In a case where a labor union at an essential public service company (필수공익사업) went on strike during a compulsory arbitration period (직권중재 기간), the Supreme Court held that the statutory ban on industrial action during compulsory arbitration does not violate the Constitution, and that a collective refusal to work during this period constitutes the crime of obstruction of business (업무방해죄). The Court further clarified that where a strike serves multiple purposes, its legitimacy should be judged based on the primary purpose, and that industrial action becomes permissible not only after a mediation decision is issued, but also once the mediation period itself has expired.

Key takeaways
  • CaseIncident: A labor union at an essential public service company went on strike during the compulsory arbitration period.
  • OutcomeResult: The Supreme Court ruled that the ban on strikes during compulsory arbitration is constitutional and that the strike constituted the crime of obstruction of business.
  • LessonLesson: Unions at essential public services (electricity, gas, railways, etc.) must never strike during a compulsory arbitration period.
Issues
  • Whether the statutory ban on industrial action during the compulsory arbitration period is unconstitutional
  • Whether a collective refusal to work during this period constitutes the crime of obstruction of business (업무방해죄)
  • Whether the ban violates the constitutional prohibition on forced labor
  • The standard for judging the legitimacy of a strike pursuing multiple purposes
  • The requirements for completing the mediation (조정) procedure before industrial action becomes lawful
Key reasoning

The prohibition on industrial action during the compulsory arbitration period in essential public services is a minimal restriction necessary to protect the public interest, and therefore does not violate the Constitution. Because a collective refusal to provide labor during this restricted period does not qualify as a legitimate industrial action (정당한 쟁의행위), it satisfies the elements of the crime of obstruction of business (업무방해죄) under the Criminal Code. Additionally, where a strike is motivated by multiple objectives, courts must assess its legality by focusing on the dominant or primary purpose of the action, rather than treating every purpose as equally determinative.

Summary of Decision (English, AI translation)

[1] Articles 62 Subparagraph 3, 63, and 91 Subparagraph 1 of the Act on the Adjustment of Labor Relations and the Promotion of Labor Unions (노동조합및노동관계조정법) have as their legislative purpose the maintenance of the public's daily life and the preservation of the national economy by making it possible to resolve labor disputes through mediation by the Labor Relations Commission instead of agreement between labor and management, in essential public-interest businesses, since frequent strikes arising from extreme conflict of interest and confrontation between labor and management could paralyze the public's daily life and place the national economy at risk of collapse. This legislative purpose is legitimate, the method of restricting fundamental rights prescribed under the Act is appropriate, the degree of restriction on fundamental rights is minimized, and a balance is maintained between the public interest sought to be protected and the private interest restricted; therefore, it does not violate the constitutional principle of prohibition of excessive restriction.

[2] "Force" (위력) as referred to in the crime of obstruction of business under Article 314 of the Criminal Code (형법) refers to a force capable of suppressing or disturbing a person's freedom of will, including but not limited to assault or intimidation. Since a labor dispute act is an act by which workers unite to exert pressure on the employer, it inherently contains the element of obstruction of business by force. Accordingly, workers' collective failure to report to work during working hours is, absent other unlawful elements, nothing more than a nonperformance of the duty to provide labor. However, even a mere refusal to provide labor, if it is not a legitimate act of dispute and reaches the point of obstructing the normal operation of business by force, may constitute the crime of obstruction of business under the Criminal Code.

[3] Even if a collective refusal to provide labor inherently possesses the character of force and thus formally satisfies the elements of the crime of obstruction of business, if it is recognized as a legitimate exercise of rights within the scope guaranteed by the Constitution and statutes, its illegality is negated and it cannot be punished. This is because such regulation merely restrains acts that exceed the inherent limits of the three labor rights guaranteed by the Constitution (acts falling outside the area of constitutional protection), and does not punish the legitimate exercise of rights; therefore, it cannot be said to constitute the compulsion of forced labor against a person's will.

[4] Where a dispute act pursues multiple objectives and some of them are not legitimate, the propriety of the objective of the dispute must be determined based on the propriety of the principal or genuine objective. If it is found that the dispute act would not have been undertaken had the improper demands been excluded, the entire dispute act must be considered to lack legitimacy.

[5] A labor dispute, absent special circumstances, must go through mediation procedures; however, this does not mean that a dispute act is procedurally legitimate only if it is undertaken after the Labor Relations Commission has rendered a mediation decision. If a labor union files an application for mediation of a labor dispute with the Labor Relations Commission, and either the mediation procedure is completed or the mediation period expires without mediation being concluded, this is deemed to have satisfied the requirement of undergoing mediation procedures, and the union may then engage in a dispute act.

[Judgment Below] Seoul District Court Decision 2000No10376, decided April 4, 2001

[Order]

Each appeal is dismissed.

[Reasoning]

1. As to the Defendant's Appeal

A. Regarding the Constitutionality of Article 62, Item 3, Article 63, and Article 91, Item 1 of the Trade Union and Labor Relations Adjustment Act (hereinafter referred to as the "Act")

Article 62, Item 3, Article 63, and Article 91, Item 1 of the Act (hereinafter referred to as "the statutory provisions at issue") are aimed at maintaining the public's daily life and preserving the national economy by enabling the resolution of labor disputes through arbitration by the Labor Relations Commission, instead of through agreement between labor and management, since frequent strikes arising from extreme conflicts of interest between labor and management in essential public-interest businesses could paralyze the public's daily life and place the national economy at risk of collapse. This legislative purpose is legitimate, the means of restricting fundamental rights as provided under the Act are appropriate, the degree of restriction on fundamental rights is minimized, and a balance is maintained between the public interest sought to be protected and the private interest restricted. Accordingly, the provisions do not violate the constitutional principle against excessive restriction (see Constitutional Court Decision 2001Hun-Ga31, decided May 15, 2003). The judgment below, which reached the same conclusion, is justified, and there is no error of misapprehension of the legal principles concerning the statutory provisions at issue as alleged in the grounds of appeal.

