This case addressed whether income earned by transport company drivers in excess of their daily quota (사납금, 'sanabgeum') should be included in the average wage (평균임금) used to calculate severance pay (퇴직금). The Supreme Court held that if the company collected and managed the excess income, it must be included in the average wage calculation; however, if drivers kept the excess amount as personal income without the company managing it, the company had no control over it, and thus it should be excluded. The case was remanded because the lower court had made an incorrect finding of fact regarding how the excess income was actually handled.

Key takeaways
  • CaseTransport company drivers demanded that income exceeding their daily quota (사납금) be included in the average wage (평균임금) calculation for their severance pay (퇴직금).
  • OutcomeThe court ruled that only quota-excess income actually collected and managed by the company should be included in the average wage; income drivers kept personally without company oversight is excluded.
  • LessonEmployers should clearly establish and document their wage payment and management systems, since personal income not directly managed by the company may be excluded from severance pay calculations.
Issues
  • Whether income exceeding the daily quota (사납금) qualifies as wages under labor law
  • Whether such excess income should be included in the average wage (평균임금) for severance pay (퇴직금) calculation
  • What standard determines the employer's 'manageability' or 'control' over such income for wage calculation purposes
Key reasoning

The excess income beyond the daily quota (사납금) constitutes wages, as it is compensation for labor performed by the drivers. However, not all wage-like income is automatically included in the average wage (평균임금) used for severance pay calculation—only the portion that the employer can manage or control qualifies. Therefore, if the company received and managed the drivers' total transport revenue (including amounts exceeding the quota), that revenue must be factored into the average wage. Conversely, if drivers directly retained the excess amount as personal income without company oversight or control, this portion falls outside the company's manageability and is excluded from average wage calculations. The lower court failed to properly examine which scenario applied to the facts of this case.

Summary of Decision (English, AI translation)

[1] If a transportation company, in addition to paying its drivers a fixed amount according to the actual number of working days each month, has allowed the balance remaining after deducting a fixed quota amount (sanibgeum) to be paid into the company from the daily transportation revenue to be treated as the individual driver's income and left to his free disposal, in consideration of the particular nature of this type of work and the convenience of calculation, then the portion becoming the individual driver's income in this manner also constitutes wages as remuneration for labor, given its character; therefore, absent special circumstances, income exceeding the quota amount (sanibgeum) is included in the average wage that forms the basis for calculating retirement allowances.

[2] Even where wages are paid within the period for calculating average wages, in deriving the average wage that forms the basis for calculating retirement allowances, in order to ensure predictability for the employer in providing for retirement allowances, any portion that is not manageable or controllable by the employer must be excluded from that scope; accordingly, where employees have directly attributed to themselves, as personal income, the income exceeding the quota amount, since whether such personal income arises at all and the amount thereof are likewise not fixed, the transportation company cannot know how much the employees' personal income portion amounts to, and has no possibility of managing or controlling it; therefore, the employees' personal income portion is not included in the average wage that forms the basis for calculating retirement allowances.

[3] Where employees of a transportation company pay the entire total transportation revenue to the transportation company, unlike the case where employees directly attribute to themselves, as personal income, the income exceeding the quota amount, the transportation company can clearly ascertain and specify whether income exceeding the quota amount has arisen and the amount thereof, and thus it must be held that the transportation company can manage and control the income exceeding the quota amount; this conclusion is not to be altered merely because the transportation company subsequently paid the employees an amount equivalent to the income exceeding the quota amount that it had received from them; therefore, the income exceeding the quota amount that the transportation company received from its employees must be held to be included in the average wage that forms the basis for calculating retirement allowances.

