This case addressed whether a taxi company operating an alternate-day work schedule (격일제 근무), where drivers work every other day, was required to pay the minimum wage (최저임금) for hours worked beyond 8 hours per day. The Supreme Court held that overtime hours exceeding 8 hours per day are not subject to the minimum wage payment requirement, even under an alternate-day schedule. The Court also ruled that bonuses paid on the condition of not causing a serious traffic accident do not qualify as ordinary wages (통상임금), since they are not compensation for statutory working hours (소정근로) but rather for meeting an additional qualification requirement.

Key takeaways
  • CaseIncident: A dispute arose over whether a taxi company failed to pay the minimum wage (최저임금) for hours worked beyond 8 hours per day under an alternate-day work schedule, and whether a no-accident bonus should be included in ordinary wages (통상임금).
  • OutcomeResult: The Court ruled that even under an alternate-day schedule, overtime hours exceeding 8 hours per day are not subject to the minimum wage requirement, and that the no-accident conditional bonus does not qualify as ordinary wages.
  • LessonLesson: Even in alternate-day work arrangements, hours beyond 8 hours per day are excluded from minimum wage coverage as overtime, and bonuses tied to additional conditions (such as accident-free performance) can be excluded when calculating ordinary wages.
Issues
  • The scope of hours subject to the minimum wage (최저임금) payment requirement under an alternate-day (격일제) work schedule
  • Whether a bonus conditioned on not causing a serious traffic accident qualifies as ordinary wages (통상임금)
Key reasoning

Under Korean labor law, only hours corresponding to statutory working hours (소정근로시간)—generally capped at 8 hours per day—are subject to the minimum wage (최저임금) payment obligation; hours worked beyond this limit are treated as overtime (연장근로) and fall outside the minimum wage guarantee. This principle applies equally to alternate-day work schedules (격일제 근무), where drivers may work more than 8 hours in a single shift. Separately, the Court examined a bonus that was conditioned on drivers not causing a serious traffic accident. Because this bonus was not paid simply for performing the agreed statutory work but rather as a reward for satisfying an additional safety-related qualification, it lacked the character of compensation for statutory working hours (소정근로 대가성) and therefore could not be classified as ordinary wages (통상임금).

Summary of Decision (English, AI translation)

[1] In small claims cases, where there is no existing Supreme Court precedent on the interpretation of the statute applicable to the specific case, and where numerous small claims cases in which the interpretation of the same statute is at issue are pending in the lower courts, with conflicting judgments appearing depending on the panel, there is concern that if the Supreme Court were to terminate the case without rendering a judgment on the interpretation of that statute merely because it is a small claims case (소액사건), this would undermine the legal stability of the public's life. Where such special circumstances exist, even if the requirement of "having made a judgment contrary to Supreme Court precedent," which may serve as a ground for appeal in small claims cases, is not satisfied, it should be held that the Supreme Court may render a judgment on errors in the interpretation and application of substantive law, in the dimension of fulfilling the Supreme Court's essential function of unifying the interpretation of statutes.

[2] Wages other than those paid for the prescribed working hours or prescribed working days are not included in the wages counted toward the minimum wage for taxi driver employees (Article 6(5) of the Minimum Wage Act (최저임금법), Article 5-2, proviso, item 1 of the former Enforcement Decree of the Minimum Wage Act (최저임금법 시행령) (before amendment by Presidential Decree No. 29469 of December 31, 2018)). Here, "prescribed working hours" means the working hours agreed upon between the employee and the employer within the scope of 40 hours per week and 8 hours per day (Article 2(1)(8) and Article 50 of the Labor Standards Act (근로기준법)). Considering the content and purpose of these Minimum Wage Act provisions, where the weekly working hours agreed upon between the employee and the employer exceed 40 hours, or where the daily working hours exceed 8 hours, the excess portion, i.e., the overtime working hours, is not included, absent other special circumstances, in the hours for which wages equal to or exceeding the minimum wage amount must be paid. This applies equally to the alternate-day work schedule in which an employee works one day and rests the next day.

