This case addressed whether a golf caddie qualified as a 'worker' under the Labor Standards Act (근로기준법) for purposes of industrial accident compensation. The Supreme Court held that the caddie was not an employee because she had no employment contract with the golf course, received service fees directly from customers, and was not subject to concrete supervision or direction by the golf course. The Court reversed the lower court's finding that she was a worker, making it more difficult for her bereaved family to receive industrial accident survivor benefits (유족급여).

Key takeaways
  • CaseA golf caddie died, and her surviving family sought industrial accident survivor benefits, asserting she was an employee of the golf course.
  • OutcomeThe Supreme Court reversed the lower court's ruling and held that the caddie was not a 'worker' under the Labor Standards Act due to the absence of a real employment contract, direct wage payment, and specific supervisory control by the golf course.
  • LessonWhether someone qualifies as an employee depends on actual working conditions—supervision, fixed hours/location, and wage structure—rather than job title or physical presence at the workplace.
Issues
  • Whether a golf caddie qualifies as a 'worker' under the Labor Standards Act (근로기준법)
  • The specific criteria for determining a subordinate (employment) relationship for purposes of worker status
Key reasoning

The Court reaffirmed that worker status must be determined based on the actual substance of the working relationship rather than the formal type of contract. Key factors include whether the employer exercises specific direction and supervision over the work, whether the worker's hours and workplace are dictated by the employer, whether the compensation is paid as remuneration for labor itself, and whether the working relationship is continuous and exclusive. Applying these criteria, the Court found that the caddie set her own schedule to some extent, was paid service fees directly by golfers rather than a fixed wage from the golf course, and was not under the golf course's direct command and control. Because these indicia of subordination were largely absent, the Court concluded she did not meet the legal definition of an employee under the Labor Standards Act.

Summary of Decision (English, AI translation)

[1] In determining whether a person constitutes a worker under the Labor Standards Act (근로기준법), regardless of whether the contract is a civil-law employment contract or a contract for work under the Civil Act (민법), the determination must be made according to whether, in substance, the worker provided labor to the employer in a subordinate relationship for the purpose of wages at a business or workplace. In determining whether such a subordinate relationship exists, the following matters must be comprehensively considered: whether the content of the work performed by the worker is determined by the employer and is subject to rules of employment, service regulations, personnel regulations, etc., and whether, in the course of performing the work, the worker is subject to specific and direct direction and supervision by the employer; whether working hours and place of work are designated by the employer and whether the worker is bound thereby; whether the work is substitutable, such as whether the worker himself may hire a third party to perform the work in his stead; the ownership relationship of equipment, raw materials, work tools, etc.; matters concerning remuneration, such as whether the remuneration has the character of consideration for the labor itself, whether a base pay or fixed wage is set, and whether income tax is withheld at source; the continuity of the labor-provision relationship and the existence and degree of exclusive affiliation with the employer; whether the worker's status as an employee is recognized under other statutes, such as those relating to the social security system; and the economic and social conditions of both parties.

[2] A case holding that a caddie working at a golf course cannot be regarded as a worker under Article 14 of the Labor Standards Act (근로기준법) who provides labor for the purpose of wages under a relationship of employment and subordination to the golf course facility operator, in light of the following circumstances comprehensively considered: ① the caddie has not entered into any labor-supply contract, such as a labor contract or employment contract, with the golf course facility operator; ② the caddie's game-assistance work is not originally a service that the golf course must necessarily provide to visiting customers, and thus the provision of services by the caddie is not indispensable to the operation of the golf course facilities; ③ the caddie receives only a service fee called a "caddie fee" directly from the visiting customer as compensation for performing the game-assistance work for the customer, and receives no money or goods whatsoever from the golf course facility operator; ④ although there is an order (turn) assigned for providing services at the golf course, there is no fixed working hours, so that the caddie may leave the golf course facility immediately after completing her provision of services; ⑤ even if the caddie becomes unable to provide services in her scheduled turn due to a decrease in the number of visiting customers or other reasons not attributable to her, the golf course facility operator pays no money or goods corresponding to the caddie fee, nor any suspension allowance as prescribed under the Labor Standards Act; ⑥ the caddie is not subject to specific and direct direction and supervision by the golf course facility operator in the course of performing work for visiting customers; ⑦ the caddie does not pay labor income tax; and ⑧ although the caddie suffers de facto disadvantages, such as being assigned to the last position in the order of service provision, for negligence in performing game-assistance work for visiting customers, the golf course facility operator does not otherwise impose disciplinary action on the caddie on grounds such as violation of the company's service order.

