This case addressed how to calculate average wage (평균임금) for severance pay (퇴직금) purposes when a worker took over three months of unpaid leave due to detention (구속) before retiring. Since the worker received no wages during the leave period, a literal calculation would result in an average wage of zero won. The Supreme Court held that in such cases, the average wage should instead be calculated based on the worker's wages for the three months immediately preceding the leave of absence.

Key takeaways
  • CaseA worker took over three months of unpaid leave due to detention (구속) and later retired, disputing how his average wage should be calculated for severance pay purposes.
  • OutcomeThe Supreme Court ruled that when unpaid leave causes the average wage to become zero won, it must instead be calculated based on the wages earned during the three months immediately before the leave began.
  • LessonWhen special circumstances cause a worker's average wage to become abnormally low, employers must calculate it using a method that accurately reflects the worker's ordinary living wage.
Issues
  • How to calculate severance pay when unpaid leave causes the average wage to become zero won
  • The scope of interpretation when the average wage cannot be determined under the standard method
  • The appropriate remedy when average wage is abnormally low due to special circumstances
Key reasoning

The average wage system is designed to reflect a worker's ordinary standard of living based on typical wages. When special circumstances—such as an extended unpaid leave of absence—cause the calculated average wage to become abnormally low (or even zero), applying the standard calculation method would defeat the purpose of the average wage system. In such exceptional cases, courts must adopt an alternative calculation method that faithfully reflects the worker's actual ordinary living wage, rather than mechanically applying the formula that would produce a distorted, unrealistically low figure. Here, using the three months of wages immediately before the leave began was found to be the appropriate method to achieve this fair result.

Summary of Decision (English, AI translation)

[1] Article 5 of the former Enforcement Decree of the Labor Standards Act (근로기준법시행령) (before its full amendment by Presidential Decree No. 15320 on March 27, 1997) provides that where average wages cannot be calculated pursuant to the provisions of the Labor Standards Act (근로기준법) and its Enforcement Decree, such wages shall be calculated as prescribed by the Minister of Labor. Here, the phrase "cannot be calculated" should not be limited literally to cases where calculation is technically impossible, but should be construed to include cases where calculating the average wage pursuant to the relevant provisions of the Labor Standards Act would be markedly inappropriate.

[2] The average wage system is fundamentally premised on calculating the worker's ordinary living wage as it actually is. Accordingly, where the "total amount of wages paid to the worker during the three months preceding the date on which the cause for calculation arose," which is included in the calculation of average wage, is, due to special circumstances, markedly less or more than in the ordinary case, such amount cannot be used as it stands as the basis for calculating the average wage. Since the retirement allowance system, which uses this average wage as the basis for its calculation, is intended to guarantee, as before, the worker's ordinary living standard according to job grade, salary step, etc., it runs contrary to the fundamental purpose of that system for retirement benefits to become markedly more or less than in the ordinary case due to special and fortuitous circumstances. Therefore, where the average wage that serves as the basis for calculating retirement allowance is, due to special circumstances, markedly less or more than in the ordinary case, the average wage must be calculated as prescribed by the Minister of Labor pursuant to Article 5 of the former Enforcement Decree of the Labor Standards Act (before its amendment by Presidential Decree No. 15320 on March 27, 1997). However, since no standards or methods therefor have yet been established, the average wage must be calculated, in light of the basic principle of the average wage system and the purpose of the retirement allowance system, by a method that faithfully reflects the worker's ordinary living wage.

[3] A case holding that, where a worker was detained and took leave of absence for more than three months before retiring, such that the average wage calculated on the basis of the wages paid during the three months preceding retirement was markedly less than in the ordinary case, the average wage should be calculated on the basis of the wages paid during the three months preceding the leave of absence.

[Plaintiff, Appellee] Plaintiff Co., Ltd. (Attorneys Lee Jae-hu and 3 others, Counsel for the plaintiff)
[Defendant, Appellant] Defendant
[Judgment Below] Seoul District Court Decision 98Na13968 rendered on September 4, 1998

[Order]

The judgment below is reversed, and the case is remanded to a panel (Hapuibu) of the Seoul District Court.

