A taxi company, seeking to circumvent the Minimum Wage Act (최저임금법), entered into an agreement with drivers to shorten only the 'statutory working hours' (소정근로시간) stated in their contracts—while leaving actual working hours unchanged—in order to artificially inflate the hourly wage rate under a fixed quota system (사납금제). The lower court ruled this agreement was void as an unlawful evasion (탈법행위) of the law, but the Supreme Court (대법원) reversed and remanded, holding that working hours related to the weekly holiday allowance (주휴수당) must be excluded when determining whether the minimum wage requirement was violated.

Key takeaways
Issues
  • Validity of an agreement to shorten contractual working hours (소정근로시간) aimed at evading the minimum wage law under a fixed quota system (정액사납금제)
  • Whether hours related to the weekly holiday allowance (주휴수당) should be included when comparing actual wages against the minimum wage
  • The appropriate strict standard of review for determining whether an agreement constitutes unlawful evasion (탈법행위) of the law
Key reasoning

For the period before 2018, working hours associated with the weekly holiday allowance (주휴수당) must be excluded from the calculation when assessing both minimum wage compliance and whether an agreement constitutes unlawful evasion of the law. The Supreme Court held that lower courts must apply a strict standard when determining whether an agreement to shorten contractual working hours is an unlawful evasion, taking into account all relevant circumstances—including whether the agreement substantively undermines the purpose of the minimum wage system. Simply reducing contractual hours while wages remain the same does not automatically render the agreement void; courts must comprehensively examine whether the arrangement genuinely defeats the minimum wage protections in substance.

Summary of Decision (English, AI translation)

[1] Considering comprehensively the content and structure of Article 32(1) of the Constitution (헌법) and the relevant provisions of the Minimum Wage Act (최저임금법), the legislative purpose and legislative history of Article 6(5) of the Minimum Wage Act as amended by Act No. 8964 on March 21, 2008 (hereinafter the “special provision”), the purport of the provisions of the Passenger Transport Service Act (여객자동차 운수사업법) and the public nature of the general taxi transportation business, and the circumstances surrounding the agreement to shorten prescribed working hours, where, under a fixed-amount quota (sanap-geum) system, the employer, with the intent to avoid a situation in which the fixed wage excluding wages based on production performance falls below the minimum wage, agrees with the labor union of taxi driver employees to shorten only the prescribed working hours—without any actual change in the work pattern or operating hours—in order to increase the nominal amount of the hourly fixed wage calculated on the basis of prescribed working hours, such agreement must be regarded as void as an unlawful act designed to circumvent the application of the special provision under the Minimum Wage Act, which is a mandatory statutory provision.

[2] Article 5(1)(2) and (3) of the former Enforcement Decree of the Minimum Wage Act (최저임금법 시행령) (before amendment by Presidential Decree No. 29469 on December 31, 2018) provide that, with respect to wages paid on a weekly or monthly basis among the wages subject to comparison, the amount obtained by dividing such wages by “the number of prescribed working hours per week or per month” shall be treated as the hourly wage. Here, “prescribed working hours” means the working hours agreed upon between an employee and an employer within the scope of working hours under Article 50 or Article 69 of the former Labor Standards Act (근로기준법) (before amendment by Act No. 15513 on March 20, 2018; the same shall apply hereinafter) or Article 46 of the Occupational Safety and Health Act (산업안전보건법) (Article 2(1)(7) of the former Labor Standards Act), and since this is distinguished from the standard hours used for calculating ordinary wages, there is no need to take into account the working hours related to the weekly holiday allowance, which is the wage for paid holidays paid under a weekly or monthly wage system.

