In this case, a construction company paid wages in a lump sum to a third party who was completely unknown to the workers. The Supreme Court (대법원) ruled that this violated the Direct Wage Payment Principle (임금 직접 지급 원칙) under Korean labor law, rendering the payment invalid. The Court emphasized that exceptions allowing payment through an agent or messenger (사자) are only permitted under very strict conditions, and simply having a power of attorney (위임장) signed does not qualify as such an exception.

Key takeaways
  • CaseA construction company obtained a power of attorney and paid wages in a lump sum to a third party who had no connection to or knowledge of the workers.
  • OutcomeThe Supreme Court ruled that this payment violated the Direct Wage Payment Principle and was therefore invalid.
  • LessonWages must be paid directly to the worker themselves; a power of attorney alone is not sufficient to justify payment to a third party.
Issues
  • Whether an exception to the Direct Wage Payment Principle can be recognized
  • What requirements must be met for wage receipt through a messenger or agent (사자)
  • The legal validity of wage payments made to a third party
Key reasoning

Under Article 43 of the Labor Standards Act (근로기준법), the Direct Wage Payment Principle requires that wages be paid directly to the worker, and no exceptions are allowed even by law or collective agreement. Payment through a messenger or agent is only permissible in exceptional cases where, according to common social understanding, it can be considered equivalent to payment made directly to the worker, or where it is guaranteed that the wages will definitely reach the worker. In this case, the third party who received the wages had no connection to or knowledge of the workers at all, meaning this strict requirement was not satisfied. Therefore, the wage payment to this unrelated third party was deemed invalid, regardless of any power of attorney that may have been signed.

Summary of Decision (English, AI translation)

[1] Wages must be paid directly to the employee in full and in currency. However, where there is a special provision in statutes or a collective agreement, a portion of the wages may be deducted or payment may be made in a form other than currency (Article 43(1) of the Labor Standards Act (근로기준법), Article 52(1) of the Seafarers' Act (선원법)). The purpose of requiring direct payment of wages in this manner is to ensure that wages are reliably paid to the employee personally, thereby leaving them to the employee's free disposal and guaranteeing the employee's livelihood; and unlike the principle of payment in currency or the principle of payment in full, no exception to the principle of direct payment is recognized under statutes or collective agreements. Accordingly, in principle, a juristic act by which an employee entrusts or authorizes a third party to receive wages on the employee's behalf is void.
However, a ship owner must, where a seafarer on duty so requests or where there is a special provision in statutes or a collective agreement, pay all or part of the wages in currency to a family member or other person designated by the seafarer, or pay by such methods as depositing the wages in a financial institution, etc. (Article 52(3) of the Seafarers' Act). Apart from these provisions of the Seafarers' Act, where there are substantial grounds for circumstances preventing the employee from personally receiving the wages, receipt of wages by a messenger (使者) may exceptionally be permitted. However, in light of the form and purport of Article 43 of the Labor Standards Act as described above, only a person who, under generally accepted social norms, is to be treated as identical to payment to the employee personally, or a person who is certain to deliver the wages to the employee as received, should be regarded as such a messenger when receiving the wages, and whether a person falls within this category must be strictly assessed.
[2] In a case where Party A and others, upon the introduction of Party B, entered into employment contracts with Construction Company C, and in doing so prepared and submitted to Company C a "Wage Receipt Personal Consent Form (Power of Attorney)" or "Confirmation of Proxy Receipt of Wages," etc., stating that, due to the inability to use their own personal accounts, they entrusted Party D with the proxy receipt of their wages, and Company C accordingly paid the wages of Party A and others to Party D in a lump sum: in light of the overall circumstances, including Party D's testimony to the effect that "I did not know Party A and others at all, and when the wages were paid into my account, I sent them on to Party B and others," it is difficult to regard Party D as a person who, under generally accepted social norms, is to be treated as identical to payment to Party A and others personally, or as a person who is certain to deliver the wages to Party A and others as received. The court held that, therefore, even though Company C paid the wages of Party A and others to Party D, such payment violated the principle of direct payment and was void.

[Order]

All appeals are dismissed. The costs of the appeal shall be borne by the Defendant.

