This case involved an employee who was dismissed after leading a signature campaign to oust the union president in opposition to the union leadership's policy, and instigating co-workers to refuse overtime work. The Korean Supreme Court (대법원) held that these actions did not constitute legitimate union activities (정당한 노조활동), and together with the employee's false statements on his resume, they constituted valid grounds for dismissal (정당한 해고사유).

Key takeaways
  • CaseAn employee opposed to the union leadership led a campaign to remove the union president, instigated co-workers to refuse overtime, and had made false statements on his resume.
  • OutcomeThe Supreme Court ruled that these actions were not legitimate union activities and constituted interference with business operations and a breach of trust, justifying the dismissal.
  • LessonUnion activities are only protected when conducted through proper organizational channels; individual acts of opposition or interference with business operations can constitute valid grounds for dismissal.
Issues
  • Whether a union member's actions taken in opposition to official union policy constitute legitimate union activity
  • Whether instigating refusal of overtime work is a lawful form of labor action
  • Whether dismissal based on false statements in a resume is justified
  • Whether a violation of the prior consultation procedure under the collective bargaining agreement affects the validity of the dismissal
Key reasoning

The Court reasoned that individual actions opposing decisions made by the official union leadership do not qualify as legitimate union activities, since such activities must be conducted at an organizational level with proper authorization. Instigating co-workers to refuse overtime work was found to constitute interference with business operations (업무방해). Additionally, the false statements the employee made on his resume were deemed to undermine the trust relationship (신뢰관계) essential between employer and employee, independently justifying dismissal. The Court also found that any procedural defect regarding prior consultation requirements under the collective bargaining agreement (단체협약) did not invalidate the dismissal, since the substantive grounds for dismissal were valid.

Summary of Decision (English, AI translation)

[1] The act of some union members opposing or criticizing the decisions or policies of the labor union, contrary to the intent of the union's leadership and the union membership as a whole, cannot be regarded as an activity of the labor union unless there are circumstances sufficient to recognize that, by the nature of the act, it may be viewed as an activity of the labor union or that it received the implicit authorization or approval of the labor union; absent such circumstances, it is merely an arbitrary activity as a union member.

[2] Even if the act referred to in item “[1]” above was carried out as a union activity outside working hours, if the place where it occurred is within the facilities of the workplace, it must comply with reasonable rules or restrictions based on the ownership or management authority over the facilities.

[3] Even though overtime work is performed based on an agreement between labor and management, where the employer, due to a need to extend working hours, proposes overtime work to employees, an act of collectively refusing this and inciting others not to perform overtime work constitutes interference with the employer's business and cannot be deemed justifiable.

[4] A resume serves not merely to assess an employee's work capability, but also to provide material for making an overall personal judgment—covering the employee's intelligence, level of education, honesty, and settledness and adaptability to the workplace—in order to decide whether to hire the person, which is necessary for building trust between labor and management and maintaining order within the enterprise. Therefore, it cannot be deemed improper to treat the concealment of work history or false statements in a resume, as provided in the rules on rewards and punishments, as grounds for dismissal.

[5] Although personnel authority in principle belongs to the employer, the employer may, of its own volition, impose restrictions on that authority. Accordingly, if the employer has, through a collective bargaining agreement (단체협약) concluded with the labor union, recognized the union's involvement in personnel matters concerning union members, the effect of such recognition is determined according to the purport of the relevant provision of the agreement.

[6] Where a collective bargaining agreement provides that “the Company shall consult with the union in advance regarding personnel actions concerning union officers,” such prior consultation—when considered in light of the overall structure and content of the collective bargaining agreement as a whole and the practices between labor and management—differs from a case in which the union is given a joint decision-making right with the company over personnel matters, or where the union's consent or approval is required, or where the matter is to be decided in accordance with a consensus reached through consultation with the union. Rather, such a provision is intended to prevent the union's activities from being obstructed by the company's arbitrary exercise of personnel authority, by requiring the company to make sufficient efforts to persuade the union of the necessity or justifiability of a dismissal and to receive and take into consideration the union's opinion. Therefore, even if a disciplinary dismissal was carried out without going through such a prior consultation procedure, this does not necessarily affect the validity of the dismissal.

[7] Where a collective bargaining agreement or the rules of employment contain a provision requiring that the person subject to disciplinary action be notified of the facts constituting the grounds for the disciplinary charge, a disciplinary action taken without following such a procedure cannot be deemed valid; however, where no such provision exists, there is no absolute obligation to notify the person of such facts.

[Plaintiff, Appellant]

[Defendant, Appellee] Young Chang Musical Instrument Manufacturing Co., Ltd., Litigation Representative Attorney Lee Deok-mo and one other

[Judgment Below] Seoul High Court Decision 91Na42595 rendered on April 15, 1992

[Order]

The appeal is dismissed.
The costs of the appeal shall be borne by the Plaintiff.

[Reasoning]

The grounds of appeal are examined.

1. As to Ground of Appeal No. 1

Where some union members, contrary to the will of the union's executive leadership and the union membership as a whole, oppose or criticize the decisions or policies of the labor union, such conduct cannot be regarded as an activity of the labor union unless there are circumstances sufficient to recognize that, by the nature of the act, it may be viewed as an activity of the labor union or that it received implicit authorization or approval from the labor union; such conduct is merely arbitrary activity as a union member and cannot be deemed union activity. Moreover, even if such act was carried out as a union activity outside working hours, if the location was within the premises of the workplace, it must comply with reasonable regulations or restrictions based on the ownership or management authority over the facility (see Supreme Court Decision 90Do357 rendered on May 15, 1990). Furthermore, although overtime work is carried out by agreement between labor and management, where an employer proposes overtime work to employees because of a need to extend working hours, an act of collectively refusing this and instigating others not to perform overtime work constitutes obstruction of the employer's business and cannot be deemed legitimate.