[3] The Labor Standards Act provides that “prescribed working hours” means the working hours agreed upon between an employee and an employer within the scope of the standard working hours (Article 2(1)(8)), and as a general rule, such hours may be freely determined by agreement between labor and management. However, the validity of such an agreement may be denied only where special circumstances exist, such as where the determination of prescribed working hours can be evaluated as merely a formality, or where it constitutes an unlawful act designed to circumvent the application of the special provision under Article 6(5) of the Minimum Wage Act (hereinafter the “special provision”), which is a mandatory statutory provision, or the like. In order to deny the validity of prescribed working hours determined by agreement between labor and management on such grounds, in light of the exceptional nature of such grounds, a strict determination must be made by comprehensively considering relevant circumstances, including whether the minimum wage system is substantially circumvented. In this regard, when determining whether wages paid for the period before December 31, 2018 fall short of the minimum wage, or when calculating the amount of wages that fall short of the minimum wage during that period, as well as when determining whether an agreement to shorten prescribed working hours during that period is void as an unlawful act designed to circumvent the application of the special provision or other provisions under the Minimum Wage Act, the working hours related to the weekly holiday allowance must, absent special circumstances, be excluded.

[Defendant, Appellant] Silla Traffic Co., Ltd. (Attorney Lee Jin-won, Counsel for the defendant)
[Judgment Below] Daegu High Court Decision 2021Na25985 Decided May 3, 2023

[Order]

The part of the judgment below against which the Defendant lost is entirely reversed, and this part of the case is remanded to the Daegu High Court.

[Reasoning]

The grounds of appeal are examined.

1. Relevant Legal Principles

A. Considering comprehensively the content and structure of Article 32(1) of the Constitution (헌법) and the relevant provisions of the Minimum Wage Act (최저임금법), the legislative purpose and legislative history of Article 6(5) of the Minimum Wage Act as amended by Act No. 8964 on March 21, 2008 (hereinafter the "Special Provision"), the purport of the provisions of the Passenger Transport Service Act (여객자동차 운수사업법), the public nature of the general taxi transportation business, and the circumstances surrounding agreements to shorten prescribed working hours, in cases where, under a fixed-amount quota (사납금) system, an employer, with the intent to avoid a shortfall below the minimum wage in the fixed wage excluding wages based on production performance, agrees with a labor union of taxi driver employees to shorten only the prescribed working hours—without any actual change in the work pattern or operating hours—for the purpose of increasing the nominal amount of the hourly fixed wage calculated on the basis of the prescribed working hours, such agreement must be regarded as void as an evasive act intended to circumvent the application of the mandatory provisions of the Minimum Wage Act, including the Special Provision (see Supreme Court en banc Decision 2016Da2451 Decided April 18, 2019).

B. Article 5(1), Items 2 and 3 of the former Enforcement Decree of the Minimum Wage Act (before amendment by Presidential Decree No. 29469 of December 31, 2018) provide that, with respect to wages paid on a weekly or monthly basis among the wages subject to comparison, the wage per hour shall be calculated by dividing such wages by the "number of prescribed working hours per week or per month." Here, "prescribed working hours" means the working hours agreed upon between an employee and an employer within the scope of working hours under Article 50 or 69 of the former Labor Standards Act (근로기준법, before amendment by Act No. 15513 of March 20, 2018; the same shall apply hereinafter) or Article 46 of the Occupational Safety and Health Act (산업안전보건법) (Article 2(1), Item 7 of the former Labor Standards Act), which is distinct from the standard hours used for calculating ordinary wages; therefore, the working hours related to the weekly holiday allowance (주휴수당), which is the wage for paid holidays under a weekly-pay or monthly-pay system, need not be taken into consideration (see Supreme Court Decision 2006Da64245 Decided January 11, 2007; Supreme Court Decision 2014Da44673 Decided June 19, 2018, etc.).

2. Judgment of the Court Below

A. In examining the circumstances surrounding the conclusion of the collective agreement in order to determine the validity of the agreement to shorten prescribed working hours, it is reasonable to determine compliance with the minimum wage at the time on the basis of the prescribed working hours including the working hours related to the weekly holiday allowance (hereinafter "weekly holiday hours").

B. The agreements to shorten prescribed working hours from 2013 onward are void as evasive acts intended to circumvent the application of the mandatory provisions of the Minimum Wage Act, including the Special Provision, given that, when the comparison wage is converted into an hourly wage based on the prescribed working hours (including weekly holiday hours) immediately preceding each such agreement, the results all fall below the minimum wage set for the relevant year. Accordingly, the prescribed working hours applicable to the Plaintiffs are 6 hours and 40 minutes per day, as set forth in the 2011 collective agreement.