[Reasoning]

The grounds of appeal are examined.

Under the former Labor Standards Act (근로기준법) (as it stood before amendment by Act No. 5245 of December 31, 1996; hereinafter the same), "average wage" means the amount obtained by dividing the total amount of wages paid to the worker during the three months preceding the date on which the cause for calculation arose by the total number of days in that period; provided that where the amount so calculated is lower than the ordinary wage, the ordinary wage shall be deemed the average wage (Article 19, Paragraphs 1 and 2). Articles 2 through 4 of the Enforcement Decree of the Labor Standards Act (근로기준법시행령) (as amended by Presidential Decree No. 13997 of October 22, 1993; hereinafter the same) further provide special rules concerning average wages, and Article 5 thereof provides that where the average wage cannot be calculated under the provisions of the Labor Standards Act and its Enforcement Decree, it shall be calculated as prescribed by the Minister of Labor. Here, "cases where the average wage cannot be calculated" should not be limited literally to cases where such calculation is technically impossible, but should be construed to include cases where calculating the average wage under the relevant provisions of the Labor Standards Act would be markedly inappropriate (see Supreme Court Decision 94Da8631 rendered on February 28, 1995).

Furthermore, the average wage is based on the fundamental principle of calculating, in accordance with the facts, the worker's ordinary living wage. Accordingly, where "the total amount of wages paid to the worker during the three months preceding the date on which the cause arose," which is used in calculating the average wage, is markedly less or more than the ordinary case due to special circumstances, such amount cannot be used as the basis for calculating the average wage as it stands. The retirement allowance system, which uses this average wage as the basis for its calculation, is intended to guarantee, as before, the worker's ordinary standard of living according to rank, pay grade, etc. Therefore, it would be contrary to the fundamental purpose of that system for the retirement benefit to become markedly larger or smaller than the ordinary case due to peculiar and accidental circumstances.

Accordingly, where the average wage, which serves as the basis for calculating the retirement allowance, is markedly less or more than the ordinary case due to special circumstances, the average wage should be calculated as prescribed by the Minister of Labor pursuant to Article 5 of the above Enforcement Decree; however, since no standards or methods have yet been established therefor, the average wage should be calculated by a method that reflects, in accordance with the facts, the worker's ordinary living wage, in light of the fundamental principle of the average wage and the purpose of the retirement allowance system as discussed above (see Supreme Court Decisions 90Nu2772 rendered on April 26, 1991; 94Da8631 rendered on February 28, 1995; 97Nu14798 rendered on November 28, 1997; 97Da18936 rendered on January 20, 1998; 97Da54727 rendered on April 24, 1998; and 97Da5015 (en banc) rendered on May 12, 1999).

According to the record, however, the Defendant joined the Plaintiff company on July 1, 1992 and worked as the manager of the ○○ branch office; around August 28, 1995, he was detained on charges of fraudulent inducement to sexual intercourse (deceptive seduction), and was treated as being on paid leave from that time until around September 23 of the same year, after which he was placed on unpaid leave (leave of absence) and retired on February 15, 1996. The Plaintiff company calculated the average wage as 5,064,717 won based on the wages paid to the Defendant during the three months preceding his leave of absence, and, treating his period of service as the 39 months prior to the leave of absence, calculated a retirement allowance of 16,460,330 won on that basis; after deducting various taxes and the amount subject to provisional attachment, it paid the remainder to the Defendant on March 15, 1995 [sic]. Under the Plaintiff company's Rules of Employment, the retirement allowance is calculated by multiplying the average monthly wage by the retirement allowance payment rate, and the average monthly wage is calculated by adding: (i) one-third of the sum of the monthly wages paid during the three months preceding retirement (excluding special allowances and vehicle maintenance expenses) and the personal allowance; and (ii) one-twelfth of the sum of the bonus and the annual/monthly leave allowances paid during the one year preceding retirement. The wages of branch managers such as the Defendant were separately governed by the Branch Manager Regulations, under which a branch manager's wage consists of a fixed basic wage (1,000,000 to 1,300,000 won), an efficiency wage paid according to the branch's insurance solicitation performance, and a support wage paid to newly established branches; the retirement allowance is calculated according to the above payment standards, but the average monthly wage is to be calculated by including the basic wage, the efficiency wage, and the support wage. The Defendant received 4,500,000 to 5,000,000 won per month as wages before the leave of absence, of which the basic wage of 1,416,800 won and the personal allowance of 114,560 won were fixed amounts, and the remaining approximately 3,000,000 to 3,500,000 won was the efficiency wage; during the period of the leave of absence, the Defendant did not receive any wages at all, pursuant to the Plaintiff company's Rules of Employment providing that no wages shall be paid during a leave of absence taken for personal reasons.

