require protection of the de facto residential peace of their residents, and therefore constitute "a person's residence," which is the object of the crime of trespass on residence (see Supreme Court Decision 2009Do4335, decided September 10, 2009, etc.). In determining whether entry into the common areas of a multi-unit dwelling by an outsider who is not a resident constitutes trespass on residence against the residents of the multi-unit dwelling, the following matters must be comprehensively considered: whether the common area is a space not open to entry by the general public but is a space that is essentially annexed to the exclusively used portion of each household or unit used as a residence, such that control and management over the entry of outsiders is anticipated by the residents or the manager, thereby requiring protection of the residents' de facto residential peace; whether the residents or manager of the multi-unit dwelling had ordinarily controlled and managed the entry of outsiders into that area; and the purpose and circumstances of the outsider's entry, the manner of entry, and the time of entry. Based on these considerations, the determination must be made objectively and outwardly from the perspective of "whether the de facto peaceful state of the residence was infringed" (see Supreme Court Decision 2021Do15507, decided January 27, 2022; Supreme Court Decision 2022Do3801, decided August 25, 2022, etc.).

B. The mere subjective circumstance that the act of entering a residence itself is contrary to the resident's intent does not immediately constitute intrusion (see Supreme Court en banc Decision 2020Do12630, decided September 9, 2021). This is because whether an act constitutes intrusion must ultimately be determined according to whether it is a type of conduct that infringes upon the de facto peaceful state of the residence. However, whether the act is contrary to the resident's intent can be one factor to be considered in evaluating whether it is a type of conduct that infringes upon the de facto peaceful state. In this regard, the degree to which this factor should be considered may be evaluated differently depending on the circumstances at the time of entry, such as the form, use, and nature of the residence, etc., and the manner and state of control and management of entry by outsiders (see Supreme Court en banc Decision 2017Do18272, decided March 24, 2022).

C. Examining the following facts and circumstances, which can be ascertained from the reasoning of the judgment below and the evidence lawfully adopted, in light of the legal principles set forth above, there is sufficient room to view that the Defendant's act in this case constitutes "intrusion."

1) The building in this case is a typical multi-family house in which approximately 10 households, including the victim, reside. The common entrance, common stairway, and the area in front of each household's front door in the building in this case, which the Defendant entered, are spaces essentially annexed to the exclusively used portion of each household in which the residents of the multi-unit dwelling conduct their daily residential life. In light of the form, use, and nature of this space, it has a strong character as an extended residential space of the residents, and compared to commercial establishments or public institutions open to the general public, the necessity of protecting privacy and residential peace is relatively greater in this space; therefore, it is difficult to view that entry by outsiders is generally permitted.

2) On the first floor of the building in this case, there is a parking lot and a common entrance for the residents. A person wishing to visit each household would proceed from the outside through the parking lot to the common entrance, and then proceed from the common entrance through the interior stairway connecting to the upper floors to reach the front door of each household. At least two CCTV cameras are installed on the ceiling of the first-floor parking lot, and the phrases "CCTV in operation" and "No parking for outside vehicles" are written on the pillar wall below.

3) At the time of the Defendant's entry, the CCTV cameras in the building in this case were not actually operating. Additionally, no security guard was stationed in the building in this case, and no separate locking device, such as a door lock requiring a password, was installed at the common entrance. However, it can be evaluated that the residents or manager of the building in this case, through the installation of the aforementioned CCTV cameras and the phrases on the pillar wall, externally indicated their intent to control and manage not only the prohibition of unauthorized parking by outside vehicles but also unauthorized entry by outsiders into the parking lot and the entirety of the building in this case, which is the connected residential space. Moreover, a person entering the building in this case could easily recognize these indications while passing through the parking lot.

4) The Defendant had previously dated and broken up with the victim. With the intent of secretly recording the victim's private conversations, hanging a mask bearing a phrase that could induce anxiety in the victim on the front door, or placing a photograph of the victim taken with another man, the Defendant entered through the common entrance and stairway of the building in this case, up to the front door of the victim's residence, at night, at approximately 21:00 to 22:00. Before and after these acts, the Defendant also sent the victim two messages containing severe verbal abuse or sexually harassing language.

5) The victim never consented to the Defendant's entry. The victim was unaware, at the time, of the Defendant's act of entering up to the front door. However, upon becoming aware of this, the victim immediately reported it to the police, and has consistently stated that she felt fear as a result of the Defendant's conduct.

D. Comprehensively considering the nature of the common areas of the building in this case, the manner and state of control and management over unauthorized entry by outsiders, the relationship between the Defendant and the victim, the purpose, circumstances, and time of the Defendant's entry, the Defendant's conduct before and after the act in question, the victim's intent and conduct, and the common social understanding regarding unauthorized entry into residential spaces, there is sufficient room to view that the Defendant entered the building in this case in a manner that infringed upon the de facto peaceful state of the victim's residence. Nevertheless, the court below, relying solely on the circumstances set forth above, found it difficult to recognize the Defendant's act in this case as "intrusion" and thus rendered a not-guilty judgment on the facts charged in this case. This judgment of the court below contains an error that affected the judgment by misunderstanding the legal principles concerning "intrusion" under the crime of trespass on residence and failing to conduct the necessary examination. The ground of appeal pointing this out is well-founded.

4. Conclusion
Therefore, the judgment below is reversed, and the case is remanded to the court below for further examination and judgment, and it is so decided as stated in the Order, by the unanimous opinion of the Justices participating in this decision.

Chief Justice Lee Dong-won (Presiding Justice), Justice Kim Sang-hwan, Justice Kwon Young-jun (Presiding Judge for Deliberation)

4. 결론