[Judgment Below] Seoul High Court Decision 94Gu17255 rendered on August 3, 1995

[Order]

The judgment below is reversed, and the case is remanded to the Seoul High Court.

[Reasoning]

The grounds of appeal submitted by the Defendant's litigation representative are examined (as to the supplementary grounds of appeal submitted by the Intervenor for the Defendant's litigation representative after the expiration of the period for submitting the grounds of appeal, they are examined only to the extent that they supplement the grounds of appeal).

1. In determining whether a person constitutes a worker under the Labor Standards Act (근로기준법), regardless of whether the contract is, in form, an employment contract under the Civil Act (민법) or a service (contracting) contract, the determination must be made according to whether, in substance, the worker provided labor to the employer in a subordinate relationship for the purpose of wages at the business or workplace (see this Court's Decisions 91Da24250 rendered on December 13, 1991; 94Da22859 rendered on December 9, 1994; 95Nu2050 rendered on December 22, 1995; and 95Da20348 rendered on April 26, 1996, among others). In determining whether such a subordinate relationship exists, the following factors must be comprehensively considered: whether the content of the work performed by the worker is determined by the employer and is subject to the rules of employment, service regulations, personnel regulations, etc.; whether the worker is subject to specific and direct direction and supervision by the employer in the course of performing the work; whether the working hours and place of work are designated by the employer and whether the worker is bound thereby; whether there is substitutability of work, such as the worker him/herself hiring a third party to perform the work on his/her behalf; the ownership of equipment, raw materials, working tools, etc.; matters concerning remuneration, such as whether the remuneration has the character of consideration for the labor itself, whether a basic or fixed wage is set, and whether income tax on wages and salaries is withheld at source; the continuity of the labor-providing relationship and the existence and degree of exclusive affiliation with the employer; whether the worker's status as an employee is recognized under other statutes such as those concerning the social security system; and the economic and social conditions of both parties (see the above Decisions 94Da22859 and 95Da20348).

