This case addressed whether a traffic accident suffered by a worker while commuting to a construction site in a vehicle provided by a staffing agency (인력업체) qualified as an industrial accident (업무상 재해). The Korean Supreme Court reversed the lower court's decision, ruling that the worker's method and route of commuting were effectively under the employer's control and management. Key factors included the remote location of the worksite where public transportation was impractical, the employer's provision of a vehicle and transportation allowance, and the absence of any other reasonable commuting option for the worker.

Key takeaways
  • CaseA construction worker was injured in a traffic accident while commuting to a remote worksite using a vehicle arranged by a staffing agency.
  • OutcomeThe Supreme Court ruled the accident was an industrial accident because the employer effectively controlled the commuting method due to the lack of alternative transportation options.
  • LessonEmployers who arrange or fund employee transportation to remote worksites may be held liable for commuting accidents as industrial accidents, especially when no reasonable alternative commuting method exists.
Issues
  • Whether an accident occurring during a worker's commute qualifies as an industrial accident (업무상 재해)
  • Whether the commuting process was under the employer's control and management (지배·관리)
Key reasoning

Under Korean labor law, accidents occurring during a worker's commute are generally not automatically classified as industrial accidents, since commuting is typically considered a personal matter outside the employer's direct control. However, the Supreme Court held that when a worker uses a vehicle functionally equivalent to transportation provided by the employer, and has no other reasonable means of commuting, the commute itself falls under the employer's substantial control and management. In this case, the remote worksite location made public transit impractical, and the employer had arranged for the vehicle and covered transportation costs, effectively leaving the worker no realistic alternative. Given these circumstances, the accident during the commute was deemed to have occurred within the scope of the worker's employment, warranting industrial accident compensation.

Summary of Decision (English, AI translation)

[1] With respect to accidents occurring during commuting to and from work, this includes cases where a worker uses transportation provided by the employer or is made to use transportation equivalent thereto by the employer. It also includes cases where, although the method and route of commuting appear on their face to have been left to the worker's discretion, the worker actually performed work duties during the commute, or dealt with urgent work-related matters before or after the ordinary commuting hours, or, due to the nature of the work or the particular characteristics of the workplace, had no real choice as to the method of commuting, such that it cannot be said that the choice was genuinely reserved to the worker, and where it is determined that the commute is, in social norms, in an extremely close and inseparable relationship with the work. In such cases, there exists a direct and close internal connection between the accident occurring during the commute and the work, and the accident may be deemed to have occurred due to work-related causes under the employer's control and management.

[2] In a case where a worker suffered a traffic accident while driving a vehicle provided by a manpower agency (인력업체) on his way to work at a construction site of a construction company, the court held as follows: the vehicle in question could be regarded as equivalent to transportation provided by the construction company; even though the worker did not commute to the same construction site every day but worked while moving between different construction sites, this could not be considered a ground for denying the construction company's control and management over the commuting process on the day of the accident; and, in light of circumstances such as the fact that the worker had no reasonable expectation of any alternative choice other than commuting by using the said vehicle, it could not be said that the choice of the method and route of commuting at the time of the accident was in fact reserved to the worker, and there was sufficient room to find that the commute was under the objective control and management of the construction company, the employer.

[Defendant, Appellee] Korea Workers' Compensation & Welfare Service
[Judgment Below] Seoul High Court Decision 2009Nu14400 rendered on December 1, 2009

[Order]

The judgment below is reversed, and the case is remanded to the Seoul High Court.

[Reasoning]

The grounds of appeal are examined.

Under Article 5, Item 1 of the former Industrial Accident Compensation Insurance Act (산업재해보상보험법, before its amendment by Act No. 8694 on December 14, 2007; hereinafter the "Industrial Accident Insurance Act"), "occupational accident" refers to an accident that arises, based on the employment contract between the employee and the employer, in the course of performing the relevant work duties or the ordinary activities incidental thereto, under the employer's control and management, and that is attributable to such duties. Generally, even though an employee's commuting to and from work is closely and inseparably related to the duty of providing labor, as long as the choice of the method and route of commuting is left to the employee, an accident occurring during commuting cannot be deemed an occupational accident merely because the method and route chosen by the employee were the ordinary ones. However, where the employee's commuting process can be regarded as being under the employer's control and management, an accident occurring during commuting may also constitute an occupational accident (see Supreme Court en banc Decision 2005Du12572 rendered on September 28, 2007, etc.).

