In this case, an employer dismissed an employee and later refused to reinstate him even though the dismissal was later found improper. The Supreme Court held that because the employer had followed proper procedures in carrying out the dismissal, the dismissal itself did not constitute a tort (불법행위), even if it was later deemed invalid. However, the employer's subsequent refusal to reinstate the employee without justifiable cause was found to infringe upon the employee's personal legal interests (인격적 법익) and therefore constituted a separate tort.

Key takeaways
  • CaseAn employer dismissed an employee, and after the dismissal was later found invalid, the employer still refused to reinstate him.
  • OutcomeThe court ruled that while the dismissal itself was not a tort due to proper procedure, the unjustified refusal to reinstate was a tort violating the employee's personal rights.
  • LessonEmployers must promptly reinstate employees once a dismissal is found invalid, or risk separate liability for infringing on the employee's personal rights (인격적 법익).
Issues
  • What are the requirements for an unjust dismissal (부당해고) to constitute a tort (불법행위)?
  • Does an employer's refusal to reinstate an employee after an invalid dismissal constitute a separate tort?
Key reasoning

The Court reasoned that even if a dismissal (해고) is ultimately determined to be invalid, it does not automatically amount to a tort if the employer followed lawful procedures and had reasonable grounds to believe the dismissal was justified at the time. However, once a dismissal is found invalid, the employer has a duty to reinstate the employee. If the employer refuses reinstatement without justifiable reason, this refusal itself constitutes an independent wrongful act that infringes upon the employee's personal legal interests, such as dignity and the right to work. Therefore, the legality of the original dismissal and the legality of the subsequent refusal to reinstate must be evaluated separately.

Summary of Decision (English, AI translation)

[1] Generally, where an employer's disadvantageous disposition such as dismissal against an employee is found to be invalid because it is not justified, such reason alone does not automatically make the disadvantageous disposition such as dismissal constitute a tort. However, where the employer has no grounds whatsoever for disciplinary dismissal or the like against the employee, yet intentionally puts forward some nominal ground for dismissal and resorts to the means of discipline solely with the intention of driving the employee out of the workplace, or where it is objectively clear that a certain fact underlying the dismissal, etc. does not fall under the grounds for discipline prescribed in the rules of employment, etc., or cannot be used as grounds for discipline, and this circumstance could easily have been recognized with a little more attention, yet the employer nevertheless imposed a disadvantageous disposition such as disciplinary dismissal on that ground—that is, in cases where intent or negligence on the part of the employer with respect to the unjust dismissal, etc. is recognized—a tort is established, and the employer is liable to compensate for the emotional distress suffered by the employee as a result thereof.

[2] Even if the disciplinary measure against an employee is, as a result, found to have deviated from or abused the scope of discretion, such that the disciplinary disposition is determined to be invalid due to abuse of the disciplinary authority, etc., if this merely resulted from an erroneous interpretation by the members of the disciplinary committee, who are not legal experts, of the relevant statutes concerning the severity of discipline, it cannot be said that the members of the disciplinary committee who erred in determining the severity of discipline were negligent in a manner that gives rise to tort liability. Likewise, if, in light of the objective circumstances at the time the disadvantageous disposition such as dismissal was imposed on the employee, the degree of the employee's misconduct, etc., and the circumstances leading to the imposition of the disadvantageous disposition on the employee, it is recognized that it was not unreasonable for the employer to have determined that the employee's misconduct, etc. fell under the grounds for a disadvantageous disposition such as dismissal prescribed in the rules of employment or the collective agreement, and if, in addition, the employer imposed the disadvantageous disposition in question after going through the prescribed lawful procedures, etc., then the employer should be deemed to have fulfilled the duty of care that it was required to exercise in imposing the disadvantageous disposition such as dismissal on the employee. Therefore, even if the disadvantageous disposition such as dismissal in question is subsequently determined by a court to be invalid, it cannot be said that there was intent or negligence sufficient to hold the employer liable in tort.

[3] Absent special circumstances, the employer bears a duty under the principle of good faith to give consideration, within the scope compatible with the exercise of its own right of business direction and right to issue business orders, so that the employee, through the entering into of an employment contract with the employer, may realize his or her own personality by pursuing genuine personal development through the provision of labor. Accordingly, where the employer, without justifiable reason and against the will of the employee, continuously refuses to accept the employee's provision of labor, this constitutes an infringement of the employee's personal legal interests as described above, and the employer is liable to compensate for the emotional distress suffered by the employee as a result thereof.