2. As found by the court below, the deceased, the non-party, worked as a caddie at the Yangju Country Club golf course located in Namyangju-gun, Gyeonggi-do, operated by the Intervenor for the Defendant (hereinafter simply referred to as "the Intervenor") from September 3, 1993, and on the 29th of the same month, at around 11:30, while assisting a visiting customer in play near the 18th hole of the said golf course, suddenly collapsed and died shortly thereafter while being transported to the hospital. As to whether the deceased non-party was, as determined by the court below, a worker who provided labor to the Intervenor for the purpose of wages, the record shows the following: ① caddies working at the said golf course have not entered into any labor supply contract, such as an employment contract or a hiring contract, with the Intervenor, who is the operator of the golf course facilities (although the caddie master, an employee of the Intervenor who manages the caddies, recruits caddies to work at the said golf course, this is merely to secure in advance caddies who will provide the service of assisting visiting customers in their play, for the convenience of customers using the golf course, and it cannot be said that the caddies are thereby employed as employees of the Intervenor); ② the caddie's work consists of pairing up with a particular visiting customer using the golf course facilities to assist that customer's play, carrying the golf bag containing the golf clubs, taking out clubs at the customer's request, repairing damage to the turf caused when the customer swings a club, and otherwise performing, on the customer's behalf, tasks that the customer would otherwise have to do him/herself; such play-assistance service is not originally a service that the golf course side is obligated to provide to visiting customers, and therefore the provision of such service by caddies cannot be said to be indispensable to the operation of the golf course facilities; ③ caddies receive, as consideration for performing the above play-assistance work, only a service charge called a "caddie fee" directly from the visiting customer, and receive no money or goods whatsoever from the golf course facility operator such as the Intervenor; while it is customary for visiting customers generally to pay the caddie fee recommended by the golf course business association, the amount of that service charge is in principle determined at the customer's discretion, so that the service charge paid to caddies providing identical services is not necessarily uniform among customers, and the golf course facility operator, such as the Intervenor, does not determine the amount of that service charge; in light of these circumstances, it cannot be said that the Intervenor bears an obligation to pay the caddie fee (and for that reason, even where a caddie fails to receive the caddie fee, which is consideration for the service provided, from the visiting customer, the caddie cannot claim payment of the caddie fee from the golf course side); ④ although there is an order (turn) assigned to caddies for providing their services at the said golf course (this assignment of order is not so much an exercise of the Intervenor's right of direction and supervision as it is merely a means of giving equal opportunity among the caddies who provide services to visiting customers using the golf course facilities), there is no fixed working hours, so that a caddie may leave the golf course facility immediately after completing the provision of his/her service (and because there is no fixed working hours in this way, the time at which a caddie completes providing his/her service is inevitably determined solely by the pace of play of the visiting customer); ⑤ even if a caddie is unable to provide services in his/her scheduled turn due to a decrease in the number of visiting customers or other reasons not attributable to the caddie, the Intervenor does not pay any money or goods corresponding to the caddie fee, nor any leave-of-absence allowance as prescribed by the Labor Standards Act; ⑥ in the course of performing work for visiting customers, caddies are not subject to specific and direct direction and supervision by the Intervenor, but merely provide their services in accordance with the requests or instructions of the visiting customers, and the direction and supervision by the caddie master, an employee of the Intervenor who manages the caddies, is not specific and direct direction and supervision concerning the content of the caddies' work or the method of performing that work, but is merely for the purpose of managing the caddies who provide services using the facility, by educating them on the rules of play and encouraging them to observe etiquette toward visiting customers, etc.; ⑦ caddies do not pay income tax on wages and salaries, and the Intervenor likewise does not withhold income tax on wages and salaries with respect to the caddie fees received by the caddies; and ⑧ even where a caddie is negligent in performing the play-assistance work for a visiting customer, the caddie merely suffers a de facto disadvantage such as being assigned to the last position in the order for providing services (such a disadvantage cannot but be regarded as an unavoidable measure from the standpoint of the golf course side, which arranges for the provision of the caddies' services), and there is no other fact that the Intervenor imposes disciplinary action on caddies on the ground of violation of the company's service order or the like. In light of these various circumstances taken together, the caddies working at the said golf course cannot be regarded as workers, as referred to in the former Industrial Accident Compensation Insurance Act (산업재해보상보험법) (before its amendment by Act No. 4826 of December 22, 1994) and Article 14 of the Labor Standards Act, who provide labor for the purpose of wages under a relationship of use and subordination vis-à-vis the Intervenor, who is the operator of the golf course facilities. Nevertheless, the court below, for the reasons stated in its judgment, held that the deceased non-party, who worked as a caddie at the said golf course, was a worker under the Labor Standards Act who received the service charge, which is consideration for the provision of labor, under a subordinate labor relationship with the Intervenor company, and thus held that he fell under the category of worker under the Industrial Accident Compensation Insurance Act. In so doing, the court below erred by misapprehending the legal principles concerning the concept of "worker" under the Labor Standards Act and the Industrial Accident Compensation Insurance Act, which error affected the judgment. Therefore, the argument pointing out this error is well-founded.

3. Accordingly, without further examining the remaining points, the judgment below is reversed, and the case is remanded to the court below, this being the unanimous opinion of the participating Justices, as stated in the Order.

Justice Ji Chang-gwon (Presiding Justice), Cheon Gyeong-song (Justice in charge), An Yong-deuk, Shin Seong-taek
