The Supreme Court of Korea ruled that under a winter shortened-work-hours system, overtime worked within the statutory standard working hours (8 hours per day, 44 hours per week) does not qualify for premium wage payment (할증임금). The Court also held that holiday work allowance (휴일근로수당) and monthly leave work allowance (월차휴가근로수당) must be calculated based on actual hours worked, and that contractual holidays must be included when calculating the number of scheduled working days used to determine eligibility for monthly leave (월차휴가), meaning a company's extra vacation days cannot substitute for the statutory monthly leave entitlement.

Key takeaways
  • CaseThe company failed to pay premium wages for overtime during a winter shortened-work period (7-hour workdays) and calculated various allowances based on a fixed 8-hour standard rather than actual hours worked.
  • OutcomeThe Court ruled that overtime within the statutory 8-hour/44-hour limit does not require premium wage payment, but all wage allowances must be calculated based on actual hours worked.
  • LessonWhen implementing a shortened work-hour system, employers must accurately calculate and pay all wage allowances based on employees' actual working hours, not a fixed assumed schedule.
Issues
  • Whether overtime work exceeding 7 hours but still within the statutory 8-hour/44-hour limit under a winter shortened-work-hours system entitles workers to premium (할증) wages
  • The proper basis for calculating holiday work allowance and monthly leave work allowance
  • How to calculate the number of scheduled working days as a precondition for monthly leave eligibility
  • The relationship between company vacation policies that exceed the statutory minimum and the statutory monthly leave entitlement
  • The statute of limitations and possibility of offsetting various wage allowances
Key reasoning

When employees work under a winter shortened schedule (e.g., 7 hours per day) but occasionally work overtime that still falls within the statutory maximum (8 hours/day, 44 hours/week), such overtime is legally permissible extra work but does not trigger premium wage obligations, since it does not exceed the statutory ceiling. However, all wage-related allowances—including holiday work pay and monthly leave work pay—must be computed based on the employee's actual hours worked, not a fixed assumption of 8 hours. The lower court erred by calculating these allowances using an 8-hour standard even when employees actually worked only 7 hours under the winter schedule. Additionally, in determining whether an employee met the required number of scheduled working days to qualify for monthly leave, contractually agreed holidays (약정휴일) must be factored into the calculation. Furthermore, a company-provided additional vacation benefit exceeding the statutory minimum cannot be used to replace or offset the statutory monthly leave requirement.

Summary of Decision (English, AI translation)

[1] On weekdays excluding Saturday, working hours are reduced by one hour to 7 hours during the winter season; regarding overtime hours during this period, if the excess portion includes hours exceeding 4 hours on Saturday or hours exceeding 7 hours on weekdays, then any portion thereof that does not exceed 8 hours per day and 44 hours per week constitutes working hours within the statutory standard working hours set forth in Article 42 of the Labor Standards Act (근로기준법); accordingly, such work is similar to so-called "overtime within the statutory limit" and does not constitute overtime work under Article 46 of the same Act for which premium wages must be paid. Therefore, unless the rules of employment or the like specifically provide for the payment of premium wages under Article 46 of the same Act even for overtime within the statutory limit, there is no need to pay premium wages for this portion of work.

[2] Even if a provision of the rules of employment intends that any work outside the working hours prescribed by the rules of employment — including work within the statutory limit — be treated entirely as overtime work and that premium wages prescribed by the rules of employment be paid therefor, this cannot be regarded as a provision requiring the payment of premium wages under Article 46 of the Labor Standards Act for overtime work under the rules of employment.

[3] In calculating overtime allowance or holiday work allowance under Article 46 of the Labor Standards Act, and monthly paid leave work allowance under Article 47 thereof, the actual hours worked must be used as the basis for calculation. Therefore, even though the working hours on weekdays excluding Saturday during the winter season were 7 hours, it was unlawful to calculate the holiday work allowance and monthly paid leave work allowance by treating the hours worked as 8 hours and multiplying the hourly ordinary wage by 8 hours.

[4] The legislative purpose of the monthly paid leave system under Article 47 of the Labor Standards Act is to provide employees who have performed the prescribed work for a long period with one day of paid leave per month, thereby offering an opportunity for rest through recovery from fatigue caused by such prescribed work, and through such mental and physical rest, to promote the improvement of cultural life. It cannot be said that this system, unlike such purpose, is designed to grant one day of paid leave to an employee only where the employee has actually continued to work throughout the month excluding paid holidays prescribed by the Labor Standards Act. Therefore, the provisions of Article 30 of the Enforcement Decree of the Labor Standards Act (근로기준법시행령), which require that statutory holidays be included in calculating the "prescribed number of working days in one month," being a requirement for the accrual of monthly paid leave, cannot be said to violate Article 47 of the Labor Standards Act or to depart from its legislative purpose.