B. Regarding the Referral to Arbitration in This Case

Upon examination of the record, the lower court's determination that the referral to arbitration in this case was made through lawful procedures and that there was no illegality in the form of deviation from or abuse of discretion is justified and acceptable, and there is no error of misapprehension of the legal principles as alleged in the grounds of appeal.

C. Regarding the Crime of Obstruction of Business by Force

"Force" as referred to in the crime of obstruction of business under Article 314 of the Criminal Act (형법) refers not only to violence or intimidation but also to any force capable of suppressing or confusing a person's freedom of will. Since a labor dispute act is inherently an act by which workers unite to exert pressure on the employer, it inherently contains elements of obstruction of business by force. Therefore, where workers collectively fail to report to work during working hours, this constitutes, absent other unlawful elements, merely a failure to perform the duty to provide labor. However, even a mere refusal to provide labor, if it is not a legitimate act of dispute and reaches the extent of obstructing the normal operation of business by force, may constitute the crime of obstruction of business under the Criminal Act (see Supreme Court Decision 2001Do4335, decided September 28, 2001, and other cases).

In light of these legal principles and the record, the lower court's determination that, since Article 91, Item 1 and Article 63 of the Act prohibit dispute acts for 15 days from the date a labor dispute is referred to arbitration, having union members collectively refuse to provide labor during that period constitutes the crime of obstruction of business by force, is justified and acceptable, and there is no error of misapprehension of the legal principles concerning the crime of obstruction of business by force as alleged in the grounds of appeal.

Furthermore, even where a collective refusal to provide labor inherently involves the element of force and thus formally satisfies the elements of the crime of obstruction of business, if it is recognized as legitimate as an exercise within the scope guaranteed by the Constitution and statutes, its illegality is negated and it cannot be punished. This is because such regulation targets only acts that exceed the inherent limits of the three labor rights guaranteed by the Constitution (i.e., acts outside the scope of constitutional protection), and does not punish the legitimate exercise of rights; therefore, it cannot be said to constitute compulsory labor imposed against one's will (see Constitutional Court Decision 97Hun-Ba23, decided July 16, 1998). Accordingly, the argument in the grounds of appeal on this point cannot be accepted either.

2. As to the Prosecutor's Appeal

A. Regarding the Purpose of the Dispute Act

Where a dispute act pursues multiple objectives and some of them are not legitimate, the legitimacy of the purpose of the dispute should be determined based on the propriety of the primary or genuine purpose. If it is found that the dispute act would not have been carried out had the unjust demands been excluded, the entire dispute act must be regarded as lacking legitimacy (see Supreme Court Decision 91Nu5204, decided January 21, 1992, and other cases).

In light of these legal principles and the record, the lower court's determination—that although hospital reform, democratization of medical services, and the like were among the objectives asserted by the ○○○○ Union, of which the Defendant served as chairperson, the primary objective was wage increases and securing employment stability, and that the legitimacy of the purpose of each of the said dispute acts is recognized—is justified and acceptable, and there is no error of misapprehension of the legal principles concerning dispute acts as alleged in the grounds of appeal.

B. Regarding the Procedure of the Dispute Act

Article 45, Paragraph 2 of the Act provides that "a dispute act may not be conducted without going through the mediation procedures under Chapter 5, Sections 2 through 4; provided, however, that this shall not apply where mediation is not concluded within the period prescribed under Article 54, or where an arbitration award is not made within the period prescribed under Article 63." Article 54, Paragraph 1 of the Act provides that "mediation shall be concluded within 10 days for general businesses and within 15 days for public-interest businesses from the date of application for mediation under Article 53." Article 91, Item 1 of the Act provides penal provisions for those who violate the main text of Article 45, Paragraph 2 of the Act. A labor dispute must, absent special circumstances, go through mediation procedures; however, this does not mean that the procedure is legitimate only if the dispute act is carried out after the Labor Relations Commission has made a mediation decision. Where a trade union has applied to the Labor Relations Commission for mediation of a labor dispute, and the mediation procedure has been concluded, or the mediation period has expired without mediation being concluded, the mediation procedure shall be deemed to have been completed, and a dispute act may then be conducted (see Supreme Court Decision 2000Do2871, decided June 26, 2001, and Decision 2003Do1378, decided April 25, 2003, and other cases).

In light of these legal principles and the record, the lower court's determination—having found that the respective branches of the ○○○○ Union at each hospital in this case filed applications for mediation of the dispute with each Regional Labor Relations Commission around May 15, 2000, that each dispute act in this case took place more than 15 days thereafter, and that there was in fact no room for agreement between labor and management due to the sharp conflict of opinion between the parties—that each of the said dispute acts was legitimate in terms of procedure, is justified and acceptable, and there is no error of misapprehension of the legal principles as alleged in the grounds of appeal.

3. Accordingly, each appeal is dismissed, and it is so decided as stated in the Order by the unanimous opinion of the Justices participating in the judgment.

Justice Yoon Jae-sik (Presiding Justice), Byun Jae-seung, Kang Shin-wook, Ko Hyun-chul (Justice in Charge)