3. Judgment of the Supreme Court

A. Upon examining the reasoning of the judgment below in light of the relevant legal principles and the evidence duly admitted, the judgment below cannot be upheld for the following reasons.

1) The Labor Standards Act defines "prescribed working hours" as the working hours agreed upon between an employee and an employer within the scope of the standard working hours (Article 2(1), Item 8), and, in principle, such hours may be freely determined by agreement between labor and management. However, the validity of such an agreement may be denied only where special circumstances exist, such as where the determination of prescribed working hours can be evaluated as being merely nominal, or where it constitutes an evasive act intended to circumvent the application of the mandatory provisions of the Minimum Wage Act, including the Special Provision (see the above Supreme Court en banc Decision 2016Da2451). In order to deny the validity of prescribed working hours determined by agreement between labor and management on such grounds, given the exceptional nature of such grounds, a strict determination must be made by comprehensively considering relevant circumstances, including whether the minimum wage system has been substantively circumvented. In this regard, when determining whether wages paid for the period before December 31, 2018 fall short of the minimum wage, or when calculating the amount of the shortfall for that period, as well as when determining whether an agreement to shorten prescribed working hours during that period is void as an evasive act intended to circumvent the application of the Special Provision and other mandatory provisions of the Minimum Wage Act, the weekly holiday hours must, in the absence of special circumstances, be excluded (see the above Supreme Court Decision 2014Da44673, etc.).

2) The 2013 collective agreement merely reduced the daily working hours by 40 minutes compared to the 2011 collective agreement. Moreover, in light of the fact that, even under the calculation method used by the court below, the amount obtained by dividing the total sum of 949,110 won stated in the "Driver Wage Schedule" by the monthly prescribed working hours (excluding weekly holiday hours) under the immediately preceding collective agreement is significantly higher than the statutory hourly minimum wage for the years 2013 to 2015, it is difficult to regard this agreement as void as an evasive act intended to circumvent the application of the mandatory provisions of the Minimum Wage Act, including the Special Provision.

3) The 2015 collective agreement did not shorten the prescribed working hours at all, but merely slightly increased the daily quota amount, and thus does not even constitute an "agreement to shorten prescribed working hours." Furthermore, since, under the calculation method used by the court below, the amount obtained by dividing the total sum of 1,004,400 won stated in the "Driver Wage Schedule" by the monthly prescribed working hours (excluding weekly holiday hours) under the 2011 collective agreement is considerably higher than the statutory hourly minimum wage for 2015, it is likewise difficult to regard this agreement as void as an evasive act intended to circumvent the application of the mandatory provisions of the Minimum Wage Act, including the Special Provision.

4) With respect to the collective agreements concluded in 2017 and thereafter as well, it is necessary to closely examine, by comprehensively considering both the circumstances surrounding the agreements to shorten prescribed working hours and the results calculated by the above method, whether each such agreement falls under a case where, under a fixed-amount quota system, the employer, with the intent to avoid a shortfall below the minimum wage in the fixed wage excluding wages based on production performance, agreed to shorten only the prescribed working hours—without any actual change in the work pattern or operating hours—for the purpose of increasing the nominal amount of the hourly fixed wage calculated on the basis of the prescribed working hours; and, on that basis, the validity of such agreements as well as whether the wages paid thereunder fall short of the minimum wage, or the amount of any such shortfall, must be determined.

B. Nevertheless, the court below, in determining the validity of the agreements to shorten prescribed working hours from 2013 onward, determined that such shortening agreements constituted evasive acts intended to circumvent the application of the Special Provision and other mandatory provisions of the Minimum Wage Act, on the basis of prescribed working hours including weekly holiday hours, despite the absence of any apparent special circumstances. Such determination by the court below contains an error affecting the judgment, in that it misapprehended the legal principles concerning the calculation of prescribed working hours and thereby failed to conduct the necessary examination.

4. Conclusion

Therefore, without examining the remaining grounds of appeal, the part of the judgment below against which the Defendant lost is entirely reversed, and this part of the case is remanded to the court below for further hearing and determination. This Judgment is rendered in accordance with the unanimous opinion of the Justices participating in the decision, as set forth in the Order.