[Plaintiff, Appellant]

[Defendant, Appellee] Samick Musical Instruments Co., Ltd. (Attorney Oh Byung-seon, Counsel for the Defendant)

[Judgment Below]

Seoul High Court Decision 94Na35291 dated December 23, 1994

[Order]

The judgment below is reversed, and the case is remanded to the Seoul High Court.

[Reasoning]

We examine the grounds of appeal.

(1)
In general, where a disadvantageous disposition imposed by an employer on an employee, such as dismissal, is determined to be invalid because it is unjust, that fact alone does not immediately mean that the dismissal or other disadvantageous disposition constitutes a tort. However, where the employer has no grounds whatsoever for disciplinary dismissal or the like against the employee but, with the intention of solely driving the employee out of the workplace, deliberately puts forward some nominal ground for dismissal and resorts to the means of disciplinary action to impose a disadvantageous disposition such as dismissal, or where it is objectively clear that some fact relied upon as the ground for dismissal or the like does not fall under the grounds for disciplinary action prescribed in the rules of employment or the like, or cannot be used as a ground for disciplinary action, and the employer, despite being able to easily recognize such circumstances with even a little care, nevertheless imposed the disadvantageous disposition such as disciplinary dismissal on that ground—that is, in cases where intent or negligence on the part of the employer with respect to the unjust dismissal or the like is recognized—a tort is established, and the employer is liable to compensate for the mental suffering thereby incurred by the employee (see this Court's Decisions 92Da43586 rendered October 12, 1993; 93Da11463 rendered December 21, 1993; 91Da36192 rendered December 24, 1993; and 95Da11696 rendered February 27, 1996).

However, even if the disciplinary measure imposed on an employee is found, as a result, to have deviated from or abused the discretion afforded to the employer such that the disciplinary disposition is held invalid due to abuse of the right to discipline, if this merely resulted from the disciplinary committee members, who are not legal experts, having misinterpreted the relevant statutes concerning the severity of discipline, then the disciplinary committee members who erred in determining the severity of discipline cannot be found to have been negligent in a manner that would give rise to tort liability (see this Court's Decision 94Da22125 rendered February 14, 1995). Likewise, if it is recognized that, in light of the objective circumstances at the time the disadvantageous disposition such as dismissal was imposed on the employee, the degree of the employee's misconduct, and the circumstances leading to the imposition of the disadvantageous disposition on the employee, it was not unreasonable for the employer to have determined that the employee's misconduct fell under the grounds for a disadvantageous disposition such as dismissal prescribed in the rules of employment or the collective agreement, and if, in addition, the disadvantageous disposition in question was imposed following the prescribed lawful procedures, then the employer must be deemed to have fulfilled the duty of care required in imposing the disadvantageous disposition such as dismissal on the employee. Accordingly, even if the disadvantageous disposition such as dismissal in question is subsequently determined by a court to be invalid, it cannot be said that there was intent or negligence sufficient to give rise to tort liability (see the above Decision 95Da11696 rendered February 27, 1996).

Turning back to examine the instant case, the record shows the following facts: the Defendant referred the Plaintiffs to the disciplinary committee on the ground that the Plaintiffs had led an illegal strike from June 1, 1991 to June 9, 1991; the Defendant lawfully notified the Plaintiffs of the convening of the disciplinary committee in accordance with the provisions of the collective agreement and the like; after hearing the Plaintiffs' statements at the disciplinary committee held on July 11 of that year, the Defendant, in accordance with the decision of the said disciplinary committee, imposed disciplinary dismissal on the Plaintiffs on that same day; the Plaintiffs requested a reexamination on July 15 of that year pursuant to the provisions of the Defendant company's collective agreement and the like, but the disciplinary committee held on July 26 of that year again confirmed that the disciplinary dismissal of the Plaintiffs was justified; the Plaintiffs, dissatisfied with this, filed a lawsuit seeking, among other things, confirmation of invalidity of the dismissal, asserting that on June 9, 1991 there had been a so-called exemption-from-liability agreement whereby it was agreed that no civil or criminal liability whatsoever, including the disciplinary matter, would be pursued against the Plaintiffs in connection with the aforementioned strike; the court of first instance accepted the Plaintiffs' assertion regarding the said exemption-from-liability agreement, but the Defendant appealed, and in the appellate proceedings the court of second instance held that, absent special circumstances, the disciplinary dismissal of the Plaintiffs had justifiable grounds, rejecting the Plaintiffs' assertion regarding the said exemption-from-liability agreement; however, the court of second instance found as fact that on June 9, 1991 the Defendant company's representative director had promised that the disciplinary matter concerning the five members of the emergency countermeasures committee representing the demonstrators, including the Plaintiffs, would be held in abeyance until the wage negotiations were concluded and a new executive body was established, and that the utmost leniency would thereafter be shown; the court of second instance further rejected the Defendant's assertion that the promise to show the Plaintiffs the utmost leniency had been fulfilled by dismissing only the minimum number of personnel, and, taking into account the Plaintiffs' subsequent conduct and other factors, held that the disciplinary dismissal of the Plaintiffs was invalid as being in violation of the said promise to show the utmost leniency; the Defendant again appealed, dissatisfied with this, and in the appellate proceedings that followed, the Supreme Court, on September 28, 1993, held that the above factual findings of the court of second instance were justified and dismissed the Defendant's appeal.

