The union president of a taxi company refused management's request and instead incited union members to collectively use their annual paid leave (연차휴가), causing significant financial loss to the company. The company subsequently dismissed the union president, and the Korean Supreme Court (대법원) ruled that this collective leave-taking exceeded the bounds of a legitimate labor dispute (쟁의행위), making the dismissal lawful rather than an unfair labor practice (부당노동행위).

Key takeaways
  • CaseA taxi company union president, in defiance of the company's request, incited union members to collectively take annual paid leave, causing major financial losses to the company.
  • OutcomeThe Supreme Court ruled that inciting collective annual leave use without following proper legal procedures exceeded the scope of a legitimate labor dispute, making the dismissal lawful.
  • LessonUnion activities must stay within legally proper procedures and limits — exceeding those boundaries can justify disciplinary action and forfeit protection against unfair labor practice claims.
Issues
  • Criteria for determining whether an unfair labor practice (부당노동행위) has occurred
  • The scope and limits of legitimate 'rule-compliance' style labor actions (준법투쟁) as a form of lawful dispute conduct
Key reasoning

Even if an employer's anti-union sentiment can be inferred from the circumstances, a dismissal does not constitute an unfair labor practice (부당노동행위) if there is a legitimate, independent ground for dismissal. Here, the union president's incitement of members to collectively use annual leave, without following proper legal procedures for a labor dispute, went beyond the scope of legitimate union activity. Because this conduct exceeded the protected boundaries of a lawful strike or job action, it constituted valid grounds for dismissal. Therefore, the company's decision to dismiss the union president was justified and not tainted by anti-union motive.

Summary of Decision (English, AI translation)

[1] Where it is recognized that, contrary to the grounds for dismissal ostensibly asserted by the employer, the employer has in fact dismissed an employee on account of the employee's legitimate trade union activities, such dismissal must be regarded as an unfair labor practice. Whether the employee's legitimate trade union activities constituted the substantial ground for dismissal is to be determined comprehensively by comparing and examining the grounds for dismissal asserted by the employer, the content of the legitimate acts performed by the employee for trade union affairs, the relationship between the employer and the trade union, the timing of the dismissal, whether there was disparity in sanctions imposed on union members as compared to non-union members in similar cases, whether the dismissal procedures were observed, and other circumstances from which the existence of an intent to commit an unfair labor practice may be inferred. Furthermore, where a dismissal has been made on legitimate grounds, even if there are traces indicating that the employer viewed the employee's union activities with displeasure, or even if an anti-union intent on the part of the employer may be inferred, the ground for dismissal in question cannot simply be regarded as a mere pretext on its face, and therefore such dismissal does not constitute an unfair labor practice.

[2] Where the president of a taxi company's trade union incited employees to collectively use annual leave with the intent of realizing demands that had in fact been rejected by the company and of obstructing the company's normal business operations, and as a result the employees collectively used annual leave and refused to provide labor, such conduct constitutes an industrial action in the form of a so-called "law-abiding struggle" (compliance-based industrial action) conducted for the purposes of a labor dispute. In a case where it is found that, in carrying out such conduct, the union did not go through legitimate procedures under the Labor Dispute Adjustment Act (노동쟁의조정법), such as obtaining a union resolution or filing a report of the occurrence of a labor dispute, and that this caused the company unforeseen obstruction of its business and caused considerable inconvenience to taxi users, such a law-abiding struggle exceeds the bounds of a legitimate industrial action, and the union president's act of inciting it constitutes grounds for dismissal as stipulated in the collective bargaining agreement. The court held that the dismissal disposition based on this ground was a legitimate exercise of personnel authority and did not constitute an unfair labor practice.

[Judgment Below]

Seoul High Court Decision 95Gu16969, decided December 1, 1995

[Order]

The judgment below is reversed, and the case is remanded to the Seoul High Court.

[Reasoning]

The grounds of appeal are examined.