As such, the Defendant's period of leave of absence spanned more than the three months preceding his retirement, and since no wages were paid during that period, the average wage (average monthly wage), which serves as the basis for calculating the Defendant's retirement allowance, becomes zero won. Accordingly, pursuant to Article 19, Paragraph 2 of the Labor Standards Act, the retirement allowance should be calculated using the ordinary wage as the average wage. However, considering that, since the Defendant, as a branch manager of an insurance company, had most of his wages consisting of the performance-based efficiency wage, the ordinary wage calculated excluding the efficiency wage amounts to only approximately 1,500,000 won per month, which is less than one-third of the average wage of approximately 5,000,000 won per month before the leave of absence, and that this also runs contrary to the purpose of the Plaintiff company's retirement allowance regulations, which provide for including the efficiency wage in the average monthly wage serving as the basis for calculating the retirement allowance, the average wage (average monthly wage) and the retirement allowance calculated on the basis of the wages paid to the Defendant during the three months preceding his retirement are markedly smaller than the ordinary case due to the peculiar and accidental circumstance that the Defendant took a leave of absence spanning more than three months before retirement for personal reasons, and such a result cannot but be said to run contrary to the fundamental purpose of the average wage and retirement allowance system. Therefore, this case also constitutes a case where calculating the average wage under the above relevant provisions would be markedly inappropriate.

Further, as to the method of calculating the average wage in such a case: the average wage as the basis for calculating the retirement allowance is, in principle, based on the fundamental principle of reflecting the worker's ordinary living wage in accordance with the facts, and this should be the amount equivalent to the average wage that could have been calculated had there been no special circumstances such as a lengthy leave of absence. In light of the Defendant's wage circumstances and the Plaintiff company's retirement allowance regulations as discussed above, and in light of the purport of the provisions of the Labor Standards Act, which provide for calculating the average wage based on the wages of the period immediately preceding retirement on the ground that such period best reflects the worker's ordinary living wage, it is appropriate to calculate the Defendant's average wage (average monthly wage) based on the wages of the three months preceding his leave of absence (see Supreme Court Decisions 90Nu2772 rendered on April 26, 1991; 94Da8631 rendered on February 28, 1995; 97Nu14798 rendered on November 28, 1997; and 97Da18936 rendered on January 20, 1998).

Nevertheless, the court below calculated the Defendant's average wage as zero won based on the wages paid during the three months preceding his retirement, i.e., during the period of leave of absence, and on the ground that the average wage was thereby clearly lower than the ordinary wage, immediately calculated the retirement allowance based on the ordinary wage during that period. This constitutes a determination contrary to the above Supreme Court precedents concerning the method of calculating the average wage that serves as the standard for the retirement allowance, and this error affected the outcome of the judgment.

The appeal is well-founded in pointing out this error.

Accordingly, without examining the remaining grounds of appeal, the Justices unanimously agree to reverse the judgment below and remand the case to the court below, and render judgment as set forth in the Order.

Justice Song Jin-hoon (Presiding Justice), Lee Don-hee (Justice in charge), Lee Im-su, Yoon Jae-sik
