A taxi driver deliberately deposited an unusually large amount of fare revenue just before retiring, attempting to inflate his average wage (평균임금), which is the basis for calculating severance pay (퇴직금). The Supreme Court (대법원) held that this manipulation contradicted the purpose of the severance pay system and ruled that the average wage should instead be calculated based on the three months of wages prior to the manipulative act. The worker's appeal was dismissed.

Key takeaways
  • CaseIncident: A taxi driver deliberately deposited excessive fare revenue just before retiring in an attempt to inflate the average wage (평균임금) used to calculate his severance pay (퇴직금).
  • OutcomeResult: The Supreme Court (대법원) ruled that such deliberate manipulation violated the principle of good faith (신의칙), and that average wage should be calculated based on the three months of wages prior to the manipulation.
  • LessonLesson: Since severance pay is meant to reflect a worker's ordinary living wage, artificially inflating wages immediately before retirement will not be legally recognized.
Issues
  • The validity of deliberately manipulating average wage calculations shortly before retirement
  • How to interpret situations where the average wage cannot be fairly determined using the standard method
  • The fundamental purpose of the severance pay system and application of the good faith principle (신의칙)
Key reasoning

The severance pay system exists to guarantee a worker's ordinary standard of living after leaving employment. When a worker deliberately acts to artificially inflate the average wage used to calculate severance pay, this significantly undermines the purpose of the system and cannot be permitted under the principle of good faith (신의칙). In such cases, the average wage must instead be calculated using the wages from the three-month period immediately preceding the manipulative conduct, excluding the period of manipulation itself. This ensures that severance pay reflects the worker's genuine, ordinary living wage rather than an artificially inflated figure.

Summary of Decision (English, AI translation)

[1] The phrase "where average wages cannot be determined" under Article 5 of the Enforcement Decree of the Labor Standards Act (근로기준법시행령) should not be limited literally to cases where such calculation is technically impossible, but should be construed to include cases where calculating the average wages pursuant to the relevant provisions of the Labor Standards Act (근로기준법) would be markedly inappropriate.

[2] Since the retirement allowance system is intended to guarantee the ordinary standard of living of an employee in the same manner as before, if "the wages paid to the employee during the three months prior to the date on which the cause for payment of the retirement allowance arose," which serves as the basis for calculating the amount to be paid when a cause for payment of the retirement allowance arises, is markedly less or more than the ordinary case due to special circumstances, and such amount is used as the basis for calculating the average wages without modification, this cannot but be said to run contrary to the fundamental purpose of the system, which is to guarantee the employee's ordinary standard of living as before.

[3] Since average wages serve as the standard for calculating various benefits payable to an employee, including retirement allowances, and the purpose of the provisions concerning retirement allowances is, in any event, to guarantee the employee's livelihood, the average wages used as the standard for such calculation should, in principle, be based on the fundamental principle of calculating the employee's ordinary living wage as it actually is. This may be said to be the amount equivalent to the average wages that could have been calculated had the employee not intentionally engaged in conduct to markedly increase the average wages. Where the average wages cannot be calculated pursuant to the relevant provisions of the Labor Standards Act due to the employee's intentional conduct, in light of the purport of the provisions of the Labor Standards Act, which provide that, on the view that the period immediately preceding retirement best reflects the employee's ordinary living wage, the average wages shall be calculated based on the wages of the period immediately preceding retirement, the average wages forming the basis of that employee's retirement allowance shall, absent special circumstances, be the amount calculated in accordance with the method prescribed by the Labor Standards Act, based on the wages of the three months immediately preceding retirement, excluding the period that should be excluded from the standard for calculating the above average wages.

[Plaintiff, Appellant] Plaintiff, Counsel: Attorney Lee Won-jae of Seowon Joint Law Office
[Defendant, Appellee] Hanyang Traffic Co., Ltd.
[Judgment Below] Seoul Civil District Court, Judgment rendered December 30, 1993, Case No. 93Na25973

[Order]

The appeal is dismissed.
The costs of the appeal shall be borne by the Plaintiff.

[Reasoning]

The grounds of appeal are examined.