[Reasoning]

The grounds of appeal are examined.

1. Wages must be paid in currency directly to the worker in full. However, where there is a special provision in statute or collective agreement, a portion of the wage may be deducted or paid in a form other than currency (Article 43, Paragraph 1 of the Labor Standards Act (근로기준법); Article 52, Paragraph 1 of the Seafarers' Act (선원법)). The purpose of requiring direct payment of wages in this manner is to ensure that wages are reliably paid to the worker personally, so that they may be freely disposed of by the worker and the worker's livelihood is guaranteed. Unlike the principle of payment in currency or the principle of payment in full, no exceptions by statute or collective agreement are recognized with respect to the principle of direct payment. Accordingly, as a general rule, a juristic act whereby a worker entrusts or authorizes a third party to receive wages on the worker's behalf is void (see Supreme Court en banc Decision 87Daka2803 rendered on December 13, 1988, holding that even where a wage claim has been assigned, the employer must pay the wages directly to the worker; Supreme Court Decision 94Da6918 rendered on May 10, 1994, holding that a person who has been entrusted by a worker with the collection of a wage claim may not demand a distribution against the employer's property subject to execution, etc.).

However, where a seafarer on duty so requests, or where there is a special provision in statute or collective agreement, the shipowner must pay all or part of the wages by currency, or by depositing the same into a financial institution, etc., to a family member or other person designated by the seafarer (Article 52, Paragraph 3 of the Seafarers' Act). In addition to such provisions of the Seafarers' Act, where there is a substantial reason preventing the worker personally from directly receiving the wages, receipt of wages by a messenger (使者) may exceptionally be permitted. However, in light of the form and purpose of Article 43 of the Labor Standards Act as described above, only a person who, in light of common social understanding, may be regarded as equivalent to payment to the worker personally, or a person who is certain to deliver the wages to the worker as received, should be deemed such a messenger, and whether a person falls under this category must be strictly determined.

2. According to the reasoning of the judgment below and the record, the following facts may be ascertained.

A. Each of the employment contracts prepared between the Plaintiffs and the Defendant states "demolition worker" as the "job type" and "Nonparty 1" as the "team leader name," and Nonparty 1 performed duties such as introducing to the site the personnel necessary for the demolition work of the instant construction project and entering into employment contracts with the Defendant.

B. The Plaintiffs each prepared and submitted to the Defendant a "Wage Receipt Personal Consent Form (Power of Attorney)" or "Wage Proxy Receipt Confirmation," etc., which documents stated that, due to the inability to use their own bank accounts, they entrusted Nonparty 2 with proxy receipt of their wages.

C. In accordance with the above documents, the Defendant paid the Plaintiffs' wages collectively to Nonparty 2. However, at the first instance trial, Nonparty 2 testified to the effect that "I do not know the Plaintiffs at all; Nonparty 1 and an employee of the Defendant sent me a power of attorney and identification documents, and when wages were paid into my account, I forwarded them to Nonparty 1 and others."

3. Examining these facts in light of the legal principles set forth above, it is difficult to regard Nonparty 2 as a person who, in light of common social understanding, may be regarded as equivalent to payment to the Plaintiffs personally, or as a person who was certain to deliver the wages to the Plaintiffs as received. Therefore, even if the Defendant paid the Plaintiffs' wages to Nonparty 2, such payment violates the principle of direct payment and is void.

Although the reasoning of the judgment below, which appears to suggest that only the exception provided under the Seafarers' Act is recognized with respect to the principle of direct payment of wages, is somewhat inappropriate, the conclusion of the judgment below recognizing the Defendant's obligation to pay wages to the Plaintiffs is justified, and there is no error in the judgment below, as alleged in the grounds of appeal, of misapprehending the legal principles concerning the principle of direct payment under Article 43 of the Labor Standards Act that affected the judgment.

4. All appeals are dismissed, and the costs of the appeal are to be borne by the losing party. This Decision is rendered in accordance with the unanimous opinion of the participating Justices as set forth in the Order.

Justice Shin Suk-hee (Presiding Justice), Justice Ro Tae-ak (Justice in Charge), Justice Seo Kyung-hwan, Justice Ma Yong-ju