[5] Inasmuch as the monthly paid leave system is granted to an employee who has attended without absence during the "prescribed number of working days in one month" in order to provide an opportunity for rest through recovery from fatigue caused by prolonged work, in calculating the prescribed number of working days, it should not be limited to deeming the employee to have attended work only on holidays under Article 30(2) of the Enforcement Decree of the Labor Standards Act, such as the weekly holiday; rather, the employee should also be deemed to have attended work on agreed holidays and the like where the obligation to provide labor is exempted for the employee's rest pursuant to statutes, rules of employment, collective agreements, etc. Accordingly, unless there are special circumstances such that the period during which the obligation to provide labor is exempted, including the holidays under Article 30(2) of the said Enforcement Decree, amounts to one month, monthly paid leave must be granted where the employee has worked on the remaining prescribed working days.

[6] Even if the rules of employment, etc. provide for holidays and leave exceeding the minimum number of paid holidays and paid leave days prescribed by the Labor Standards Act, such holidays or leave cannot be substituted for the monthly paid leave under Article 47 of the Labor Standards Act. Therefore, even if an employee has used all of the holidays and leave granted under the rules of employment, etc., this cannot be deemed to have been applied toward the monthly paid leave.

[7] The right to claim monthly paid leave work allowance arises as compensation for work performed by an employee who has acquired the right to monthly paid leave under Article 47 of the Labor Standards Act but has worked without using such monthly leave within one year from the time the right to leave accrued; its nature is that of wages, and therefore the three-year extinctive prescription period under Article 41 of the Labor Standards Act applies thereto, with the starting point being the day following the date on which the failure to use the leave is confirmed upon the lapse of one year from the date of acquisition of the right to monthly paid leave.

[8] The conversion of annual leave into monetary compensation while the right to annual leave remains validly in existence is not permitted under the Labor Standards Act, except with respect to the portion exceeding 20 days of annual leave.

[9] In a case where the purpose or nature and the requirements for payment of a diligence allowance (정근수당) under the rules of employment are entirely different from those of the annual/monthly paid leave work allowance under the Labor Standards Act, the court held that where an employee acquired the right to annual/monthly leave under the Labor Standards Act but continued to work without using it within the statutory period, the employer must pay the annual/monthly paid leave work allowance under the Labor Standards Act regardless of whether the diligence allowance under the rules of employment was paid.

[10] In general, wages must be paid directly and in full to the employee, and therefore, as a rule, an employer may not set off a claim it holds against an employee against wages owed to the employee. However, where wages have been overpaid due to a computational error or the like, and the timing of the exercise of the right to recover the overpayment is reasonably close in time to the period of overpayment so as not to lose the substantive character of wage settlement and adjustment, and the amount and method are already predetermined such that there is no risk of harming the employee's economic life stability, or where an employee, after retirement, claims wages or retirement allowance that remained unpaid during his or her employment, the employer may set off the claim for return of the overpaid wages as an automatic claim. Accordingly, in light of the foregoing legal principle, where an employee claims unpaid statutory allowances for a certain period, it is also permissible for the employer to assert set-off or appropriation on the ground that there was an overpayment of statutory allowances during the same period. Furthermore, if the provisions of the rules of employment, etc. concerning the method of calculating statutory allowances are invalid for falling short of the minimum wage payment conditions prescribed by the Labor Standards Act, then even where the amount calculated and paid according to the calculation method under such rules of employment, etc. exceeds the properly calculated statutory allowance, the excess portion is deemed to have been paid in error, and the fact that it was paid in accordance with the rules of employment, etc. does not render such payment legitimate.

[Plaintiff, Appellee]

[Defendant, Appellant] Hapcheon-gun Medical Insurance Cooperative, Attorney-in-fact Dongyang General Law Firm, in charge of attorneys Kim Seong-gi and 4 others

[Original Judgment] Changwon District Court, Judgment of February 17, 1994, Case No. 93na6823

[Order]

The part of the original judgment against the Defendant is reversed, and this part of the case is remanded to the Changwon District Court Panel Division.

[Reasoning]

The grounds of appeal are examined.

