This case established the legal principle that when calculating 'ordinary wages' (통상임금) — the base wage rate used to compute overtime, holiday pay, and other allowances — payments for paid holidays and paid hours on Saturday afternoons must be excluded because they are conditional, not fixed, wages. The Supreme Court held that regardless of whether an employee is paid monthly or hourly, such conditional wage components must be deducted when calculating ordinary wages, and it also laid out a specific method for calculating the hourly ordinary wage rate. The appeal was dismissed, resulting in a win for the employer.

Key takeaways
  • CaseAn employee sought additional allowances by arguing that paid holiday wages and paid Saturday afternoon wages should be included in the calculation of ordinary wages (통상임금).
  • OutcomeThe Supreme Court ruled that wages conditioned on requirements such as perfect attendance are not 'fixed' wages and therefore must be excluded from ordinary wages.
  • LessonWhen calculating ordinary wages (통상임금), employers and employees should exclude any wage components that are conditioned on attendance or specific work requirements, counting only truly fixed and guaranteed payments.
Issues
  • The definition and scope of 'ordinary wages' (통상임금) under Korean labor law
  • Whether paid holiday wages should be included in the calculation of ordinary wages
  • Whether the paid 4-hour Saturday afternoon wage qualifies as part of ordinary wages
  • The correct method for calculating the hourly rate of ordinary wages
Key reasoning

Under Korean labor law, 'ordinary wages' (통상임금) must consist of wages that are paid regularly and uniformly as fixed, guaranteed compensation. Because the paid holiday wage in this case was contingent on the employee having a perfect attendance record, and the paid Saturday afternoon wage (covering 4 hours) was contingent on the employee having worked the Saturday morning shift, neither payment qualified as 'fixed' wages. As a result, both types of conditional payments must be excluded when determining ordinary wages, and this rule applies uniformly whether the worker is compensated on a monthly salary basis or an hourly wage basis.

Summary of Decision (English, AI translation)

[1] Money and valuables paid to an employee as consideration for prescribed work or total work, if paid regularly and uniformly, shall in principle all constitute wages belonging to ordinary wages under the former Labor Standards Act (Act No. 5309, before its full amendment on March 13, 1997; 근로기준법). However, in light of the legislative purpose of the Labor Standards Act and the function and necessity of ordinary wages, in order for a certain wage to constitute ordinary wages, it must belong to a fixed wage that is paid regularly and uniformly; therefore, a wage whose payment and amount vary depending on actual work performance cannot be regarded as a fixed wage and does not constitute ordinary wages.

[2] Where wages are paid to an employee on a monthly basis, such monthly pay shall be deemed to include wages for paid holidays under Article 45 of the former Labor Standards Act. Such wages for paid holidays are originally paid only to employees who have worked without absence for the prescribed number of working days, and thus cannot be considered fixed wages paid regularly and uniformly, and do not constitute ordinary wages. Therefore, in calculating ordinary wages, such wages for paid holidays must be deducted from the monthly pay that combines the monthly basic salary and fixed allowances received each month.

[3] Where an hourly-paid employee receives, in addition to the basic hourly wage, a fixed allowance each month in the form of monthly pay, it is reasonable to view that such fixed allowance includes a portion having the character of wages for paid holidays under Article 45 of the former Labor Standards Act. Therefore, in calculating ordinary wages, the portion corresponding to wages for paid holidays must also be deducted from the fixed allowance received each month.

[4] When the Labor Standards Act was amended on March 29, 1989, and weekly working hours were reduced from the previous 48 hours per week to 44 hours per week pursuant to Article 42(1) of the same Act, if the company and the labor union, in concluding a collective agreement, agreed to work six days per week with weekly working hours of 44 hours in order to compensate for the decrease in wages, such that if an employee worked four hours on Saturday morning, the four hours of Saturday afternoon would be treated as paid, then the wages for the four hours of Saturday afternoon vary in payment depending on whether the employee worked on Saturday morning, and thus cannot be regarded as a fixed wage and cannot be deemed to constitute ordinary wages. Accordingly, in calculating the ordinary wages of monthly-paid employees, this portion must also be deducted. Likewise, it is reasonable to view that the fixed allowance received monthly by hourly-paid employees also includes a portion having the character of wages for the four hours of Saturday afternoon, which cannot be regarded as ordinary wages. Therefore, in calculating their ordinary wages as well, the portion corresponding to wages for the four hours of Saturday afternoon must also be deducted from the fixed allowance received each month.