[Plaintiffs, Appellants] Plaintiff 1 and 9 others (Attorney of record: Kim Nam-jun, Attorney at Law, Citizens' Comprehensive Law Firm)
[Defendant, Appellee] Geumgang Transportation Co., Ltd.
[Judgment Below] Suwon District Court Judgment of November 30, 2001, Case No. 2001Na1499

[Order]

The part of the judgment below concerning Plaintiff 3, Plaintiff 4, and Plaintiff 10, and the parts of the judgment against Plaintiff 2, Plaintiff 5, Plaintiff 6, Plaintiff 7, and Plaintiff 8 (in which they lost) are all reversed, and this part of the case is remanded to the Panel Division of the Suwon District Court. The respective appeals of Plaintiff 1 and Plaintiff 9 are dismissed. Of the costs of appeal, the portion arising between Plaintiff 1, Plaintiff 9, and the Defendant shall be borne by the said Plaintiffs.

[Reasoning]

1. Determination on the grounds of appeal of the remaining plaintiffs excluding Plaintiff 1 and Plaintiff 9 (hereinafter referred to as "the remaining plaintiffs")

A. According to the reasoning of the judgment below, the court below found as follows: Article 22(1) and Article 28(2), etc. of the Passenger Transport Service Act (여객자동차운수사업법), which was wholly amended by Act No. 5448 on December 13, 1997, provide that "a passenger transport service operator shall receive the full amount of transport revenue from transport workers," and "transport workers shall pay the full amount of transport revenue to the passenger transport service operator." As the government's policy established the "Full Management System for Taxi Transport Revenue" (택시운송수입금 전액관리제), which abolished the quota (sanhap-geum) system in relation to the taxi transport business and required the full amount of transport revenue to be paid to the taxi company, it became necessary for the Defendant company and the labor union of the Defendant company to reach an agreement between labor and management on a new wage system. Accordingly, although the Defendant company attempted to implement the Full Management System for Taxi Transport Revenue from February 1998, since the relevant statutes did not contain detailed provisions regarding the complete monthly salary system and the issue of returning revenue exceeding the quota under the said system, and no agreement had been reached between labor and management, the Defendant company failed to receive from the remaining plaintiffs the revenue exceeding the quota. Then, on July 16, 1998, the Defendant company and the said labor union concluded a collective agreement providing that the amount exceeding the quota would be paid in full to the drivers on the monthly payday, but would not be included in the average wage for the purpose of calculating retirement allowances, while raising the quota for union members from the previous 87,500 won per day to 94,730 won, an increase of 7,230 won, and implemented this from July 20, 1998. From July 20, 1998, when the new collective agreement took effect, the Defendant company received revenue exceeding the quota from its employees. It was further found that Plaintiff 2, Plaintiff 3, Plaintiff 4, and Plaintiff 5 had retired before July 20, 1998, the date the new collective agreement took effect. Based on these findings, the court below determined that since Plaintiff 2, Plaintiff 3, Plaintiff 4, and Plaintiff 5 had never paid the revenue exceeding the quota to the Defendant company, the Defendant company had no possibility of managing or controlling such revenue exceeding the quota with respect to these plaintiffs; and that even under the new collective agreement effective from July 20, 1998, although employees were required to pay the revenue exceeding the quota to the Defendant company, the Defendant company merely kept such money in custody and paid it to the employees in a lump sum on a monthly basis, and it was agreed that such amounts would not be included in the average wage for the purpose of calculating retirement allowances; therefore, even after the conclusion of the said collective agreement, the Defendant company did not substantially manage or control, but merely kept in custody, the revenue exceeding the quota received from Plaintiff 6, Plaintiff 7, Plaintiff 8, and Plaintiff 10 from July 20 of that year, when the collective agreement took effect, until the respective retirement of these plaintiffs, and thus such revenue could not be included in the average wage, which is the basis for calculating retirement allowances. On this basis, the court below rejected the remaining plaintiffs' argument that the revenue exceeding the quota should be included in the average wage.

B. However, the above factual findings and determination of the court below are difficult to accept for the following reasons.

