This case involved a construction site accident in which a worker fell to his death. The representative of the primary contractor (원청회사) was found not guilty because he had no direct involvement in the failure to implement on-site safety measures, while the safety manager of the subcontractor (하청회사) was found guilty for violating his duty to ensure safety measures. The Supreme Court clarified that a violation of the Occupational Safety and Health Act (산업안전보건법) requires the employer's direct instruction or willful neglect, and that application of the joint penalty provision (양벌규정) against a corporation requires proof that the corporation failed to exercise reasonable care and supervision.

Key takeaways
  • CaseA worker fell to his death at a construction site, leading to charges against both the primary contractor's representative and the subcontractor's safety manager for violating the Occupational Safety and Health Act.
  • OutcomeThe primary contractor's representative was acquitted due to lack of direct involvement, while the subcontractor's safety manager was convicted for failing to fulfill safety obligations.
  • LessonA violation of the Occupational Safety and Health Act is not established merely because an accident occurred — criminal liability requires proof of the employer's direct instruction or deliberate neglect of safety duties.
Issues
  • Requirements for establishing an employer's criminal liability under the Occupational Safety and Health Act
  • Scope and conditions for applying the joint penalty provision (양벌규정) to corporations
  • Scope of the safety and health manager's (안전보건관리책임자) duty to implement safety measures
Key reasoning

A violation of the Occupational Safety and Health Act is only established when the employer directly instructs the omission of safety measures or knowingly neglects to implement them — the mere occurrence of an accident at the workplace is not sufficient to establish liability. The court emphasized that criminal liability under this Act requires a clear causal link between the employer's conduct (or failure to act) and the safety violation. Furthermore, when applying the joint penalty provision (양벌규정) to hold a corporation liable for an employee's violation, it must be shown that the corporation itself failed to exercise reasonable care and supervision over its employees or agents. Since the primary contractor's representative had no direct connection to the specific failure to implement safety measures at the site, he could not be held criminally liable. In contrast, the subcontractor's on-site safety manager, who had direct responsibility for implementing safety measures, was properly found guilty for breaching that duty.

Summary of Decision (English, AI translation)

[1] The former Industrial Safety and Health Act (산업안전보건법) (before amendment by Act No. 8475 on May 17, 2007) provides in Article 23(1) for the business owner's duty to take safety measures, and in Article 71 allows for the punishment of the business owner even where the violation of the above Act was committed by a person other than the business owner. Therefore, the offense under Article 67 Item 1 and Article 23(3) of the above Act is established only where it is recognized that the violation was committed by the business owner, such as where the business owner, without taking the safety measures prescribed by the Rules on Industrial Safety Standards (산업안전기준에관한규칙) at the workplace operated by him, instructed work involving safety hazards as provided in Article 23(3) to be performed, or, knowing that such work was being performed without the required safety measures, left it unaddressed. The offense is not established merely by the fact that work involving such hazards was performed at the business owner's workplace without the necessary safety measures.

[2] Although it is clear from the provision itself that the subject of the penal provision set forth in Article 68 Item 1 and Article 29(2) of the former Industrial Safety and Health Act (before amendment by Act No. 8475 on May 17, 2007) is the business operator, Article 71 of the above Act provides a joint penal provision stipulating that where a representative of a corporation, or an agent, employee (including a supervisor) or other worker of a corporation or individual commits a violation under Articles 67 through 70 in connection with the business of the corporation or individual, not only shall the actual offender be punished, but the penal provisions of each relevant article shall also be applied to the corporation or individual. The purpose of this provision is to punish both the actual offender and the business operator in cases where the business operator, being a corporation or individual, did not directly commit the violation under each relevant article. Accordingly, by virtue of this joint penal provision, an offender who is not the business operator also becomes subject to the penal provisions of each relevant article that apply to the business operator.

[3] In light of the principle of self-responsibility in criminal punishment, the joint penal provision under Article 71 of the former Industrial Safety and Health Act (before amendment by Act No. 8475 on May 17, 2007) should be deemed applicable only where the corporation has neglected its duty to exercise due care or supervision and control in relation to the business in connection with which the violation occurred. Whether a corporation has neglected such duty of due care or supervision and control in a specific case must be determined by comprehensively considering all circumstances related to the violation in question, including the legislative purpose of the relevant statute, the degree of infringement of legal interests anticipated from the violation of the penal provision, the purpose of establishing the joint penal provision with respect to the violation, as well as the specific manner in which the violation occurred, the actual damage or extent of the resulting harm, the scale of the corporation's business, the possibility of supervision over the offender or the specific relationship of direction and supervision, and the measures actually taken by the corporation to prevent the violation.

