A worker who resigned in the middle of a month received full monthly pay for that month under the company's employment rules (취업규칙). The Supreme Court ruled that including this full monthly payment in the calculation of average wage (평균임금) for severance pay purposes was improper, since it was merely a policy accommodation rather than a reflection of the worker's ordinary living wage. The Court reversed the lower court's decision and remanded the case, overturning its prior precedent on this issue.

Key takeaways
Issues
  • Whether full monthly pay received upon mid-month resignation should be included in the average wage (평균임금) calculation basis
  • The fundamental principle of average wage calculation and the purpose of the severance pay (퇴직금) system
  • Proper interpretation of employment rule (취업규칙) provisions granting full monthly pay upon mid-month resignation
Key reasoning

The fundamental principle of average wage (평균임금) calculation is to reflect a worker's ordinary living wage. Therefore, amounts that are unusually high or low due to special circumstances should not be used as the basis for this calculation. The rule providing full monthly pay upon mid-month resignation is merely a policy accommodation by the employer, not a true reflection of the worker's regular earnings. If such full payment were included in the average wage calculation, the amount of severance pay would vary unreasonably depending on the exact date of resignation within the month. Therefore, this full monthly payment must be excluded when calculating the average wage basis for severance pay.

Summary of Decision (English, AI translation)

[1] In order for money and valuables paid to a worker to be included in the total amount of wages that serves as the basis for calculating average wages, regardless of the name thereof, and even if the payment of such money and valuables is made pursuant to a collective agreement, rules of employment, employment contract, etc., or the employer's policy, the occurrence of the obligation to pay must be such that it can be seen as directly related to, or closely related to, the provision of labor, that is, it must be recognized as having been paid as consideration for labor.

[2] Average wage has as its basic principle the accurate calculation of a worker's ordinary living wage as it actually is, and where "the total amount of wages paid to the worker during the three months prior to the date on which the cause therefor arose," which is included in the calculation of average wage, is remarkably less or more than in the ordinary case due to a special cause, it cannot be used as it is as the basis for calculating average wage. Since the retirement allowance system, which takes such average wage as the basis for its calculation, is intended to guarantee, as before, the worker's ordinary living standard according to job grade, pay step, etc., it would be contrary to the fundamental purpose of the system for retirement benefits to become remarkably more or less than in the ordinary case due to special and incidental circumstances.

[3] A provision in the rules of employment stating that even if an employee retires in the middle of a month, the full amount of remuneration for that month shall be paid, must be construed as a provision containing a policy-based and beneficent consideration in the calculation of wages for a retiring worker, and not as meaning that the wage for the month of retirement is to be increased and paid in full to the retiring worker regardless of the actual number of days worked. Therefore, the full amount of remuneration for the month of retirement cannot be included in the amount of wages paid during the last three months from the day immediately preceding retirement in calculating the average wage, and a retirement allowance cannot be calculated on that basis.

[Plaintiff, Appellee] Plaintiff (Attorneys Lee Won-mok and 1 other, Counsel for the Plaintiff)
[Defendant, Appellant] Korea Highway Corporation (Attorney Kim Dong-hwan, Counsel for the Defendant)
[Judgment Below] Seoul High Court Judgment 96Na7566 rendered on December 12, 1996

[Order]

The part of the judgment below regarding retirement pay that was against the Defendant is reversed, and this part of the case is remanded to the Seoul High Court.

[Reasoning]

The grounds of appeal are examined.

1. According to the reasoning of the judgment below, the court below found, based on the evidence indicated therein, that the Plaintiff joined the Defendant Corporation as a security guard (청원경찰) on May 14, 1984, and worked there until retiring on May 11, 1995; that the Defendant Corporation's rules of employment (취업규칙) provided that wages shall be calculated from the 1st to the last day of each month, and that upon retirement, the full monthly wage for the month shall be paid; and that retirement pay shall be calculated by multiplying the "monthly wage" by the retirement benefit payment rate, with the "monthly wage" being calculated by dividing by three the total wages, etc. paid during the final three months from the day immediately preceding the date of retirement. The court below then determined that, in general, even where an employee retires in the middle of a month, if the employee receives the full monthly wage for that month pursuant to the rules of employment providing that the full monthly wage shall be paid at the time of retirement, such wage is paid as compensation for work performed up to the date of retirement and cannot be regarded as having the nature of consideration premised on continued work until the last day of that month; therefore, the entire amount of such wage should be included in the total wages paid during the three months prior to the date of retirement, and the average wage should be calculated on that basis (see Supreme Court Decision 92Da24509 delivered on May 27, 1993). Based on this reasoning, the court below included the entire monthly wage for May 1995, the month of the Plaintiff's retirement, in the wages paid during the final three months from the day immediately preceding the date of retirement, calculated the "monthly wage" accordingly, and computed the Plaintiff's retirement pay on that basis.