[5] Where, under a collective agreement, employees work six days per week with weekly working hours of 44 hours, the "prescribed daily working hours" shall be 44/6 hours, and the "prescribed monthly working days" shall be the average number of days in a month minus the average number of holidays in that month, i.e., "365/12 - 365/(12×7) = 365/12 × 6/7" days. Accordingly, the "prescribed monthly working hours" shall be "44/6 × 365/12 × 6/7 ≒ 191.19" hours. Therefore, when calculating, as an hourly amount, the ordinary wage determined as a monthly amount pursuant to Article 31(2) of the Enforcement Decree of the Labor Standards Act (근로기준법시행령), such calculation must be made by dividing that amount by the number of prescribed monthly working hours. In order to calculate the hourly ordinary wage by this method of dividing by the "number of prescribed monthly working hours," the ordinary wage determined as a monthly amount must first be ascertained. However, where it is difficult to ascertain the ordinary wage because the monthly pay received by monthly-paid employees and the fixed allowance received monthly by hourly-paid employees include a portion having the character of wages for paid holidays under Article 45 of the former Labor Standards Act and a portion having the character of wages for the four hours of Saturday afternoon, both of which cannot be regarded as ordinary wages, it is also permissible to calculate the total working hours by deeming that the employees worked on the paid holiday and for the four hours of Saturday afternoon, and then to calculate the hourly ordinary wage by dividing the monthly pay or fixed allowance—which includes the portion having the character of wages for paid holidays and the portion having the character of wages for the four hours of Saturday afternoon—by such total working hours {=(44+8+4)/7 × 365/12 ≒ 243.33 (hours)}.

[Judgment Below] Busan High Court Judgment 96Na5230, rendered May 30, 1997

[Order]

All appeals are dismissed.
The costs of the appeal are to be borne by the Plaintiffs.

[Reasoning] The grounds of appeal are examined as follows.

1. As to the portion of the first ground of appeal alleging violation of the rules of evidence and insufficiency or inconsistency of reasoning

According to the reasoning of the judgment below, the court below found as follows: Plaintiff 1 and Plaintiff 2 are hourly-wage employees of the Defendant company, while Plaintiff 3 is a monthly-salary employee; Plaintiff 1, an hourly-wage employee, has received, in addition to the basic hourly wage, fixed monthly allowances consisting of a family allowance, a welfare allowance, a production incentive allowance, and a long-service allowance; Plaintiff 2, likewise an hourly-wage employee, has additionally received a qualification allowance; and Plaintiff 3, a monthly-salary employee, has received a welfare allowance and a long-service allowance as fixed allowances together with the monthly basic salary. The court below further found that the Defendant company had previously paid a weekly holiday allowance to hourly-wage employees who had worked full attendance during the prescribed weekly working hours, calculating it on the basis of the basic hourly wage; that on November 16, 1988, the Defendant company agreed with its labor union to pay the weekly holiday allowance based on the ordinary hourly wage calculated by the formula "basic hourly wage + fixed allowances/240," rather than on the basic hourly wage, and thereafter began paying the weekly holiday allowance to hourly-wage employees on that basis; and that the hourly-wage employees of the Defendant company have been demanding conversion to the monthly-salary system for the sake of stable livelihood and guarantee of a living wage, and that even upon such conversion from the hourly-wage to the monthly-salary system, the existing fixed allowances have been maintained as before. Based on these findings, the court below determined that the change in the method of calculating the weekly holiday allowance was merely intended to bring about an increase in the weekly holiday allowance for hourly-wage employees, and could not be viewed as an attempt to change the method of calculating the ordinary hourly wage in a manner that would bring about an overall wage increase effect for hourly-wage employees, or to recognize a new method of calculating the ordinary hourly wage more favorable than that applicable to monthly-salary employees.

