In this case, a newspaper company reassigned journalists who had been critical of management to administrative (non-editorial) positions without prior consultation, and subsequently dismissed them. The Supreme Court held that the reassignment order (전직발령) was invalid as an abuse of the employer's right, and that the dismissal constituted an unfair labor practice (부당노동행위).

Key takeaways
  • CaseA newspaper company reassigned journalists critical of management to administrative positions without prior consultation and then dismissed them.
  • OutcomeThe court ruled that the reassignment order was void as an abuse of right, and that the dismissal was an unfair labor practice.
  • LessonEmployers must establish genuine business necessity and obtain employee consultation before reassignment, and must never use disciplinary action as retaliation for union activities.
Issues
  • Whether the employer's reassignment/transfer order (전직·전보처분) constituted an abuse of right
  • Whether the dismissal constituted an unfair labor practice (부당노동행위)
Key reasoning

The Court found that the reassignment lacked significant business necessity and imposed substantial hardship on the affected employees' daily lives, particularly because it was carried out without any prior consultation process with the workers. Such unilateral action, disproportionate to any legitimate business need, amounted to an abuse of the employer's right to reassign employees (전직명령권의 남용), rendering the reassignment order void. Furthermore, the Court determined that the subsequent dismissal was not a legitimate personnel action but was in substance a retaliatory measure against the employees for their union activities. As such, the dismissal was classified as an unfair labor practice (부당노동행위) prohibited under Korean labor law, rather than a valid exercise of the employer's disciplinary authority.

Summary of Decision (English, AI translation)

[1] Reassignment or transfer of duties for an employee falls, in principle, within the authority of the employer as the holder of personnel authority, and thus the employer has considerable discretion within the scope necessary for business operations; such a measure cannot be deemed invalid unless there are special circumstances, such as its violation of the Labor Standards Act (근로기준법) or its constituting an abuse of rights. Whether a reassignment or similar measure constitutes an abuse of rights must be determined by comprehensively considering the business necessity of the reassignment, weighed against the disadvantages to the employee's living conditions resulting therefrom, as well as whether procedures required under the principle of good faith, such as consultation with the employee, were followed in the course of the reassignment.

[2] Where a media company, without prior consultation or consent procedures, reassigned an employee who had worked as a reporter and had taken a critical stance toward management to a non-reporting administrative position, and newly hired a reporter to fill the vacated position, the court held that the reassignment was invalid on the grounds that its business necessity was not particularly significant, whereas it caused substantial disadvantage to the employee's living conditions, and that the procedures required under the principle of good faith had not been followed in the course of making the reassignment.

[3] Where it is recognized that an employer, in dismissing an employee, has in substance dismissed the employee because of the employee's legitimate trade union activities, notwithstanding the dismissal grounds ostensibly asserted, such dismissal must be regarded as an unfair labor practice. Whether the substantial ground for dismissal was the employee's legitimate activities conducted for trade union business must be determined by comparatively examining and reviewing all relevant circumstances, including the dismissal grounds asserted by the employer and the content of the legitimate trade union activities conducted by the employee, the timing of the dismissal, the relationship between the employer and the trade union, whether there was disparity in sanctions between union members and non-union members in similar cases, whether the dismissal conformed to past practice, the employer's words and conduct or attitude toward union members, and other circumstances from which the existence of an intent to commit an unfair labor practice may be inferred.

[4] A case holding that a dismissal disposition constituted an unfair labor practice, in that it was, in substance, intended to impose a disadvantage for organizing and engaging in activities of a trade union.

[Order]

The appeal is dismissed. The costs of the appeal shall be borne by the Plaintiff.

[Reasoning]

The grounds of appeal are examined.

1. As to Grounds of Appeal Nos. 1 and 2

A reassignment or transfer of an employee's position in principle falls within the authority of the employer, who has the power of personnel management, and therefore the employer has considerable discretion within the scope necessary for business purposes; such measure cannot be deemed invalid unless there exist special circumstances such as a violation of the Labor Standards Act (근로기준법) or the like, or an abuse of rights. Whether a transfer order or similar disposition constitutes an abuse of rights should be determined by comprehensively considering the business necessity for the transfer order, etc., weighed against the disadvantages caused to the employee's livelihood as a result of the transfer, etc., and whether the procedures required by the principle of good faith, such as consultation with the employee side, were followed in the course of the transfer order, etc. (see Supreme Court Decision 97Nu5435 rendered on December 22, 1998).