2. However, in order for money or valuables paid to an employee to be included in the total wages that form the basis for calculating average wage, regardless of its name, and even if the payment of such money or valuables is made pursuant to a collective agreement, rules of employment, employment contract, or the employer's policy, the obligation to make such payment must be directly related to, or closely related to, the provision of labor—that is, it must be regarded as having been paid as consideration for labor (see Supreme Court Decisions 94Da55934 delivered on May 12, 1995, and 95Da19256 delivered on May 14, 1996, etc.). Meanwhile, average wage is based on the fundamental principle of calculating, as a matter of fact, the employee's ordinary living wage; therefore, where the "total amount of wages paid to the employee during the three months prior to the date on which the cause [for calculation] arose," which is included in the calculation of average wage, is significantly less or more than the ordinary case due to special circumstances, such amount cannot be used as-is as the basis for calculating average wage (see Supreme Court Decisions 90Daka4683 delivered on November 9, 1990; 90Nu2772 delivered on April 26, 1991; 94Da8631 delivered on February 28, 1995; 97Nu14798 delivered on November 28, 1997, etc.). Since the retirement pay system, which uses such average wage as the basis for its calculation, is intended to guarantee, as before, the employee's ordinary living standard according to job grade, salary step, etc., it would be contrary to the fundamental purpose of the system for retirement benefits to become significantly greater or less than the ordinary case due to special and coincidental circumstances (see Supreme Court Decisions 97Da18936 delivered on January 20, 1998; 97Da54727 delivered on April 24, 1998, etc.).

Furthermore, rules of employment set forth standards concerning employees' code of conduct and working conditions such as wages, to be applied uniformly to all employees of the relevant enterprise by the employer, and must be interpreted in a manner that is universally reasonable and rational for the parties concerned, including the employer and employees; the common intent of the employees is also one of the general standards for such interpretation. If, as the court below held, the mere existence of a provision in the rules of employment stating that the full monthly wage shall be paid upon retirement means that, regardless of the date of retirement, the full wage for the month of retirement must be included in the wages paid during the final three months from the day immediately preceding the date of retirement in calculating the average wage, and retirement pay must be computed on that basis, then an imbalance would arise whereby employees at the same enterprise, receiving the same monthly salary and having worked for the same period of continuous service, would suffer significant disparities in their retirement pay merely because they retired on different dates within the same month. Moreover, this would even produce the bizarre phenomenon whereby the earlier an employee retires within the month of retirement—that is, the fewer days worked in the month of retirement—the greater the retirement pay received. This is highly unreasonable, does not accord with the common intent of employees, and is contrary to the principles of interpreting rules of employment.

In light of the above fundamental principles governing average wage, the purpose of the retirement pay system, and the general standards for interpreting rules of employment, a provision in the rules of employment stating that the full monthly wage shall be paid even where an employee retires in the middle of a month should be understood as a provision reflecting policy-based and benevolent consideration in calculating the wages of retiring employees, rather than as intending to increase and pay in full the wage for the month of retirement to a retiring employee regardless of the actual number of days worked.

Accordingly, Supreme Court Decision 92Da24509 delivered on May 27, 1993, which took a different view, is hereby overruled.

Consequently, the court below, having taken a different view, misapprehended the legal principles concerning average wage and erred in its interpretation of the Defendant Corporation's retirement benefit regulations, thereby affecting the outcome of the judgment. The appeal is well-founded on this point.

3. Therefore, the part of the judgment below regarding retirement pay that was against the Defendant is reversed, and this part of the case is remanded to the court below for further hearing and determination. This judgment is rendered in accordance with the unanimous opinion of all Justices participating in the decision, as set forth in the Order above.