[3] Article 6(1) of the Enforcement Decree of the Labor Standards Act (근로기준법 시행령) defines ordinary wages as "the hourly wage amount, daily wage amount, weekly wage amount, monthly wage amount, or piece-rate amount agreed to be paid regularly and uniformly to an employee for prescribed work or total work." Interpreting the concept of ordinary wages faithfully to this statutory definition and purpose, ordinary wages refer to wages agreed to be paid regularly and uniformly as consideration for prescribed work. Wages that are agreed to be paid regularly and uniformly as consideration for an employee's full provision of prescribed work fall under ordinary wages regardless of the existence or likelihood of fulfillment of any condition attached thereto. Of course, depending on the type and content of the condition, the ordinary wage character of the wage item to which the condition is attached may be denied. This is not because the payment or amount of the relevant wage depends on the condition attached to that wage item, but because, in the process of substantively determining the ordinary wage character according to the objective nature of the relevant wage, the condition was considered as one of the factors negating the wage's character as consideration for prescribed work, its regularity, or its uniformity.

Even where a wage is subject to a condition that it be paid only upon fulfillment of a certain number of working days (hereinafter "working days condition"), if such condition is one that an employee who fully provides prescribed work would fulfill—that is, a working days condition set within the number of prescribed working days—the mere fact that such a condition is attached does not negate the ordinary wage character of that wage.

[4] In a case where, in a wage agreement concluded between Company A, a limited liability company (유한회사) operating a general taxi transportation business, and a labor union, the monthly prescribed working days for alternate-day employees were set at 12 days, and a bonus was to be paid to employees who had continuously worked for at least one year and had actually worked 55 days or more based on a six-month period, but the bonus was not to be paid to employees who caused a serious traffic accident resulting in personal or property damage exceeding a certain standard: the working days condition attached to the above bonus was merely a condition that an employee who fully provides prescribed work would fulfill, and therefore the mere fact that such condition was attached cannot be deemed to negate the ordinary wage character of the bonus. However, since the above bonus was paid on the condition of "not causing a serious traffic accident" over a certain period, in addition to the provision of prescribed work, and was thus paid as compensation for achieving an additional qualifying requirement beyond the provision of prescribed work, it lacks the character of consideration for prescribed work and cannot be deemed to constitute ordinary wages. The Court held that the court below erred in reaching a contrary conclusion, thereby rendering "a judgment contrary to Supreme Court precedent" as provided in Article 3(2) of the Small Claims Act

[Defendant, Appellee and Appellant] ○○ Transportation Yuhan Hoesa (Legal representative: Somang Law Firm, Attorney Oh Seung-won and 3 others)
[Judgment Below] Busan High Court Judgment (Changwon Branch) 2021Na12929, decided July 7, 2022

[Order]

The part of the judgment below concerning the defendant's losing portion, specifically the claim for unpaid contributions, is reversed, and this part of the case is remanded to the Busan High Court. Both the Plaintiff's appeal and the remainder of the Defendant's appeal are all dismissed.

[Reasoning]

1. Ex officio determination as to whether this case is a small claims case

According to the record, it can be seen that this case was filed as a small claims case and was assigned a small claims case number, but was later transferred at the court of first instance for consolidated hearing with a related case and was assigned a panel (合議部) case number; however, without actually being consolidated with the related case, the hearing proceeded and a separate judgment was rendered.

Article 1-2 of the Rules on Trial of Small Claims (소액사건심판규칙), which defines the scope of small claims cases, provides that a small claims case under Article 2, Paragraph 1 of the Small Claims Act (소액사건심판법) shall be a first-instance civil case seeking payment of a certain quantity of money, other fungible goods, or securities, where the value of the subject matter of the litigation at the time of filing does not exceed 30 million won, provided that (i) a case that, due to an amendment of the claim, no longer falls under the case set forth in the main text, and (ii) a case that comes to be consolidated for hearing with a case not falling under the main text due to a third-party intervention, a claim for interim confirmation, a counterclaim, or consolidation of pleadings, shall be excluded from small claims cases.