(1)
Where it is recognized that, contrary to the reason for dismissal formally asserted by the employer, the employer has in substance dismissed the worker on the ground of the worker's legitimate trade union activities, such dismissal must be deemed an unfair labor practice (see Supreme Court Decision 92Nu13035, decided January 15, 1993; Decision 93Nu4595, decided December 10, 1993; Decision 95Nu6151, decided April 23, 1996, etc.). Here, whether the worker's legitimate trade union activities constituted the substantial reason for dismissal must be determined comprehensively by comparing and examining the reason for dismissal asserted by the employer, the content of the legitimate acts performed by the worker for trade union affairs, the relationship between the employer and the trade union, the timing of the dismissal, whether there was any disparity in sanctions between union members and non-union members in similar cases, whether the dismissal procedures were complied with, and other circumstances from which the existence of intent to commit an unfair labor practice may be inferred (see the above Decisions 92Nu13035 and 93Nu4595, and Supreme Court Decision 91Nu9572, decided February 28, 1992, etc.).

Furthermore, in a case where there exists a legitimate ground for dismissal and the dismissal was made on that ground, even if there are traces that the employer viewed the worker's union activities with displeasure, or even if an anti-union intent on the part of the employer may be presumed, the reason for dismissal in question cannot be regarded as a mere pretext, and therefore such dismissal cannot constitute an unfair labor practice (see Supreme Court Decision 87Nu818, decided February 9, 1988; Decision 87Daka3196, decided March 14, 1989; Decision 89Nu8217, decided August 10, 1990; Decision 89Nu6792, decided October 23, 1990; Decision 94Nu3001, decided December 23, 1994; and the above Decision 95Nu6151, etc.).

(2) Turning to the present case, the record reveals the following facts: the Intervenor for the Defendant (hereinafter simply "the Intervenor") joined the Plaintiff company as a driver on November 10, 1987 and worked there; from October 10, 1991 he served as chairman of the Plaintiff company's labor union; from March 19, 1993 to November 30 of the same year he served as branch chief of the Daejeon City Branch of the National Federation of Taxi Workers' Unions; and on June 24, 1994 he was re-elected as chairman of the Plaintiff company's labor union and continued to act in that capacity. While serving in this capacity, on November 16, 1994, he requested the Plaintiff to consult on the handling of the day-laborer issue; on December 2 of the same year, he requested consultation on matters such as the hiring of car washers; and on December 9 of the same year, while demanding payment of annual leave allowance to Yun Un-yeong and bonus payment to An Byeong-rok, he requested that the Plaintiff remedy the situation whereby, although three persons including Yun Un-yeong had not obtained the taxi driving qualification and thus had not been formally appointed, the Plaintiff had deliberately delayed formal appointment for a considerable period, causing disadvantage to the workers concerned. He also demanded consultation on matters such as the distribution of taxi advertising revenue and the increase of fixed allowances. When the Plaintiff refused these requests by the union on the ground that there was no precedent for such demands and that the Plaintiff could not accommodate them, the Intervenor, despite there being no particular circumstance calling for publicizing or educating union members on the use of annual leave, in early January 1995 took the wage ledger kept by the Plaintiff without authorization, calculated the annual leave days of union members based thereon, and at a meeting of union members on January 7 of the same year informed the attending union members individually of their annual leave days, thereby inciting them to use their leave. On the 11th of the same month, using a leave application form he himself had arbitrarily created, he notified the Plaintiff of a list of ten union members intending to take annual leave. Although the Plaintiff, on the 17th of the same month, notified the Intervenor that instigating union members to use annual leave collectively and simultaneously as a form of struggle constituted an illegal industrial action and demanded that this be withdrawn, the Intervenor, on the 18th of the same month, just before the Lunar New Year holiday, without going through any resolution of the labor union, posted a notice on the union bulletin board addressed not only to union members but to all employees of the Plaintiff company including non-union members, including the following statement: "Fellow workers of Seungma Yukwoon [transliteration of company name], let us use our annual leave. Under Article 48 of the Labor Standards Act (근로기준법), the employer must grant annual leave to workers, and where the employer, in violation thereof, fails to grant the statutory leave to a worker who has requested annual leave, the employer shall, pursuant to the Labor Standards Act, be subject to imprisonment for not more than two years or a fine not exceeding ten million won." Through this notice, the Intervenor incited the workers to use annual leave collectively as a de facto matter. As a result, on the 31st of the same month, which was the Lunar New Year's Day, a total of 38 workers — 19 union members and 19 non-union members — refused, in substance, to provide labor on the pretext of using annual leave and similar reasons, and on the following day, a total of 45 workers — 19 union members and 26 non-union members — refused to provide labor. As a result, the taxi operation rate of the Plaintiff company, which operates a total of 54 taxis, fell to a very low level of only 26% on the morning of the Lunar New Year's Day, 43% in the afternoon of that day, 20% on the morning of the following day, and 52% in the afternoon of that day, far below the operation rate of other competing companies of similar size during the same Lunar New Year holiday period and far below the Plaintiff's own operation rate during the Lunar New Year holiday period in an average year. As a consequence, the Plaintiff company was unable to conduct normal business operations and suffered a business loss of 5,220,000 won, and moreover, since taxis, being a means of public transportation, are in high demand during the Lunar New Year holiday, the suspension of taxi operation caused considerable inconvenience to passengers wishing to use taxis. Meanwhile, the wage agreement concluded between the Plaintiff company and the labor union provides that annual paid leave may be substituted with an allowance payment by agreement between the parties; accordingly, given the nature of the transportation business, in which normal taxi operation becomes impossible if drivers use their leave all at once, the Plaintiff company's usual practice was for drivers not to use annual leave but instead to receive, around March of the following year, an allowance corresponding to the number of annual leave days accrued based on the previous year's work record after acquiring the right to annual leave, while allowing drivers who wished to use leave prior to the March allowance payment, or who wished to use leave after returning an allowance already received, to do so. It can further be recognized that, after being re-elected as chairman, up until around the end of December 1994, the Intervenor requested consultation with the Plaintiff on the various matters set out above, but never once demanded remedy from the Plaintiff regarding the use of annual leave or raised it as an issue for consultation.