Accordingly, the court below's determination, premised on the foregoing, that the Plaintiff's conduct — namely, having harbored dissatisfaction with the content of the wage negotiation concluded between the union leadership and the Defendant Company, having demanded a referendum vote among union members and having been in conflict with the union leadership, then gathering approximately 40 union members at the entrance of the cafeteria during lunchtime, asserting that the union was a company-controlled union, instigating a signature campaign for the resignation of the union president and instigating refusal of overtime work, thereby causing approximately 120 workers who sympathized with him to refuse overtime work — cannot be regarded as legitimate labor union activity, and that such conduct falls under the grounds for dismissal prescribed in the disciplinary rules, is justified (see Supreme Court Decision 91Nu124 rendered on September 24, 1991), and there is no error of law such as misunderstanding the legal principles concerning grounds for dismissal.

2. As to Ground of Appeal No. 2

The court below found the following facts: that although the Plaintiff, after graduating from high school, had worked at non-party Daewoo Electronics Co., Ltd. and non-party Jeil Engineering Co., Ltd. and had resigned due to instigating labor disputes or participating in sit-in protests, the Plaintiff, upon joining the Defendant Company, concealed his work history at the aforementioned non-party companies and submitted a resume falsely stating that he had worked as an accounting clerk at a billiard hall, and at the job interview also falsely stated that he had resigned because the atmosphere at the billiard hall was not good; and that the Defendant Company, after confirming the Plaintiff's history by making inquiries to the owner of the billiard hall, hired the Plaintiff after receiving from him a written pledge stating that he had truthfully stated all matters in his resume without falsification or omission and that he would voluntarily resign immediately if any falsehood were discovered.

Based on these findings, the court below determined that a resume serves not merely to assess a worker's job capability, but also functions as material for judgment in deciding whether to hire, based on a comprehensive assessment of the worker's overall character, including intelligence, level of education, honesty, and settledness and adaptability in the workplace, which are necessary to build trust between labor and management and to maintain order within the enterprise; therefore, it cannot be deemed improper for the disciplinary rules to treat concealment of one's work history or false statements in a resume as grounds for dismissal. Furthermore, the court below found it clear that had the Defendant known, at the time of hiring the Plaintiff, that the Plaintiff had concealed his work history to be stated in the resume and had further actively fabricated a false work history, the Defendant would not have hired the Plaintiff; and that the mere passage of three years since the Plaintiff joined the company cannot be deemed to have cured this defect. The court below thus determined that the Defendant's disciplinary dismissal of the Plaintiff on the basis of the aforementioned grounds for dismissal was justified.

Upon examination of the record, the above fact-finding and determination by the court below are justified, and there is no error of law such as misunderstanding the legal principles as argued in the grounds of appeal.

3. As to Ground of Appeal No. 3

Although the authority over personnel matters belongs in principle to the employer, since the employer may, of its own volition, impose restrictions upon such authority, if the employer, through a collective bargaining agreement concluded with the labor union, has recognized the union's involvement in personnel matters concerning union members, the effect thereof shall be determined according to the purport of the provisions of the agreement. Article 13, Paragraph 2 of the collective bargaining agreement at issue provides that "the Company shall consult with the union in advance regarding personnel matters concerning union officers." Considering this in light of the overall structure and content of the collective bargaining agreement as well as labor-management practices, such prior consultation differs from a case where the union is given co-determination authority together with the Defendant Company over personnel matters, or where the decision is to be made in accordance with the mutually agreed intent of the union, and instead means that, in order to prevent the Defendant Company's activities from being impeded by the arbitrary exercise of personnel authority, the Defendant Company must make sufficient efforts to convince the union of the necessity or legitimacy of the dismissal and must receive and take into consideration the opinions presented by the union. Accordingly, even if a disciplinary dismissal is carried out without going through such a prior consultation procedure, this does not necessarily affect the validity of the dismissal (see Supreme Court Decision 91Da41477 rendered on June 9, 1992). The court below's determination that, even though the Defendant did not go through the prior consultation procedure under the aforementioned personnel-related agreement in carrying out the disciplinary dismissal of the Plaintiff, this does not affect the validity of the personnel action itself, is, as a result, justified, and there is no error of law such as misunderstanding the legal principles concerning dismissal procedures as pointed out in the grounds of appeal.

4. As to Ground of Appeal No. 4

Where a collective bargaining agreement or the rules of employment contains a provision requiring notice to be given to the subject of disciplinary action of the facts constituting the disciplinary charge, a disciplinary action taken without following such procedure cannot be deemed valid; however, where no such provision exists, there is not necessarily an obligation to notify such facts.

The court below determined that, since Article 21 of the Defendant Company's collective bargaining agreement merely provides that, in disciplining a union member, notice shall be given to the person concerned and to the union at least five days in advance, granting the right to make statements regarding the matter, and contains no provision concerning the notification of the facts constituting the disciplinary charge, the disciplinary action cannot be deemed invalid merely because the Defendant, in convening the disciplinary committee concerning the Plaintiff, notified the Plaintiff and the union of the fact thereof but dismissed the Plaintiff without notifying him of the facts constituting the disciplinary charge. This determination is justified, and there is no error of law in misconstruing the collective bargaining agreement as pointed out in the grounds of appeal. All the arguments are without merit.

5. Therefore, the appeal is dismissed, and the costs of the appeal are to be borne by the Plaintiff, the losing party. This judgment is rendered as stated in the Order, with the unanimous concurrence of the Justices involved.