Regarding Grounds 6 and 7
The court below found, upon fact-finding, that the Plaintiffs worked overtime of 15 to 40 hours during the relevant months from May 1989 to December 1992, as stated in the table calculating each Plaintiff's allowances attached to the first instance judgment, and cited the first instance judgment which calculated the Plaintiffs' and the designated parties' (hereinafter "Plaintiffs, etc.") overtime work allowance by applying the premium rate prescribed in Article 46 of the Labor Standards Act (근로기준법) thereto.

Meanwhile, the first instance judgment cited by the court below also found the fact that, according to the Defendant Cooperative's Regional Medical Insurance Cooperative Operation Regulations (hereinafter "Operation Regulations"), employees' working hours are to conform to those of public officials. Accordingly, it must be found that the court below also acknowledged the fact that, in the case of the Defendant Cooperative, the working hours on weekdays excluding Saturdays are shortened by one hour to 7 hours during the winter season, from November to February of the following year.

Therefore, if the overtime hours of the Plaintiffs, etc. during the winter season as found by the court below include the aforementioned shortened one hour, then even if such overtime includes hours exceeding 4 hours on Saturdays or hours exceeding 7 hours on weekdays, the portion of such overtime hours, when combined with the shortened one hour, that does not exceed 8 hours per day and 44 hours per week falls within the statutory standard working hours prescribed in Article 42 of the same Act. Accordingly, this portion of work is akin to so-called "overtime within statutory limits" and does not fall under the "overtime work" prescribed in Article 46 of the same Act, for which the premium wage is paid. Therefore, unless it is found that the Operation Regulations provide for payment of the premium wage prescribed in Article 46 even for overtime within statutory limits, there is no need to pay the premium wage prescribed in Article 46 for this portion of work (see this Court's Decision 90daka14758, delivered June 28, 1991). Furthermore, according to Article 105 and Attached Table 15 of the Defendant Cooperative's Operation Regulations, overtime work allowance is to be paid to employees who worked pursuant to an overtime work order, with the premium rate prescribed as 150% of the amount equivalent to 1/184 of the base salary (see Exhibit B No. 1). However, even if the Operation Regulations, in treating work beyond the working hours prescribed under the Operation Regulations as overtime work (even where this includes overtime within statutory limits), intended to pay the premium wage prescribed under the Operation Regulations for such work, it cannot be deemed, on that basis, that the Operation Regulations provide for payment of the premium wage prescribed in Article 46 of the Labor Standards Act for overtime work under the Operation Regulations.

Ultimately, while the court below found that, in the case of the Defendant Cooperative, the weekday working hours excluding Saturdays during the winter season are 7 hours, it nevertheless recognized the entirety of the overtime work claimed by the Plaintiffs, etc. during the winter season as overtime work under Article 46 of the Labor Standards Act, without examining whether the aforementioned shortened one hour was included in the hours claimed as overtime work by the Plaintiffs, etc., and accordingly calculated the Plaintiffs' etc. overtime work allowance by applying the premium rate prescribed in the same Article. This constitutes an error of failing to exhaust the necessary examination due to a misunderstanding of the legal principles concerning overtime work and its allowance. Therefore, the argument pointing out this error is well-founded.

In addition, even though the Defendant did not argue, up to the court below, that the Plaintiffs' etc. extended work on Saturdays constituted overtime within statutory limits, since the Plaintiffs, etc. submitted a statement of leave usage for the period during which they claim this allowance (see Exhibit B No. 2), the court below should have ascertained whether the Plaintiffs, etc. actually used holidays or leave other than the weekly rest day during the period for which they claim to have worked overtime, and determined whether the claimed overtime hours fall within the range of 8 hours per day and 44 hours per week, and should have ordered payment of the premium wage prescribed in Article 46 of the Labor Standards Act only for the hours exceeding this range. Nevertheless, the court below readily concluded that the entirety of the overtime work claimed by the Plaintiffs, etc. constituted overtime work under the Labor Standards Act and ordered payment of the premium wage prescribed in the same Article. Further examination is also necessary on this point.