[Defendant] Defendant 1 and 3 others
[Appellant] Defendants
[Defense Counsel] Attorney Lee Hong-ryeol
[Lower Court Judgment] Chuncheon District Court Judgment 2008No104, decided August 20, 2008

[Order]

The part of the lower court judgment concerning Defendant 1, Defendant 2 Corporation, and Defendant 4 Corporation is each reversed, and this part of the case is remanded to the Panel Division of the Chuncheon District Court. The appeal by Defendant 3 is dismissed.

[Reasoning]

We examine each ground of appeal.

1. Determination on the grounds of appeal by Defendant 1 and Defendant 2 Corporation

The lower court found that Defendant 1 had a worker perform work in a dark place without any identifiable markings, with part of the safety handrail removed and a cover left open, without turning on lighting, thereby failing to take the necessary measures to prevent danger, and that Defendant 2 Corporation, through its representative Defendant 1's failure to take such necessary measures to prevent danger in connection with the business of Defendant 2 Corporation, each violated Article 67 Subparagraph 1, Article 23 Paragraph 3, and Article 71 of the former Occupational Safety and Health Act (산업안전보건법) (before amendment by Act No. 8475 of May 17, 2007; hereinafter the "former Act").

However, for the following reasons, the lower court's determination is difficult to accept as it stands.

The former Act, while providing for the safety measure obligations of a business owner in Article 23 Paragraph 1, also provides in Article 71 that even where a violation of the former Act is committed by a person who is not the business owner, the business owner may nevertheless be punished. Therefore, the offense of violating Article 67 Subparagraph 1 and Article 23 Paragraph 3 of the former Act is established only where it is recognized that the violation was committed by the business owner—such as where the business owner directs work involving safety hazards under Article 23 Paragraph 3 to be performed at a workplace operated by the business owner without taking the safety measures prescribed by the Regulations on Industrial Safety Standards, or where the business owner, knowing that such work is being performed without the safety measures having been taken, leaves it unaddressed. It is not established merely by the fact that such hazardous work was performed at the business owner's workplace without the necessary safety measures having been taken (see, e.g., Supreme Court Decision 2006Do8874, decided March 29, 2007).

According to the reasoning of the lower court's judgment and the record, the following facts are found: Defendant 2 Corporation, a company of considerable size employing approximately 70 regular workers and simultaneously carrying out construction at 11 sites nationwide at the time, had dispatched Non-Indicted 1 as the site manager to the site of this accident at the time of the accident; Non-Indicted 1 also attended meetings of the safety and health council at the accident site, which was composed of the general safety and health manager and safety manager of Defendant 4 Corporation and representatives of the subcontracted companies; Defendant 1 visited the accident site only approximately once every three months during the 18 months the construction was underway, in order to attend the safety and health council meetings convened by the contracting company, Defendant 4 Corporation; the specific on-site work, provision of safety protective equipment, and safety education, among other matters, at the accident site were all handled independently by Non-Indicted 1; and the victim, Non-Indicted 2, was hired as a day laborer by Non-Indicted 1, the site manager, according to his own needs, with Non-Indicted 1 also having placed the job advertisement.

Given these facts, it cannot be found that Defendant 1 directed the victim to perform work without safety measures having been taken, or that he left work being performed without safety measures unaddressed. Accordingly, Defendant 1 cannot be charged with the offense of violating Article 67 Subparagraph 1 and Article 23 Paragraph 3 of the former Act, and the offense against Defendant 2 Corporation under the former Act, which presupposes the establishment of that violation, likewise cannot be established.

Nevertheless, the lower court, having made a different determination, committed an error affecting the outcome of the judgment by misunderstanding the relevant legal principles or by violating the rules of evidence and thereby erring in its fact-finding.

The grounds of appeal pointing this out are with merit.