According to the record, at the time of the reassignment order at issue in this case, there was no objective performance evaluation system within the Plaintiff company for assessing the abilities of reporters; the Defendant's Intervenors (hereinafter referred to simply as the "Intervenors") and other reporters subject to the reassignment at issue included a considerable number of reporters who were evaluated as competent within the Plaintiff company and who had taken a critical stance toward the Plaintiff company's management; furthermore, immediately before the reassignment order at issue, the Plaintiff had posted a notice recruiting new reporters and hired 11 new employees, including 9 reporters, and even recruited 7 executive-level employees from outside the company. In light of these circumstances, it cannot be said, as the Plaintiff asserts, that the reassignment order at issue was made as part of a downsizing management effort due to a situation in which the company's deficit operation could no longer be left unaddressed. Moreover, the Plaintiff company has failed to assert or prove any specific criteria used in selecting the persons subject to reassignment. In addition, in the press industry, the status of a reporter and the status of an administrative staff member are generally regarded as having considerable differences, and the content of their duties also differs. The Intervenors joined the Plaintiff company from the outset as reporters, worked in the editorial department for a considerable period, and believed that they would continue to work in the same occupation in the future. Despite the fact that the reassignment order at issue would reduce the Intervenors' salaries by between 730,000 won and 1,100,000 won compared to before, it can be seen that the Plaintiff company did not hold prior consultations with the Intervenors in making the reassignment order at issue, nor did it seek the Intervenors' consent. Given these circumstances, the reassignment order at issue against the Intervenors involved relatively little business necessity, while causing significant disadvantage to the Intervenors' livelihood, and the Plaintiff company failed to follow the procedures required by the principle of good faith in the course of making the reassignment order at issue. Accordingly, the reassignment order at issue made by the Plaintiff company against the Intervenors lacks justifiable cause and must be deemed invalid.

The judgment below, which reached the same conclusion, is justified, and there is no error therein such as a misapprehension of facts or a misunderstanding of the legal principles concerning an employer's authority to order reassignment and its limits, as alleged in the grounds of appeal. This part of the grounds of appeal is without merit.

2. As to Grounds of Appeal Nos. 1 and 3

Where it is recognized that, contrary to the dismissal grounds ostensibly asserted by the employer, an employee was in fact dismissed on account of the employee's legitimate labor union activities, such dismissal must be regarded as an unfair labor practice. Whether an employee's legitimate act for labor union business was the substantive ground for dismissal should be determined by comparatively examining the dismissal grounds asserted by the employer and the content of the employee's legitimate act for labor union business, the timing of the dismissal, the relationship between the employer and the labor union, whether there was disparate treatment between union members and non-union members in similar cases, whether the measure conforms to established practice, the employer's words and conduct or attitude toward union members, and other circumstances from which the existence of an intent to commit an unfair labor practice may be inferred (see Supreme Court Decision 96Nu6431 rendered on July 8, 1997).

According to the record, it is recognized that Intervenor 2's act of being absent from work in protest of the reassignment order at issue in this case, the act of Intervenor 1 and Intervenor 3, while active as union officers, of criticizing the Plaintiff company's representative director and editor-in-chief and stating matters defamatory to their honor in somewhat excessive language through wall posters or statements issued in the name of the labor union, and Intervenor 1's act, while active as the president of the labor union, of refusing to perform newly assigned duties, each fall under the grounds for dismissal set forth in the Plaintiff company's disciplinary regulations. However, as noted above, the reassignment order at issue against the Intervenors itself constitutes an abuse of rights and is invalid; accordingly, it appears that Intervenor 2's absence from work and Intervenor 1 and Intervenor 3's posting of wall posters and issuance of statements were part of a protest against, or a demand for correction of, that reassignment order. Considering that the overall content of the wall posters and statements so posted or issued criticized the Plaintiff company management's attitude toward operating the newspaper and its editorial policy, and called for solidarity among union members, it cannot be said that the Intervenors' such conduct constitutes misconduct of a degree that would render it manifestly unreasonable to continue the labor contract. Moreover, considering additional circumstances such as the fact that the Intervenors played a leading role in establishing the labor union and acted as its president or officers; that, the day before the dismissal disposition, the Intervenors had even demanded collective bargaining with the Plaintiff company, which the Plaintiff company refused; and that, among the 21 persons subject to the reassignment order at issue, the dismissal disposition was imposed only on the Intervenors, together with the timing of the reassignment order and the subsequent course of events, it must be concluded that the Plaintiff's dismissal disposition against the Intervenors was, in substance, intended to disadvantage the Intervenors on account of their having organized and engaged in activities for the labor union, and thus constitutes an unfair labor practice.

The judgment below, which reached the same conclusion, is justified, and there is no error therein such as a misapprehension of facts or a misunderstanding of the legal principles concerning unfair labor practices, as alleged in the grounds of appeal. This part of the grounds of appeal is likewise without merit.

3. Accordingly, the appeal is dismissed, and the costs of the appeal are to be borne by the losing party. This judgment is rendered in accordance with the unanimous opinion of the participating Justices, as set forth in the Order above.

Justice Seo Seong (Presiding Justice), Ji Chang-kwon (Justice in Charge), Yu Ji-dam