Upon examination of the record, the fact-finding and determination of the court below as set out above are acceptable, and there is no illegality therein such as violation of the rules of evidence or insufficiency or inconsistency of reasoning. The argument in the grounds of appeal on this point is without merit.

2. As to the portion of the first ground of appeal alleging misapprehension of the law, and as to the second ground of appeal

A. In principle, all money and valuables paid to an employee as consideration for prescribed work or total work, when paid regularly and uniformly, fall under ordinary wages within the meaning of the former Labor Standards Act (근로기준법, prior to its abolition by Act No. 5305 of March 13, 1997; hereinafter referred to simply as the "Labor Standards Act"). However, in light of the legislative purpose of the Labor Standards Act and the function and necessity of the concept of ordinary wages, in order for a wage to constitute an ordinary wage, it must be a fixed wage paid regularly and uniformly; accordingly, a wage whose payment or amount varies depending on actual work performance cannot be considered a fixed wage and thus does not constitute an ordinary wage (see Supreme Court Decision 94Da19501, delivered February 9, 1996; Supreme Court Decision 95Da2227, delivered May 10, 1996; Supreme Court Decision 95Da24074, delivered June 28, 1996, etc.).

According to the facts lawfully established by the court below, Plaintiff 3, a monthly-salary employee, has received a welfare allowance and a long-service allowance as fixed allowances together with the monthly basic salary. Where wages are paid to an employee in the form of a monthly salary, such monthly salary shall be deemed to include the wages for the paid holiday prescribed in Article 45 of the Labor Standards Act (see Supreme Court Decision 90Daka12493, delivered December 26, 1990; Supreme Court Decision 90Daka14758, delivered June 28, 1991, etc.), and since the wages for such paid holiday are originally paid only to employees who have worked full attendance on the prescribed working days, they cannot be considered fixed wages paid regularly and uniformly and thus do not constitute ordinary wages. Accordingly, in calculating Plaintiff 3's ordinary wage, the wages for the paid holiday must be deducted from the monthly salary that combines the monthly basic salary and the fixed allowances received each month.

Moreover, according to the facts lawfully established by the court below, Plaintiff 1 and Plaintiff 2, hourly-wage employees, have received the fixed allowances set out in the judgment below, together with the basic hourly wage, on a monthly basis. Inasmuch as these Plaintiffs receive such fixed allowances in the form of a monthly payment, it is reasonable to view that a portion of such fixed allowances also has the character of wages for the paid holiday prescribed in Article 45 of the Labor Standards Act (this conclusion is not altered by the fact that the said Plaintiffs, when they worked full attendance during the prescribed weekly working hours, received the weekly holiday allowance calculated by the method set out in the judgment below). Therefore, in calculating the ordinary wages of the said Plaintiffs as well, the portion corresponding to the wages for such paid holiday must be deducted from the fixed allowances received each month.

Furthermore, according to the reasoning of the judgment below and the record, when the Labor Standards Act was amended on March 29, 1989, reducing the weekly working hours from the previous 48 hours to 44 hours pursuant to Article 42, Paragraph 1 of the same Act, the Defendant company and its labor union concluded a collective agreement on June 30, 1990, agreeing to work six days a week with weekly working hours of 44 hours, and that if an employee worked four hours on Saturday morning, the four hours in the afternoon would be treated as paid. It can be discerned that the Defendant company's decision to treat the four hours of Saturday afternoon as paid was taken, out of consideration for the employees, to compensate for the reduction in wages that would naturally result from the reduction in weekly working hours, even though such reduction in the corresponding amount of wages received by employees would ordinarily be expected; and that, at the time, neither the Defendant company nor the labor union anticipated that such measure would result in an increase in the ordinary hourly wage. Given these circumstances surrounding the decision to treat the four hours of Saturday afternoon as paid, the wages for the four hours of Saturday afternoon, whose payment depends on whether work was performed on Saturday morning, cannot be regarded as a fixed wage, and therefore cannot be considered to constitute an ordinary wage.