First, according to the record (in particular, the entry in Exhibit A No. 27, and the respective testimonies of witnesses Nonparty 1 and Nonparty 2), it can be sufficiently recognized that, in attempting to implement the Full Management System for Taxi Transport Revenue from February 1998, the Defendant company received the revenue exceeding the quota from its employees, including Plaintiff 2, Plaintiff 3, Plaintiff 4, and Plaintiff 5, during the period from February 1 to February 24, 1998 (the Defendant company itself admitted this in its briefs dated August 21, 2000 and December 4, 2000). Nevertheless, the court below determined that, because these plaintiffs had never paid the revenue exceeding the quota to the Defendant company, the Defendant company had no possibility of managing or controlling such revenue with respect to these plaintiffs, and thus it could not be included in the average wage, which is the basis for calculating retirement allowances, thereby rejecting these plaintiffs' argument that the revenue exceeding the quota should be included in the average wage. This constitutes an illegality that violated the rules of evidence and led to an erroneous finding of fact, which affected the outcome of the judgment. Therefore, the argument in the grounds of appeal pointing this out is well-founded.

Next, where a transport company, in addition to paying its drivers a fixed amount according to the actual number of working days each month, has, in consideration of the peculiar nature of the work form and convenience of calculation, allowed the balance remaining after deducting a fixed quota amount to be paid to the company from the daily transport revenue to be treated as the individual driver's own income and freely disposed of by the driver, then the portion constituting such individual income of the driver also falls under wages, being remuneration for labor, in light of its nature (see Supreme Court Decision 87Daka570, delivered March 22, 1988; Supreme Court Decision 91Da36192, delivered December 24, 1993, etc.). Therefore, absent special circumstances, revenue exceeding the quota shall be included in the average wage, which forms the basis for calculating retirement allowances.

However, even wages paid within the period for calculating average wages must, in calculating the average wage that forms the basis for retirement allowances, be excluded to the extent that they are not subject to the employer's ability to manage or control, in order to ensure predictability for the employer in providing for retirement allowances. Accordingly, in cases where employees directly appropriate to themselves, as personal income, the revenue exceeding the quota, since the occurrence and amount of such personal income portion are not fixed, the transport company cannot know the amount of the employees' personal income portion and has no possibility of managing or controlling it; therefore, such personal income portion of employees is not included in the average wage that forms the basis for retirement allowances (see Supreme Court Decision 95Da55733, delivered March 13, 1998; Supreme Court Decision 98Da18568, delivered April 23, 1999, etc.). However, in a case such as the present one, where employees pay the entire total transport revenue to the Defendant company, unlike the case where employees directly appropriate the revenue exceeding the quota to themselves, the Defendant company can clearly ascertain and specify whether revenue exceeding the quota has arisen and the amount thereof, and thus it must be viewed as having the ability to manage and control the revenue exceeding the quota. This conclusion is not altered by the fact that the Defendant company later paid to the employees an amount equivalent to the revenue exceeding the quota that it had received from them. Therefore, the revenue exceeding the quota that the Defendant company received from the remaining plaintiffs must be regarded as included in the average wage that forms the basis for calculating retirement allowances.

Nevertheless, the court below determined that the revenue exceeding the quota could not be included in the average wage, which is the basis for retirement allowances, and thereby rejected the above plaintiffs' argument. This constitutes an illegality that misapprehended the legal principles concerning retirement allowances and affected the outcome of the judgment. Therefore, the argument in the grounds of appeal pointing this out is well-founded.

2. Determination on the claims of Plaintiff 1 and Plaintiff 9

The appellate brief and the petition of appeal submitted by the said plaintiffs contain no statement of grounds of appeal whatsoever.

3. Therefore, the part of the judgment below concerning Plaintiff 3, Plaintiff 4, and Plaintiff 10, and the parts against Plaintiff 2, Plaintiff 5, Plaintiff 6, Plaintiff 7, and Plaintiff 8 (in which they lost) are all reversed, and this part of the case is remanded to the court below for further hearing and determination. The respective appeals of Plaintiff 1 and Plaintiff 9 are dismissed, and of the costs of appeal, the portion arising between Plaintiff 1, Plaintiff 9, and the Defendant shall be borne by the losing parties. This judgment is rendered as set forth in the Order by the unanimous opinion of the participating Justices.