Regarding Ground 8
In calculating the overtime work allowance or holiday work allowance under Article 46 of the Labor Standards Act, or the monthly paid leave work allowance arising from work performed by an employee who has acquired the right to monthly paid leave under Article 47 of the same Act but has not used such monthly leave within one year thereof, the actual hours worked must be used as the basis. However, while the court below found that, in the case of the Defendant Cooperative, the weekday working hours excluding Saturdays during the winter season are 7 hours as stated above, in calculating the holiday work allowance and monthly leave work allowance for the Plaintiffs, etc., it nevertheless treated the Plaintiffs, etc. as having worked 8 hours even during the winter season, and calculated said allowances by multiplying the hourly ordinary wage as determined in its judgment by 8 hours. If this is so, the court below misunderstood the legal principles concerning the calculation of holiday work allowance and monthly leave work allowance, thereby committing an illegality that affected the judgment. Therefore, the argument pointing out this error is also well-founded.

Regarding Grounds 2 and 3
The legislative purpose of the monthly leave system prescribed in Article 47 of the Labor Standards Act is to provide an opportunity for rest through recovery from fatigue resulting from prescribed work, by granting one day of paid leave per month to employees who have performed the prescribed work over an extended period, and thereby to promote the enhancement of cultural life through such mental and physical rest (see this Court's Decisions 90daka13465, delivered December 26, 1990, and 90daka11636, delivered July 26, 1991, among others). It cannot be said, as the argument contends, that this system grants one day of paid leave to an employee only where the employee has continuously performed actual work for one month, excluding paid holidays prescribed under the Labor Standards Act. Therefore, it cannot be said that the provisions of Article 30 of the Enforcement Decree of the same Act violate the provisions of Article 47 of the same Act or depart from its legislative purpose.

Furthermore, insofar as the monthly leave system is granted to those who have worked without absence for the prescribed number of working days in a month in order to provide an opportunity for rest through recovery from fatigue resulting from such extended work, in calculating the prescribed number of working days, it is not the case, as the argument contends, that only holidays prescribed under Article 30(2) of the Enforcement Decree of the same Act, such as the weekly rest day, should be regarded as days on which the employee attended work. Rather, even in the case of agreed holidays or the like, where an employee's obligation to provide labor is exempted for the purpose of rest pursuant to laws, rules of employment, collective agreements, etc., such days should also be regarded as days on which the employee attended work. Accordingly, unless there are special circumstances such that the period during which the obligation to provide labor is thereby exempted, including the holidays prescribed under Article 30(2) of the Enforcement Decree, amounts to one month, monthly leave must be granted where the employee has worked on the remaining prescribed working days.

Moreover, while it may be acknowledged that Articles 46 through 55 of the Defendant Cooperative's Operation Regulations provide for holidays and leave exceeding the minimum number of days for paid holidays and paid leave prescribed under the Labor Standards Act, holidays or leave under the Operation Regulations cannot be substituted for the monthly paid leave prescribed in Article 47 of the Labor Standards Act. Therefore, even if, as the argument contends, the Plaintiffs, etc. used all of the holidays and leave under the Operation Regulations, this cannot be deemed to have been applied toward the monthly leave.

Therefore, the argument based on a different view is without merit in all respects.

Regarding Ground 4
Since the nature of the right to claim payment of the monthly leave work allowance, which arises when an employee who has acquired the right to monthly paid leave under Article 47 of the Labor Standards Act does not use such monthly leave within one year from the time such right arose and instead works, is that of wages (see this Court's Decision 90daka24496, delivered December 21, 1990, and the aforementioned Decisions of this Court, among others), the three-year extinctive prescription period under Article 41 of the same Act applies, and the starting point of such period is the day following the date on which the failure to use the leave is confirmed by the lapse of one year from the date of acquisition of the right to monthly paid leave.

Therefore, it cannot be said that the right to claim payment of the monthly leave work allowance claimed by the Plaintiffs, etc. is extinguished simultaneously with the extinction of the right to claim monthly leave.

Furthermore, it is clear from the record that the monthly leave allowance claimed by the Plaintiffs, etc. is merely claimed as compensation for having provided labor without using the monthly leave, and is not based on the sale or conversion into cash of the monthly leave.

The argument based on a different view or premised thereon is without merit in all respects.

However, it is clear from the assertions of the Plaintiffs, etc. that the unused annual leave work allowance for the year 1992 claimed by the Plaintiffs, etc. arises from the failure to use, within that year (1992), the annual leave right acquired by satisfying the requirements for annual leave in 1992 (see the preparatory brief dated June 18, 1993, record p. 931). Accordingly, such annual leave work allowance must be regarded as arising from the conversion into cash of annual leave during the period in which the right to annual leave validly subsists, and such conversion into cash of annual leave during the period in which the right to annual leave validly subsists is not permissible in violation of the Labor Standards Act, except with respect to the portion exceeding 20 days of annual leave.