The value of the subject matter of the litigation in this case was 7,810,134 won at the time of filing the action and was ultimately expanded to 9,618,194 won, both of which do not exceed 30 million won. Therefore, even though this case was assigned a panel case number and was not tried under the Small Claims Act, since Article 1-2 of the Rules on Trial of Small Claims does not contain a provision excluding cases from small claims cases based on the manner in which the trial was conducted, this case must be regarded as a small claims case (see Supreme Court Decision 2003Da4808, decided April 25, 2003; Supreme Court Decision 2010Da105495, decided July 28, 2011, etc.).

2. Determination on the Plaintiff's grounds of appeal

A. Where there is as yet no Supreme Court precedent on the interpretation of the statutes applicable to the specific matter in a small claims case, while numerous small claims cases in which the interpretation of the same statute is at issue are pending in the lower courts, and there are instances of differing determinations depending on the panel, there is a concern that if the Supreme Court were to terminate the case without ruling on the interpretation of that statute merely because it is a small claims case, this would undermine the legal stability of the people's lives. In such special circumstances, even if the requirement of "having made a determination contrary to Supreme Court precedent," which may serve as a ground of appeal in a small claims case, is not satisfied, it should be held that the Supreme Court may render a determination on errors in the interpretation and application of substantive law, in order to fulfill its essential function of unifying the interpretation of statutes (see Supreme Court Decision 2003Da1878, decided August 20, 2004; Supreme Court Decision 2012Da48824, decided March 26, 2015, etc.).

There is as yet no Supreme Court precedent on the method of calculating the hours for which wages of at least the minimum wage amount must be paid (hereinafter referred to as "minimum wage payment hours") under an alternate-day work schedule, which is the issue in this case, and the determinations of the lower courts are divided. Therefore, in order to unify the interpretation of the statute, we render a determination on this issue.

B. Wages included in the minimum wage of a taxi driver employee do not include wages paid for anything other than the prescribed working hours or the prescribed working days [Article 6, Paragraph 5 of the Minimum Wage Act (최저임금법), and the proviso of Item 1, Article 5-2 of the former Enforcement Decree of the Minimum Wage Act (최저임금법 시행령) (before amendment by Presidential Decree No. 29469, December 31, 2018)]. Here, "prescribed working hours" means the working hours agreed upon between the employee and the employer within the scope of 40 hours per week and 8 hours per day (Article 2, Paragraph 1, Item 8, and Article 50 of the Labor Standards Act (근로기준법)). Considering the content and purpose of these provisions of the Minimum Wage Act and its Enforcement Decree, where the weekly working hours agreed upon between the employee and the employer exceed 40 hours, or the daily working hours exceed 8 hours, the excess portion, i.e., the overtime working hours, is not included in the minimum wage payment hours, absent other special circumstances (see Supreme Court Decision 2023Da223744, 223751, decided July 25, 2024). This applies equally to an alternate-day work schedule in which an employee works one day and rests the following day.

C. The court below determined that, prior to the agreement to shorten the prescribed working hours, only the 8-hour portion per day among the working hours set forth in Article 4 of the 2003 Wage Agreement constituted prescribed working hours, and calculated the Plaintiff's shortfall in minimum wage based solely on 8 hours per day. In light of the legal principles set forth above, this determination by the court below is justified, and there is no error therein, such as a misunderstanding of the legal principles concerning prescribed working hours, as argued in the grounds of appeal.

3. Determination on the Defendant's grounds of appeal (the contents of the supplementary appellate brief and other documents submitted after the deadline for submission of the appellate brief shall be considered only to the extent they supplement the grounds of appeal)