However, since the monthly salary received by Plaintiff 3 includes wages for the four hours of Saturday afternoon which, as noted above, cannot be regarded as ordinary wages, such wages must likewise be deducted in calculating his ordinary wage. Similarly, it is reasonable to view that a portion of the fixed allowances received monthly by Plaintiff 1 and Plaintiff 2, hourly-wage employees, also has the character of wages for the four hours of Saturday afternoon which cannot be regarded as ordinary wages (this conclusion is not altered by the fact that the said Plaintiffs receive, as wages for the four hours of Saturday afternoon, an amount equivalent to the hourly wage for four hours). Therefore, in calculating the ordinary wages of the said Plaintiffs as well, the portion corresponding to the wages for the four hours of Saturday afternoon must be deducted from the fixed allowances received each month.

B. Meanwhile, according to Article 31, Paragraph 3 of the Enforcement Decree of the Labor Standards Act (근로기준법시행령), "the prescribed monthly working hours" means the hours obtained by multiplying the prescribed monthly working days by the prescribed daily working hours, and "the prescribed daily working hours" means the hours agreed upon between the employee and the employer within the scope of the working hours prescribed under the main text of Article 42, Paragraph 1 of the Labor Standards Act, Article 46 of the Occupational Safety and Health Act (산업안전보건법), or the main text of Article 55 of the Labor Standards Act. Therefore, in the case of the Plaintiffs, whose collective agreement provides for a six-day work week with weekly working hours of 44 hours, "the prescribed daily working hours" would be 44/6 hours, and "the prescribed monthly working days" would be the number of days obtained by subtracting the average number of holidays in a month from the average number of days in a month, i.e., "365/12-365/(12×7)=365/12×6/7" days; accordingly, "the prescribed monthly working hours" would be "44/6×365/12×6/7≒191.19" hours.

Therefore, when converting an ordinary wage fixed as a monthly amount into an hourly amount pursuant to Article 31, Paragraph 2 of the Enforcement Decree of the Labor Standards Act, such conversion must be made by dividing the monthly amount by the aforesaid prescribed monthly working hours. In order to calculate the ordinary hourly wage by dividing by "the prescribed monthly working hours" in this manner, it is first necessary to determine the ordinary wage fixed as a monthly amount. However, since the monthly salary received by Plaintiff 3 and the fixed allowances received monthly by Plaintiff 1 and Plaintiff 2 include portions having the character of wages for the paid holiday prescribed in Article 45 of the Labor Standards Act and portions having the character of wages for the four hours of Saturday afternoon, both of which cannot be regarded as ordinary wages, it is difficult to determine their ordinary wages precisely. In such a case, it is permissible to calculate the total working hours by deeming the Plaintiffs to have worked on the paid holiday and for the four hours of Saturday afternoon, and then to calculate the respective ordinary hourly wages by dividing the monthly salary or fixed allowances, which include the portions having the character of wages for the paid holiday and the portions having the character of wages for the four hours of Saturday afternoon, by such total working hours {=(44+8+4)/7×365/12≒243.33 (hours)}.

C. According to the reasoning of the judgment below, the court below determined that, by dividing the sum of the monthly basic salary and fixed allowances received by Plaintiff 3, a monthly-salary employee, and the fixed allowances received monthly by Plaintiff 1 and Plaintiff 2, hourly-wage employees, in addition to the basic hourly wage, by 243.33 hours—calculated by including the Plaintiffs' 8 hours of working time corresponding to the weekly holiday and the 4 hours of Saturday afternoon in the prescribed monthly working hours—one obtains the respective ordinary hourly wages; and on the ground that, inasmuch as the Defendant company had treated the prescribed monthly working hours as 240 hours in calculating the Plaintiffs' ordinary hourly wages, this had rather resulted in a more favorable outcome for the Plaintiffs, the court below rejected the Plaintiffs' claims in this case. Although the reasoning of the court below differs somewhat from that set out above, its determination may be regarded, in its result, as being consistent with the view of this Court, and is therefore justified; there is no illegality therein such as misapprehension of the law concerning ordinary wages, misapprehension of the law concerning the principle of good faith or the principle of fairness, or violation of the rules of evidence. The grounds of appeal on this point are all without merit.

3. Accordingly, all appeals are dismissed, and the costs of the appeal are to be borne by the losing parties. This judgment is rendered as set out in the Order by the unanimous opinion of the Justices participating in the decision.