Nevertheless, the court below erred in citing the first instance judgment, which ordered payment of the annual leave work allowance corresponding to the unused days of annual leave, on the ground that the annual leave for 1992 accrued from the Plaintiffs' etc. prescribed work was to be used by the Defendant and the Plaintiffs, etc. only within that year, and that, at the end of that year, the Plaintiffs, etc. were deemed to have expressed an intention not to use the unused days of annual leave.

However, since it cannot be ruled out that the Plaintiffs, etc., after acquiring the right to annual leave accrued from their prescribed work in 1992, worked without using the number of days of annual leave they claim for one year thereafter, the court below should also have examined whether the Plaintiffs, etc., by actually working without using the annual leave accrued from their prescribed work in 1992 for one year thereafter, consequently acquired the annual leave work allowance corresponding to the number of unused days of annual leave as claimed.

The argument disputing this point is well-founded.

Regarding Ground 5
The diligence allowance prescribed under the Defendant Cooperative's Operation Regulations is paid to all persons who satisfy the payment requirements under Article 106(1) of the Operation Regulations, regardless of whether the employee used annual or monthly leave. Furthermore, in light of the fact that paragraph (2) of the same Article provides for a reduced payment of the diligence allowance, in the manner prescribed therein, for those who received a disciplinary action of pay reduction or higher, or those who received a suspension from office, the diligence allowance under the Operation Regulations differs entirely, in its payment purpose, nature, and payment requirements, from the annual/monthly leave work allowance under the Labor Standards Act. Accordingly, if an employee acquired the right to annual or monthly leave under the Labor Standards Act but continued to work without using it within the statutory period, the Defendant Cooperative must pay the annual/monthly leave work allowance under the Labor Standards Act regardless of whether the employee received the diligence allowance under the Operation Regulations.

If this is so, the court below's action in citing the first instance judgment, which determined that, even though Article 106(3) of the Operation Regulations is ineffective, the Defendant must pay the annual/monthly leave work allowance under the Labor Standards Act based on the ordinary wage, is justified.

The argument disputing this point is without merit.

Regarding Ground 1
Generally, wages must be paid directly to the employee in full; therefore, in principle, an employer may not set off a claim it holds against an employee against wages owed. However, where wages have been overpaid due to a calculation error or the like, and the timing of the exercise of the right of set-off is reasonably close to the time of the overpayment such that the character of settlement or adjustment of wages is not lost, and the amount and method are already predetermined such that there is no risk of harming the employee's economic stability of living, or where an employee, after retirement, claims wages or retirement allowance unpaid during their employment, set-off may be effected using the claim for return of the overpaid wages as the automatic claim (see this Court's Decisions 93da28737, delivered October 12, 1993, and 93da38529, delivered December 28, 1993, among others).

Therefore, in light of the above legal principles, where an employee claims unpaid statutory allowances for a certain period, it is permissible for the employer to assert set-off or appropriation on the ground that there was an overpayment of statutory allowances during the same period. Moreover, if the provisions of the rules of employment or the like concerning the method of calculating statutory allowances are invalid for falling below the minimum standards concerning wage payment conditions prescribed under the Labor Standards Act, then even where the amount calculated and paid according to the calculation method under such rules of employment exceeds the properly calculated statutory allowance, the excess portion must be deemed to have been erroneously paid, and the fact that it was paid pursuant to the rules of employment does not render such payment proper.

Nevertheless, the court below rejected the set-off or appropriation based on the overpaid amount, on the ground that, where the overtime work allowance and holiday work allowance already paid by the Defendant to the Plaintiffs, etc. exceed the properly calculated amounts, since such payment was made pursuant to the Defendant Cooperative's Operation Regulations, the claim for return of the overpaid amount, or the appropriation thereof toward unpaid allowances, cannot be recognized. Accordingly, the court below misunderstood the legal principles concerning set-off and appropriation of overpaid wages.

The argument disputing this point is well-founded.

Regarding Ground 9
This argument merely criticizes facts not found by the court below, and thus cannot constitute a legitimate ground of appeal; it is therefore not accepted.

Therefore, having accepted part of the grounds of appeal, the part of the original judgment against the Defendant is reversed, and this part of the case is remanded to the court below for further examination and determination. The opinions of the Justices involved being unanimous, the judgment is rendered as stated in the Order.
