A labor union staged violent industrial action to oppose a company's decision to relocate its factory. The Supreme Court held that a factory relocation falls within the core scope of management rights (경영권), so the union's collective action lacked a legitimate purpose. As a result, the convictions of the union officials were upheld, confirming that management prerogatives take precedence in such disputes.

Key takeaways
  • CaseA labor union conducted violent industrial action to protest the company's decision to relocate its factory.
  • OutcomeThe Supreme Court ruled that factory relocation belongs to management's exclusive authority, so the union's action lacked legitimate purpose, and it upheld the union officials' convictions.
  • LessonEmployers and unions should understand that core business decisions like relocation generally fall outside the scope of permissible labor disputes, and any use of violence during industrial action will automatically disqualify it from legal protection.
Issues
  • Whether an employer's management rights (경영권) are protected under the Constitution
  • The standard for reconciling management rights with workers' three labor rights (노동3권) when they conflict
  • Whether corporate restructuring or factory relocation can be a legitimate subject of a labor dispute (노동쟁의)
  • The requirements for recognizing the legitimacy of industrial action (쟁의행위)
Key reasoning

The Court established that management rights (경영권) are a constitutionally protected right, on par with workers' labor rights. Business decisions such as restructuring or factory relocation, which are aimed at enhancing competitiveness, generally cannot be the proper subject of a labor dispute (노동쟁의). Because the union's industrial action targeted a matter within management's exclusive authority, it lacked the required legitimacy of purpose. The Court further emphasized that industrial action involving violence can never qualify as legitimate conduct (정당행위) under labor law, regardless of the underlying cause. Consequently, the union leaders' criminal liability for violence and obstruction was confirmed.

Summary of Decision (English, AI translation)

[1] Looking at the purport of the provisions of Article 23(1), Article 119(1), and Article 15 of the Constitution (헌법) from the aspect of business activities, every enterprise has the freedom to freely manage the business or enterprise it has chosen and to make decisions for that purpose, and has the freedom to change (expand, reduce, or convert) or dispose of (abolish or transfer) its business or enterprise, and this is guaranteed by the Constitution.

[2] Where management rights conflict with the three labor rights, in setting the limits for harmonizing them, a solution should be sought in a direction that does not impair, but rather promotes, the economic initiative and investment motivation of enterprises and strengthens their competitiveness.

[3] Management measures taken by the management entity to strengthen the competitiveness of an enterprise, such as restructuring or mergers, cannot in principle be the subject of a labor dispute, and unless there are special circumstances such as the measure being pursued with impure intent without an urgent managerial necessity or reasonable grounds, legitimacy of purpose cannot be recognized for industrial action carried out by a labor union to oppose the implementation of such measures.

[4] In order for workers' industrial action to constitute a legitimate act under the Criminal Act (형법), all of the following requirements must be satisfied: first, the subject must be one who can be a party to collective bargaining; second, the purpose must be to foster autonomous negotiation between labor and management for the improvement of working conditions; third, the action must commence when the employer has refused collective bargaining regarding specific demands for improvement of workers' working conditions, and, absent special circumstances, must go through procedures prescribed by statute, such as a resolution of approval by union members; and fourth, the means and methods must be in harmony with the employer's property rights and must not amount to the exercise of violence.

[5] A case holding that, since the purpose of the industrial action was to oppose the relocation of the factory itself, which belongs to the essence of management rights, the action not only lost legitimacy of purpose but also, because its means and methods were not in harmony with the employer's property rights and involved the exercise of violence, did not constitute a legitimate act.

[Judgment Below] Seoul District Court Decision 2002No5577, dated January 10, 2003

[Order]

All appeals are dismissed.

[Reasoning] The grounds of appeal are examined.
Looking at the purport of Article 23, Paragraph 1, Article 119, Paragraph 1, and Article 15 of the Constitution (헌법) from the perspective of corporate activity, every enterprise has the freedom to freely manage the business or enterprise it has chosen and to make decisions therefor, and has the freedom to change (expand, reduce, or convert) or dispose of (abolish or transfer) its business or enterprise, and this is guaranteed by the Constitution. Where such management rights conflict with the three labor rights, in setting the boundary for reconciling them, a solution must be sought in a direction that does not impair, but rather promotes, the economic creativity and investment motivation of enterprises and strengthens their competitiveness. From this perspective, management measures taken by management to strengthen an enterprise's competitiveness, such as restructuring or mergers, cannot in principle be the subject of a labor dispute, and unless there are special circumstances such as the measure being pursued with improper intent without urgent managerial necessity or reasonable grounds, the legitimacy of purpose cannot be recognized for a labor union's dispute action carried out to oppose the implementation of such measures (see Supreme Court Decision 99Do5380, delivered February 26, 2002; Supreme Court Decision 2002Do7225, delivered July 22, 2003).
Meanwhile, in order for workers' dispute action to constitute a legitimate act under the Criminal Act (형법), all of the following conditions must be satisfied: first, the subject must be one who can be a party to collective bargaining; second, the purpose must be to foster autonomous negotiation between labor and management for the improvement of working conditions; third, the action must be commenced when the employer has refused collective bargaining regarding specific demands for improvement of workers' working conditions, and, absent special circumstances, procedures prescribed by laws and regulations, such as a resolution of approval by union members, must have been followed; and fourth, the means and methods must be in harmony with the employer's property rights and must not amount to the exercise of violence (see Supreme Court Decision 98Do3299, delivered May 12, 2000; Supreme Court en banc Decision 99Do4837, delivered October 25, 2001).
According to the reasoning of the judgment below, the court below, based on facts recognized from the evidence it adopted, determined that the purpose of the dispute action in this case was to oppose the relocation of the factory itself, which belongs to the essence of management rights, and thus the dispute action not only lost legitimacy in its purpose, but its means and methods also failed to harmonize with the employer's property rights and involved the exercise of violence, and therefore the dispute action in this case does not constitute a legitimate act. In light of the legal principles set forth above and the record, the fact-finding and determination of the court below are justified, and there is no illegality therein as alleged in the grounds of appeal.
Furthermore, according to the facts found by the court below, the business obstructed by the Defendants, who were union members of the labor union of Non-Indicted Company, was either part of the original business operations of the said company or business closely and inseparably related to its principal business. Therefore, there is no illegality, as alleged in the grounds of appeal, in the judgment of the court below finding the Defendants guilty on all charges of obstruction of business.
Therefore, all appeals are dismissed, and it is so decided by the unanimous opinion of the participating Justices as stated in the Order.

Justice Park Jae-yun (Presiding Justice), Cho Mu-je, Lee Yong-woo (Reporting Justice), Lee Kyu-hong