2. Determination on the grounds of appeal by Defendant 3

It is clear from the provision itself that the penal provision set forth in Article 68 Subparagraph 1 and Article 29 Paragraph 2 of the former Act applies to business owners. However, Article 71 of the former Act contains a joint penalty provision (양벌규정) stipulating that where a representative of a corporation, or an agent, employee (including a supervisor), or other worker of a corporation or an individual, commits a violation under Articles 67 through 70 in connection with the business of the corporation or individual, not only shall the actor be punished, but the penal provisions of each respective article shall also apply to the corporation or individual. The purpose of this provision is to punish both the actor and the business owner where the business owner, whether a corporation or an individual, does not directly commit the violation under each respective article. Accordingly, under this joint penalty provision, even an actor who is not the business owner becomes subject to the penal provisions of each respective article that apply to business owners (see, e.g., Supreme Court Decision 95Do230, decided May 26, 1995).

In the same vein, the lower court's determination—citing the circumstances set forth in its judgment—that Defendant 3, as the general manager responsible for safety and health management at the construction site in this case, falls under the category of "actor" as set forth in Article 71 of the former Act, and that since the victim, a worker employed by the subcontractor Defendant 2 Corporation, performed work in a location where there was a risk of falling, Defendant 3 was under a duty to take safety measures such as installing a safety net at the work location, and violated this duty, and that accordingly Defendant 3 should be charged with the offense of violating the former Act and the offense of occupational negligence resulting in death, is justified and acceptable, and there is no error therein of the kind alleged in the grounds of appeal, such as a misunderstanding of the relevant legal principles.

3. Ex Officio Determination Concerning Defendant 4 Corporation

Prior to determining the grounds of appeal, examining the matter ex officio: the lower court upheld the first instance judgment as it stood, which found Defendant 4 Corporation, a corporation, guilty pursuant to the joint penalty provision of Article 71 of the former Act, on the ground that Defendant 3, an employee, committed a violation of Article 68 Subparagraph 1 and Article 29 Paragraph 2 of the former Act by failing to take the necessary measures to prevent danger in connection with the business of Defendant 4 Corporation.

However, in light of the principle of personal culpability in criminal punishment, it is appropriate to hold that the above joint penalty provision applies only where the corporation neglected its duty of reasonable care or supervision and management with respect to the business in connection with which the violation occurred. Whether a corporation, in a specific case, neglected its duty of reasonable care or supervision and management must be determined by comprehensively considering all circumstances related to the violation in question—namely, the legislative purpose of the relevant statute, the degree of infringement of legal interests anticipated from a violation of the penal provision, the purpose behind establishing the joint penalty provision for that violation, as well as the specific manner of the violation, the actual damage or extent of the resulting harm, the scale of the corporation's business, the possibility of supervision over the actor or the specific relationship of direction and supervision, and the measures the corporation actually took to prevent the violation, among other factors (see, e.g., Supreme Court Decision 2009Do5824, decided February 25, 2010).

Accordingly, in order to hold Defendant 4 Corporation liable pursuant to the joint penalty provision of Article 71 of the former Act, it is necessary to examine and determine matters such as the scale of Defendant 4 Corporation, including the number of its employees, and its relationship of direction and supervision over its employees; whether Defendant 4 Corporation had ordinarily managed and supervised so as to ensure that necessary measures were taken or facilities installed to prevent danger; whether Defendant 4 Corporation needed to anticipate Defendant 3's violation and exercise reasonable care or thorough supervision and management to prevent it; and, if such a need existed, whether Defendant 4 Corporation faithfully fulfilled such duty.

Nevertheless, the lower court, merely on the ground that Defendant 3's act constituted a violation of the former Act, punished Defendant 4 Corporation pursuant to the above joint penalty provision without further examining the content of Defendant 4 Corporation's duty of care or whether it was breached. The lower court's judgment thus contains an error in misunderstanding the legal principles concerning the liability of a business owner under the joint penalty provision of the former Act, or in failing to exhaust the examination required, and it is clear that this affected the outcome of the judgment.

4. Conclusion

Accordingly, without addressing the grounds of appeal raised by Defendant 4 Corporation, the part of the lower court judgment concerning Defendant 1, Defendant 2 Corporation, and Defendant 4 Corporation is each reversed, and this part of the case is remanded to the lower court for further examination and determination, while the appeal by Defendant 3 is dismissed. This judgment is rendered as set forth in the Order, by the unanimous opinion of the Justices participating in the decision.