A. As to the Defendant's Third Ground of Appeal

1) Legal principles concerning ordinary wages

Article 6, Paragraph 1 of the Enforcement Decree of the Labor Standards Act defines ordinary wages as "the hourly wage amount, daily wage amount, weekly wage amount, monthly wage amount, or piece-rate wage amount determined to be paid regularly and uniformly to an employee for prescribed work or total work." Interpreting the concept of ordinary wages faithfully to the definition and purpose of the statute, ordinary wages refer to wages determined to be paid regularly and uniformly as consideration for prescribed work. Wages determined to be paid regularly and uniformly as consideration for an employee's full provision of prescribed work constitute ordinary wages regardless of the existence or the possibility of fulfillment of any condition attached thereto. Of course, depending on the type and content of the condition, the ordinary wage nature of the wage item to which the condition is attached may be denied. This is not because the payment and amount of the relevant wage are governed by the condition attached to that wage item, but because, in the process of substantively determining the ordinary wage nature of the relevant wage based on its objective character, that condition is considered as one of the factors negating the wage's character as consideration for prescribed work, its regularity, or its uniformity.

Even if a wage is subject to a condition that it be paid only upon fulfillment of a certain number of working days (hereinafter "working-days condition"), if that condition is one that would be fulfilled by an employee who provides prescribed work in full — that is, a working-days condition set within the number of prescribed working days — then the mere fact that such a condition is attached does not negate the ordinary wage nature of that wage (see Supreme Court en banc Decision 2020Da247190, decided December 19, 2024, etc.).

2) Determination as to this case

A) Facts and the determination of the court below

According to the reasoning of the judgment below and the evidence that the court below lawfully adopted and examined, it can be seen that in the wage agreement concluded between the Defendant, which operates a general taxi transportation business, and the labor union, the monthly prescribed working days for alternate-day employees were set at 12 days, and a bonus was to be paid to an employee who had worked continuously for at least one year and had actually worked at least 55 days based on a 6-month period per year, provided that no bonus would be paid to an employee who caused a serious traffic accident resulting in personal or property damage exceeding a certain standard (hereinafter, the bonus paid by the Defendant under the above conditions is referred to as "the bonus in this case").

The court below included the bonus in this case in ordinary wages on the ground that it was scheduled to be paid if ordinary work was performed.

B) Determination of the Supreme Court

In light of the legal principles set forth above, the working-days condition attached to the bonus in this case is merely a condition that would be fulfilled by an employee who provides prescribed work in full, and therefore the mere fact that such a condition is attached cannot be deemed to negate the ordinary wage nature of the bonus in this case.

However, the bonus in this case is a wage paid on the condition of "not causing a serious traffic accident" for a certain period, in addition to the provision of prescribed work, and is paid as compensation for achieving an additional qualification requirement beyond the provision of prescribed work. Therefore, it lacks the character of consideration for prescribed work and cannot be deemed to constitute ordinary wages.

Nevertheless, the court below determined, for the reasons stated in its judgment, that the bonus in this case constituted ordinary wages. This determination by the court below contains an error affecting the judgment by making "a determination contrary to Supreme Court precedent" as set forth in Article 3, Item 2 of the Small Claims Act, with respect to ordinary wages. The Defendant's ground of appeal pointing this out is well-founded.

B. As to the Defendant's remaining grounds of appeal

Since this case is a small claims case, an appeal may be made only where it falls under one of the grounds set forth in each item of Article 3 of the Small Claims Act. The Defendant's remaining grounds of appeal either do not fall under any of those grounds, or constitute new arguments raised for the first time at the appellate stage, and thus do not constitute lawful grounds of appeal.

4. Scope of Reversal

The portion of the judgment below concerning the defendant's losing portion that included the bonus in this case in ordinary wages contains the grounds for reversal set forth above. In the court below after remand, it is necessary, in consideration of the purport of the above reversal, to newly calculate the ordinary wages and, based thereon, to newly calculate the scope of the contributions that the Defendant failed to pay into the Plaintiff's defined contribution retirement pension account. Accordingly, the portion of the judgment below concerning the defendant's losing portion relating to the claim for unpaid contributions must be reversed in its entirety.

5. Conclusion

The portion of the judgment below concerning the defendant's losing portion relating to the claim for unpaid contributions is reversed, and this part of the case is remanded to the court below for further hearing and determination; the Plaintiff's appeal and the remainder of the Defendant's appeal are without merit and are therefore all dismissed. This judgment is rendered as set forth in the Order by the unanimous opinion of the Justices participating in the case.