With respect to accidents occurring during commuting, this includes cases where the employee uses transportation provided by the employer, or where the employer causes the employee to use transportation equivalent thereto (see Supreme Court Decision 2004Du121 rendered on April 23, 2004). Furthermore, even in cases where, on the surface, it appears that the choice of the method and route of commuting has been left to the employee, if the employee performed work duties during the commute, or if, due to urgent business matters related to work before or after the ordinary commuting hours, or due to the nature of the duties or the peculiar characteristics of the workplace, there was in fact no room for choice in the method of commuting, such that it cannot be said that the choice was actually left to the employee, and it is determined that, in social terms, the commuting is closely and inseparably related to the work to a very tight degree (see Supreme Court Decisions 2002Du10124 rendered on November 25, 2004; 2002Du12298 rendered on November 25, 2004; 2005Du4458 rendered on September 29, 2005; 2006Du2022 rendered on March 27, 2008; and 2006Du15660 rendered on April 24, 2008), there exists a direct and close internal connection between the accident occurring during such commuting and the work, and the accident may be regarded as having occurred due to work-related causes under the employer's control and management.

According to the reasoning of the judgment of the first instance court, as cited by the court below, and the judgment below itself, the first instance court, comprehensively considering the evidence it adopted, found as follows: Girin Construction, a subcontractor of Hanwha Construction Co., Ltd., subcontracted and constructed part of the new construction work of the Gapyeong Training Center located in Gapyeong-gun, Gyeonggi-do, and agreed to receive skilled manpower through a labor placement agency; the labor placement agency was to arrange transportation for the daily workers' commuting, and Girin Construction agreed to pay an additional KRW 40,000 per day as transportation expenses in addition to the daily wages of the daily workers; from around early June 2007, the Plaintiff, together with other workers, gathered at around 5:00 a.m. at the office of the labor placement agency and commuted to the new construction site using the van at issue in this case ("this van") provided by the agency; the Plaintiff did not commute to the construction site every day, but worked 8 days in October 2007 and 5 days in November 2007, and also worked from time to time at construction sites of other companies; and on November 14, 2007, at around 6:15 a.m., the Plaintiff was involved in the traffic accident at issue in this case while driving this van to work. Based on these findings, the court below determined that the accident in this case did not constitute an occupational accident, on the grounds that Girin Construction did not directly provide the vehicle necessary for the long-distance commute but had the labor placement agency provide the transportation, such as the vehicle, based on its own judgment, and that the Plaintiff had received no instructions or control whatsoever from Girin Construction regarding the method and route of commuting.

However, according to the facts lawfully established by the court below and the record, the following circumstances may be identified: the Plaintiff, who resided in Yeongdeungpo-gu, Seoul, had to commute to the construction site in Gapyeong-gun, Gyeonggi-do by 7:00 a.m., and it appears that it was difficult to commute using public transportation such as buses within the commuting time, such that the Plaintiff had no choice but to use this van; it appears that Girin Construction, well aware of these circumstances, instead of directly providing transportation for the daily workers, paid additional transportation expenses to the labor placement agency and had it provide this van as the means of transportation for the workers' commuting; and it appears that, at the time of the accident, the Plaintiff was driving this van, having picked up daily workers and departed from the office of the labor placement agency located in Yeongdeungpo-gu, Seoul, heading toward the construction site at issue, when the traffic accident at issue occurred.

In light of the legal principles set forth above, considering the facts found by the court below together with each of the above circumstances, this van may be regarded as equivalent to transportation provided by Girin Construction. Even though the Plaintiff did not commute to Girin Construction's construction site at issue every day, but worked while changing construction sites from time to time, this is merely attributable to the nature of the daily employment contract, and it is difficult to regard this as a ground for denying Girin Construction's control and management over the commuting process on the day of the accident at issue. There is substantial room to find that the Plaintiff had no reasonable possibility of choice other than commuting using this van. If that is the case, then, absent special circumstances such as the Plaintiff having deviated from a reasonable route while driving this van to the construction site at issue, it cannot be said that the choice of the method and route of commuting was in fact left to the Plaintiff at the time of the accident at issue, and there is sufficient room to find that the commute was under the objective control and management of Girin Construction, the employer.

Nevertheless, the court below, without fully examining whether the exceptional circumstances necessary for determining whether an accident occurring during commuting constitutes an occupational accident, as discussed above, existed, concluded merely on the basis of the circumstances stated in its reasoning that the accident in this case was not an occupational accident. This constitutes an error of law in misunderstanding the legal principles concerning occupational accidents under the Industrial Accident Insurance Act and in failing to conduct the examination necessary therefor.

The argument in the grounds of appeal pointing this out is well-founded.

Therefore, the judgment below is reversed, and the case is remanded to the court below for further examination and determination, and it is so decided as stated in the Order by the unanimous opinion of the Justices participating in the decision.

Justice Yang Chang-soo (Presiding Justice), Justice Yang Sung-tae, Justice Kim Ji-hyung (Justice in Charge), Justice Jeon Su-an