If these are the facts, then the Intervenor's conduct as described above cannot possibly be regarded, as he asserts, as merely informing workers of, or conducting education regarding, annual leave as part of trade union activities. Rather, it is clear that, in substance, with the intent of forcing through demands that had previously been raised with the Plaintiff but rejected by the Plaintiff, the Intervenor incited workers to use annual leave collectively with the intention of obstructing the Plaintiff's normal business operations. Accordingly, the workers' use of annual leave and refusal to provide labor that resulted therefrom constitutes what is called a "disputative work-to-rule action" (쟁의적 준법투쟁), which amounts to an industrial action. Even though the Intervenor did not specify a particular date, such as the Lunar New Year holiday period, when causing workers to collectively use annual leave in this manner, this does not alter the conclusion. In light of the fact that the Intervenor, in engaging in such conduct, did not go through a resolution of the labor union or a report of the occurrence of a labor dispute, or otherwise follow the lawful procedures under the Labor Dispute Adjustment Act (노동쟁의조정법), and that this conduct caused unforeseen disruption to the Plaintiff company's business and considerable inconvenience to taxi users, such work-to-rule action must be said to have exceeded the limits of a legitimate industrial action. Accordingly, the Plaintiff's act of referring the Intervenor's conduct to the disciplinary committee on the ground that it fell under "inciting or instigating an industrial action in violation of law," a ground for dismissal under Article 22, Paragraph 1, Item 8 of the collective agreement, and dismissing the Intervenor after undergoing the lawful dismissal procedure, constitutes a legitimate exercise of personnel authority. Even if, as found by the court below, the Intervenor had engaged in union activities, it cannot be said that the Plaintiff, in substance detesting the Intervenor's union activities and intending to exclude him from the workplace, dismissed the Intervenor merely using the above-described conduct of the Intervenor as a surface pretext; therefore, this cannot be deemed an unfair labor practice.

The court below erred, contrary to the above, in regarding the Intervenor's conduct as described above as merely conducting education on the use of annual leave and making workers aware thereof, characterizing it as legitimate union activity, and further determining that the dismissal of the Intervenor constituted an unfair labor practice. In so doing, the court below committed an error affecting the judgment by violating the rules of evidence and thereby making an erroneous finding of fact, or by misunderstanding the legal principles concerning disputative work-to-rule actions and unfair labor practices. The argument is well-founded.

(3) Accordingly, the judgment below is reversed and the case is remanded to the court below, all participating Justices concurring, as set forth in the Order.

Justice Jeong Gwi-ho (Presiding Justice), Kim Seok-su (Justice in charge), Lee Im-su
