What Are Unemployment Benefits?

Unemployment benefits are a system established under the Employment Insurance Act (고용보험법) that supports the livelihood of workers who have involuntarily lost their jobs while they actively seek re-employment. The precise legal term is job-seeker allowance (구직급여), though it is commonly called "unemployment benefits (실업급여)." Article 40 of the Employment Insurance Act (고용보험법 제40조) sets out the following eligibility requirements: ① a cumulative insured unit period of at least 180 days within the 18 months prior to separation; ② involuntary separation (involuntary dismissal, recommended resignation, contract expiry, business closure, etc.); ③ active re-employment activities; and ④ the willingness and ability to work.


Am I Eligible?

The most commonly misunderstood point is the distinction between voluntary resignation and involuntary separation. As a general rule, a simple voluntary resignation does not qualify. However, if there is a justifiable reason listed in Attached Table 2 of the Enforcement Rules of the Employment Insurance Act (고용보험법 시행규칙 별표2) — such as unpaid wages, workplace harassment, relocation of the workplace to an unreachable location, or failure to fulfill contractual terms — benefits may still be available even if you resigned voluntarily. Always carefully verify your reason for separation before leaving your job.

Note for foreign workers: Your employment contract may specify terms that differ from the statutory minimum, but the eligibility criteria above apply regardless of contract language.


Application Process – 5 Steps

Step 1 | Confirm the Separation Confirmation Form
After you leave your job, your employer must submit a notice of loss of insured status and a separation confirmation form (이직 확인서) to the Ministry of Employment and Labor. If the employer fails to do so, you may request that the Employment Center (고용센터) handle it directly.

Step 2 | Register as a Job-Seeker on Work24
You must first complete a job-seeker registration on 고용24 (www.work24.go.kr) or Worknet. This can be done online in under 5 minutes.

Step 3 | Complete the Eligibility Application Training
Complete the online eligibility applicant training (approximately 1 hour) on 고용24. This is a mandatory step before visiting an Employment Center in person.

Step 4 | Visit the Employment Center or Apply Online
Submit an application for recognition of benefit eligibility at the Employment Center with jurisdiction over your place of residence, or submit it online via 고용24. Required documents are your ID and a copy of your bank account. If your employer has already submitted the separation confirmation form electronically, you do not need to bring a separate copy.

Step 5 | Unemployment Certification and Benefit Receipt
After your eligibility is recognized, apply for unemployment certification at the Employment Center or online at intervals of 1 to 4 weeks. You must provide evidence of active re-employment activities (e.g., submitting job applications, attending employment seminars). Job-seeker allowance is paid on each certification date.


How Much Can I Receive?

The daily job-seeker allowance is 60% of the average wage prior to separation, subject to statutory upper and lower limits. The benefit period (prescribed number of benefit days) ranges from 120 to 270 days depending on age and length of insured period, as provided under Article 50 of the Employment Insurance Act (고용보험법 제50조). For example, if you are under 50 years of age and your insured period is 3 years or more but less than 5 years, you are entitled to 150 days of benefits.