Accordingly, it follows that the disciplinary dismissal of the Plaintiffs originally had justifiable grounds and was carried out lawfully in accordance with the provisions of the collective agreement and the like as to procedure; it is merely the case that the members of the disciplinary committee, in determining the severity of the discipline to be imposed on the Plaintiffs, misinterpreted the meaning of the promise to show the utmost leniency, resulting in an erroneous determination of the severity of discipline that was held invalid; and it cannot be said that the disciplinary committee members who erred in determining the severity of discipline, or the Defendant who acted in accordance with their decision, had intent or negligence sufficient to give rise to tort liability.

If so, although the reasoning set forth by the court below was not appropriate, its conclusion that the disciplinary dismissal of the Plaintiffs cannot constitute a tort is, as a result, justified. Therefore, the argument disputing this point is without merit.

(2) An employee who continuously provides labor pursuant to an employment contract is a person possessing dignity and worth as a human being, and since the employee invests his or her entire personality in the employer's workplace, the employee's provision of labor in the employment relationship cannot be separated from the employee's own personality. On the other hand, it cannot be denied that an employee's provision of labor pursuant to an employment contract is not aimed merely at earning wages; rather, through labor, the employee achieves self-realization and further seeks to develop his or her true personality by acquiring skills, maintaining and improving abilities, and forming amicable human relationships, thereby realizing his or her own personality (see the above Decision 93Da11463 rendered December 21, 1993). Therefore, absent special circumstances, an employer bears a duty under the principle of good faith to take care, through the conclusion of an employment contract with the employee, to enable the employee, within a scope that is reconcilable with the exercise of the employer's right to direct and order work, to achieve self-realization by developing his or her true personality through the provision of labor as described above. Accordingly, where an employer, against the will of the employee and without justifiable grounds, continuously refuses to accept the employee's provision of labor, this constitutes an infringement of the employee's personal legal interest as described above, and the employer is liable to compensate for the mental suffering thereby incurred by the employee (see this Court's Decisions 79Da1883 rendered January 15, 1980, and 92Da893 rendered February 8, 1994).

According to the record, as found by the court below, although a judgment holding invalid the Defendant's dismissal disposition against the Plaintiffs was rendered and became final, the Defendant has paid the Plaintiffs only the amount ordered to be paid in that judgment, and, despite the Plaintiffs' demand for reinstatement, has not reinstated the Plaintiffs and continues to refuse to accept the Plaintiffs' provision of labor. In this case, there is no proof whatsoever of any special circumstances that would justify the Defendant's refusal to accept the Plaintiffs' provision of labor; accordingly, the Defendant's continued refusal to accept the Plaintiffs' provision of labor despite the Plaintiffs' demand for reinstatement, and its failure to engage the Plaintiffs in actual work, constitutes an infringement of the Plaintiffs' personal legal interest as described above, and it is clear, in light of common experience, that the Plaintiffs must have suffered considerable mental distress as a result.

Nevertheless, contrary to this, the court below, for the reasons set forth in its judgment, rejected the Plaintiffs' claim for consolation money arising from the Defendant's refusal to reinstate them. This constitutes an error of law affecting the judgment by misapprehending the legal principles concerning the establishment of tort liability arising from refusal to reinstate, and on this point the judgment below cannot be upheld as it stands. The argument is well-founded on this point.

(3) Therefore, the judgment below is reversed and the case is remanded, and it is so decided, with the unanimous consent of the participating Justices, in accordance with the Order.