1. According to the reasoning of the judgment below, the court below found, based on the evidence cited therein, the following facts: that the wages paid to the Defendant company's taxi drivers consisted of ordinary wages (such as basic pay, work allowance, and length-of-service allowance, which are paid in fixed monthly amounts according to each driver's working hours and length of service), other allowances such as night work allowance, and performance pay, the amount of which is determined according to the amount of transportation revenue deposited by the taxi drivers; and that the Plaintiff, having applied for and obtained a license for individual taxi transportation business, anticipating that he would retire around the end of August 1992, deliberately deposited with the Defendant company, during the three months prior to his retirement, transportation revenue amounts far exceeding his usual amounts in order to raise the average wage that would serve as the basis for calculating his retirement allowance, with the result that his monthly wages for the three months prior to retirement, from June to August 1992, increased by approximately 73% compared to the average monthly wage for the preceding five months (and, if performance pay alone is compared, increased approximately fourfold). Examining the record, the above factual findings of the court below can be sufficiently upheld, and no error can be found therein.

2. Under the Labor Standards Act (근로기준법), "average wage" means the amount obtained by dividing the total amount of wages paid to the worker during the three months prior to the date on which the event requiring calculation occurred by the total number of days in that period; provided, however, that if the amount so calculated is less than the ordinary wage, the ordinary wage shall be deemed the average wage (Article 19, Paragraphs 1 and 2). Articles 2 through 4 of the Enforcement Decree of the Labor Standards Act (근로기준법시행령) further provide special provisions concerning average wage, and Article 5 thereof provides that in cases where the average wage cannot be determined pursuant to the Labor Standards Act and its Enforcement Decree, it shall be determined as prescribed by the Minister of Labor. The phrase "cannot be determined" in Article 5 of the Enforcement Decree should not be limited, in its literal sense, to cases where such calculation is technically impossible, but should be construed to also include cases where calculating the average wage pursuant to the relevant provisions would be markedly inappropriate.

Now, since the retirement allowance system is designed to guarantee that a worker's ordinary standard of living continues as before, if "the wages paid to the worker during the three months prior to the date on which the event giving rise to the retirement allowance occurred," which serves as the basis for calculating the amount to be paid when the cause for retirement allowance arises, is markedly less or markedly more than the ordinary case due to special circumstances, and such wages are nevertheless used as-is as the basis for calculating the average wage, this cannot but be said to contravene the fundamental purpose of the system, which is to guarantee the worker's ordinary standard of living as before (see this Court's Decision 90Daka4683, rendered November 9, 1990).

Accordingly, to treat the Plaintiff's deliberate conduct, as found by the court below, as valid, and to calculate the average wage based on the wages paid to the worker during the three months prior to the date on which the intended cause for retirement occurred, would be markedly contrary to the fundamental purpose of the retirement allowance system and thus is not permissible under the principle of good faith. Accordingly, this case falls under a case where calculating the average wage pursuant to the relevant provisions of the Labor Standards Act would be markedly inappropriate.

Therefore, as to how the average wage should be calculated in such a case, since the Minister of Labor has not yet prescribed any standard or method pursuant to Article 5 of the Enforcement Decree of the Labor Standards Act, the average wage cannot be calculated as prescribed by the Minister of Labor either. However, considering that the average wage serves as the standard for calculating various benefits payable to a worker, including retirement allowance, and that the purpose of the provisions concerning retirement allowance is, after all, to guarantee the worker's livelihood, the average wage, as the standard for such calculation, should in principle be based on the fundamental principle of calculating the worker's ordinary living wage in accordance with the actual facts (see this Court's Decision 90Nu2772, rendered April 26, 1991). This may be said to be the amount equivalent to the average wage that could have been calculated had the worker not deliberately engaged in conduct to markedly increase the average wage. In a case such as the present one, where the average wage cannot be calculated pursuant to the relevant provisions of the Labor Standards Act due to the Plaintiff's deliberate conduct, in light of the purport of the provisions of the Labor Standards Act, which provide that the average wage is to be calculated based on the wages of the period immediately preceding retirement on the ground that such period best reflects the worker's ordinary living wage, the average wage forming the basis of the Plaintiff's retirement allowance should, absent special circumstances, be the amount calculated in accordance with the method prescribed by the Labor Standards Act, based on the wages of the three-month period immediately preceding the period that should be excluded from the basis for calculating the average wage as described above.

Therefore, the court below's determination that the average wage forming the basis for calculating the Plaintiff's retirement allowance in this case should be calculated based on the three-month period from March to May 1992, as set forth above, is justified, and it cannot be said that there is an error in the judgment below resulting from a misunderstanding of the legal principles concerning the calculation of retirement allowance and average wage that affected the outcome of the judgment. The argument is without merit.

3. Accordingly, the appeal is dismissed, and the costs of the appeal are to be borne by the losing party. This judgment is rendered as set forth in the Order, by the unanimous opinion of the participating Justices.
